Sefton: sefton at cutjibnewsletter.com | Email: Hillary Personally Ordered Aide to Strip Classified Markings Out of Classified Document and Send It "Nonsecure"![]() ![]() ![]() All but one of the 66 messages have been labeled "confidential", the lowest level of classification. The remaining email has been labeled as "secret." The total number of classified emails found on Clinton's personal server has risen to 1,340 with the latest release. Seven of those emails have been labeled "secret." In all, the State Department released 1,262 messages in the early hours of Friday, making up almost 2,900 pages of emails. Unlike in previous releases, none of the messages were searchable in the department's online reading room by subject, sender or recipient.I don't know what significance that has. But.... [O]ne email thread from June 2011 appears to include Clinton telling her top adviser Jake Sullivan to send secure information through insecure means. In response to Clinton's request for a set of since-redacted talking points, Sullivan writes, "They say they've had issues sending secure fax. They're working on it." Clinton responds "If they can't, turn into nonpaper [with] no identifying heading and send nonsecure."They had trouble sending classified information via a secure fax. So, Clinton told him, just strip out the classified warnings in the header, turn it into "nonpaper" (that is, scan it so it can be sent in email), and send it "nonsecure." This sentence is Hillary Clinton explicitly ordering an underling to violate the most basic laws of confidential information, namely, that classified information cannot be sent except on classified channels. Of course, Hillary's private email server was not a classified channel, but she still wanted the convenience of email, so it appears she routinely ordered people to take classified documents -- physical documents, which were specifically not electronic in order to prevent wide nonsecure transmission via email -- and make them "nonpaper" and send them "nonsecure." This does not appear to be some innovation she's suggesting here -- the flatness of the order, with an air of "do what we usually do," strongly suggests this was the normal course of business in the House of Clinton. But we don't have to go that far: What we now have in our hands is smoking-gun proof of a felony, and not a felony about sex, but instead a felony about the national security of the United States. Remember that Hillary has always offered the lawyerly limitation that she sent no information "marked classified through her email. Well, here we have her ordering Jake Sullivan to strip out those markings. If the FBI does not indict Clinton, two things follow: 1. There is no longer any law against the selling or transmission of classified information. 2. There is no longer any rule of law in the United States of America, and, the United States being conceived as a place of laws not men, there is then no longer any United States of America, either. There is simply a rogue gang that has all of the heavy guns, cowing the rest of the populace into compliance. More at Hot Air, including screenshots of the email chain in question. Correction: A commenter points out the FBI doesn't indict people; the DOJ does. The FBI can merely present findings. Well, in that case, I demand the FBI at least scream bloody murder when Loretta Lynch does what we all know Loretta Lynch is going to do. Their institutional honor, and institutional credibility, depends on at least that. "Non-Paper:" Rhomboid writes: ace, though the context here clearly indicates it is *not* the use of the term intended, "non-paper" is a guvamint/State term for a version of a memo or proposal, intended to have some sort of informal or deniable status. That is, it's a formal sort of trial balloon. But as I said, in this context it clearly seems to be a reference to actual physical paper, fax, vs. electronic version.Next Step? I wonder if Hillary will next claim that she wasn't the person with primary control of her email, and that this must have been done from some underling (who she won't name). Question: how many of her true-believer voters will abstain from voting for her over this? How many will stop campaigning for her?
The problem is not merely that Hillary was a lawless official. It is also a problem that there are so many people in this country for whom this does not matter. How many people are there out there who will still cast their vote for her if, next November, she were to be behind bars and wearing an orange pantsuit? ace, your #2 is absolutely correct, yet as you probably agree, it's already been the case for some time. At the top level of govt., it's been true since at least the felony not-about-sex but about perjury (in a sexual harrassment case, which I thought was sacred and central and not just salacious stuff about "sex") of the haggard queen's husband. You have to parse what the Clintons say. When Hillary said that "nothing she got on her unsecured e-mail server was marked classified" that was literally true. But those of us with half a brain said at the time "how could you be Secretary of State and never have gotten an e-mail that was supposed to be classified?"
The answer is that someone had to copy and paste classified e-mails off the secure government system to forward them to Hillary's unsecured home brew server. When they did they didn't include the labels. So this wasn't some oversight but an actual conspiracy to workaround government security. Until now the smart money was on the bet that Hillary was insulated and someone in Hillary's circle would take the fall but probably not Huma, and certainly not Cheryl. My money was on the guy who pled the Fifth before the Gowdy Commission. Now Hillary is implicated. I don't see how Comey can ignore this. If I've got it right, these e-mails are being made public by the efforts of Judicial Watch. Comey may have a lot more because he has Hillary's entire server. rickb223 raises an interesting point - but I don't think Hillary would have had classification/de-classification authority such that she could do this legally. But I am not sure. It all depends on who had classified the info originally. Usually such stuff is intel-based and therefore State would not have declassification authority, but it's impossible to say without knowing the specifics. Bear in mind, however, that there *is* a slight technical possibility that this angle may enter into the legality of some of the shenanigans involving classified info being improperly transmitted via email. Unless Hillary! had her own personal declassification group that included herself, Huma, Sullivan, and a couple other boot-lickers. I have a theory I've been working on for awhile. I think Obama *wants* a Republican to win. Here it goes:
1) Obama has said that after he is no longer president he wants to go back to 'community organizing.' 2) Obama does not like Hillary and only offered her the job of Sec'y of State so that she would shut up about things like the birther stuff and his hijacking of the primary process. He needed their support to run for president after she lost. Hillary Bill weren't going to give it unless they got something in return. 3) Obama likely told Biden to stand down on a run for president to leave Clinton as the best option Democrats had. 4) He will indict her for her crimes and hope to take her out of the running. He can claim he has no control over the 'law' and as much as he hates to see Hillary go through this, he cannot get involved. She made her own bed. 5) When a Republican wins the presidency, Obama will have an 'enemy' to go after in his post-presidency career. This will allow him to stay in the public eye, give him a way to amass $$, and affect policy changes or continue the growth of such groups as Black Lives Matter in order to create instability in the U.S. We'll see if my theory comes true. Just remember, Obama does not like the Clintons. He would likely do anything he could to take them out...he just needs to make it appear like he cannot do anything about it, or the Clintons will take him out. Just holy shit!
I've handled classified myself. Confidential is REALLY low-level stuff. Show up at work on your first day with your birth certiicate, and they give you a Confidential clearance on the spot. I think of Secret as "regular" classified stuff. Depending on how hamstrung the govt bureaucracy is, it can take months for your secret clearance to come through. Kind of serious, but not End of the World stuff. For "Special Access" (sometime called "Compartmentalized"), I hear it's almost like a Top Secret. I knew a guy who forgot to put one of those documents down before he left the area to go to the men's room, realized it, freaked, and scurried back to the secure area. A round trip of maybe 50 yards, but I think he got sent home for about a week without pay. On that same program there was a management guy like Clinton who considered himself above the rules (and we weren't about to cross him). Mostly, he would pressure others to bend or break the rules, but generally had deniability. Certainly he never left a paper trail that proved he broke any rules. This is really brazen. I know they let the Clintons get away with everything, but how do they justify letting her skate on something THIS brazen? Posted by: Optimizer at January 08, 2016 12:35 PM (/q6+P) 230

