Sefton: sefton at cutjibnewsletter.com | A Conversation That Sort of Took Place TodayRuy Texiera, 1992: The "browning of America" guarantees an unbreakable, unshakable Democratic majority forever more, because Hispanics lean Democratic. GOP Chattering Classes: Yes, alas. GOP Consultant Post-Mortem, 2012: The GOP cannot win without Hispanics, and it cannot win Hispanics without agreeing to some kind of amnesty. Amnesty is critically important to Hispanics, and without amnesty, you can write off their support forever. GOP Chattering Classes: Indeed! We must have amnesty no matter what. Marco Rubio Supporters, 2015: Hispanics are hostile to the GOP and the only way to soften their opposition is to nominate a Hispanic boy who likes water and grandpas and mass amnesty for illegals. GOP Chattering Classes: Took the words right out of our mouths. #NeverTrumpers, a week ago: You're insane to have nominated Trump -- Hispanics hate him, and therefore he will be blown out in an election. GOP Chattering Classes: Preaching to the choir, baby. Donald Trump, this week: This judge is biased against me because he's Hispanic and I'm anti-amnesty. GOP Chattering Classes: It's so racist to brand an ethnic group politically like that!!! BTW: I'm not really sure that accusing a minority of having a Democratic bias is really one of the classic racial slurs. I consider racial slurs things like calling someone lazy, stupid, greedy, whatever because of race. Not accusing someone of most likely having a particular political bent. Which isn't racism -- it's fucking basic campaign modeling. GOP and Democratic campaign turnout models both assume that Hispanic voters will be something like 65-75% pro-Democrat. It cannot be racist to say what everyone calculates in their fucking turnout models. BTW: I'm waiting for the gnashing of teeth over the Democrats' sixty billionth pronouncement that we need Wise Latinas to bring their particular and unique political perspectives to the court.

Ace, that over-simplfies it. The better turnout models separate the Hispanic vote into cultural blocs. The Cuban's, the 'Rican's, the rural Hispanic, etc. all have different voting characteristics.
But, yes. DC is rife with Republican consultants running around with crap stats saying we need the "Hispanic Vote", "Don't be Mean", and "SoccerMoms, OMG". I'm of divided opinion about Venezuelan women having to wait seven hours to buy groceries. On one hand, they've won so many beauty contests, it seems a fair handicap. On the other hand, it might be an advantage.

The straw man that Ace is burning here is unbelievable. Trump is doing the same racial identity politics of Obama, but in reverse, yet someone how's calling the people that objected to Obama's "wise Latina" rationale hypocrites because they also object to Trump doing it.
Doing election modeling based on ethnic communities is not the same as saying a certain race shouldn't be a judge in a Trump case because most of that race is Democrat. I get why Ace was annoyed by Rubio people (I was too). Rubio staying in only to be crushed in his home state is why we have Trump today, but he's become so disillusioned that he's no longer making cogent arguments, which is the brand of this blog. There are specific grounds on which an argument for conflict of interest can be based. They're actually pretty obvious, things like being related to a party, or having a financial interest in a business at stake in the proceedings.
Ordinarily I think it would be obvious that we wouldn't say a person is biased against someone simply because of their ethnic heritage when that heritage is not at issue in the proceedings. But that was before the GOP decided to support Trump. Creating an atmosphere where a defendant can choose the judge hearing his case by the simple expedient of insulting ethnic groups is a pretty grim way to go. What happens if this judge recuses himself and the next judge is jewish? What does Trump say then? What will his defenders be asked to support? Not playing by the rules doesn't always mean you're doing wise things. The simplest explanation for this is that Trump knew the unsealed records were potentially extraordinarily damaging, as they showed just how bad Trump U was, just how much of an effort to scam people it involved. If he can create sufficient public pressure, maybe he can get the judge recused and keep the case slowed down until after the election, when the details won't matter (except to shock us). Posted by: Cody's Feed Bag at June 03, 2016 06:42 PM (V40IZ) 219
I wish Trump had used different language - it's not the judge's Mexican heritage, it's that he is a member of an organization that advocates for a legal changes that benefit particular heritage. While I don't know anything about that La Raza Lawyers Assn, it was founded by a radical activist who founded other Mexican supremacy-type groups, including MALDEF, who were working for a takeover of CA by Mexicans. That presents an appearance of a conflict of interest, at minimum, when it is Trump's immigration stance that has been one of his signature issues in this race.

