Obama's action is clearly extra-legal, as it usurps the role of the courts and possibly the ATF. Statutory interpretation is no place for executive orders. This is actually a big deal from a legal standpoint.
"Engaged in the business" is defined at length by the statute. There's a bit of gray, but that often happens with statutory definitions. So if you're not a full-time gun seller because you have another day job, but you sell a lot of guns each year you might find the ATF coming down on your ass.
Lots of statutes have this kind of gray. Sometimes agencies have the authority to issue regulations to give clarification. Sometimes agencies issue non-binding guidance to give clarification. You can also look at the kinds of enforcement actions the agency has taken.
If you get into a fight over this with the ATF, that's when the courts get involved.
But this is no place for a Presidential executive order.

On Christmas Eve, our son-in-law arrogantly lectured my husband on how wonderful Obamacare is, that it was a Republican idea, and that Obama wouldn't make the list of the 5 worst presidents.
The most gratifying reaction was that of our son-in-law's registered Democrat uncle, who told his nephew he never voted for Obama and that he would go down as the worst president ever.

I agree 100%. Obama has welcomed the accusations about him being born outside of the U.S. in order to obscure his real problem -- he was born in Hawaii but falsely claimed to be a non-American (i.e., foreign student) in order to obtain financial aid and scholarships. That's why he refuses to release any of his official college records, including transcripts, financial aid/scholarship documents, etc. It definitely doesn't look too good if a President or even just a presidential candidate denied their citizenship on official documents. His grades probably were mediocre, too, but that's less important than breaking the law by lying to obtain money for school. It's just a theory, but I think it's certainly more likely than him being born outside of the U.S.

I was convinced from everything revealed in advance that it would be a standalone, fun little Victorian mystery. But Moffat cannot help himself so he craps all over it and tries to tell five different stories at once, while fanservicing/fantrolling the audience. I award him no points.

I got through to the end of the 2nd ep. Wanted to like it more than I did. It does have an interesting setup and it's got Christian Slater in it. Found the lead actor to be a major distraction. He doesn't work for me. Found the story interesting, though it seemed to constantly veer into in OWS territory, which wasn't so interesting. I was hoping there'd be some surprises beyond the predictable to keep it engaging... but, I sort of wandered away from the show. Was hoping to hear from others that it was worth persisting with, actually.

Aeronaut's Windlass was very fun! IS a brand new series, first book in his new Cinder Spires series. Very worth the time.
Was my first time reading Butcher ever. I see why he has so many fans! Very well written, multifaceted characters and plots. The cat is the best. Unassuming details or plots reveal themselves important later on or tie disparate things together, which a good writer should do. My only complaint is that sometimes you do not get descriptions or certain facts about the world till later on, that really would have been more helpful in setting up the world. but unveiling a new world from scratch is always a challenge. Satisfying ending but set things up nicely for more books.
In short, go forth and read it.

And some point Obamas original was misplaced, all they had was the "digitized" version.

The way it worked back in 1961 was that there was a statewide wire agency under contract to the state government.
The state health department got the lists of births and gave them to the wire agency, who transmitted those to the newspapers, who ripped them off the teleprinter and sent them direct to the presses.
This of course assumes that the state birth lists were on the up and up.
The reality was that in 1961, there were a ton of loopholes, sloppy work, and procedural hinkiness all through the Hawaiian state agencies, including the health department. A system made to be gamed. Not that people like Obama's grandparents with longstanding ties to the old hard left had any experience in gaming systems to their advantage. Heavens no.

I tend to favor the idea that Obama is not the son of Barack Obama Sr., but instead the son of Frank Marshall Davis. There's a lot of evidence suggesting a physical relationship between FMD and Stanley Ann Dunham. While she was underage.
But FMD, while a U.S. citizen, was a known outright card-carrying Communist, and in 1961, there was still huge stigma associated with such things.
Attributing Obama's paternal parentage to a guy from another country who would eventually leave the USA for good would be a way of getting around that little problem.
People talk about how Obama looks older than his years. Consider that he may have been born, at home, two years or so before the ostensible date. Hawaiian law of the era allowed for home births to later file as if born in hospital.
Consider also that if you needed to conceal a child being older than claimed during those early years when it's impossible to hide such things, taking the kid off to an Indonesian madrassah for a while does just that.
Note that Obama has never submitted to a DNA ancestry test.

My friend Gayle, one I asked for prayers in November updated her FB profile now, she had golf ball sized cancerous brain tumor & surgeons could only remove 80% of Stage 4 cancer. Today was supposed to be first day of 42 days straight of both chemo & radiation.
I hope she decides to skip the 42 days of torture & enjoys what's left of her life.

Back in the 80s when I was a hippy dippy liberal, I was against the War on Drugs, 'cause drugs were totally cool, man. But I was all in favor of gun control.
I knew that the War on Drugs made criminals out of otherwise decent, law-abiding citizens.
Then one day it suddenly hit me: What would make a War on Guns any different?
