And will continue to do so, until the gender disparity in expulsions, etc. is eliminated. There must be equal numbers of female students getting rung up to avoid this obvious differential enforcement.

28 IIRC there has already been one lawsuit against a college who expelled a student based on an accusation in which he not only didn't get to present his side of the story but they wouldn't even tell him the accuser.


The student won hands down and the judge severely admonished the college. But this has not stopped the other colleges. I had not heard this was by order of the Obamanites but it doesn't surprise me. In any case it is a clearly illegal order and the colleges should have refused and sued Obama themselves.

Instead sue the Federal Government, which has unconstrained resources and infinite time, over an almost 50 year old law which is as "settled" as settled gets, for a departmental rule making standard that has also been signed off on by the courts, with questionable standing to sue the Feds anyway.

And since he got his degree, difficult to show the loss to be adjudicated.

Good plan.

In a few cases no, they ignored the court order. When the plaintiffs went back to the judge they brought the DOJ lawyers back in and ate their asses and gave them 30 days to comply or else.

In one recent case the judge ordered the lawyers to attend an ethics class. But after a couple of weeks he rescinded that order.

The EPA has been the most egregious violator of court orders.

219 This topic is one that hits quite close to home for me, but perhaps not for the reasons you might think.

My last job in law enforcement (ended in 2001, so it's been awhile) was working for a private university in Texas; Texas law allows public and private universities to hire and retain police officers. While this never occurred to me on my shift, I had heard from my colleagues that of a number of alleged rapes has occurred. The university's unfailing response was to send the victim (usually a female) to talk with a counselor on-campus and to administrative deal with the perpetrator administratively. I asked within the department, why this wasn't being pursued through our department as a criminal matter and was told, essentially, that's the way the University wants to handle it.

Needless to say, I was flabbergasted. To me, in Texas, sexual assault is/was a crime and the University had no business interfering with what should have been a criminal investigation. Anything else is a cover-up and willful interference with a criminal investigation. But the head of the campus police was quite "go along to get along" and he didn't want to rock the boat . . . or his retirement money.

My impression at the time was that the University interfered so it didn't catch a bad rap for having a "rapey" campus culture, 'cause that's bad for business. Nowadays, I think we have an overabundance of SJWs in charge of faculties and campus administrations nationwide. And boy do they love getting the rush of power that these Title IX kangaroo courts give them.

Still, this treating sexual assault like a simple "administrative matter" should have the DoJ and state AGs going crazy, and civil lawyers salivating. Disappointing to see that we're not seeing more pushback against universities on this whole matter.