@164 Rhomboid re: Pay-for play Clinton Cash
If charges are only on e-mails, Hillary will say it's hyper technical, asked and answered a million times already, and my servants screwed up. The bigger the target, the bigger the bullet you need. Pay-for-play is corruption, selling your office for personal gain. Nearly everyone understands that it's really bad. Many Democrats will stay home in November 2016 if well documents charges get in the public domain, either by indictment or by leak or by a Comey resignation. As does rhomboid's point, where I think I see Hillary's escape: ace, though the context here clearly indicates it is *not* the use of the term intended, "non-paper" is a guvamint/State term for a draft version of a memo or proposal, intended to have some sort of informal or deniable status. That is, it's a formal sort of trial balloon. But as I said, in this context it clearly seems to be a reference to actual physical paper, fax, vs. electronic version. This is SOOOOO interesting. This election now takes on issues of life or death for her.
If she stays in the race, takes the nomination, and loses in the general, then she's dependent either on a Gerald Ford preemptive pardon from Obama or a remarkably lax GOP AG to keep her from spending the rest of her natural life in prison. And I have to think that even some of our kneepad-bearing Democrat media whores might choke on the idea of a candidate whose only way to avoid a felony rap is to win the Presidency. Any reasonable sort of risk-management strategy would say she has to negotiate a deal with Lynch and Obama to ensure this all goes away, permanently, before Obama leaves office. But how do you do that and stay in the race? All you need is one text message from one disposable phone from one Bernie fan in DOJ to a reporter and her candidacy's plunging toward the karst.
--- I've had such thoughts as well, not so much that buy design he wants an R to win, but that he's perfectly ok with that outcome for exactly item #5 you mention, something to do immediately following his presidency and assures lots of money will flow to whatever organization he sets up, and you know he'll set one up. Never forget that Clinton's guy Livingston got her those 900 FBI files, which was also a clear and egregious breach of a number of laws, policies, and procedures. They were raw files, which meant they were chock full of dirt that had not been vetted. Given how incestuous the Beltway truly is, files on 900 people could conceivably contain damning information on thousands of people or their closest associates. Given that Biden was a powerful Senator and not a Clinton ally, they probably have his file and multiple files with him in them on a tangential basis. The Clintons play the Long Game. It has long been speculated that those same files united the Dems in their refusal to remove BJ from office. Posted by: Qoheleth at January 08, 2016 12:04 PM (iIzG7) Stop thinking about this on the merits, folks. The reality is that she would be tried either in DC or in New York. The likelihood of finding twelve random Washingtonians or New Yorkers who would vote unanimously to convict Hillary of anything is zero. She could eat a baby on live television and the jury would still be hung. She could hold up a 7-11 and wave at the camera and the jury would be hung. She is not convictable, especially if David Boies can throw up some kind of technicality defense that at least sounds plausible. She knows she is not convictable, and the US Attorneys' offices involved know it, too. It sucks, but welcome to the Mafia world we live in. OneEyedJack's comment gets at the appalling reality/apparent reality of it all - whether in fact the electorate cares any longer about central things like rule of law and corruption. It's hard to figure out, as you are always up against the "do they even know/understand about this?" vs. "they know and don't care". Unscientific personal sampling indicates a lot of "don't know" thanks to normal people depending on normal channels of info (MSM, NPR). This applies to hugely important topics that might shock you (or not, with this crowd). I do know that with several friends it's been axiomatic for years to point out that even a fraction of the scandals/failures/disasters associated with Clinton orher former boss (prez) would have, just a few years ago, simply been the end of the line for a major public figure. Hell, a few of Bill Clinton's nominees for 2nd-tier cabinet positions, in his first term ("honeymoon"), had to withdraw their nominations due to such calamitous scandals as having nannies who weren't in the social security system. Try - just try - to imagine a country where unwritten rules of public integrity were at that level. Seems like ancient history. Posted by: rhomboid at January 08, 2016 12:56 PM (QDnY+) 383