Just made a similar critique of WAPO's coverage (which focused entirely on the ethnicity-as-conflict-of-interest sound bite. This is a little long, but gets to the heart of the matter: Calling out judicial bias is a-okay! c.f. Taney and Dred Scott.
Typical WAPO, leaving out the MAIN reason Trump offered for believing that Judge Curiel is biased: that on every motion he keeps ruling against what Trump believes to be the merits of the case: "We're in front of a very hostile judge," Mr. Trump said. "The judge was appointed by Barack Obama, federal judge. Frankly, he should recuse himself because he's given us ruling after ruling after ruling, negative, negative, negative." ... "I'm telling you, this court system, judges in this court system, federal court, they ought to look into Judge Curiel. Because what Judge Curiel is doing is a total disgrace, OK?" Trump is looking for an explanation for what he sees as judicial bias. Huge numbers of latinos, including pretty much all Democrat Latinos (and street thugs in San Jose) are calling Trump racist for being against ILLEGAL immigration (as if breaking the law is a race), so it is not unreasonable to suspect that, if Curiel really is biased, this is the reason: because like every other Democrat hispanic in the country he has the insane idea that it is racist to oppose illegal immigration, and anyone who is that irrational WILL have a conflict of interest. Should Trump forbear to state such suspicions? A forbearance that nobody expects when faced with bias on the part of non-minority males? Who in the world thinks there is anything wrong with calling out Chief Justice Taney for his bias in the Dred Scott case? It's okay to call out bias! Trump shouldn't say that Curiel's ethnicity itself creates a conflict of interest. It is Curiel's BIGOTRY creates a conflict of interest, demonstrated by the bias of his rulings. Maybe Trump is right about Curiel being biased, maybe he is wrong, but it is very dishonest of WAPO (and typical of WAPO) to pretend that it is Curiel's ethnicity, not his actions, that Trump is objecting to. He is offering ethnicity as a likely EXPLANATION for what he sees as objectively biased actions, and it WOULD be a likely explanation, along with having been appointed by Obama. I really hope Trump doesn't pander and pick a Hispanic or woman. I expect to be disappointed but he has surprised us so many times during this primary season. I'm looking forward to the announcement. I wonder how much the RNC and GOPe are trying to manage him so they get a foot in the door to influence him and make themselves relevant again.
Also, concerning his adversarial relationship with the press, I expec that to explode at some point. He was asked at a press conference if his treatment of the press during the campaign is how he would treat the press as President. He didn't flinch and said yes, it will be exactly the same. Hahaha. Posted by: Jean at June 03, 2016 06:40 PM (Doh4+) In the first place, Cuccinelli was outspent 2-to-1, not 10-to-1. It was also an off-year election. VA does its state races in off years (the Cuccinelli-McAuliffe race was 2013), which keeps turnout lower. 43% of eligible voters turned out in 2013; 72% turned out in 2012, when Obama won the state over Romney. Turnout dipped slightly, to 41.6%, in 2014, when Ed Gillespie narrowly lost the Senate race. To think Trump can win the state in a presidential year you have to figure out where he's going to get a whole lot of additional votes in a higher-turnout year. He's not winning it without winning solidly in places like Colorado. Posted by: Cody's Feed Bag at June 03, 2016 06:54 PM (V40IZ) 268

240 Just made a similar critique of WAPO's coverage (which focused entirely on the ethnicity-as-conflict-of-interest sound bite.
Posted by: AlecRawls at June 03, 2016 06:48 PM (5z7RS) Judges are trained to be impartial. They would never be biased! Posted by: ThunderB at June 03, 2016 07:05 PM (zOTsN) The thing is that a judge is supposed not only to be unbiased, but to avoid any appearance of suspicion of bias, I believe. His membership in racially-based groups raises suspicions regarding his ability to be impartial in a case that has tangential racial connections. If the shoe were on the other foot, and he belonged to La Raza Blanca Lawyers Association, leftists would be howling about his bias. I think a goal should be to get them to return home when it is safe to do so. The thing is that a judge is supposed not only to be unbiased, but to avoid any appearance of suspicion of bias, I believe. His membership in racially-based groups raises suspicions regarding his ability to be impartial in a case that has tangential racial connections.
If the shoe were on the other foot, and he belonged to La Raza Blanca Lawyers Association, leftists would be howling about his bias. Trump's best move would be to call on the judge to assert publicly his lack of bias (which the judge won't do) or recuse himself. "Next you will tell me that the judge that overturned the CA Marriage Amendment did it because he was a closet gay and wanted to marry his boyfriend?"
