Appeals Court: Cheating Tom Brady Must Stop Cheating the NFL and Serve His Four-Game Suspension for All His Cheating

Deflategate, reinflated.

A lower court had previously blocked his punishment, claiming the NFL's adjudication and punishment system deprived Brady of "fundamental fairness."


NEW YORK (AP) — New England Patriots quarterback Tom Brady must serve a four-game "Deflategate" suspension imposed by the NFL, a federal appeals court ruled Monday, overturning a lower judge and siding with the league in a battle with the players union.

A three-judge panel of the 2nd U.S. Circuit Court of Appeals in Manhattan ruled 2-to-1 that Commissioner Roger Goodell did not deprive Brady of "fundamental fairness" with his procedural rulings....

It is also likely to fuel a fresh round of debate over what role, if any, the quarterback and top NFL star played in using underinflated footballs at the AFC championship game in January 2015.

He'll have to sit out four games this upcoming season, where he can, from the bench, think up bold new ways of cheating and nearly getting away with it.

The deference given to arbitrators under the LMRA is ludicrous. It's smoking the monkey crack crazy. Depending on the terms of the agreement, an arbitrator can get something point blank wrong and, oops, too bad so sad, you agreed to let the arb do that and no review for you.

So *grits teeth* while the decision may be right legally, it's still an example of where the LMRA is ridiculously overbroad and should be amended to allow realistic review.

The contract states and both entities agreed in it that the NFL is the sole arbitor of determination of league rules, violations, and punishment for violations.

When the NFL went through the months long process of determining the game balls were purposefully deflated and determined that Brady was involved or had knowledge, they handed down the punishment.

Brady's lawyers then challenged it in court, citing everything from Brady's loss of work, to unfairness by the NFL, etc.

Lower court singular judge agreed.(Probably got season tickets, LOL)
NFL appealed. Do we have a CBA or not? Do they mean anything?

Federal court said yes, you have a CBA, it means what it says, and you were within the limits of the agreement to impose a suspension for violation of the rules.

Finally, a court that recognizes contracts. And upholds them.

There's a collective bargaining agreement between the league and the players union that has an arbitration process for handling this. Tom Brady did a Cartman and made it a federal suit. LOwer court should have deferred to the arbitrator ruling but didn't, and it got overturned on appeal.

There was also a good article showing primary voters were up 60% over 2012 and Trump is pulling in some key demographics.

Combine that with The Hag's also high negatives and that Dem's are worried a matchup with Trump will bring her negatives with women up once he starts to go after her.

Again, I am a Cruz supporter, but to deny there are some positives which may help Trump turn the tide is somewhat dishonest.

I won't go so far as saying he is a disgusting human being, but it did seem that Chemjeff offered legitimate and factual criticisms of Trump. Whether bankruptcy, emnient domain, or campaign contributions are legal or not doesn't really matter. They set a patter of someone - fairly or unfairly - who avoids paying creditors, uses the government to help obtain private property, and "bribes" (influences) politicians (usually Democrats). In the whole, these are generally things not to be admired.

I personally do not care much about the bankruptcies as much as some of the other issues. They are a legitimate way to get out from creditors - and most creditors could have protected themselves.

Both have used bankruptcy laws to their advantage. But Dave Ramsey is at least repentant enough to say that he wishes he hadn't stiffed his creditors but due to his own stupidity and behavior, he had no other choice. Donald Trump doesn't even seem cognizant of the fact that his use of the bankruptcy laws was actually harmful to other people. Now all of it is legal. Nobody disputes that.

It was dumb at the time and everyone knew it but they were so desperate to do business with him that they made total fools of themselves. So they screwed themselves over.

This is not New York values. I value the investor's and the lender's responsibility to do due diligence in assessing their capital use. I don't cry for lenders who throw money at people they think are hot, at the moment. I cry for creditors, such as Chrysler's, who had their collateral and place in line spelled out in black and white on a contract and had the government and court just decide that the contract was void.

There is a difference between a personal bankruptcy and a commercial, business bankruptcy.
Business often have to take risks, are subject to market conditions and having to try to make forecasts years ahead, etc. Products can be determined to be hazardous years down the road,(like asbestos), and companies are on the hook for products they haven't made for years, because someone thirty years ago contracted a disease from it.
Right now, coal companies are filing bankruptcy because we have a government that is determined to put them out of business and has said the same. Shipping companies, such as freighters won't be far behind, as demand for coal, etc. is shut down by the government.
Real estate developers are notorious for filing bankruptcy(remember, they are filing typically for reorganization, not Chapter 7 liquidation). They get relief from their creditors, their responsibility to them is not summarily dismissed.

I've posted this before, businesses that file for chapter 11 reorganization typically come out stronger than before, their previous customers normally will stick with them through the bankruptcy and emergence because all payments during bankruptcy are supervised by the court and aren't late, and even though the customer has lost a sum of money in the initial bankruptcy, they normally should have been aware that the company was struggling and therefore limited their exposure, including insurance, factoring receivables, etc.
They want the company as a customer because the benefits outweigh the risks.

Business bankruptcies should not be looked at like someone who ran up six credit cards with vacations, clothes, etc. knowing they couldn't pay it back and then file bankruptcy.
The bankruptcy code for businesses was written to help companies reorganize, allowing them to remain in business(therefore preserving jobs, local economy, etc.) while providing court supervised restructuring that makes sense and gives as much reimbursement to creditors as possible.
Remember, in a bankruptcy, your creditor gets to argue their place in line and amount owed. Doesn't mean they get it , but they are not without legal consideration from the court.

I could go on and on, there are hundreds of major companies and thousands of small ones that have used the bankruptcy code to stay in business, or in the case of Enron, etc. to liquidate.
In Trump's case, his bankruptcies were all chapter 11 reorganizations of his casinos.

Per Moneymaker magazine
Reed Smith partner Michael Venditto, who has represented clients in high-profile Chapter 11 cases (including bankrupt airline TWA), added in the same article that "to the ordinary person in the street, [four corporate bankruptcies] may seem surprising, but certainly not to me. Chapter 11 is how you reshape and restructure a company that has problems. It doesn't indicate anything nefarious or even bad management."

This statement is so completely lacking in critical analysis, it's disappointing coming from you. It's obvious you haven't read much about this (maybe just the headlines). There is so much more to this that the NFL had to lie and manipulate evidence just to make its case. The only reason they won is because of the CBA giving Goodell broad powers as abitrator. The court case was never about guilt or innocence.

I'm sure when Judge Berman overturned the NFL last year, you thought Brady was innocent, right? Or was it just about labor law then?

440 Pixy won't let me copy parts of the article from Forbes, but if you read articles in business magazines on line regarding the Trump bankruptcies, you'll find that each time he ended up giving up a larger portion of his stake in the company.

The bankruptcy in 2009 left him with only 5% interest in the casino. His name was still on the casino as a branding to bring in customers, but he is essentially out of the casino business in Atlantic City.

446 The odd part is, the process by which they "determined" that the footballs had been deflated was so badly carried out that the evidence to prove any wrong doing is simply not there. The two pressure gauges they used gave different pressures that varied by enough to cause the observed difference, and they were UNABLE to show which gauge they used at specific times.

Brady may or may not have been attempting to deflate footballs, but there's no reliable evidence to show that he did.
