Oh joy.

Listen, I do not necessarily want to get on the Trump train. I laughed all the way back when _Spy_ first called him a short-fingered vulgarian.

And I'm instinctively mistrustful of "conservatives" from places like Manhattan. Just as I was (correctly) suspicious of the "conservative" former CA governor from Hollyweird.

But when my second, third, and fourth place options are Colin Powell M.D., the fembot version of the Mittbot 3000, and Crown Prince Jeb?

Lemme think about that for a second.

Someone gave him bad advice.

52 2016 is shaping up to be the last in which the "Republican" brand is used. I still believe Trump is going to flame-out, but the elites are under the illusion that once that happens, we're all going to run to Jeb!!! and that just ain't gonna happen. If he's the nominee, the Democrat candidate wins.

The kicker is that when that happens, the spin from the elites will simply run like this..."Trump so damaged the GOP brand with his anti-Hispanic talk that moderates stayed away...."

They'll never learn.

93 You all do realize that there's some splashover in re name recognition rising due to any attention paid by Trump to them?

That's why Perry was going on and on after him and why Jindal has started doing the same thing.

They're hoping for a buzz to get started by having Trump respond to their BS.

It's worked for some I think. I don't believe Carson or Fiorina would be as high in the polls if they hadn't gotten Trump's attention and him responding or pointing them out.

Like they say, there is no such thing as bad publicity. (scandal is something else)

I think Fiorina will get shot down this evening. Trump may not even say a thing to her. And thus she will start being ignored by the media. Carson too. He's got to step up his game and quit playing some cuddly professorial physician if he actually wants the nomination. I don't think he wants it that much. 151 Ben Carson is a good man and goes a long way in restoring my badly damaged faith in race relation after Obama's - and those of his ilk - race mongering.
That having been said I would not want him as the Republican nominee for 2 reasons:
1) Because of the above stated ilk and the message that it would send them. They would not see this as an MLK philosophy affirming vote on character but rather as another 'victory over The Man'.
2) Lack of experience. I know that that criteria went out the window with the election of Obama, what with his wealth of his 'community organizing' activities but still, the experiences one gets in the OR or even running a small private practice (which I don't know if he did or not) are a far cry from the business/wordly saavy that's needed to run the largest corporate organization in the world - The United States. Again, he's a fine man but so is my next door neighbor and I wouldn't vote for him as President either.

Posted by: LGoPs at September 16, 2015 01:59 PM (FzE3e)

152 I'd vote for any of those three, probably. Trump is a great unknown. He could be a good president, or as bad as Obama. I like his policies, but he's got real issues with his personality. Fiorina would probably win by the largest margin in the general.

And my reply is: yeah and what exactly is wrong with that? Obama won twice by being "Obama". You know who didn't win twice? The "serious" candidates with 500 page white papers on every topic under the sun.....McCain and Romeny

Posted by: Monsieur Mew Mew at September 16, 2015 02:00 PM (0LHZx)

159 Maybe now is a good time to bring up the idea again of using a crude evolutionary algorithm for picking the voting order of primary states.

Over and over, the current early GOP primary states have selected candidates who then dominate for the rest of the calendar, and secure the nomination, and then get spatchcocked in the general.

The rock-ribbed Republicans of New Hamster thought that John McCain was the path to victory. Oops. Then they figured Mitt Romney was a sure thing. Sad trombone.

So, take that role away from them. If an early state selects an eventual general election loser, they then drop to the rear of the primary queue for the next election cycle.

After a few cycles, states whose primary voters ARE good at selecting general election victors will come to dominate the early primary calendar.

160 This is going to be the craziest presidential election in memory.

Despite overwhelming national obsession with politics, NEITHER major party can produce a decent viable candidate.

Every person running on either side of the aisle is a complete shambolic disaster.

Hillary? Criminal sociopath granny, deeply hated by 2/3 of the nation?

Sanders? Crackpot old communist hippie?

Biden? The Gaffe-Master? The Buffoon-in-Chief? SRSLY?

Trump? The reanimated golem of PT Barnum?

Carson? Totally inexperienced vanity candidate?

Fiorina? Self-obsessed failed former CEO of a company on a downward trajectory?

Jeb? Silver-spoon soulless scion from a family no one wants to hear the name of ever again?

