Former CIA Official: There Is "Zero Ambiguity," Hillary Clinton Broke the Law and the FBI Has No Other Choice But to Recommend a Criminal Grand Jury

And she "absolutely" endangered lives.

Guy Benson:

In a powerful interview on Fox News' America's Newsroom, former CIA officer Charles Faddis delivered succinct, devastating responses to anchor Bill Hemmer's questions about the latest revelations pertaining to Hillary Clinton's email scandal. The segment was conducted in a grave tone, with network judicial analyst Andrew Napolitano concluding that it's "hard to believe that the FBI will not recommend indictment for Mrs. Clinton."

Why? Regarding the mishandling of classified material (the ongoing FBI probe has expanded into other areas as well), the law, the burden of proof, and the facts already made public all cut against her: Clinton's apparent crime is “the negligent treatment, the failure to protect national security secrets. The government does not have to show that she intended to treat them negligently. The government does not have to show harm. It only has to show negligent treatment. The evidence is overwhelming,” he said.

An important thing here is that there is simply no question that Hillary or one of her trusted aides deliberately and knowingly took this information off the secured system and put it into the unsecured private email -- something which is specifically forbidden by the law. There is no other explanation for its presence there.

Its mere presence on her unsecured private server is proof of a crime.

Team Hillary's response is more of the same: Vast Right Wing Conspiracy, LOL.

Clinton's campaign responded by attacking the Intelligence Community directly.

"This is the same interagency dispute that has been playing out for months, and it does not change the fact that these emails were not classified at the time they were sent or received," campaign spokesman Brian Fallon said in a statement to ABC News.

"It is alarming that the intelligence community IG, working with Republicans in Congress, continues to selectively leak materials in order to resurface the same allegations and try to hurt Hillary Clinton's presidential campaign. The Justice Department's inquiry should be allowed to proceed without any further interference."

The head of the Senate Intelligence Committee, Richard Burr (R-NC), denied the claim from Fallon. "I didn't conspire with anybody," he told ABC News.

Interestingly, the emails on Hillary's servers are so secret that the lawmakers investigating this situation do not have the clearance to read them.

Some of Hillary Clinton's emails on her private server contained information so secret that senior lawmakers who oversee the State Department cannot read them without fulfilling additional security requirements, Fox News has learned.

The emails in question, as Fox News first reported earlier this week, contained intelligence classified at a level beyond "top secret." Because of this designation, not all the lawmakers on key committees reviewing the case have high enough clearances.

The Clintons have gotten away with so much law-breaking for so long they thought themselves untouchable.

But this time, this time -- Hillary just might have schlonged herself.

And that sounds just about right.

"I never sent or received material marked classified"

===

No. That statement isn't a legal defense at all. Its a POLITICAL one. She's trying to have the public think that this mishandling of classified material was accidental, and/or unimportant.

Parsing the statement does NOT look good for her.

*SHE* didn't send the material. . .her subordinates did, acting under her direction. Doesn't matter. . .it was still her responsibility to ensure it was handled correctly. It wasn't MARKED "classified" because she illegally stripped the classification markings off. And whether or not it was wasn't MARKED classified doesn't change anything. Its still illegal to mishandle this information, as as mentioned above, the very fact that it was found on her non-secure server means it was mishandled.

No FBI agent is going to take it on their own to arrest the Attorney General. Are you insane? In fairness, like any prosecutor, the AG does enjoy some latitude to decide what type of prosecution to pursue.

In this particular case, there is a significant systematic reason TO prosecute. As Hilary put it herself, no individual should be "too big to jail", and if she herself doesn't face the same legal process that (say) one of her subordinates would have caught doing this, there will be no public faith in Federal law enforcement.

And on the GOPe side, they'll also arrange a convention where they reluctantly aren't able to say a candidate won the race so they will have to name a candidate. (and we know who that is don't we?)

the underlying problem is that once the rule of law is no longer adhered to, what is left? actual force

if Clinton does not go to jail, the rule of law is publicly shredded.

in times of disorder, restoring order requires acting first. clinton, lynch, and anyone else in the obama admin that violates law, hint hint, can sit in jail cells until things get sorted out.

Stipulating that I agree 100% with you, that ultimately the POTUS is going to make the call on whether or not Clinton gets prosecuted, in theory the AG has the ability to make the decision.

And I also think the "fix" is in here. There is almost no way HRC and Obama haven't already struck some arrangement here. Doesn't mean that Obama can't "schlong" her later, but I think they're just going to try and drag his out as long as possible.

"I never sent or received material marked classified"

carefully vetted for legal reasons

but did she instruct others to send and receive such material on her behalf?

absolutely yes

prosecute and prison
=========
Actually, that's carefully vetted for public consumption. The law is clear that whether or not it is marked "classified" is irrelevant.

What she is trying to do is set the stage for her public defense of "_I_ never did anything wrong."

She's relying on the LIV's to assume the law only applies if it is _marked_ classified.