Known unknowns. (I actually wrote this earlier this week)
Obama and the Clintons cut some kind of deal when Biden dropped out. What were the terms? Does Obama get to pick Hillary's VP? Will Obama actively hump the vote for Hillary in the fall of 2016? Or was it a Hitler/Stalin non-aggression pact that can break down at any time? Are Obama and Jarrett willing to cede control of the Democratic party to the Clintons? FBI has Hilllary's server. What's recoverable? E-mail scandal can expand if, as many suspect, people like Huma were taking classified documents, stripping off the labels, and then forwarding them to Hillary. Apparently something like this had to happen as a matter of e-mail mechanics, so someone had to do it. Will Comey go there? Pay-for-play Clinton Cash is the bigger scandal. Unlike the Gowdy Commission, Comey can get into this. Will he? Do recoverable e-mails help here? I bet they do: "huma, make sure I see Mr Big when I'm in Brunei. Baby needs shoes." If the non-aggression pact breaks down, it doesn't matter how independent Comey is, because Obama is actually driving it. Obama may use MSM to create a show so that he's not seen as driving Hillary's downfall. If the non-aggression pact holds, Comey may still go rogue. If Lynch doesn't act, will Comey leak that the FBI made a criminal referral? Will anyone else in the FBI leak? I've long believed that Obama wan'ts a third term and that Hillary isn't his best way of getting around the 22nd Amendment. If Hillary gets indicted or there's a leak of a criminal referral it'll be an open convention. Posted by: Ignoramus at January 08, 2016 01:01 PM (r1fLd) 414
Next Step? I wonder if Hillary will next claim that she wasn't the person with primary control of her email, and that this must have been done from some underling (who she won't name).