And everyone else: under 5% even among the GOP base? How much traction are they going to get in the general eelctorate then? 2% max?

No one -- NO ONE -- has a chance. Everyone is disqualified.

And yet...

And yet...

One of them is going to win.

It seems incredible -- impossible.

But it must be.

Not least that Carson is prone to a bad tendency already widespread in America, the well-meaning nanny-state medicalization of everything.

We need to have guns banned in the inner city for "public health" reasons.

We need to lower the DUI limit to 0.02, a quarter of what it is now, again for "public health" reasons.

I hate cigarette smoke and I don't smoke myself. Carson wants to completely ban the things. Since banning drugs has worked such a charm. Again, "public health".

No. No no no no. Hey, guess what? I have someone who pesters me nonstop with bullshit nannying medical advice already. That's what mothers-in-law are for.

Posted by: SH at September 16, 2015 02:05 PM (gmeXX)

______

But at least a good governor shows you that someone can be a good executive. And there's some history of political action from which you can infer future actions. If someone's a governor for 4 or 8 years and cuts taxes during that time, it's a safe assumption that he will cut taxes - or at least try to cut taxes - as president.

But from someone like Carson, it's a blank slate, you have no idea what he will do since there is no history. I mean I suppose is someone ever needed emergency surgery in teh White House, he's your man, but aside from that, who teh fuck knows what he'd do?

And yes I realize that the same argument can be made against Trump. Yet nobody ever seems to acknowledge Carson is as much of an unknown quantity as Trump.

Fiorina is for amnesty, Dreamers, essentially open borders. She's jumped on the gender card and is riding it for all it's worth. She jumped on the "War on Women" stuff with Megyn.

She's at best a right leaning liberal.

Yet somehow her positions are okay?

She may be saying a few things different now than her Senate run but we know what that's worth don't we? At least Trump didn't make his declarations from the position of running for office so his changes (if they are) can be set aside.

Fiorina lost against Boxer because they saw that there wasn't much difference between them and they went with the incumbent who had seniority and experience.

I was all for her but then she came out with a video dissing businessmen that looked like it was done by NPR. She's made other statements and review of her positions past and current shows someone who's at best GOPe and just more of the same. She's not an outsider by any means.

She's got more energy but then so do a lot of folks who shouldn't be given any power.

So? Character and willingness to learn go a long way. Generals, admirals, cabinet secretaries, spymasters, and so on all already exist and already experts in their respective domains. The idea that the President must also be an expert is not true.

A short list of at least reasonably successful presidents who did not have such expertise: Andrew Jackson (frontier fighter), Harry Truman (half educated farm kid from Missouri), Abraham Lincoln (an upjumped Congressman and frontier lawyer).

People whine about overcredentialed elites living in the clouds while driving the country into the dirt, but then turn their noses up to experiences that don't fit the cursus honorum.

Not that I know of. We don't talk that often, and when we do we don't talk about politics. I get the sense from her FB posts that she is a left leaning Repub or a right leaning Dem. So, they did manage to find each and every Repumpkin voter in NH.

Let's round that to 5% and do some of that maths thingy:

DT at 27 instead of 22.
Cruz at 10 instead of 5.
Yeb! at 4 instead of 9.

380 Three minutes into the main debate, Rick Perry, who hasn't been seen since he suspended his campaign, will walk onto the stage buck naked except for his cowboy hat and boots.

He'll walk casually over to Carly Fiorina, tip his hat, and say "Howdy, ma'am. Hold this for me while I talk to the folks".

Carly, not wanting to seem easily shocked, complies and takes Perry's dick in hand.

Totally fucked up on bourbon and oxycontin, relaxed and confident, Perry goes on to make a 8 minute impromptu speech off the cuff that flows like butter and is the equivalent of the Gettysburg Address.

Speechless, the moderators sit slack jawed as Perry retrieves his dick , straightens his hat and strolls offstage with Carly following 3 steps behind and to the right.

In her senate run; Fiorina was for the Dreamers act. She said she was for "comprehensive immigration reform" (that's a PC way of saying amnesty. She says she against amnesty but so do a lot of folks we know are going to vote for amnesty. She was actively seeking Latino organizations and received donations from them.

guess what her position really is? I don't have the time.