Her defense is to go like this:
1) Nothing I sent or received was marked "classified."
2) Even if it was classified, I had no way of knowing it was, since #1
3) If it was classified, someone else stripped the heading.
4) I never ordered anyone to strip the heading
5) The system is old and confusing, not up with my modern Blackberry
6) Whoever stripped the headings, only did so to pass on non-classified material
7) Too many times, overworked staffers in the NSA fail to properly redact or remove classified material.

And on and on and on: It's the old Clinton play from the 90's. Deflect, Deny, Evade, Act Stupid.

210 Hillary has nowhere to go but down. She may lose Iowa. She's certain to lose NH, badly. She's wed to Obama, so that anything bad on his watch becomes her problem too. She can't press flesh, but no one goes to her events anyway. She can only work with co-opted media and even then it can go badly. 13 Hours is a hit movie. Revelations continue to dribble out.

This latest revelation highlights that the test for a violation of mishandling confidential information has a low threshold.

The test for the federal statute for not taking anything of value from a foreign entity makes it a misdemeanor if done without intent, a felony if done with intent.

You could write an FBI criminal referral with facts already in the public domain, without the support the FBI may find on Hillary's server which the FBI has had for several months.

Otherwise, Hillary is inevitable as always .....

247 It doesn't matter if the documents were marked classified. If she was "grossly negligent" in taking a document (a term that includes emails) relating to the national security outside of its "proper place of custody" (i.e. on her homebrew server), it's a crime under 18 U.S.C. 793(f)(1) (google it) punishable up to 10 years in prison. "Relating to the national security" has been defined in some court decisions, but it's not a requirement that the document be marked classified. It's a case-by-case analysis that depends on the content of the document. Her defense in the media about the documents not being marked in a certain way is not a legal one.

I'm glad; I think-as hard as it might be-it's the responsibility of teachers to maintain the boundaries and when you're dealing with "star stuck" women who may never had had a relationship t is even harder and more crucial. Had my English professor come onto me who knows what I would have done ( don't know that I would have had the sense to feel he should have acted better) but he was married and either ethical or had no interest in me. I'm sure he was smart enough to figure out I liked him a lot.

Secret Service agents are law enforcement personnel just like the FBI.
If an FBI agent shows up with a valid arrest warrant, they will put
Hillary in the FBI vehicle and generally act in a respectful,
professional way. Then, when she's gone, get drunk and party for 24
hours.

And I think as responsible God fearing, law abiding citizens that we are should start a GoFundMe account to pay for their drunken party. They deserve it after all they have had to put up with.

Not sure how many will buy 1911's at $1,000 a pop, I know I won't get one even though I was ready to give them some cash for one, but a grand is too much for me.

As far as the rest of their programs they still do tons of stuff. Camp Perry matches and they still sell ammo. The run those new armorer classes where you get to build a Garand and go home with it. Not so much surplus stuff as it is all pretty much gone, but they do buy in bulk on commercial ammo and sell that.

In ancient Rome, when a man died, his cloak, or 'pallium,' was spread over his body or coffin as it was carried from the home to the cemetery. A group of men would bear the body on their shoulders.

By the time of the Middle Ages in Europe, the 'pallium' had become a 'pall' that was rectangular and was used to cover the coffin especially as it lay in a Christian church.

Everything prior that he provably had fingers in was just grubby politics, nothing FDR wouldn't have recognized. Mitchell was guilty, as were some others, but my recollection is that it didn't tie directly back to Nixon.

Well, there is someone carrying the casket to the gravesite, but doing it isn't considered a position of honor, nor part of the traditional ceremony.

Two things Jews also don't do at funerals are:

-Display embalmed cadavers at a wake. Displaying a dead body is considered uncivilized, to put it mildly. And.

-Have a big party involving drinking. Meal/food afterwards yes. Booze. . .no.

While those local stations and papers may be leftists, they are more likely to get excited about a local opportunity to interview a current or recently retired FBI agent who can pass on to them exclusive details about Mrs.Clinton's many felonies associated with the server. 461 Usually the DOJ and the FBI work together throughout an investigation. FBI investigtes, if they have questions they call the DOJ. Many FBI agents are lawyers but they do not prosecute. They forward the file to the US attny, who looks at it and they might tell the FBI if they think they need more evidence

the US Attny can return the report asking for more evidence; or draft charges; or decline to investigate; or do nothing. Just sit on it, like a pocket veto

if the US attny decides to prefer charges, they draft them and may send them back to the FBI to execute the arrest warrant. The US attny is independant of the FBI and is an employee of the DOJ

Well, I wouldn't call the dead person "a maguffin." That's rather tactless. The whole reason they are there grieving is because they just lost a person they deeply loved. It's not like the death of just any old person will do, they'll react exactly the same.

But I get what CT means, in that the funeral rites help the survivors deal with the loss. Even those of us who believe in an afterlife doubt that the dead are concerned with who turns up at their funeral.

