On Race and Judges, Trump Isn't a Racist nor a Conservative -- He's a Standard Issue Liberal

There's no part of a minority that's expected to rule in solidarity with his race?

No particular racial mode of thinking a minority brings to the table?

That would be a shock to these liberals:

-- Liberal Maureen Dowd making the standard liberal criticism of Clarence Thomas -- that he's a race traitor insufficiently biased towards members of his own race.

Did Jake Tapper call Maureen Dowd a "textbook racist" for that bit of demagoguery?

Of course not.

Did Paul fucking Ryan?

I doubt it.

He sure didn't remember objecting to it when called upon to comment upon Trump's similar race essentialism. Guess it didn't make much of an impression on him then.

Incidentally, Clarence Thomas is a figure of hate for the left because of his relative uniqueness.

Therefore, in the minds of liberals, most black judges are sufficiently solicitous of the political interests of their own races.

Again-- any upset from the liberals over this liberal idea that judges of color are supposed to "look out for their own"?

This "Thomas pulls the ladders up from other blacks (which most black judges don't do)" critique is of course not original to Dowd -- nothing is original to this tired, sad hag. It's standard issue liberal cant.

None of which is ever objected to by our liberal media masters.

Indeed, Clarence Thomas is attacked for his race quite frequently, on bizarrely unrelated grounds.

The left is renewing its venomous, racist attacks on Thomas in the aftermath of his dissent in the Supreme Court’s 6-3 ruling in favor of gay marriage.

Actor George Takei smeared Thomas as a “clown in blackface.” The Huffington Post called his dissent “beyond ridiculous” and tarred him as a hypocrite for opposing a court-created “right” to gay marriage:

“Clarence Thomas is married to a white woman — something that would be illegal today, if it weren’t for the Supreme Court’s historic Loving v. Virginia ruling.” As if his personal life is fair game.

Last Friday, in another low blow, New York Times reporter Adam Liptak portrayed Thomas as a lightweight whose opinions are cut-and-paste jobs from briefs submitted to the court.

Do Hispanics have a different style of judging than whites -- a different set of inputs leading to a different array of outputs?

Yes indeed they do, says liberal Justice Sandra Sotomayor.

In 2001, Sonia Sotomayor, an appeals court judge, gave a speech declaring that the ethnicity and sex of a judge "may and will make a difference in our judging."

In her speech, Judge Sotomayor questioned the famous notion -- often invoked by Justice Ruth Bader Ginsburg and her retired Supreme Court colleague, Sandra Day O’Connor -- that a wise old man and a wise old woman would reach the same conclusion when deciding cases.

"I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life," said Judge Sotomayor, who is now considered to be near the top of President Obama’s list of potential Supreme Court nominees.

Her remarks, at the annual Judge Mario G. Olmos Law and Cultural Diversity Lecture at the University of California, Berkeley, were not the only instance in which she has publicly described her view of judging in terms that could provoke sharp questioning in a confirmation hearing.

This month, for example, a video surfaced of Judge Sotomayor asserting in 2005 that a “court of appeals is where policy is made.” She then immediately adds: “And I know — I know this is on tape, and I should never say that because we don’t make law. I know. O.K. I know. I’m not promoting it. I’m not advocating it. I’m — you know.”

Indeed, President Obama himself has suggested that minority judges like Sotomayor may bring something to the bench that whites can't bring -- "empathy."

Republicans have signaled that they intend to put the eventual nominee under a microscope, and they say they were put on guard by Mr. Obama's statement that judges should have "empathy," a word they suggest could be code for injecting liberal ideology into the law.

Now some conservatives will claim that they agree with the above-going complaints.

But okay -- then why didn't you say so?

Because these quotes were insanely easy to find.

If you had any interest at all in attacking both Trump and the liberal race-based worldview he seems to espouse, you could have done so.

But you didn't.

You only seemed interested in joining the PC Pitchfork Brigade.

