Another Comic's Joke Again Finds Its Way Into Amy Schumer's Repertoire

The claims of "parallel thinking" are sounding increasingly preposterous.

Bumped: Because of all the enstompening earlier, I wound up stomping this thread.

Let me post this analysis deeming Schumer guilty as charged (though possibly only guilty of subconscious plagiarism) as a new addition to the post.

The writer points out that Schumer doesn't really rebut the charges very well -- she just offers a series of deflections (this is all about bringing down a successful female comic) and attacks on her critics (such as Tammy Pacatelli, who Schumer says is accusing her of plagiarism out of jealousy).

Update: Oh, wow.

By the way, that MAD TV sketch she ripped off from start to finish was hilarious.

Unless she paid MAD TV to re-do the sketch (a possibility -- maybe something that happens in the field, and why not?), then we have a problem.

Buzzion asks, "Is it possible that the writer of the MAD TV sketch is now a writer on her show?"

Sure that's possible -- and I'm not sure what the etiquette and legality is there. Can you re-sell your old material? I imagine you can, in many cases. Comedians and writers might have contracts that specify that they're coming in with some bits, and they're leaving with those same bits, that they keep them, and can re-sell them at a later date.

A magazine doesn't purchase your article outright -- it buys the right to be the first publisher in North America for a year or whatever. Then it reverts to you.

This one's so blatant that I gotta think there's some legality that justifies it.

Otherwise, wow, game over.

It's occurred to me that the writer of this sketch (who I assume wasn't Schumer) might have owned the sketch himself, because he did it for, say, Second City or the Groundlings or something. So he has the right to sell it to Mad TV, and then sell it again to Schumer. Or something.

I don't know. I can imagine there being a perfectly innocent and plausible explanation.

Of course I can imagine the absence of one too.

My personal prediction, which I'm trying to get odds on from a Vegas sportsbook, is that Huma Abedin will fall on her sword claim she cut and pasted all the challenged material.

107 Girls, your mother and I are getting divorced. Don't cry. I know you're upset, I know you're confused. I don't know what your mother told you, but let me explain it from my side in terms you can understand... You got your doll, right? You got your doll there.

You got your doll and you like your doll, right? You love your doll.

Gordon: Yes, you love the doll. But what if I told you that was the only doll you're allowed to play with the rest of your life. How would you feel?

Five Year Old Kim: Sad.

Gordon: You'd feel sad, of course, 'cause there are a lot of other dolls on your shelves. And if you play with the other dolls, you can't have that doll anymore. Even though that doll doesn't want to play with you at this point. You're both living a lie. There's other dolls you like, and they're making new dolls every year. You want a stewardess doll?

Nine Year Old Amy, Five Year Old Kim: Yeah.

Gordon: How about a slightly overweight cocktail waitress doll?

Nine Year Old Amy, Five Year Old Kim: Yeah.

Gordon: What about a doll who happens to be best friends with your main doll?

Nine Year Old Amy, Five Year Old Kim: Yeah.

Gordon: It could happen, right?

Nine Year Old Amy, Five Year Old Kim: Yeah.

Gordon: What about a doll you only play with one day and never see again?

Nine Year Old Amy, Five Year Old Kim: Yeeeah.

Gordon: What about a doll where your friend's playing with a doll and he needs you to, you know, kinda man up with the other doll? You don't even wanna play with that doll but you do it cause your friend's playing with that doll and you don't want to sit there and look at the other doll unattended.

Nine Year Old Amy, Five Year Old Kim: ...yeah.

Gordon: So that's why me and mom are getting divorced.

114 29 Some comics used to live on that kind of thing. Milton Berle was more than willing to, er, borrow from other comics infamously. But back then, it wasn't so much a problem because they were spread out, didn't have so much TV and internet coverage, and it wasn't so easy to find the swipes.

Berle got away with it because he was a B-lister (even with the brief insane popularity of the Texaco show) and because his theft was part of the act.

Berle's delivery was really good too: it worked. Henny Youngman's delivery was just horrific but he was such a machine gun eventually he'd say something that was funny, so it worked for him. If you saw someone talking like Mitch Hedberg you'd never think he could be a comedian but he did internal damage to me I laughed so hard at his stuff. Comedy is weird that way.

But this woman doesn't really seem to be all that funny any way you put it. I'm with the guys who say there just aren't very many funny women. Maybe that's unfair, there are some (Elaine on Seinfeld, the woman on Third Rock from the Sun, etc) but just not very many. I have never seen a really great female standup. Strangely enough Roseanne's early stuff was some of the best, but still not as great as the guys.

