In UK, Judges Propose Making It Illegal to Utter Any Statement Denying Global Warming

This was proposed at a conference -- they're always clanning up in conferences, aren't they? -- in London on "Climate Change and the Law." The conference was funded by UK's Supreme Court (I didn't know they had one), the UK government, and the UN's Environmental Program.

They wish to make it illegal to question the "science."

The purpose of this strange get-together was outlined in a keynote speech (visible on YouTube) by Philippe Sands, a QC from Cherie Blair's Matrix Chambers and professor of law at University College, London. Since it is now unlikely that the world will agree in Paris to a legally binding treaty to limit the rise in global temperatures to no more than 2 degrees C from pre-industrial levels, his theme was that it is now time for the courts to step in, to enforce this as worldwide law.

Although his audience, Sands said, would agree that the scientific evidence for man-made climate change was "overwhelming", there were still "scientifically qualified, knowledgeable and influential individuals" continuing to deny "the warming of the atmosphere, the melting of the ice and the rising of the seas", and that this is all due to our emissions of CO2. The world’s courts, led by the International Court of Justice, said Sands, could play a vital role "in finally scotching these claims".

"The most important thing the courts could do," he said, was to hold a top-level "finding of fact", to settle these "scientific disputes" once and for all: so that it could then be made illegal for any government, corporation (or presumably individual scientist) ever to question the agreed "science" again. Furthermore, he went on, once "the scientific evidence" thus has the force of binding international law, it could be used to compel all governments to make "the emissions reductions that are needed", including the phasing out of fossil fuels, to halt global warming in its tracks.

The fact that it could be seriously proposed in the highest courtroom in the land that the law should now be used to suppress any further debate on what has become one of the most contentious issues in the history of science (greeted with applause from the distinguished legal audience) speaks volumes about the curious psychological state to which the great global warming scare has reduced so many of the prominent figures who today exercise power and influence over the life of our Western societies.

The video of his speech is here, if you can take it.

I'm old enough to remember when courts of uninformed, politicized judges deciding what was and what was not heresy was a bad thing.

56 Burning is a horrible way to go. And when they put those pouches of gun power around their necks with the hope the flames wd ignite and explode and kill them before the fire did, usually made things worse. The would strangle them sometimes before the fire lit but again, not fool proof in that people were often passed out and not dead.

Then the chopping of the head also a big mistake. You can look at the cartel videos and it takes numerous whacks before the person is dead.

So all this whining the UK does about how our justice system is cruel and unusual punishment is nonsense.

82 Noted climate heretic Judith Curry is fond of Richard Feynman's 1974 Caltech commencement address, "Cargo Cult Science." Feynman discusses the cargo cults: On primitive remote Pacific islands during WWII, they watched engineers build airstrips, then they watched great flying machines land and disgorge materiel beyond their imagining. So after the war, there were (perhaps apocryphally) cults who built runways, built towers, had a guy waving sticks, and waited for the planes to land.

Feynman discussed a common problem in experimental science and commented, "That's not why the planes don't land - but the planes don't land."

This is the fun thing about Settled Science that isn't. You can get as loud as you want in your doomsaying (if people have tuned you out, ramp up the alarmism!), you can try to criminalize criticism of your theories - but the planes still won't land.

106 The State makes laws through the legislatures and the courts, just as this nice fellow suggests.

But enforcement, ahh yes, that's done by police power, by taking away your property and your liberty through fines and imprisonment.

This man proposes to steal innocent citizens property, the food out of their kids mouths, and their life and liberty, all to enforce his totalitarian design. We are leaving the realm of fascism and going right to Stalinism.

Once violence is planned by the State against citizens for political opposition civil war cannot be far behind. I hope some English kept their guns, and let this be a lesson: never, ever, let the government take guns away in this country.

156 Darrell Whitman who worked as a San Francisco-based investigator for the Whistleblower Protection Program - the very Federal agency tasked with offering protection to whistleblowers - when he went public with claims that the agency failed to defend workers who faced retaliation for reporting illegal activity and public safety concerns.

In an interview with NBC Bay Area earlier this year, Whitman said he tried to warn OSHA leaders that his managers pressured investigators to close complaints without proper review to clear a backlog of cases.

Whitman said his supervisor altered his reports by changing his conclusions and dismissed cases even when Whitman found they had merit.