You may disagree with Trump's Standard Liberal Take on Race Essentialism.

However, if you do not simultaneously point out that this is the Standard Liberal Take, and is, when uttered by any liberal, completely unremarkable and indeed routine, then your goal here is not to push back against PC Speechcodes and Racethink -- but to advance it, because it temporarily (?) serves your interests to do so.

Shall we search for more quotes, or will everyone concede the left routinely attacks conservative minorities for not having sufficient race solidarity, and routinely praises liberal minorities for thinking in racially-harmonious ways?

Which is why I am so reluctant to vote for Trump. He is a liberal. He engages in identity politics too (only his version is white identity politics). If I hate identity politics and find them destructive, why would I vote for the "white peoples'" version of them?

I don't understand how the solution to the cancer that is identity politics is MORE identity politics. Trump has exposed the left's hypocrisy, but this won't change anything. Everyone will only get more entrenched in this destructive tribalism.

I know it's pie-in-the-sky idealism on my part to hope for a candidate and party that rejects all this nonsense (and successfully persuades the general public that it needs to be rejected), but I'm not holding my breath.

The idea that it is not only right but necessary to put one's tribal identity/political opinion on hold when it comes to rendering justice (whether as a judge or on a jury) is just "crazy talk" these days. Yes, such impartiality is hard, but we should demand it of everyone, not make excuses for minority judges like Sotomayer to bring their "wise Latina" ways to the bench. The GOP should have fought tooth and nail against her nomination, but they didn't have the balls.

Keep in mind that Mr. Trump is very thin-skinned. What someone else might term mild criticism of a strategy he often perceives as a horrible personal attack. This point is not debatable. He is thin-skinned.

If another Republican attacks him, he might try brushing it off in a way that suggests the criticism/attack isn't right, isn't important, and should be ignored. For example, if he disagrees with something Lindsey Graham says about him, maybe try saying "I don't agree with his viewpoint. Gosh, he's very excitable isn't he? Next question?"

Regarding the fund-raising. No, I haven't donated and don't intend to. He said he was self-funding. He also has a large group of very dedicated supporters. I expect them to max out their contributions in the primary and then again once he gets the nomination. My concern about the fund-raising is that he didn't do enough (in my opinion) to build out a strong campaign infrastructure and is going to dump it all on the RNC to do. That's going to hurt candidates down-ticket.

Most white people now believe that reverse racism is a bigger problem then racism. They're open to this line of thinking, and it cast aspersions onto questions regarding Trump U and the media's handling of it (why didn't they report the judge was a member of La Raza?). They could've tied it into the riots to say that the left is driving America apart along racial lines.

Instead the GOP leadership is giving them cover by bashing their nominee on CNN. There is no 3rd party white knight. There is not going to be a rules change big enough. There is not going to be any convention shenanigans big enough to stop Trump from being the GOP nominee and being the best shot against Clinton.

Romney, Dole and McCain were RINO's, but they were still politicians with a lifetime of service to some form of conservative ideals. Sure, some of them had their share of heresies - Romneycare, anybody? - but they within, imho, acceptable bounds. Lord knows Bush 1 and 2 weren't perfect either, but again, they were lifelong party soldiers. Trump is to me, and obviously a lot of others, a bridge too far.

We always hear about a party divorce in the wake of a contentious primary, but that usually lasts a month or two and everything is hunky dory when the next cycle starts. I don't think that's going to be the case this time.

No, he did not. You can try and pretend that's what happened but that is not what happened. He said not once but multiple times that the judge was biased against him because he was a Mexican. Period. He was even given a chance to expand upon that statement when it was pointed out that he was born in Indiana and Trump just said he was of Mexican heritage. It's only been in the last day or so that he's said squat about La Raza and that should have been the focus all along.

Do you know that his lawyers have not asked for the judge to recuse himself over any conflict? If this is such a big issue why haven't they done that?

This was an own goal by Trump. He is the one responsible for what he said and only he can clean it up.

