As I have documented before, the law protects firearms manufacturers, but excepts cases where there is "negligent entrustment." I recall thinking as I read this, "this is an oddball exception." The reason that it is odd is that firearms manufacturers don't sell to customers. And it suggests that an increasing number of young people are so focused on the attention they get from asking someone to prom that they forget what the high school ritual is supposed to be about: having fun with your friends before you all grow up and have to face the real world. The biggest disappointment was Louis, who isn't in Kipling's stories (well, that I recall -- it's been years since I read it). He makes a point of describing himself as a Gigantopithecus, which is a long-extinct 9-foot tall species of orangutan. Still, Disney made him King Kong size.

If You Know Who is targeted by "Daisy" ads ...... which part of FEC regs and the constitution did I miss which prohibit You Know Who (and "unaffiliated" PACs, wink wink) from running 10 times as many devastating ads in response?
The "Daisy" concept - then and now - depends on a great deal of naivete and ignorance about US military operations and the formal/informal processes that shape decisions about those operations. Sadly this naivete is not limited to the great unwashed - one sees it rightcha here in these comment sections (mmm, and one post, actually).
Anyway, all the 3,294 different ways that presumably sophisticated observers are scrambling to find to say "I don't want You Know Who as the nominee" have long since started to seem ridiculous. Lots of reasons not to want You Know Who - no need to beclown yourselves with endless implausible or weakly argued hypotheticals about how his being the nominee might present challenges.
ANY nominee running against the Borg most of this country, and almost all of its public culture, have become will face a steep climb.

Might I humbly suggest that you get a pro up on that roof to take a look at it from the proper angle?
That which looks OK from the ground is often....very, very often, far more damaged than you might otherwise imagine.
Hail damage doesn't always look like OMG DESTRUCTION on a roof shingle. Could look like a mild dent from an errant golf ball. But those add up, and you might be entitled to a brand new roof via your insurance.
Get a Certain-Teed "Select Shingle Master Contrator", or a GAF "Premium" contractor out there. They'll inspect for free. They'll show you photos of what they find, and you can discuss any damage with them, in terms of presence, severity, and options for moving forward, or not.
But, get it looked at. Things look different up there, when seen from atop the roof, and not out on the sidewalk.

First day started off with a "not bad" video on Angola as a "complex emergency" (euphemism for ridiculous man-made catastrophes in places that should be richer than Singapore). Included (nearly fell out of my chair) the throwaway factoid that one of the few areas of the country free of mines was the strip that had been occupied by the evil South African military.
I jumped in right after the video ended. Explained that mines are only a problem when used improperly - no maps, no records, no strategy - and that the strip of southern Angola was a perfect example - South African army was professional and operated on western standards for things like use of mines. Added in the example of Normandy in WWII (more mines than Cambodia, cleared up without much trouble, and quickly).
American instructors were taken aback, quiet, clearly not pleased. Foreign staffers were fascinated, thanked me later, said they never had known that about mines and mine warfare.

They say a peasant boy from dirt poor surroundings can make more money as a ladyboy than anything else he could ever do by a long shot. He could keep up his whole damn family in a life of relative luxury compared to the dirt poor countryside.
And that's something else I wondered. Why Thai ladyboys? For some reason, Thai boys make good girls, just something about the stock. I don't know if I believe it, but I read that got started because of the high demand for Thai girls as prostitutes. Supply was running low, and some of these cutthroat ruthless pimping operations started just grabbing young boys, putting wigs and makeup on them, and using them.
And that caught on, some of the "customers" started really digging that, and so the ladyboy demand came into being.
Now, I just don't know about whole, "Hey, let's slap a wig on some boys and whore them out. Them drunks may not know the difference or even care...." I just don't know if anyone would really think that.

So, I'm a female who works in a non-traditional field, and have never been able to play the woman card. In fact, I was told point blank by my union steward that I couldn't get away with the things my male black co-worker could. Because he had the NAACP card. There are also men who screw you over at times and make you work harder, simply because you're a woman and they like to watch you struggle.
Not complaining about any of it; just giving another point of view. The woman card might work for some, but as far as I know, I've never been able to play it myself.
Now if I was a black Muslim transgender, well, I'd own the world.