It didn't stop there: Whitman wrote letters to OSHA leadership and to the U.S. Secretary of Labor, Thomas Perez. "I had gone through every conceivable channel and what I saw was inaction," Whitman said.

In the end Whitman told NBC Bay Area that he was fired as retaliation for raising red flags about the agency.

"They got rid of the squeaky wheel," Whitman said. "I was going to report what I thought to be violations of law and policy. They were going to have to answer to those reports and they didn't like that."

The letter announcing his termination said Whitman had been fired for six separate reasons, including "lack of candor during an investigatory meeting" and "unauthorized release of government documents."

Whitman said the "real reason" he was fired is because he took his concerns public.

168 82 Noted climate heretic Judith Curry is fond of Richard Feynman's 1974 Caltech commencement address, "Cargo Cult Science." Feynman discusses the cargo cults: On primitive remote Pacific islands during WWII, they watched engineers build airstrips, then they watched great flying machines land and disgorge materiel beyond their imagining.

Posted by: JPS

135 Feynman discusses the cargo cults:

Hah! Thank you. I hadn't known where that phrase came from.
Posted by: Bandersnatch

The cargo cult observations actually started PRIOR to WWII, in the mid-'30s. They just became more commonplace during WWII because so many more foreigners were showing up.

And they're not apocryphal -- massive evidence for it. Just Google "John Frum" for tons of info.

Cargo cults last at least until the '70s, and may still even persist to this day. It's not a specific religion, but a manner of thinking.

Kelley is not alone among meteorologists in his views. Results of a survey of 571 weathercasters, released on Monday by George Mason University, found 54 percent believed that global warming was happening, with 31 reporting it is mostly caused by human activities and 63 percent saying it is mostly caused by natural changes in the environment. Fifty-eight percent of respondents indicated humans could reduce global warming.

That's right.

54% believe global warming is happening.

58% believe humans can reduce global warming.

So at least 4% of meteorologists believe we can reverse a thing that isn't happening.

The famous Soviet geneticist and president of the Agriculture Academy, Nikolai Vavilov, was arrested in 1940 and died in prison in 1943.[12] Hermann Joseph Muller (and his teachings about genetics) was criticized as a bourgeois, capitalist, imperialist, and promoting fascism so he left the USSR, to return to the USA via Republican Spain. your basic full-tilt Crichton good guys v. bad guys (à la Jurrassic Park). not incredibly WOW!, but i think it's well worth the occasional complete take-downs by the main protagonist of the AGW idiots throughout the story.

but the best part is the description - about 3/4ths through (pp 451 in the hardback copy) that describes the AGW fever as a replacement for the keep-the-sheeple-afraid-and-under-control mechanism to replace the cold war boogey man; i.e. kept in a "State of Fear".

I have a theory that the Aliens are hollow. That they have a layer of exoskeleton, a layer of that godawful acid, and then some musculature and nervous system, and inside its empty which explains their massively rapid growth.

I also think they are bio weapons developed by the big elephant guy race.

We also further declare that any opposition to said ruling, either written or spoken, constitutes Contempt of Court, and anyone guilty of such contempt, will be jailed until we deem otherwise.

405 Ace; that was before the internet. People now can examine the opinions of thousands of other people. Some qualified and some not but even the unqualified pose questions that can't be answered or haven't been answered by the AGW priests.

This is why they must resort to a broad and sweeping rule to shut off the skeptical and the outright naysayers.

I would agree with this law IF all climate scientists were required to submit their data, methods and any software used to a public venue where anyone could see what they did and how to reach their conclusions and could then attempt to duplicate their work.

This has always been the gold standard of scientific research; present your theories then present your data for others to duplicate. Or Not.

And it's the OR NOT that's got them worried.

I also think there should be full disclosure on how much and AGW researcher gets for his or her work.

At recess, all the Western (and the three Israeli) kids would get pelted with rocks, knocked down, hit, etc, while the "playground moms" who were supposed to be watching and stopping that stuff looked the other way. Because, strangely, school admin wouldn't let us western moms have playground duty. We were allowed to read to the kids, and help with schoolwork, but not that. When one of the little brats almost broke my daughter's leg, we had a chat with administration, who breezily said it were her fault, because red head, or something. Yeah, they are real sweethearts. 421 415-why on earth would she ask that? what difference does it make?

