Failure Theater, Act IV: Mitch McConnell Confesses, Sadly, That the Rules of the Game on the Iran Deal Are, For Some Reason, Stacked In Obama's Favor and He Doubts He Can Stop the Deal

Aw, applesauce!

Gee we really tried, by giving Obama the ability to pass this with a tiny fraction of Congress, and now it looks like we won't be able to stop him, because of the things we already did when no one was paying attention.

It looks like Senate Majority Leader Mitch McConnell (R-KY) may have thrown in the towel on the GOP’s effort to stop the Iran nuclear deal from going into effect.

To reject the pact designed to rein in Tehran’s nuclear ambitions, a majority of Congress would need to vote against it. But a two-thirds majority would be required to overcome the president’s promised veto of the resolution of disapproval, including at least 13 Democrats in the Senate, something McConnell admitted looks unlikely.

Obama "can win by getting one-third plus one of either house," McConnell told a business group at an event on Monday in Kentucky, according to the Associated Press. "So he’s still got a great likelihood of success."

"I hope we can defeat it, but the procedure is obviously stacked in the president's favor," he told reporters after the event. "We'll see."

Passive voice "the deck is stacked in the president's favor" sounds so much better than active voice "several months ago we deliberately stacked the the deck in the president's favor, so that we could pretend to vote against the deal while having already passed it into law."

ace, your contempt for the leadership is justified - hell, it's "moderate", given the stakes and the situation.

But just as an exercise, let's use your time machine, go back in history, and assume Corker never happened.

So the administration announces it is treating the agreement(s) as executive arrangements, like hundreds of other such agreements implemented by many previous presidents. No treaty status, no Senate procedure for treaties.

Nothing can be done about this, per se.

So what could Congress do? Well - pretty much exactly what it can do now. Directly, it can amend/reinstate/author new sanctions provisions in US law that the president is either waiving under legislated procedures or letting lapse. All such moves would be subject to the usual hurdles: Senate filibusters, presidential vetoes, need to over-ride said vetoes.

Corker or no Corker, the "legal" situation doesn't technically change. Congress can *always* impose laws incl. sanctions provisions if it can get past a president (and any court challenge, though that's not a player here). Congress can *always* deny funding, condition funding, hold nominees hostage in an effort to force a president to do/not do something.

Corker or no Corker, Congress can try to do anything it wants. It should burn down the building over this - but it should have also done so over O-care, and the abandonment of the constitutional budget process, and the complete and final transformation of the SCOTUS into a super-legislature for idiots.

The overall failure of leadership and competence and seriousness in the GOP leadership is very real. The Corker bill is not really a material or different part of that.

Yeah, but Congressional assent to calling a nuke settlement with Iran a "deal" rather than a "treaty" began under W. The Pelosi/Reid Congress passed the same defining bill for Obama.
All of which turns it around 180 degrees, as you say.

Obama was actually right when he said he didn't need to even consult Congress about this "deal" since they had already given him full power over it, i.e., defined it as not being a "treaty." The Corker bill is an attempt to correct that but it's a day late and a dollar short.

Congress should not have given the POTUS, whether Bush or Obama, the power to begin with.

Whether you think there is a treaty definition problem with this, or not, is irrelevant. The Corker bill was just plain stupid and gave further powers to Barky. We might disagree on whether those powers were un-Constitutional or not, but there was still no reason, whatsoever, for the Corker mechanism to be passed. And you have to take into account that this is the same Congress that went ahead and passed the TPA bill, too.

Whatever your position on the Constitutionality of these bills is should pale in comparison to the idea that this Congress has been happy to give extra powers to a lawless enemy in the White House who has shown that he takes every opportunity to harm this nation and the citizenry.

Yes, taking money from the single mother struggling to pay her property taxes and mortgage and giving that money to cronies who donate to the right politicians to build multi-million dollar sports complex for multi-million dollar sports franchises is absolutely "looting the treasury" and I don't care if its short sighted or long sighted, it's theft of public money to use for a private organization.

Google Bradley Center St. of Wisconsin obligations. Either way if they had stayed or left WI was going to be on the hook for an arena. Secondly, new owners of Bucks are proven "winners" when it comes to developments. There is nothing going on in the CIty of Milwaukee. Lastly, quite a bit of state income tax comes in from NBA players.

I'm from NW Wisconsin and could care less about the Bucks. However, the whole new vs. old is a wash. The problem with Walker is he is too dam nice and won't speak about it.

In addition, taxes are assessed on hotels, and restaurants in proximity to stadiums and arenas. Not to mention income taxes on people who actually work at the facilities and the vendors who provide services, all of whom are out of luck if the facility doesn't exist.

Correct. But half the season is in Milwaukee, yes? So, there is money to be taxed on those games, yes?

Money which would not be available to be taxed if the team weren't there anymore, and the city and state would still be on the hook for the existing arena, which would now have no tenant. Walker got the best deal he could in that situation.

Sometimes you don't have a good option, you only have a least-worst option. People who are currently in executive elected office have to make decisions and not just talk, talk, talk. Making decisions means pissing some people off. But the least we could do is not lie about those decisions.