Thanks, Jim. Our roofer is also a friend and he was all over the first and second stories by 9:00 AM the next morning. We got a new 40-year roof after a big hailstorm some 7 years ago and, though no roof in the Dallas area will ever last 40 years, it held up pretty well with only some minor damage to the ridges.
We'll have the ridges replaced but we'll wait till after after the major hail season has passed.
If the storm had come from the south instead of the southwest, we probably would have lost some large windows. It was a close call.

BTW if you mistakenly hit the "Schedule update" (or however it reads) button, keep on clicking through the scheduling popups about what day and time you want it to happen because there's eventually one that allows you to cancel the scheduled update entirely.
I hit the 'schedule' button by mistake when I slipped with the mouse while still half asleep; thought I was now screwed into getting Windows 10 that I didn't want; but found there was a 'cancel update' screen eventually.

I don't live there myself, but I follow Clayton Cramer's blog. He still recommends the license if there is any chance you will be traveling to another state. Most other states will recognize other states' licenses, but you have to have one for that to work.

Driver support deficiencies. It'll say cheerily "your system is compatible" when it may not necessarily be, and where upgrading will break it to the point of unusability.
A ton of "phone home" telemetry reporting back to Redmond in detail on everything you do with your computer. The privacy angle notwithstanding, this also chews up bandwidth and slams people into network usage totals. You can disable this stuff, apparently, but they can also apparently easily re-enable it with updates.
It makes your machine into a redistribution node for W10 binaries. So Microsoft end up benefiting from bandwidth you paid for, instead of paying to scale up their own server farms.
You give up control over which updates get downloaded and installed, and having such control has been the only thing in the past that has stopped certain toxic Windows updates from wreaking havoc on users.

Download the license terms, enlarge the print, and look at 'em. Microsoft will own anything you say or do using Windows 10. They'll own your creations, they'll own your secrets, they'll own your metadata, your rolodex, and your browsing history. Take a picture on your camera, upload it into your Pictures directory -- they can use it in their advertising, royalty free. It doesn't "feel" any different. But use a Win 10 computer running Word to compose a patent application and see who owns your thoughts.....

It's not what they're doing with it now, as they're forcing everyone onto it....it's what the license terms allow after everyone is stuck. I have one toy that runs Android so I could see how it worked -- it has no access to my identity, my finances, or anything else useful. I may end up with a similar Win10 device -- but I am otherwise done with Microsoft.
And, incidentally, much of what I transport over Google Mail is going to include encrypted packets. (There is someone here who has received pictures pasted into encrypted spreadsheets.)

No, it's not going to try. Vista is not a upgrade candidate for Windows 10. Although any machine that shipped with Vista will probably work alright. I had no problem installing the preview of 10 on a Core 2 Duo machine I originally built to run vista when it was in beta. It needed a BIOS update to switch to 64-bit and eventually was upgraded to 6 GB from the original 2 GB. (It was a choice between 8 GB of PC5300 and 6 GB of PC6400 due to bandwidth limits of the memory channels in that chip set generation.)
The main source of problems would the traditional lack of ongoing OEM support for a hardware item. For example, a lot of machines from the late XP era to the early Win7 era used a Ricoh chip for implementing a SD card slot. Ricoh dropped support for the chip before Windows 7 but the existing driver did work initially and a lot of PC makers kept using it. But by the time of Win7 SP1 there were security holes patched that showed the driver wasn't properly coded and could no longer run. So it really became an issue for Windows 8 but since it was Windows 10 that was the free upgrade it was more recently that many became aware of Ricoh abandoning support for the chip. There isn't anything Microsoft can do if Ricoh doesn't want to share the necessary info privately or open source it.