440 Being for some sort of legal status, after the border is secured, is not a wild-eyed open borders stance. It's practical.

If anyone believed the GOP was serious about fixing the border, this might be a starting point.

But the GOP has made and broken this promise repeatedly. No sane person is going to trust them to fix the border.

The GOP could have a border security plan up for a vote in Congress right now if they were serious. They are not.

Carly Fiorina rose from secretary to CEO of a major corporation.

Donald Trump, GENIUS AND SAVIOR, was given 15,000+ pieces of prime NY real estate by his father, real estate mogul Fred Trump. Young Donald has declared bankruptcy four times. When asked during the last debate about various stakeholders burned in those bankruptcies, Trump responded by asking, 'Have you met those guys? They're not nice guys.' As if niceness is a measure in fiancial matters.

So yeah: Trump supporters have every reason to attack Fiorina, compare her to a crack whore and call her a RINO. She is a threat to their Beloved so they jump to protect him. Right. She's also for ending sanctuary cities (hard to believe that is a right-leaning position rather than a bipartisan position, but there you go); she's specifically against a path to citizenship for those who came here illegally; she's even in favor of better tracking those who come here legally on limited visas, rather than letting them in and forgetting about them; she wants to fix the employer verification system.

I would enforce federal laws in every city, including sanctuary cities. I would secure the border; it isn't rocket science to secure the border. It takes money, it takes manpower, it takes technology, but mostly, apparently, it takes political willpower and leadership. So let's secure the border and end sanctuary cities.

I would fix the legal immigration system. We have at least 16 different visa programs, half the people who are here illegally came on a legal visa and just overstayed. We hand out thousands of border crossing cards that are supposed to be good for a day but then it turns out they're good for years. We let the wrong people in, we send the wrong people home, and then finally, of course, we need to deal with those people have come here illegally and stayed here illegally. And what I've said for a very long time is they do not earn a pathway to citizenship, because people who have played by the rules, and studied our history, and taken the oath, they have to be rewarded for understanding what the responsibility of citizenship means.

Four businesses he was involved in did.

As to business acumen, I don't see Carly name on any buildings or real estate.

Sure his father gave him a leg up but that can easily be dissipated.

It takes business savvy to set up a deal. It takes organizational smarts to know you don't know something and hire those that do. He's big picture kind of guy and I think he's looking to improve the country's economy because Obama has pretty much trashed the place.

Carly's limited experience doesn't bode well. She's actually failed the company while doing well herself. Something Mitt Romney could relate to but for folks like myself I see some problems with her past and her positions and her personality.

I have yet to see anyone who actually claims to support Trump. Most "supporters" are really just people who want to see the traditional Establishment be torn down, and Trump pisses off all the right people. And his lack of guiding philosophy means he might accidentally come up with a conservative solution every now and then.

Anyone else, with the exception of Cruz and probably Carson, I see expressions of conservatism as a ruse. With Trump, I know that he will not govern as a conservative. That is not his appeal. He is the anti-establishment.

But to refer to him as "their Beloved" is to mischaracterise what is going on. I would happily support anyone else (I support Cruz), but I would consider Trump to be better than most of the rest and he is at least entertaning for the moment.

Don't need to modify the 14th. Congress has the explicit power to decide who is a citizen and who is not.

The standard procedure now is simply because there is no guidance so they've defaulted to the position of giving anyone born here citizenship.

Congress by itself can change that. It's within their purview.

515 Don't need to modify the 14th. Congress has the explicit power to decide who is a citizen and who is not.

The standard procedure now is simply because there is no guidance so they've defaulted to the position of giving anyone born here citizenship.

Congress by itself can change that. It's within their purview.

-----

Even those born here? I have read compelling arguments from people for and against on the 14th A birth clause. I thought Thomas Crown made the most compelling argument against, but I am still not persuaded. A person born here is basically a citizen by virtue of the 14th A. Congress cannot change that.

Posted by: SH at September 16, 2015 02:50 PM (gmeXX)

__________

They become legal residents (green card holders) pretty much right away. And then after 5 years of being a legal resident, they can become citizens. And this isn't just for dreamers it's for everyone.

And not just parents either. A US citizen can bring in any immediate relatives - parents, siblings, spouses. And once they become citizens, they can bring in immediate relatives.