A North Dakota man was arrested after Washington, D.C., police investigated him on a tip that he traveled to the nation's capital to abduct Bo, one of the Obamas' two dogs, authorities said.
Scott Stockert was set to appear in D.C. Superior Court on Friday on firearms charges for Wednesday's incident at a Hampton Inn near the Washington Convention Center. An officer responding to a tip from the Secret Service tracked down Stockert at the downtown D.C. hotel. He admitted that he had a shotgun and a rifle in his pickup truck, both unloaded, along with ammunition for the weapons, according to a police report. It's illegal to possess unregistered firearms in D.C. The report said police also found a machete and a billy club. When he was arrested, the police report said, Stockert claimed that his parents were John F. Kennedy and Marilyn Monroe and that he came to the capital to announce his campaign for president and advocate for a $99 per month healthcare plan. As he was being taken into custody, the apparently mentally disturbed Stockert also told authorities that he was Jesus Christ, court documents said, according to NBC Washington. Tobasco, I think that esp. in terms of this post's focus, it certainly would have been appropriate - no, vital - that Clinton be removed from office for perjury. His failure to be convicted on impeachment charges - and thus removed from office - is pretty much the definition of the rule of law being specifically *not* applied to the most powerful. Can't see any other way to frame it. If he were just any lawyer out there, then disbarment and loss of license might be the right consequence. As president? There were literally no consequences, for a slam-dunk undeniable federal felony. Impossible to convincingly portray this as anything but a de facto exception to the law for high office holders. It appears that more than two dozen bottles of rare bourbon, stolen from a central Kentucky distillery, will be destroyed. Investigators say the bottles of Pappy Van Winkle were stolen Buffalo Trace Distillery in Frankfort as part of a theft ring in 2013. Police later recovered the bourbon. Franklin County Sheriff Pat Melton said he had hoped the bourbon would be auctioned off for charity. However, he told WKYT that the Van Winkle family is worried that the bourbon could have been tampered with or contaminated. The sheriff says the family wants the 28 bottles to be destroyed as a precaution. Posted by: RWC - Team BOHICA -@DMS1974 at January 08, 2016 01:09 PM (fWAjv) 452

Actually, no he didn't. It was a conditional amnesty. Those that wished to have their actions dismissed had to appear in the US and file papers and agree to do community service. Length to be determined. He also included those discharged from the service for being absent from their unit or having fled to Canada to be given General (for the good of the service) discharges. They too had to file paperwork to qualify and agree to do community service. At least that's what I remember from what the press said at the time. There were not that many takers due to the legal ramifications and that most of those that it applied to saw no reason to take part as their status at the time was not hurting them. Except for those in Canada with pending Military charges who wished to re enter the US. Posted by: Bitter Clinger 1.0 and All That at January 08, 2016 01:15 PM (Xo1Rt) 497