(1) I believe that Windows license terms forbid running on virtual machines. I also believe that such license terms are, as a practical matter, unenforceable.
(2) What attractions does Win10 exclusively have that are so compelling that someone wouldn't just use a Linux application? For instance, I am unaware of anything in Photoshop that is superior to GIMP. I regularly use Libre Office.....there's nothing in Microsoft Office that compels me to use it.

My sometime employer does lengthy and complex documents for proposal bids to various levels of government for communications planning. I'm usually only peripherally involved in these as I'm not an RF and Telco guy but every year they experiment with the lower cost alternatives to Office for creating these documents and they always end going back to Office because those alternative falls down badly on the big stuff.
That is a subset of the market but there is a reason why they still hold the position.

BTW, Anon -- steam runs on Linux, so a good chunk of games run fine.

Who made the machine? If it was a big brand still in business the update should be on their site. If it was a white box system, either from a small shop or DIY, with an identifiable motherboard make and model, look on the motherboard maker's site. Some brands, like ASUS, have utilities you can run that will examine the machine and tell you if they have a newer version for the BIOS or drivers.
In the case of the machine I mentioned above, I built it myself with an Intel motherboard, so the updates weren't a problem. Before they got out of the retail motherboard business, the Intel boards were very good for everything just working. They wouldn't have exciting whizbang features to appeal to the overclockers and such but those can be a real source of problem if you aren't intending to use them. A lot of people building a system for themselves will buy too much motherboard and discover the high end features don't do anything useful for them and complicate matters when there is a problem to be solved.
If I was gathering parts for a new build tomorrow, I'd almost certainly get a Z170 board but not an especially high end one. I want the full Intel platform spec but unless I know I'm going to build a monster hot rod or upgrade that way later, it would be both a waste of money and source of potential problems. I'd want an PCIe x4 M.2 slot but I wouldn't be concerned with SLI or Crossfire, and especially not a triple or quadruple GPU setup. Perhaps if I won the lottery and was doing it as an idle rich hobby.

Absolutely. Although I am not doing so at the moment, I used to dual boot with a Linux OS. I'm no fan of Win10. I am currently running an unsupported Win OS, and will likely move up to Win7 before too long. When the time comes that MS stops supporting Win7, I will likely setup that OS as a virtual one with some form of Linux. But, that is a few years off, so other alternatives could present themselves before then.
I do like using open source software, and my dabbling with GIMP has been from within Windows.
The alternatives to MS Office are not quite up to snuff, either. Most of the Open Office suite I could get by with, but the Access replacement was horrendous. Databases that worked in Access would just not convert properly to [whatever they call the db program in Open Office]. And, last I looked, nobody has come close to coming up with a replacement for Outlook. Thunderbird isn't horrible, but it just isn't Outlook.

My firewall stops 256 outgoing connections every 2-3 days (it hits 256 and does a dump). They didn't ask me to communicate or tell me what would be said, so they hit the default block....and, yet, my system works fine.
Just as I see someone on TV and think, "what nonsense does this witless Marxist asshole want me to believe?", anything I see from a software publisher makes me think, "what personal information does this person intend to covertly rip from me to sell to enemies and con artists?"

Nolan Bushnell wanted to have open expandable machines, like the Apple II but with far better video and audio functionality. Warner insisted on a closed box and the best features kept secret. Bushnell gave up in frustration and left, signing a non-compete contract in exchange for a pile of cash.

Ask somebody who uses such apps professionally. There is no comparison.
My sometime employer does lengthy and complex documents for proposal bids to various levels of government for communications planning. I'm usually only peripherally involved in these as I'm not an RF and Telco guy but every year they experiment with the lower cost alternatives to Office for creating these documents and they always end going back to Office because those alternative falls down badly on the big stuff.
That is a subset of the market but there is a reason why they still hold the position.

Like many others, she has learned the lesson from Madonna: slut it up and you can get some attention to your work. What she and most others failed to realize (or at least emulate) is that Madonna was also doing some interesting things musically, so even if she got the initial attention by acting slutty, there was something more substantial that kept people interested.