It doesn't happen overnight. But the 4 million DREAMERs could potentially lead to tens of millions of relatives coming here as well. So yes when you say I want to legalize DREAMers you're in effect saying I want to make the DREAMers and everyone in their family a US citizen at some point in the future.

Also, crucially, the focus of tonight's debate is foreign policy. Carly was on the CIA External Advisory Board. She no-shit knows what's going on in the world.

There's a typical liberal trick.

I did not compare her to a crack whore. I said she was desperate like a crack whore. I say she's desperate because she was low in the polls was at the junior table and by the rules should still have been there. But she whined to the RNC and they whined to CNN and they caved.

Sure they gave reasons for it but they were fine about it before Carly started whining. Women's card played - check

She's for Dreamers and all that that means as a consequence. Doesn't matter she says she's not for AMNESTY because she knows that's a dirty word with most people but she's for "comprehensive immigration reform" and we all know who says this and that they're really for amnesty.
So For Amnesty - check

Megyn Kelly started her questioning off with Trump by framing it in a manner that would fit quite well within any liberal's guidebook on the Republican's so called War on Women and it was done for the same purpose to make Trump look bad to women voters. Carly then sided with Megyn immediately before the blood comment.
So War on Women attitude - check

Carly was a part of producing a video with Buzzfeed (a known liberal political spin and trolling site) that made business men look like sexist idiots as if that's a common attitude and actions by business men today and as if poor Carly had to face that while fighting to reach the top of HP.
So Feminist Exaggeration Mocking Men - check

Why would someone take so many liberal positions and actions unless they actually were a liberal progressive politically and/or desperate for attention?
So Desperate like a Crack Whore - check.

And that's just off the top of my head. If I were to look harder, I'm sure I could find even more stuff.

How many people did Lincoln fire and replace with foreigners? And before they were allowed to leave HPthe fired were required to train their replacements in order to get severance. So yeah. Its not so much that she can't present herself well, or isn't intelligent. She will be viewed as abhorrent because of her behavior.
The fact that she ran in California and made a poor showing is evidence that the voters will hold her conduct at HP against her and not view it as a plus. However, I respect your opinion and your knowledge of Lincoln's home state.

589 Why do I still read about Trump flaming out, but no one ever says Carson will flame out? I really don't see Carson gaining much more ground here.

Well, probably because Carson is not well-known; this means it is technically possible for people to see Carson and think, I did not know that, I support him now. Whereas Trump is very well known, and it is unlikely that people will, even if they do learn something new about him, do anything other than slot it into their current feelings about him.

I am not sure that this is true--this election is a wacky one, and conventional wisdom may fail us.

So I don't necessarily fault Republicans for taking that position, but only if it is made clear that border security - real border security, with a fence- must come first.

663 Then why was the 1924 Indian Citizenship Act needed to grant citizenship to all native americans born in hospitals off the reservations? Do you think all Indians were born on the reservation?
Posted by: Draki

That's a complicated question with many possible answers.

Option 1.
First, I believe, is that many Indians didn't want to become US citizens between the time of the Indian treaties (mid 19th-century-ish) and 1924. That year was right around the time Indians decided to throw in the towel and give up traditional ways. Also: The US starting then wanted that sweet sweet income tax (passed a few years earlier) from the Indians, so the motivation on both sides at that moment in history was to affirm that Indians could become citizens, albeit for two different reasons.

Option 2
The racism against Indians in that era was even stronger than the racism against blacks, and that Indians had been excluded from being included under the 14th Amendment because they were barely even considered "people." The 1924 law was to clarify that, yeah, Indians are human beings too.

Option 3
The 1924 law wasn't even needed. It was just passed as a "clarification" to nail down and finally enforce what was already the law.

There are probably other options as well.

Posted by: prescient11 at September 16, 2015 03:19 PM (q5APL)

Indians are a unique case as they were considered separate nations and separate people that, while in the U.S., were not of the U.S. Such cases have never been applicable to non-citizens with the exception of Ambassadors and the like.

As to the debate, if they meant for the Amendment to be exclusive of foreign citizens, like the 1866 naturalization act was, then they should have used the language of the act.