he conviction on Impeachment had to come from the Senate, a political body clearly not interested in the rule of law at that time.
They postured for the cameras for months claiming one thing, then another, as each revelation became public. I remember that KlanBastard from WV saying that if perjury were proven, that would change things and of course, the rule of law would be upheld. When it mattered, ROL lost to "but he's our devil". The Attorney General is supposed to be independent, even though he works for the President...
Because otherwise the very concept of prosecutorial discretion is moot.. ------------- Supposed to be by whom? The Constitution is clear on this. The executive is vested in the President. Him alone. We can pretend that we want them to be independent, but that is not permissible under our Constutitional structure. There is prosecutional discretion, but ultimately the discretion resides with the President. Now he may delegate that discretion to them on small matters, drug cases against individual, smaller parties. He may also stay out of it to avoid showing an partiality - but that is a political maneuvar. The President has the power to quash any prosecution.
Posted by: rhomboi _____________ Well my point was not about Bill Clinton's impeachment, it was whether he received appropriate punishment for lying in a sexual harassment lawsuit. In my opinion he did in that instance. Regarding impeachment, I remember at the time thinking the same way you did, but over time, it was just a stupid path politically. We have never removed a President from office in our nation's history, and doing it over not being truthful regarding a blowjob in a sexual harassment lawsuit does not rise to "high crimes and misdemeanors" in my book but I can see how some would disagree Posted by: Tobasco at January 08, 2016 01:32 PM (MWLby) Posted by: SH at January 08, 2016 01:32 PM (gmeXX) 578

#ArrestHillary
Hillary has committed a felony. Citizen's arrests can be executed under felonies. "Felonies A person can arrest someone that they reasonably suspect of committing a felony, even if the felony didnt occur in the presence of the individual making the arrest. As long as a felony was actually committed and the individual making the arrest knew of the crime, a reasonable suspicion about the identity of the perpetrator will justify their arrest. The felony must have actually occurred before an individual can make a citizens arrest. Even if a person reasonably believes that a felony has occurred, if the crime did not in fact happen, the person making the arrest could become civilly and criminally liable. - See more at: http://tinyurl.com/lnrcx7a" Posted by: Aye Mi Trumpi! at January 08, 2016 01:38 PM (iMzPV) 603

"It was dumb politically, because it was done by political dummies. Gope has been stepping on their own philandering d*cks since long before Obama entered the scene."
Too true. If the GOPe had been smart, they would have told the Democrats to deal with it. The Democrats would have had either to censure their own guy, or whitewash him. In either case, they would be stuck with the issue. Instead, the GOPe turned the election issue from Bill Clinton's perjury, to their reaction to it. The GOPe could screw up a wet dream. 2. There is no longer any rule of law in the United States of America,
and, the United States being conceived as a place of laws not men, there is then no longer any United States of America, either. That is not exactly true. There is still law, it is just that it is applied only against those who oppose the ruling class, aka Democrats; e.g. Dinesh D'Sousa; IRS vendetta against the Tea Party etc. This is the classic definition of Tyranny. The FBI has Hillary's server. Recovered e-mails can easily connect the dots for a pay-for-play Clinton Cash indictment. There's already enough in the public domain to sketch out an indictment. There are over 1,000 donors who's identities have yet to be revealed which were run through a Canadian affiliate of the Mother Ship Foundation.

A 21st-century version of "it depends on what your definition of the word is is"...classic Clintonian parsing. Which staffer / henchwoman will take the fall for sending this, because - as the Hillary camp said - Hillary Clinton never ordered anyone to blah blah blah. Someone else did. That will be the semantic dodge that the media will accept breathlessly, breathly.

Wait a minute!!!
I came back and read this again, and it sounds like we're getting ourselves overworked over something that is may be NOTHING. Which totally sucks. The thing is, I would think that talking points are generally NOT classified. I could EASILY see that State might be in the habit of using secure means of transmission whether stuff is classified or not, just to avoid prying eyes. So she could EASILY just be saying "Look, it's not classified, so just scan the damn thing and send it in a way that won't attract attention." "No identifying heading" can also mean no fancy State Department letterhead, can't it? When I used to handle classified, I don't think we referred to the classification markings as an "identifying heading". Anyway, my point is that unless we know that she's actually talking about classified material here, and classification markings, the "smoking gun" here is a BB gun, right?