Okay, I had to Google that. So Judge Vaughn Walker really is a flaming homosexual who wanted to marry his boyfriend? Wouldn't say that per se creates a conflict of interest, but if his ruling shows bias (and in my opinion it was egregious), his homosexual activism is the likely explanation and would constitute conflict of interest. Posted by: Jean at June 03, 2016 06:59 PM (Doh4+) There's a tool you can play around with here, to show the impact of various turnout changes. http://tinyurl.com/hlgjo5t Just cutting the AA turnout to pre-Obama levels won't get you Virginia; you have to assume that Trump does significantly better with whites than Romney did. And his abysmal ratings with women- not just single women, but married women, traditionally a GOP strength- is going to make that an extremely difficult task. You haven't really responded to anything I've said in a way that, well, actually addresses anything I've said. It's just, "WHOA HEY! 'White Supremacy'--I'm not with that." Which is odd, since I'm neither White--at least, not all the way--nor a "White Supremacist." "I understand, and in fact fear that your innuendo laden subtly advanced views may be pertinent and admitted as much about 25 posts upthread." Uh-oh. Sounds like you're attributing views to me instead of actually reading what I said and understanding. This is part of crimestop. You have a built-in psychological mechanism that makes you stop short of any strain of thought that *could* lead in a heretical direction. Obviously, such things must be rooted out. One of the points made by #NeverTrump is that those who defend Trump will inevitably be corrupted by him.
Predictably, this is now happening to our friend Ace. It's obvious that Trump's references to Judge Curiel as "a Mexican," who simply must be biased by virtue of that fact, are racist. Trump isn't even bothering to conceal his bigotry behind a figleaf anymore. But his defenders must find a way to excuse his behavior. In the process they corrupt themselves by making common cause with overt racism. As Trump would tweet: Sad. Posted by: Sauropod at June 03, 2016 09:29 PM (iLoHX) 365

"Senate Majority Leader Mitch McConnell worries that Donald Trump could ruin the GOP's relationship with Hispanics beyond repair."-CNN
Mitch then goes on to compare Trump/Clinton to Goldwater/Johnson, and then admits he supported LBJ over Goldwater. HE'S ON ANOTHER PLANET. Probably Uranus, but allow me to elaborate. Goldwater didn't lose because he chased away the black vote, LBJ won because he bought the black vote. Great Society promised welfare, food stamps, public schools, and public housing for all. Blacks got most of it, and if a white guy complained that he didn't want to pay for it via taxes, he could be branded a racist and chased off with the Equal Rights Act. Never mind that every time MLK (Republican) and Eisenhower (Republican) would work together to pitch something similar to the ERA, Senator Johnson (Democrat) would call it the "n****r bill," on tape, and shoot it down. When LBJ put his signature on all of this, he claimed blacks would vote Democrat for the next hundred years. In the 50 years since, this has gotten the blacks drugs, crime, unemployment, illiteracy, poverty, teenage single moms, and abortions . Now we get BLM on top of that. Blacks can't be expected to obey the law, apparently. LBJ didn't live to see what he had wrought, Mitch might. In return for a percentage of the Latino vote, Mitch would make illegal immigrants legal. The quickest way to this with most of the Latino vote was President Marco "Gang of Eight" Rubio. That didn't work out. Plan B was Jeb "Squishy" Bush, who would talk tough right up untill Pelosi or Reid or Wasserman-Schultz called him a racist. Then he would break down in tears and sign whatever they put on his desk. That didn't work, either, so now he has to try to shame Trump into moving his direction, and Trump is like "F you." Hillary might help Mitch if Mitch...well..."rubbed her feet" if you catch my meaning, but i don't think Mitch would go that far, yet. Things move a lot faster now than they did then. It took decades to go from "I have a dream" to "HE DIDDN DONUFFIN," but the La Raza guys are pitching eggs at people right now. His sin of the day was what exactly? Assuming the judge's prejudice against him is mixed up in his national origin. We make assumptions about people all the time based on various dimensions of their identity. Why is nationality off limits? No wonder the right is so ineffective. They haven't even decolonized their minds from all this crap. This picayune bullshit still hangs them up. And the most pathetic part is that they fancy it makes them "decent." God help us. "Because not everyone from every nationality thinks the same. Duh."
