Former CIA Official: There Is "Zero Ambiguity," Hillary Clinton Broke the Law and the FBI Has No Other Choice But to Recommend a Criminal Grand Jury

And she "absolutely" endangered lives.

In a powerful interview on Fox News' America's Newsroom, former CIA officer Charles Faddis delivered succinct, devastating responses to anchor Bill Hemmer's questions about the latest revelations pertaining to Hillary Clinton's email scandal. The segment was conducted in a grave tone, with network judicial analyst Andrew Napolitano concluding that it's "hard to believe that the FBI will not recommend indictment for Mrs. Clinton."

Why? Regarding the mishandling of classified material (the ongoing FBI probe has expanded into other areas as well), the law, the burden of proof, and the facts already made public all cut against her: Clinton's apparent crime is “the negligent treatment, the failure to protect national security secrets. The government does not have to show that she intended to treat them negligently. The government does not have to show harm. It only has to show negligent treatment. The evidence is overwhelming,” he said.

An important thing here is that there is simply no question that Hillary or one of her trusted aides deliberately and knowingly took this information off the secured system and put it into the unsecured private email -- something which is specifically forbidden by the law. There is no other explanation for its presence there.

Its mere presence on her unsecured private server is proof of a crime.

Team Hillary's response is more of the same: Vast Right Wing Conspiracy, LOL.

Clinton's campaign responded by attacking the Intelligence Community directly.

"This is the same interagency dispute that has been playing out for months, and it does not change the fact that these emails were not classified at the time they were sent or received," campaign spokesman Brian Fallon said in a statement to ABC News.

"It is alarming that the intelligence community IG, working with Republicans in Congress, continues to selectively leak materials in order to resurface the same allegations and try to hurt Hillary Clinton's presidential campaign. The Justice Department's inquiry should be allowed to proceed without any further interference."

The head of the Senate Intelligence Committee, Richard Burr (R-NC), denied the claim from Fallon. "I didn't conspire with anybody," he told ABC News.

Interestingly, the emails on Hillary's servers are so secret that the lawmakers investigating this situation do not have the clearance to read them.

Some of Hillary Clinton's emails on her private server contained information so secret that senior lawmakers who oversee the State Department cannot read them without fulfilling additional security requirements, Fox News has learned.

The emails in question, as Fox News first reported earlier this week, contained intelligence classified at a level beyond "top secret." Because of this designation, not all the lawmakers on key committees reviewing the case have high enough clearances.

The Clintons have gotten away with so much law-breaking for so long they thought themselves untouchable.

But this time, this time -- Hillary just might have schlonged herself.

And that sounds just about right.

As a former top-level security clearance holder he says it is plainly explained to you that "accidents" or intent have nothing to do with national security law. No. That statement isn't a legal defense at all. Its a POLITICAL one. She's trying to have the public think that this mishandling of classified material was accidental, and/or unimportant.

Parsing the statement does NOT look good for her.

*SHE* didn't send the material. . .her subordinates did, acting under her direction. Doesn't matter. . .it was still her responsibility to ensure it was handled correctly. It wasn't MARKED "classified" because she illegally stripped the classification markings off. And whether or not it was wasn't MARKED classified doesn't change anything. Its still illegal to mishandle this information, as as mentioned above, the very fact that it was found on her non-secure server means it was mishandled.

No FBI agent is going to take it on their own to arrest the Attorney General. Are you insane? In fairness, like any prosecutor, the AG does enjoy some latitude to decide what type of prosecution to pursue.

In this particular case, there is a significant systematic reason TO prosecute. As Hilary put it herself, no individual should be "too big to jail", and if she herself doesn't face the same legal process that (say) one of her subordinates would have caught doing this, there will be no public faith in Federal law enforcement.

Actually, that's carefully vetted for public consumption. The law is clear that whether or not it is marked "classified" is irrelevant.

What she is trying to do is set the stage for her public defense of "_I_ never did anything wrong."

She's relying on the LIV's to assume the law only applies if it is _marked_ classified.

Her defense is to go like this:
1) Nothing I sent or received was marked "classified."
2) Even if it was classified, I had no way of knowing it was, since #1
3) If it was classified, someone else stripped the heading.
4) I never ordered anyone to strip the heading
5) The system is old and confusing, not up with my modern Blackberry
6) Whoever stripped the headings, only did so to pass on non-classified material
7) Too many times, overworked staffers in the NSA fail to properly redact or remove classified material.