They know, there just isn't much to be done about it. The numbers just aren't there for many developers to see the ROI. A lot of indies do it just because they feel like and have the freedom to make such choices but they'll ship the Windows version first to get the revenue happening and may cancel the ports if it doesn't go well.
This extends into the console business. A developer might have a relationship with a console maker that gives them first dibs on a new title but when that isn't a factor the installed base is the 800 pound gorilla. For a typical indie that doesn't push the hardware very much, the PS4 and Xbox One are nearly identical machines at the hardware level. The infrastructure for online services may also be a factor but a small dev looking to break even ASAP on the sunk costs of a project is likely to favor completing the PS4 version first just because it has a bit over twice the installed base globally. (The difference is a lot narrower if you're initially just targeting North America and far wider if you're targeting Asia.)
Most games are considered successful if they reach 5% of the target market. This is why 20 million installed base is a big deal in consoles because that gives you a million likely customers for a run of the mill success. Obviously, the platform that doubles that is going to draw more interest, unless there is some special audience interest cluster on a particular machine. Nintendo can make big money on a game because they can see a 50% or better attach rate, even if the total market on that machine is dismal from a third party dev's perspective.
If anybody is making serious money on selling a game to Linux users, they're in a very small club. They're biggest hope for such ports is if SteamOS machines achieve a really substantial installed base of people who don't really think about the OS under the UI. One avenue that could hold out some hope are the people who prefer the genres that are severely underserved on consoles but find dealing with PC gaming bewildering and want a turnkey experience.

It needs to start over, and do education better this time.
"No more Katy Waldman's" is probably too lofty a goal, I suppose, but it's worth trying for! Maybe Yale should try to only produce engineers and physicists for awhile. Leave the English to UConn or whatev. Maybe that will help.

A better solution is cease all public funding for colleges and make them survive on tuition alone. And since SCOTUS said government scholarships were considered "funding" end that too.
When colleges have to make ends meet through their own devices as was the normal up until more recent times a lot of this stupid shit will go away.

Do you really think so Vic? Land grant schools have got public money (from individual states) since the Civil War and have done pretty well at educating engineers and farmers. I'd like to keep them going, but I agree taking Federal money out of all non-Constitutional Federal activities (and where does it say the Feds are supposed to provide grant money to colleges?) is worth doing. Do it at the State level I can agree with though.

I remember when the Amalgamated Baggage Screeners of America were all private contractors working for minimum wage and the argument was that government had to take over the process of screening airline baggage and passengers because private business had failed to protect the air traveler and that only highly qualified government employees hiring only highly qualified candidates who would go through a very through government run training program that would be administered by highly talented highly paid government services employees who would be in the union would protect the air traveler far better than the slubs hired by for profit greedy capitalists.
So now you are telling us that fat cat government politicos who are making security decisions based on politics rather than security, who are administering security operates based on political ideology don't do any better job than minimum wage contractors? So why are we paying those government union employees above average wages for below average performance?

Well the University of SC was founded here in 1801 as a State supported school, as were most of the original public colleges. However, it is long overdue to stop all public funding of these liberal hells and let them sink or swim on their own.
We have one semi-conservative college left in the State (Wofford) and it is a private school. It may get some public funding but I surmise that it is not much. It is expensive as hell and IIANM there is a waiting list to get in.

Back in the old days when liberal arts were the most prestigious part of a university (yes, that time existed), it would let you become more cultured. There also wasn't much of a point to learning a more practical area, as a university would be far more filled with upper class scions...Yeah, I know, but that was much more the case in the early 20th century.
However, since this isn't the early 20th century, it can also let you pad your GPA while still dicking around and still getting a decent job/grad school from a place like that.

Back when there was still a fight over the unconstitutionality of Title IX SCOTUS ruled that it was funding and therefore opened the doors for government intervention in colleges. That case involved a private college which got no direct federal aid. (That being the cause for the government to intervene in all public schools despite there being no authority in the Constitution).
