The law is clear. The US Supreme Court, in their 1963 case Gideon v Wainwright,
ruled that everyone who is accused of a crime has a Constitutional
right a lawyer at the state's expense if they cannot afford one.

Not exactly true, only for significant felonies.

Note that there are slight daily fluctuations due to the IBD/TIPP daily tracking poll.

Clinton continues to dominate Trump with an average lead of 10.4%. After some questionable assertions by Trump supporters yesterday I looked again at state polling and Trump does not put the Northeast in play. He loses to Clinton badly in New York and New England.

Note that Cruz is also behind Clinton but by a much smaller number. They are effectively tied except for the Bloomberg poll that puts Clinton up by 9.

The Senate and House remain the same with the Democrats gaining at least 3 in the Senate and 12 in the House.

1. Health exchanges are closing
2.. Health insurance carriers are walking away and/or are shutting down.
3. If you are not a recipient you have to spend nearly $20,000 on premiums and then another $5-10K on deductible before your health plan pays a dime.

83 Why I personally can't stand Trump:

Note that if I have to vote for him instead of Clinton, I will.

Trump has two traits that I despise in people. He is a braggart and a whiner.

He talks about how great he is, but objective measurement of his performance shows he is pretty mediocre. He hires the "best" people, but really he hires cronies and yes men that aren't able to deal with the slightest amount of adversity.

And then the whining. It is so annoying. When things go wrong it is always "unfair". He is a special snowflake that should be in a modern University to shelter him from any adversity. The bitching about Colorado is especially annoying. I'm not a professional and I knew what was needed to win delegates in that state. How did it escape his big brain?

After South Carolina he could have won the nomination and the Presidency. All he had to do was act mature and presidential. Instead he kept acting like a 13 year old and turned people off who were open to rally behind him.

If he loses the nomination it will be his own fault for being lazy and entitled. I won't shed a tear. But we will hear non stop about how he was cheated. It won't be true.

No one in their right mind signs up for Fredocare unless they have NO other option or they are young with NO health problems. The Fredocare networks are so narrow, your lucky if your local Vet is on one. So most people who do not have work supplied health care ( and that number is shrinking every day) get plans outside of Fredocare and because of Fredocare those premiums are skyrocketing.

111 2. Federal income tax goes into the general revenue pot which funds the federal portion of Medicaid and Obamacare exchange subsidies.

Posted by: Seamus Muldoon at April 13, 2016 09:13 AM (NeFrd)

112 3. The ever increasing deductibles create a financial disincentive to utilize your insurance, making putting off certain medical care more attractive than paying the deductible. Medicaid patients do not have any co-pay or deductible and therefore don't share this financial disincentive.

Posted by: Seamus Muldoon at April 13, 2016 09:14 AM (NeFrd)

113 4. Medicaid reimbursement rates are so low that hospitals and providers attempt to make up their losses by increasing the rates they charge to insured and private pay customers. E.g. a procedure that should cost, say $500, gets reimbursed by Medicaid at $300, so the list price gets marked up to $750. Since you haven't met your deductible you pay that $250 mark-up out of pocket.

It also has the benefit of being elective.

By definition, people can live without it, and shop. And the people who can do it have the disposable income.

We are seeing something close in the rise of care facilities which now handle many of the minor stuff we all experience that usually involved sitting for hours or days in an ER.

There, it was realized that here was a win/win; minor care could be delivered without subsidizing the high costs of an ER. So insurance often does cover such care.

165 I always wondered if there would be any profit as an employer to fraudulently apply for a couple of ITINs, make up fake SSNs to match, "hire" them, make withholdings on a fake W4 that declares the maximum dependents, file tax returns on them for two years, and then have them "quit" when you start "garnishing" the wages for back taxes by demand from the IRS.

I figured that the employer would get the write-off for the "employee's" wages and only had to pay the minimum withholding, and when the garnishment notices come, the "employee" would get the blame when he "disappears"
With the payroll software available the computation would be easy, and apparently there is nothing the IRS is doing to research this sort of stuff.

And if someone with an ITIN suddenly leaves and is never seen again, well, It's supposed he went home.

I asked a tax preparer about this once. She declined to answer.

At some point, the American people, or whatever is left of them, will be faced with a nasty choice: capitulation, an authoritarian state to try to deal with the crisis, or outright and open rebellion. I'll go ahead and point out that the first gives the Left what it wants, as does the second, while the third is doomed and provides pretext for the second.

It'll be like what the oldtimers from the FSU said life was like - humiliation with every breath.

171 >>The ever increasing deductibles create a financial disincentive to utilize your insurance, making putting off certain medical care more attractive than paying the deductible. Medicaid patients do not have any co-pay or deductible and therefore don't share this financial disincentive.

And I guarantee that if you do use insurance you will find it beyond confusing to the point of giving up trying to understand what is covered, what isn't, what is being fully reimbursed, how your co-pay is being applied, etc., etc. It's a nightmare.

172 Also, you know how Obamacare makes some stuff free - like everyone should be able to get a free colonoscopy screening at age 50?
So a lot of insurance companies have it so that it's free if it's a screening, but not if it's a diagnostic test or anything else.
So if you have no symptoms and get the colonoscopy and they find nothing, congrats, it's free.
But if they find polyps and treat, it's treatment, so you pay.
If you have symptoms before the test then it's diagnostic, you pay.

This is what happens when lawyers in congress try to practice medicine.

Great minds VM! Scheduled for tomorrow morning!

Thanks Lizzy, I normally plan some sort of trip itinerary, but it's just a rough outline this time. Weather (and activity in the Pubs) will dictate the direction we take.

'Too ill to travel' wouldn't fall in the non-emergency category, would it?

I disagree with the other assumptions. People traveling long distances to engage the services of a specialist has never been limited to the wealthy. There was a time I can recall when people came many hundreds of miles just for a diagnostic when only a few places in the country had the facilities. When other costs weren't insane, the cost of travel was not a problem for the middle-class. Also, there have been charities that existed solely for that purpose. I don't think I need to explain the difference between a charity and a government service paid for by taxes.

There is a hell of a lot of improvement to be had by getting government out of medicine and stop pretending it's something other than a business. As long as health care is treated as a basic human right it will remain an economic albatross around the nation's neck. Access to health care should not mean every productive citizen should be on the hook for picking up the tab, especially not at gunpoint, which is the implied threat for anything paid for by taxes.

Posted by: Fritz at April 13, 2016 10:30 AM (UzPAd)

254 I'm counting on nothing Tim.

Trump can still win if he can get 1237 on the first ballot. He won't get there with committed delegates so he will have to get some uncommitted delegates to vote for him. We will see how well he does given the way he keeps insulting the party and the process.

If he doesn't then Cruz is more likely to win on the second or third. I doubt it goes to 4th.

256 To really force the GOP establishments hand Trump just needs to start picking which GOP Congressional Leadership he wants his supporters to target in the event he is not the nominee. People focus when they face the threat of loosing their jobs. Trump needs to hit back twice as hard. Punch them right where it hurts them the most, their personal power. He needs to publish an enemies list also, just to make it clear and something that we can point to after the election to remind the GOP donor class who actually has the power. This wouldn't be a bad thing for the Conservative movement in general to do just to let the Rhinos know that their days of screwing us are over.

Because the way we have been doing things has been working sooo well for us.

Until we make the Donor Class fear us they will continue to betray us. They need a good solid punch in the nose in order to encourage that pack of thieves and liars to do the right thing.
Because again the way we have been doing things, playing nice with them has worked out so well for us. I say we need to take a page or two from the Lefts playbook, because you know they are actually moving the ball down field and scoring whereas we aren't.