They might have tried to spin it to sound more "PC" but they would've probably taken the Alberto Gonzales approach.

Instead, Trump tosses out the "He's a Mexican" stuff at one of his rallies and it's purely a play to certain segments of the crowd. It feels like signaling to alt-right types. It's not even that he's wrong (the judge most likely is liberal and hates Trump's stance on immigration). But it's the way he uses that to rile people up. I really don't like how emboldened the alt-right is thanks to Trump's candidacy.

Andrew Breitbart was able to make brilliant, funny, incisive and cutting extemporaneous replies to the gotcha questions of the media. That is a rare skill. Most of us can't do that.

I look at it sort of like teaching self defense. Most of us do not have the inherent ability nor will we spend the time to acquire the skills to become some kind of ninja master of self defense but we can learn some basic skills that will work more often than not. Defense against the partisan Republican hating media is similar. Learn the boiler plate replies to the questions and don't say anything else. The media will hate it but you will not be the one who gives the media a juicy quote to use for one or more news cycles.

Republicans should look at talking to the news media like talking to the police in an interrogation room. They are not your friends and they do not have your best interests at heart. In fact, it is probably accurate to say that there is a significant divergence between your best interests and their best interests. And before you decide to engage with them consider that they do this stuff a lot more than you do so they are probably better at it than you are.

The only thing I could do is influence others, but I don't have a particularly large platform to do so, and the only thing I would recommend would be to stay home, which only aids Hillary if the people I persuade were otherwise going to lean GOP.

And for the record, I must not be all that persuasive, because a lot of my family members are voting for Trump. So my household is still going to be a net gain for Trump, even if I stay home.

Calling your group "The Race" is not exactly friendly sounding to non-Hispanics. (Yes they claim it is not called the Race, but its alternatives are the Ethnicity, and things like that).

This is a chance to make all race based groups the issue. If minorities can have them, why not whites, and if not then neither should they. Instead we have Paul Ryan saying how racist this all is...Paul the Judge belongs to a group called "The Race" for heavens sake!

I'm kind of there. We'll see if taking down the Republican collaborators can change our opinions any. The best I can muster is 'maybe.' The United States likely is beyond fucked at this stage.

I'm about spent on this Two Minutes of Hate, but just want to make an observation. Republican senators and other elected officials routinely used to pose as they received special awards from La Raza. Usually the plaques were for their assistance with the Reconquista via mass amnesty. La Raza even was more open about its revanchist goals a few years back.

Related. Mark Krikorian of the Center for Immigration Studies reported, also a few years back, that Republican officeholders and Bush cabinet officials begged an envoy from the Mexican government privately to "send more" illegals. This particular Mexican official was appalled and went public, but of course it wasn't reported widely.

If Trump wins this thing all the better. If he has pulled the pillars out of the Thing called the GOP, mission accomplished either way.

Well that's my problem with the Libertarian Party: its not that they are inconsistent so much. All of us have lines where we draw and believe the government ought to be involved or not. Libertarians aren't pure anarchists who wish no government at all.

They just pick stupid places to draw the line, in what seems to be just utterly arbitrary. In what way is freedom advanced by compelling bakers to make cakes?

The conservative commentariat at large amply condemned Maureen Dowd's comments about Thomas as racist. They very much complained about Sotomayor saying her race makes her more of an asset to the Supreme Court than a white person. These were things that pissed us all off back in the day.

If the point is that the media is applying a double standard to Trump vs. these liberals, then yes, I agree. Also, the sun rises in the east.

But why are you calling out conservatives who are calling Trump's comments beyond the pale and distancing themselves from them? Seems to me they are entirely consistent in their philosophy: if you claim to know what's in someone's mind because of the color of their skin, that's not consistent with conservative principles. I'm not talking statistics here. I'm talking about judging the fairness, or lack thereof, of an individual based on broad trends. You can say that a judge is more likely to vote democratic if he's of Mexican descent, but what proof do you have that this particular judge votes democratic and will be biased against Trump?
If you mention his involvement in all kinds of legal societies as evidence of his potential bias, then to me, that's absolutely fair play, and many people here have done that.