(Well, except that I will be. I'll be pissed if you're not all there - take a few days off damnit and get your asses over here. I also expect nice flowers and music and my family better not pop for the el cheapo coffin.)

If Democrats don't have to obey the law, then this country's contract with us is off.

So - is it now everybody just do what you want?

570 Godly people generally don't grieve (or wail) at funerals.
Posted by: Soona at January 21, 2016 03:45 PM (Fmupd)

I was in pieces at my mother's funeral. Cried all the way though it.

I went to a funeral of a 5 year old once. The parents (religious people) sobbed throughout the service. They believed their son was in heaven, but they still wept.

I think it's a cultural thing and a question of family style as well. Not everyone is stoic. It also depends on the age of the deceased and how they died. A 95 year old who went after suffering from ill health -that's a bit different than going to the funeral of a child who died of a rare disease or a 20 year who died in a car accident.

Many times it was the only photograph that was ever taken of the person. My grandmother had a small album of all her dead family and relatives as corpses. It was strange.

573 >>If there's a criminal referral -- and it's likely there will be --

Fox.
I don't see how Hillary can survive that, because she's already weak as a candidate and getting weaker.

Its amazing to me that she's even still a candidate. . .though who the hell knows. She was supposed to be "inevitable" last time too.

>>Comey doesn't have to resign in protest. Obama/Jarrett/Lynch don't
have to lift a finger and won't want to. If Hillary threatens Obama, he
drops an anvil on her head ... and Bill's ... and Chelsea's ... and
Charlotte's. And Huma's and Cheryl's and Sid's.

Yeah, I'm starting to think that this is how the White House *wants* things to go. They don't prosecute, then they let the FBI do the dirty work by ruining what little remains of Clinton's reputation, and forcing her to drop out of the race. Clinton retires out of public life, and the Obama administration has no fingerprints on it.

575 >>I think it's a cultural thing and a question of family style as well.

Yes, I think that's a huge part of it. There is a cultural expectation of what is supposed to go on at funerals. Some cultures have "stiff upper lip" and no public signs of grieving, and some do the full wailing and gnashing of teeth and ripping of clothes thing, and there is plenty of room for everything in between.

But if you don't do the thing within the culturally appropriate spectrum that the family and mourners expect, that could be problematic.

Okay.
She will win.
There is no scandal unless the MSM makes it a scandal.
And they won't do that.
Oh, they'll have a story or two and then it will be old news.

You think the FSA cares about this?
You think the Oppressed Minorities care?
You think the SJWs care?

Yes, the soccer moms and hip suburbanites might care a bit. But they'll hold their noses and vote for her.
They sure as hell aren't voting for Trump. That would be ....low class. It's not what the chic Smart Set does.

583 What happened to the story that the investigation had expanded to a public corruption probe? I realize that the email misdeeds are very serious, and are plenty newsworthy all alone, but I think the American people ought to know if a leading contender for president is under investigation for public corruption. The 150 agents is the kicker. Hell of a lot of resources to commit knowing it is for nothing in the end. She won't be alone is my take. Huma, Cheryl Mills, David Kendall too. That's the e-mails. The Foundation case is going to be even bigger.

586 Let say Obama doesn't let Lynch prosecute (March), the FBI festers (April-May), the Hill starts yammering for a special prosecutor (September); Trump wins (November). Now, all of Team Hilary has to beg outgoing Obama for a pardon (January) or they are looking at spending the rest of their lives in jail.

Because AG Levin might not be the guy they want to plea bargain with.

It's actually in Team Clinton's best interest that the prosecutions happen under Lynch; she can plead them out to wrist slaps.

587 Having been a State Department employee from 1999 through 2009 with a TS/SCI clearance, I can tell you for a fact that anyone of us who had done what this traitor did would be facing a very long time in the slammer.
And BTW, classified material is marked with the classification top and bottom of each page. The only way to take that off is to literally cut the imprint off the page and then re-copy the page which is a MAJOR violation to say the least.
With email, the classified emails come over a separate system which is only used for (that's right) CLASSFIED MATERIAL.
And at high clearance levels you get re-cleared often enough that you ain't going to be able to use the excuse, "I forgot, I don't know, I don't remember", etc.

590 I think they will keep pushing Hillary until she locks up delegates and then she'll have to withdraw due to criminal charges and Biden (who gets to skate in unvetted and no negative ads) will become the nominee and voila........Obama's 3rd term. Judge Napolitano (I think it was him) said there weren't really any rules about replacing a candidate with delegates committed to them...they would have to make it up as they go..... Dems are really good at making up their own rules.

597 Team Hillary's response is more of the same: Vast Right Wing Conspiracy, LOL.
selectively leak materials in order to resurface the same allegations and try to hurt Hillary Clinton's presidential campaign.
I've always said that Hill spilt the beans many years ago when she screamed about the "vast right wing conspiracy" because dems project their selves and their corrupt ways onto their opponents, as a means to deflect scrutiny of what they do.