Comedy is a tough business and comics are brutally tough on other comics. Women who go into comedy often feel they have to out-tough the men with regards to language and smut. Phyllis Diller was good and so was Joan Rivers, but, they both relied on making fun of themselves for laughs.

165 If she'd just lose a few pounds, she would be pretty, or at least cute. Dunno about the funny. Hard for anybody to compete with Phyllis Diller:

"The passenger behind me [on the cut-rate airline] stuck his fork into my hair. Then he had the nerve to complain about the spaghetti with the black roots!" "The stewardess, bless her, was so old -- You know how women get those little crow's feet around their eyes? This broad had mastodon tracks!"

I was on about this yesterday. Female stand ups are rarer because stand up (unlike comic acting and writing) relies on traveling all the time and working in bars. So nearly all the straight women who want kids (aka most of us) are eliminated. Funny women tend toward writing, hosting and other more consistent work. It's not a coincidence that most of the prominent female stand ups are lesbians or straight women who don't want kids or had dysfunctional relationships with their kids before going into stand up.

I liked it. Yeah there's a lot of "hear me roar" down-and-a-little-too-dirty girl jokes in it, but it's pretty funny, and the poop joke scene...they raised the stakes enough and did it in a creative enough way that it works. It's supposed to just be a nightmare, and they aren't actually that explicitly gross/nasty with it.

Although I recalled being pretty put off at the time.

237 Wrong answer: Make excuses (jealousy, sexism)

Right answer: Book a late show appearance to respond, on the show, pull out the Milton Berle Joke Book and read, deadpan, a joke about stealing jokes.

Nobody *ever* does these things right.

Remember Star Wars Kid and the embarrassing video? If he had just (and this is *not* easy) done a press conference and laughed nervously and said "yeah, that was pretty embarrassing, wasn't it?" - the results would have been 10x better for him than his parents threatening to sue the school and other students.

You can deflect, avoid, or.... TAKE OWNERSHIP of the joke. Make it YOUR joke.

If it's not yours, it's someone else's to use against you.

Now, none of this means Schumer isn't a plagiarist (or is funny), but she's *also* not handling it well.

279 You guys are right, and he converted in 1998.

Caveat to the below: it's my understanding that:

Blacks in this country have a sophie's choice when it comes to cultural identity, which is something black males have more pressure to signal than other races. They can be square and appear inauthentic, embrace the stereotype of pop African American culture and *be* inauthentic, or take a third path and just do their own thing, which is lonely AND doesn't free you from the original dichotomy.

Islam preys on that. The US also happens to be one of the only places in the entire world where you can be a practicing muslim and treat it as a philosophy, without having to deal with cultural islam. That will be changing soon.

I guess what I'm trying to say is that I think African Americans and islam have a relationship where their black identity is served through their adoption of a non-christian religion in a way that allows them to not be "of white culture" which is important for a formerly (and, in my opinion, currently) enslaved people. Knowing what a hot- and pig-headed individual I am, if I was black, I'd probably have a tendency there myself. As it is, I think everyone has a right to fly the CFB if they like, and it's not racist to do so. I extend the same gray area to black American muslims.

Am I worried about our black countrymen and islam in the near future? Sure am. It would be a shame for them to go on the pyre with the rest of those human stains.

But then they did the same exact thing in all the subsequent movies.

338 Islam could be beneficial, if stripped of certain aspects. It calls for charity, humility, cleanliness, order, etc. If reformed and cut away from the Hadiths and some of the more bloodthirsty parts (easy enough to do, if you had a good group of clerics in charge to issue the rulings, with the way Islam works) the religion could be as beneficial to society as, say, Mormonism.

For example, the Nation of Islam in practice generally ends up with neighborhoods being better protected, kids being put in school, men dressing better and being more responsible, etc.

But the trend is away from that and toward the more bloodthirsty, extreme, and tribal side.

The islamic world didn't even accept the nation of islam as islamic for decades ... until the first world trade center bombing when they realized that the nation of islam represented a presence "in the belly of the beast".

Personally, I get a kick out of the fact that blacks are attracted to islam when islam is more anti-black than pretty much anyone else. Of course, Louis Farrakhan thinks that islam has more to do with aliens and the Mother Ship ... so I can see why he doesn't care about that.

Who do blacks think started the African slave trade and opened up the routes? Who do they think continued it long after Europeans had stopped? It's just pathetically funny.