The pure fact of the matter is that the Amendment says what it says. "Jurisdiction" has well established usage. See: http://preview.tinyurl.com/p7pz5v2

'Tis a unique jurisdiction where it is completely not applicable to anyone who has any connection with a foreign power. Does such a "jurisdiction" apply in any other fashion aside from citizenship? If some of the advocates for the 14th Amendment indented to create is ex nihilo, then they should have actually mentioned that in the text of the Amendment. Aside from two aberrent asides with zero justification that conflicted with decisions made before and after, there is little evidence for this new style of "jurisdiction" that are not of a Humpty-Dumpty nature.

Please note, I did not state that your understanding of the 14th amendment was ill founded. I simply pointed out it isn't stated in the words of the amendment. It would not have been very hard for them to use the word slave, or emancipation in the text. In fact, it would have made your positioncompletely unarguableif they had stated it explicitly- wouldn't it? Sad I guess, if you are correct, that they did not.

Posted by: simplemind at September 16, 2015 03:51 PM (XkdIH)

693 From what I understand, the authors of the 14th amendment intended "jurisdiction" to mean more like "allegiance", so basically it meant "if you are born here and you owe allegiance to this country and only this country then you are a citizen". But say a pregnant tourist who gives birth here, neither that child nor the parents bear any sort of allegiance to this country, so they shouldn't be automatic citizens.
Posted by: chemjeff at September 16, 2015 03:20 PM (lVU49)

Allegiance and jurisdiction are not the same thing. You may want it to mean that in this particular case, but you can not rewrite the plain text of the law to fit your policy preferences.

-----

I'm not sure what you want me to fix. I interpret the Constitution by its text - not its intent. But I believe that words should be given the meaning at the time of adoption. For instance, not used, but if marriage were somehow used in the Constitution in some capacity, I would interpret it to mean a one man-one women marriage because that is clearly what was meant by the term marriage for most of history.

So the only question is what does the phrase "subject to the jurisdiction of" mean? I take it to mean does the US have jurisdiction over that person. Not sole jurisdiction, but jurisdiction. At the time and even now, the US does not have jurisdiction over diplomats. There are other differences.

I have no doubt and do not argue that the primary (and maybe sole) purpose of the birthright citizenship clause was to deal with freed slaves. But by its words it extends out.

That is merely my interpretation. I am open to being persuaded that "subject to the jurisdiction of" is more narrow than I am interpreting it.

You don't have to read the 14th Amendment as requiring birthright citizenship in all cases, because of the words "subject to the jurisdiction thereof." The Supreme Court has only ruled that a child of long-term legal residents is a citizen. This ruling doesn't cover children of tourists and certainly not the children of illegals. So Congress has latitude to act here and has done so in the past (children of diplomats, Indians).

No other country in the World has unrestricted birthright citizenship. Why should we?

If you accept birthright citizenship for anchor babies then you lose all your leverage for dealing with the problem. Trump understands this.

Read Article V.

The power to propose is reserved to the Congress and to the Convention. "Propose" does not mean two different things in the same sentance. The states are not given the power to propose, but only the right to petition Congress to call a Convention that would propose amendment.

For you to be right, "petition for a convention" means "proposing an amentment," but that "proposing an amentment" doesn't mean "proposing an amentment".

Also, the convention is not a creation of the states, but of the Constitution. "Conventions of States" had restrictions by the states buecause they were not creatures of the Constitution.

721 The Congress, whenever two thirds of both houses shall deem it necessary, shall propose amendments to this Constitution, or, on the application of the legislatures of two thirds of the several states, shall call a convention for proposing amendments, which, in either case, shall be valid to all intents and purposes, as part of this Constitution, when ratified by the legislatures of three fourths of the several states

Who proposes?

"Congress... shall propose"

"a convention for proposing"

Who proposes? Congress or the convention.

What does the state do?

"application of the legislatures of two thirds of the several states" to petition Congress to call for a convention.

"ratified by the legislatures of three fourths of the several states"

What does the state do? They petition congress to call a convention and they ratify proposed amendment.

722 If you insist that the Constitution requires us to accept anchor babies, then you're not being serious about dealing with Illegal Immigration. So far, only Trump is being serious.

-------

First, I don't insist on anything other than a correct interpretation of the Constitution. And frankly, my interpretation may be incorrect, but I certainly do not think it out of bounds.