But that's not what Trump has done.

He's said "he's Mexican, and he's been so unfair to me". not "he's part of the La Raza organization, and he's been so unfair to me". There's a huge difference. One speaks to genetics, the other speaks to an active involvement. Trump's choice to word it as the former is not the kind of rhetoric I want to see from a "conservative" party nominee.

But then, Ace frames it well: Trump is conventionally liberal.

So why defend Trump?

I don't understand.

It really depends on what you think about Trump. If you are like Ace who loves to play Chief inspector Dreyfus to Trump's Clouseau then you'll just assume it's all blind luck as he defeats the media, the GOP, and so far anybody else that has cared to take him on, but if you're Scott Adams and believe that he's an evil genius then things will look different.
If he is manipulating this for maximum effect then he'll build momentum. He'll let them build the story, and chum the waters and stir up the interest of the public, so that when he takes it from them they won't be able to just drop it. They'll be forced to explain in detail what La Raza means and what it stands for to the general public. I personally don't know what to think of Trump anymore. I can't decide if he's evil genius or a moron. I guess we'll wait and see.

I had old friends of very long standing whom I stopped visiting and talking with after our paths had diverged too far politically. I'll probably never see any of them again. Other than by occasional happenstance. No regrets.

If I hadn't done that, I would have had to confess to myself that my core beliefs regarding politics were shallow and trivial. They're not.

Politics matter. Intensely. Politics have a huge impact on real people's lives in the real world. Including negative impacts. It's not like a friend's taste in entertainment or sports teams. Politics are different.

In war you don't worry about morality, you just win. This is a cold war for the soul of American and Western Civilization. Do national borders matter, does the rule of law matter, citizenship matter, or does social justice make all that void. I don't think politics that worked in a time of social stability and peace at home are effective now if you believe in the former.

So when Paul Ryan, for example, is critical like he was it is unhelpful for those who are in the National Sovereignty camp, and it gives aid to those who belong to the social justice camp. Ryan never seems to be critical like that of La Raza...or any social justice group.

Yet he is of Trump. Don't need that when you are in a fight for America. It is beyond politics and winning a few extra voters in some subset of a ethnic group now...and Ryan does not get that. Saying Trump is a racist, while saying nothing about the group the Judge belongs to called "The Race" says a lot about how he wants to like him. Who he sides with, and will side with when the chips are down.

But you see all Trump says is "Mexican", and then leaves supporters, and you, to spend quite a bit of time explaining it for him. Who wants to spend this kind of energy explaining these things away for him. If he wants to make a point on this, I'd be fine with defending this stance, but he does not even try to make the point you are making. Carrying his water has got to get annoying. Also, if he was making a similar observation about a different case, I might be more inclined to throw him a bone here. But he's making this point regarding his case, his shitty Trump University. He could argue a whole variety of issues he raises that people might disagree with should be cause for all kinds of people to remove themselves from overseeing this case.

According to Politico, Trump told his rally in San Diego, "The judge, who happens to be, we believe, Mexican..."

Now, he did go on to say, "...which is great. I think that's fine. You know what? I think the Mexicans are going to love Donald Trump when I give all these jobs, OK?"

Now, in the second part of the quote, I am not sure if he's talking about Americans of Mexican descent (like Curiel) or if he's talking about actual Mexicans (i.e.: people who live in Mexico), but trying to parse Trumpian word-salads is not my forte. (Also, the president "gives" jobs to people? Sounds conservative to me!)

I don't think Trump is a racist. But, like so many things, he tries to have it both ways: he mentions the judge "who happens to be Mexican," and then in the very next breath says, "That's great!" People at the rally get to hear what they want to hear and cheer either way.