And "Palestine" really was never occupied, anyway. When modern Jewish settlement began in the early 20th Century, mostly the settlers bought land from its existing owners, often Ottoman Turk absentee landlords. And whatever land Israel has annexed since, as a result of winning wars started by brain-dead muslims, they own, fair and square, by right of conquest. They should have expelled all the muzzies right from the get-go.

Besides, it would be completely unmanageable to allow such a thing. You would have to sort out who was responsible for which joke, a nearly impossible task since comedy skit-writing is such a collaborative process. Also, the last thing a production company wants is to be unable to sell its product five years from now because 10 different writers have hypothetical claims over parts of it's shows.

459 If that's John Mulaney (I think that picture is him), then it's possible Schumer thought it was a great joke on any of the night's they played together. He tweeted about how they were performing together this last Christmas Eve.

Though I'm sure the video of Schumer predates that performance. So either he was cool with the "borrowing," he didn't know about it, or he just wasn't angry enough to let it prevent one brief bit of promotion for the two of them.

They would keep the trademark, since it's an active product. This would bar people from producing new MM stuff.

But the copyright on things they already produced, years ago, should have expired long ago, if they didn't keep buying politicians to extend it for them. Therefore, people could copy (and sell) Steamboat Willie all they liked.

488 So the other night I went to the movies and sat behind what I thought was a man and a woman with long beautiful blonde hair. Only thing was, she wasn't a woman, but one of those long haired afghan dogs (but from the back you'd a thought "that's a blonde haired woman!").

So anyway, throughout the movie, the dog was laughing during the funny parts, crying at the sad parts and generally acting like a very enthusiastic human movie goer.

At the end the audience clapped and the dog stood on her hind legs and clapped her front paws in terrific excitement. On the way out I said to the man "that's incredible that your dog responded to the movie like that!"

He replied, "what's amazing about it is that she wasn't too fond of the book."

Patents are for 20 years. Copyright is forever as long as Disney keeps bribing Congress.

If Republicans had the sense to understand that everybody in Hollywood hates them, they would do a common sense rationalization of out intellectual property laws and make copyright also good for 20 years. Every song or movie made before January 26, 1996 would be in the public domain.

Posted by: Jane D'oh at January 26, 2016 06:24 PM (FsuaD)

Yes, we knew that yesterday. Assistant DA Lauren Reeder, who is on the board of PP, is the one who cherry-picked the grand jury that returned the indictment. The actual DA was not involved, AFAIK.

Although I am wondering if perhaps there is not some 3-D chess being played here. Let the Demo-scrunt assistant DA run with it a while, get egg on her face, and then bring the hammer down?

Story Number: NNS160126-06
Release Date: 1/26/2016 12:36:00 PM
From Commander, Navy Region Southwest Public Affairs

"According to initial reports of a single witness, at approximately 8 a.m. this morning three shots were reportedly heard in the basement of Building 26, a combination gym/barracks/administrative facility located on the grounds of the Navy's Medical Center Balboa Park facility.

The ensuing response and investigation by first responders and Navy working dog units, including offices of local federal, state and city authorities, determined that no evidence could be found of shots fired and there were no casualties.

The intensive and thorough search of Building 26, as well as the grounds and additional buildings located on the grounds of NMCSD, did not reveal anything unusual after the initial witness report was made."

607 What we need is to go to the root of this "culture of crime" by bringing back the pillory for small crimes.

A pillory is similar to stocks; the difference is, though, that the victim stands up and the pillory holds fast his or her arms and head, not legs.

The purpose of bringing back the pillory is to end the cycle of sending young criminals to prisons, which they use as a badge of respect, but rather "diss" the living crap out of them, while they are young.

Actually, there used to be some really funny women comics out there. You probably never heard of them because they aren't profane like Schumer, Dunham, etal.

Lets just stipulate that Lucille Ball and Carol Burnett are the standard by which all other female comedians are measured. Gilda Radner was also very funny.

Schumer, Dunham, Lampenelli...not funny.

Jeanne Robertson is very funny as is Chonda Pierce.

617 This may have been addressed upstream or in a different post but I remember that Robin Williams used to be a regular at two San Francisco comedy clubs (one in particular not far from his house). Particularly on weeknights and he'd come in late and hang around at the back. Sometimes he'd try out new material. Sometimes he'd just watch.

Then he started to get accused, even by friends, of stealing jokes. He found the evidence convincing and, since he knew he wasn't doing it on purpose, stopped going to the clubs altogether (moving to Tiburon around this time I believe).

I have no idea if this applies here but thought the concept of 'accidental plagarism' makes some sense. With alcohol flowing I can see waking up the next day and having an 'idea'..........inadvertently stolen from last night's comic.
