Jim Geraghty: Time to Go Nuclear on Obama's Nuke Deal?

The logic is simple.

Harry Reid did away with filibusters, himself using the "nuclear option" to pass the new rule over the objections of more than a filibuster-level of opponents, for a certain category of vote -- votes with a Constitutional separation-of-powers dimension. Reid claimed the president had the right to get his personnel into the Executive and that the Senate should not stop him via a Senate rule (the filibuster rule); that such votes, affecting, as they do, a coequal branch of government, should be free of the filibuster rule and default to the rule in the constitution -- which is, of course, a simple majority rule.

Okay, makes sense.

But you know what other sorts of votes have a constitutional, separation-of-powers, turf-protecting dimension? Votes on agreements made with foreign regimes-- which the Constitution says are subject, as treaties, to the "advice and consent of the Senate" and a specified two thirds supermajority.

So, the Republicans could follow Reid's lead and pass a resolution declaring that the Iran treaty is in fact a treaty and must be treated as such. When Democrats attempt to filibuster that, they break out the nuclear option Reid did and say that given that this is a matter of separation-of-powers constitutional dimension, they will have the vote on a filibuster-free basis. (The actual process is that the question is submitted to the parliamentarian, who rules the motion to proceed without hte filibuster to be against the rules -- but then you overrule him with a simple majority vote. Which is exactly what Reid did.)

Now you have a majority of senators declaring that this is a treaty and must be treated like a treaty.

Now, Geraghty proposed this last Friday, but then backed off the idea when someone said that a resolution would also be subject to Obama's veto.

For reasons I don't understand -- and I sure wish he'd elaborate -- AllahPundit doesn't seem to think that that is much of an obstacle.

The question is, what do you do once the filibuster’s been nuked? If the GOP decides to pass a resolution declaring the Iran deal a treaty that requires two-thirds of the Senate to approve it, Obama will veto that resolution. That shouldn’t matter-- since when is Article II contingent upon the president’s assent? -- but you're looking at a court battle at least, and the public will be bewildered after weeks of "does Obama have the Senate votes to protect his Iran deal?" headlines suddenly switch to "GOP changes rules on voting to block Iran deal."

Obviously this is all hypothetical, because the Donor Class has forbidden McConnell to spend any political capital on this; the Donor Class demands that all political capital will be spent on things that really matter, like the Export-Import Bank.

Still, in order to have fruitful political discussions, it is necessary that we pretend to be members of a functioning democracy in which voters have some sort of influence on government and popular will is somehow of concern to politicians.

So we'll pretend along, because otherwise, every blog post will be very short: "The Donor Class wins."

It's all for show.

They voted 98-1 to approve the deal without knowing what was in it.

All they had to say was, "hey, Obama -- if you're going to be going off half-assed making treaties with foreign countries, you need to keep in mind that you'll need 2/3 of us make it, you know, an actual thing."

And if Obama ignore that, then they could ignore his treaty.

And/or just slow the government down to a crawl by passing the budget line by line or any other legislative trick out there.

If McConnell was unsure of which tricks were available to him, he could have just asked his buddy, alleged pederast Harry Reid.

If the next President realizes that it's necessary to either (a) let the Israelis take out the Iranian nuke facilities, or (b) actually assist the Israelis in that effort, then in either case, aircrew are going to be in considerably more danger thanks to those S-300s.

The supposed difference between an Executive Agreement and a Treaty, is that a Treaty would need some Legislation to back it up... ie it could NOT be done with just Executive powers.

This treaty makes US pay for Iranian inspections of their own Nuclear facilities... only a few Million, but this money must be APPROPRIATED, thus, it will take legislative action...

Thus, it is, by definition, a Treaty, and THIS should be the argument.... it should need to be ratified by the Senate.... as the Constitution states.

164 I think people are forgetting that the deal is not a treaty, it's just a deal, it can be cancelled by the next President. Not saying that it will be cancelled by Trump, just that it can be cancelled.

No matter what Congress does, Iran is going to be freed from sanctions by the UN which will happen even if the Senate gets enough votes to overturn the Veto. I don't understand why everyone is getting a huge case of the vapors over this. The vote doesn't mean anything, the deal is already done and over with.

The deal is setup so that Obama can unfreeze Iran's money before he leaves office and call it a victory and that he single handily prevented Iran from nuking Israel after that he simply doesn't care. He now has his Foreign Policy display for that wing of his Library.

Iran is going to get what they want from at least Russia and Europe no matter what happens here in the US. Heck Iran is already getting around the sanctions with Germany and Russia and no one is saying or doing anything about that.

The time to stop that is now, not in two years. Either we stop this now or Israel, Egypt, and the Sauds will be forced to start war with Iran, one that has no guaranteed outcome.

Big business has it's interests and they're well within their rights to promote them.

When it all boils down, we need people in elective office with enough character to balance campaign contributions to what is right for the country.

The trouble is, sometimes the people with proven character have accents or the tone of their voice is irritating to sensitive elite ears. When that happens, we need to ignore the good in people and destroy them before they embarrass us.

It is pretty much up to Israel now. The US isn't going to do anything to stop Iran from getting a Nuke.

Problem is that will never work. "Politics" is just "popular government," and government will always be "in" money. Not just coining it, but enforcing contract law and criminal code, setting trade regulations, and so forth.

As long as there is a government worth the name, it will be deeply involved in the economy.

So what you do is limit the government to a set of explicitly designated powers (huh, seems like I've heard this concept somewhere), and even then you break it up so that no one person or group has too much (funny, I think I've heard that one, too).

The big donors give the RNC their S&M sex bar junkets and bloated salaries. Candidates can pull all kinds of crap with their campaign contributions to live off their donors' largesse.

The issue is that people should be able to spend as much as they want on advocacy, but NOT on bribery of officials.

Campaign Finance Reform laws worked to limit what groups could advocate in public, not the poisonous backdoor stuff.

Feinstein used the laws to target pro-life people for putting up billboards, not for making obscene donations and buying candidates. In fact, those laws made that method more likely.

The problem with the current accident is that, as far as I know, no one has cornered the other driver and forced her to give her insurance information. She's being criminally investigated, but that doesn't seem to be doing much.

So *my* insurance is the one on the hook.

I'll say this about Progressive (the other guy's insurance in the last wreck)- they were prompt, polite, and easy to work with. They gave us no guff when we chose not to sign the medical claim release for my wife until after we'd actually seen the doctor, and then again when we found out she'd actually have medical bills.

I don't even mind that they didn't volunteer to pay us devaluation (well, okay, a little, but I understand why they wouldn't).

And term limits for all Federal offices, and no pension OR federal salary. All reps to be paid by States, in the manner of their choosing.