The way to do it would be to have a lower level FBI guy casually mention to a lower level DoJ guy that the agency is concerned about the lack of accountability for security lapses, because (ahem) "lack of accountability can inevitably lead to further security lapses." The detail unloaded the casket from the hearse, got about halfway to the grave site, and suddenly the casket got significantly lighter...the bottom had fallen out of it, along with the body. Shortly thereafter, the family got very hefty settlement from the airline that had shipped the deceased home to be buried.

It's kind of easy these days because most of the time the casket is now on a wheeled cart - not a lot of bearing it on your shoulder anymore...- and there will be at least 5 other guys there so you can follow their lead. Also, the funeral parlor usually has a bunch of guys ready to jump in and help carry. They'll tell you all you need to know.

That's the standard procedure for a Catholic funeral. The casket is carried from the hearse and down the central aisle and laid in front of the alter. Anytime the casket has to be moved, the pallbearers do it. It's really beautiful actually.

I've done the carry-thing, it wasn't Catholic but we were responsible for getting the encased deceased from the front of the church to the hearse without benefit of wheels.

While your first prayers should be with the family, your next prayer needs to be that they didn't order the heavy, expensive casket.

535 NGU - other suggestions. Try to be in the middle position, if possible. You'll probably need to support about 50# of weight. If you're on the end and have to reposition your hands from fatigue it would be obvious.

I've had to carry nearly every member of my wifes (Catholic) family to the grave. It's actually a sign of respect to be chosen. You're probably in pretty decent shape.

Well, I wouldn't call the dead person "a maguffin." That's rather tactless. The whole reason they are there grieving is because they just lost a person they deeply loved. It's not like the death of just any old person will do, they'll react exactly the same.

But I get what CT means, in that the funeral rites help the survivors deal with the loss. Even those of us who believe in an afterlife doubt that the dead are concerned with who turns up at their funeral.

(Well, except that I will be. I'll be pissed if you're not all there - take a few days off damnit and get your asses over here. I also expect nice flowers and music and my family better not pop for the el cheapo coffin.)

I was looking for it to make a little piece about the difference between the West and the muslim world in which I was contrasting Reagan's funeral with the Ayatollah's mob scene. I searched and searched and searched for that footage of the ayatollah thrown off by the mob (which was some of the funniest stuff ever) but could not find it. It has been taken down from everyplace.

Arafat's funeral procession in Ramallah came pretty damn close. It was almost a classic as they tried to get his grungy corpse onto that helicopter.

Funerals are for the living. Yes, the "theme", if you like, is the dead person, and their family, and their accomplishments, etc, but its really an opportunity for those still left to share something in common (which is their connection to the dead person).

I was in pieces at my mother's funeral. Cried all the way though it.

I went to a funeral of a 5 year old once. The parents (religious people) sobbed throughout the service. They believed their son was in heaven, but they still wept.

I think it's a cultural thing and a question of family style as well. Not everyone is stoic. It also depends on the age of the deceased and how they died. A 95 year old who went after suffering from ill health -that's a bit different than going to the funeral of a child who died of a rare disease or a 20 year who died in a car accident.

Yeah, I'm starting to think that this is how the White House *wants* things to go. They don't prosecute, then they let the FBI do the dirty work by ruining what little remains of Clinton's reputation, and forcing her to drop out of the race. Clinton retires out of public life, and the Obama administration has no fingerprints on it.

Yes, I think that's a huge part of it. There is a cultural expectation of what is supposed to go on at funerals. Some cultures have "stiff upper lip" and no public signs of grieving, and some do the full wailing and gnashing of teeth and ripping of clothes thing, and there is plenty of room for everything in between.

But if you don't do the thing within the culturally appropriate spectrum that the family and mourners expect, that could be problematic.

587 Having been a State Department employee from 1999 through 2009 with a TS/SCI clearance, I can tell you for a fact that anyone of us who had done what this traitor did would be facing a very long time in the slammer.
And BTW, classified material is marked with the classification top and bottom of each page. The only way to take that off is to literally cut the imprint off the page and then re-copy the page which is a MAJOR violation to say the least.
With email, the classified emails come over a separate system which is only used for (that's right) CLASSFIED MATERIAL.
And at high clearance levels you get re-cleared often enough that you ain't going to be able to use the excuse, "I forgot, I don't know, I don't remember", etc.

590 I think they will keep pushing Hillary until she locks up delegates and then she'll have to withdraw due to criminal charges and Biden (who gets to skate in unvetted and no negative ads) will become the nominee and voila........Obama's 3rd term. Judge Napolitano (I think it was him) said there weren't really any rules about replacing a candidate with delegates committed to them...they would have to make it up as they go..... Dems are really good at making up their own rules.