This is a non answer. I'll say it again: we make assumptions about people based on dimensions of their identity all the time. For instance, we assume that a person who is a liberal will believe in something called patriarchy--but he may not. That doesn't make the assumption irrational. We assume that a 60 year old baptist from Georgia opposes gay marriage--but he may not. And yet the assumption is still rational. (And, technically speaking, more of a preliminary conclusion than an actual assumption.) Generalization is kind of unavoidable. You don't have an opposition to generalization per se. No one does. You just don't like it as applied to certain categories. So, the point you thought you were making? Yeah, you weren't actually making it. "Spare me from this leftist collective thinking." Lol. "Leftist." Acknowledging that different believes are more common among different groups of people isn't "collectivist." Posted by: Anti Antifa at June 03, 2016 10:45 PM (RPsRI) 384

What does this mean? See, this is one of the problems I have with "Constitutional Conservatism." What exactly is it? The Constitution is a document setting forth a system of governance, the powers of the federal government, and its limits. It isn't a Cato Institute white paper. There are a thousand dumb ideas that are perfectly constitutional. Most of the ideas Trump *and* Hillary support are facially constitutional, be they good or bad. What "anti-constitutional principles" are you talking about exactly? I'd take anyone on his list of judges over any other jurists Hillary might appoint. How 'bout you? "As I said, going by what Trump just said, he would have to shitcan an excellent judge like Miguel Estrada just on nationality, because based on nationality he's a Democrat." Assuming a Hispanic person is a Democrat isn't the same as claiming a Hispanic person who has been a KNOWN REPUBLICAN since the early 2000s is a Democrat. Good Lord. "That's astonishingly stupid, and completely indefensible." On that, I'd agree. Thank God Trump didn't say that, huh? "Angrier by the minute. The next GOP that calls me is going to get a screaming earful. No money for the party this time around." Incidental agreement there, too. I haven't given money to the party since the election of '10. "I'll support individuals, but no money for the Trumpthing, that LIED about being self-funding--as if anyone would be stupid enough to believe that." Oh, stop. You don't care about that. You voted for McCain and Romney despite their lies, flip flops, and embrace of "anti-constitutional principles." You don't care whether Trump is self-funding or not, or whether he lied about it. No one does. I guarantee you you didn't care that Rubio flip-flop-flipped on immigration. You don't care about any of these anti Trump talking points you bring up. You just don't like the dude. I accept that. I don't get it--I love Donald Trump almost as much as I love Milo Yiannopoulos and Tila Tequila--but I accept it. Fine. But it's probably time to put your dislike aside, stop pretending that you care whether Trump lied about self-funding, and start caring that Hillary got four people killed in Benghazi and put our national security at risk--and then lied about it. Lies: they ain't all created equal, and when it comes to politicians, you really just have to pick the least bad ones. Posted by: Anti Antifa at June 04, 2016 02:48 PM (RPsRI) 395
Ace, there's a big difference between saying that a large group of people (there are over 40 million hispanics in America) is likely to vote, more or less, in this way. That's the kind of crude estimation in which analysts must deal when trying to examine how a country of 300 million people is likely to choose its leader this year and for the foreseeable future.
However, when you've got one federal judge, with a particular background and views, and one particular lawsuit, arguing that the judge's race will affect the outcome of the case is ENTIRELY different. It's certainly possible that Trump's right, and that this judge hates his guts because he's "building the wall" (note the delusional present tense he uses, as if the wall is actually under construction). (Trump's doubling-down here also makes the hispanic=anti-trump formulation a self-fulfilling prophecy.) But when you've got more information about the judge than simply his race, I think it's best to use that information, rather than race, to evaluate his neutrality towards Trump (or lack thereof). So, that's where I think your point breaks down. But even if you were right, and you could equate electoral predictions with outright racial attacks on judges, Trump's recent comments are idiotic for so MANY reasons. First, it seems like an unforced error. I don't think the media was focused on this topic prior to Trump's comments. Maybe let Hillary's myriad problems be the focus for a while. And, if Trump U comes up, pretend like it's no big deal, instead of the case of the century. Second, even if it's true that the judge is biased b/c THE WALL, why would you say this? It is only going to serve to enrage the judge (hurting Trump's chances in the case and therefore his shot at electoral success as well), and from a political point of view, enrage and motivate hispanic voters who are already enraged and motivated against trump. Why stoke the electoral forces that are your biggest problems? Because Trump doesn't think or plan. Because he's not that smart. Because he's the chronically unprepared trust fund kid who's gotten through life b/c of his surname and a the bullying attitude that comes along with it. The whole Supreme Court thing had me for a minute thinking I'd vote Trump. Now, that's gone again. Posted by: gts109 at June 06, 2016 10:50 AM (rX06+) Processing 0.05, elapsed 0.0717 seconds. |