Second, I really do not care what the US Supreme Court has said on the matter. The Court has been wrong in the past in Constitutional interpretation and it will be wrong in the future. The court is not superior to the text of the Constituion itself.

Third and finally, I think you can be serious on immigration without amending the Constitution or ignoring its plain meaning. Now if you honestly believe that subject to the jurisdiction of is much more narrow for birthright citizenship, then that is fine. We don't have to agree.

The states could limit the justices through an amendment to the Constitution leaving the congress and the justices out of the voting process. Duh.
Again, I do not take your implication of my simplemindedness in the wrong way. "Duh". Please note again the "nick".
Even underthis scenario (whichI did not comment on previously)would yougiveme your estimate ofthe statistical likelihood in your "could"?

724 How about we repeal the 14th Amendment and every one of the thousands of crappy laws that are derived from it?

725
The "problem" is that we have allowed governments into office that does not respect our country's sovereignty.
They got there, slowly over time, by coopting the educational institutions and churning out "useful idiots". They got there because we elected people who lied about what they would do, and who take money in exchange for their lies.
The solution is, not amenable to human intervention. Please feel free to pray. Your vote, seriously, isn't going to matter.

Sorry I should have said " spit balling WILDLY optimistic solutions."

727 Am I the only one looking at this and saying "Who the heck is John Kasich?" and "How is Jeb Bush even still in this thing?". I can't be the only one that's not yet very engaged with the process this early.

729 #22: "Chris 2% Christie is probably still trying to kick himself for not switching to the Democrat Party."

You're so right about that! He would be thrashing Hillary and Sanders from the nomination if he'd thought of it a year or two ago.

730 To SH: How you and I read the 14th Amendment doesn't control. There is no "correct" interpretation until SCOTUS rules. If it were asked to rule, it would have to decide what the phrase "subject to the jurisdiction thereof" means in this context. It can be read the way I (and others) suggest, which is that it gives Congress the power to exclude anchor babies. This reading is consistent with the history of the 14th Amendment and later precedent.

I would argue that to not read the 14th Amendment my way is to read the phrase as not adding meaning, which is contrary to how you're supposed to construe legal language.

Bottom line: Congress can act if wants.

Question is whether it will or not.

We can't fix Illegal Immigration if we continue to allow anchor babies.

The states do not call a convention for proposing amendment. They apply to Congress to call for a convention that proposes.

By cropping the quotes to exclude the fact that Congress, not the states, is who actually calls the convention you are being dishonest.

732 2/3rds of the States apply, congress sets up the date for the convention, then either 3/4 of the states pass or don't pass the proposed amendment. Come on Hat you're making this too hard, you know exactly what Article V means even if you don't think it can happen.

But who was granted the power to propose? The Convention.

734 Convention of the STATES.

735 Convention of the STATES.
Posted by: Arson Wells at September 16, 2015 04:54 PM (UnJ7w)

"Convention of the States" as Levin defines it =/= Convention as outlined in Article V.

Posted by: The Political Hat at September 16, 2015 05:01 PM (vBeA5)

736 The states vote in the convention that is proposed by the states. 3/4 of the state legislature can pass an amendment. Call me crazy but if the States are attending and voting at the convention then it is a Convention of the States.

Posted by: Arson Wells at September 16, 2015 05:07 PM (UnJ7w)

737 I think George Mason and not Mark Levin knew what he was talking about when he had the language added to Article V. As a matter of fact you can read why Mason wanted this part in the Constitution.

738 The states vote in the convention that is proposed by the states. 3/4 of the state legislature can pass an amendment. Call me crazy but if the States are attending and voting at the convention then it is a Convention of the States.
Posted by: Arson Wells at September 16, 2015 05:07 PM (UnJ7w)

The states, per se, wouldn't attend, but their delegates would. Any restriction is done by the choice of the convention, and not by the states who suggested particular amendments when applying to Congress to call a convention.

Posted by: The Political Hat at September 16, 2015 05:14 PM (vBeA5)

739 If a delegate votes against the State he represents then the state can withdraw that delegate. You're starting to veer into convention hijacking. But at least you concede that the convention is for the states for the purpose of proposing amendments.