Posted by: Moki at October 15, 2015 03:26 PM (x303I)

422 Wrote this a few years ago... NO ONE has ever been able to dispute it with actual evidence.

CO2 and climate change... the PHYSICS do not work.

First, the theory of Greenhouse Gases.

All energy comes to, and leaves the Earth as Radiation.

Radiation comes from the Sun, in a specific spectrum (including light), and is then either Reflected back to space, absorbed by the Atmosphere, or absorbed by the earth's surface.

Energy is also Radiated by all matter (called Black Body Radiation) in specific wavelengths dependent primarily on the Temperature of the mass.

Matter also will absorb radiation, but different molecules absorb different frequencies of radiation energy... known as the absorption spectrum. This energy will raise the energy state of the molecule, which it will then either reradiate (as blackbody radiation), or loose energy through conduction.

The theory behind a greenhouse gas is that the Gas will absorb incoming radiation from the sun, and through conduction, heat the rest of the air around it. It will also absorb IR radiation radiated by the Earth itself (black body radiation again), and use conduction to spread it to the rest of the atmosphere.

So, is CO2 a Greenhouse Gas? YES, it is, but only up to a point.

CO2 ONLY absorbs IR energy in well known, and clearly defined frequencies, which comprise about 8% of the IR Spectrum. This IR can come from the Sun, the Blackbody radiation of the Earth, or the Blackbody Radiation of the atmosphere itself.

The problem is that ALL of the IR radiation in the Earth's biosphere, within those frequency ranges IS ALREADY BEING ABSORBED!

http://www.nov55.com/atmo.html

The above chart is a visual representation of the Energy absorption spectrums of the atmosphere, and the %'s of those spectrums being absorbed. If you look at the CO2 absorption frequencies, you will see that they are already at 100% absorption...

or, to put it simply, there is no more energy to absorb, thus there can be no Temperature increase by adding more CO2!

So, in conclusion, is CO2 a Greenhouse Gas? YES! But its already reached its maximum Greenhouse effect, adding more will not do anything.

Therefore, the Cap and Trade legislation will not do anything except bankrupt us.

427 The problem with modern discussion is that political talk while always uncomfortable and unwelcome in friendly gatherings, has become so toxically unliked and obnoxious that people with a shred of dignity and self awareness avoid it, but the left has neither, so they totally dominate the discussion. 453 The spread between record high and record low in my home town is 130 F. The idea that a 2 C rise when be catastrophic is ludicrous, if even measurable in any meaningful way.

Over long term, if a real rise in temp were realized, that would probably be a net benefit as it would increase the average growing season by a day or two. Almost as if we were still coming out of the last ice age.

Gross oversimplification representing the whole planets temperature as a single number is in itself completely meaningless unless you are an astronomer looking a specs of dirt millions of miles away.

469 Pennsylvania has the highest percentage of Firearms Carry licenses.

In PA there is NO concealed carry license. You get licensed to carry a firearm (LTCF) and you then can carry it anyway you want to. (they do frown on concealed carry in crowded public places as it scares the liberals)

The other thing the LTCF does is you can transport a loaded weapon in your car and can go anywhere you want with it. If you don't have the license, you can only transport an unloaded gun with ammunition physically separated to a gunsmith, range, gunstore or other gun activity location. No side trips.

I think PA turns red next year. I know they elected a Democrat Governor but that's because Corbett was an idiot and the GOPe didn't get rid of him and try to run someone else so of course he lost.

Most of the state is red except for the obvious places but even those are getting a bit reddish lately. Watch the Philly Mayor's election this year. That will be a clue.

The only way to stifle free speech is to punish it.
That necessitates some sort of sanctioned force, authorized to do so, or a mob.

Speech is just the expression of thought, and as Descartes noted "I think, therefore I am", a forcible stifling of speech is a negation of more than just words, but of the validity of one's perceptions, experience, values, and life.

I disagree. Behavior predates language. It is not language that creates behavior. The first proto human understood that he could eat by taking food from the other member of the tribe, killing the other if necessary.

Language allows the organization of behavior, it doesn't create that contradictory interest. Nations, philosophy, religion, sure but that is the organized behavior of competition for something desired. Language facilitates, and justifies, or obscures the base desire.
