It's Hooky, But It's Not Fun Hooky

Just a word on why I've been away: Once again, things have hit a stage in the unending lawsuits requiring my attention. These come occasionally; you might remember another not-fun-time-away-from-the-blog last February and March.

I will post here and there, but once again I am forced to work a second job and not do my actual job.

How bullshit? I owned some stock in an energy company that went bankrupt. A group of people is suing ME as a shareholder (no involvement in the company whatsoever) for the dividends it paid me from 4 years ago.

And I have a judge that keeps letting this lawfare play out in the name of everyone getting their day in court.

This country needs tort reform.

That really depends on what side you are on. Usually personal injury plaintiffs attorneys do contingency, but most other work is usually a flat fee for the matter (i think that is common in your run of the mill criminal cases) but most bill by the hour and they argue over the bill and it gets reduced. Insurance companies have taken to using third-party administrators to "evaluate" legal bills.

Yeah its a bit of a convoluted mess of who owns all that. Of course Fox and Disney could see dollar signs of knowing that remastering and releasing the original trilogy as played in the theater would be worth it. Because they aren't the whiny petulant George "The Special Editions are the real movies!" Lucas.

Though I could see Disney holding out till 2020 when they have all the rights to the movies except the original.

Usually personal injury plaintiffs attorneys do contingency, but most other work is usually a flat fee for the matter (i think that is common in your run of the mill criminal cases) but most bill by the hour and they argue over the bill and it gets reduced. Insurance companies have taken to using third-party administrators to "evaluate" legal bills.

Correcto. Flat fees aren't very common on the defense side of things, although some insurance companies have tried to push that. Most insurance companies pay hourly, but usually at bottom of the barrel rates.

The playing field is not level. Consider this: Shirley Sherrod is suing Breitbart's widow for Andrew showing a video that quoted her accurately. The courts allowed her to transfer the case against Andrew to his widow. She is being assisted by pro bono counsel from a high dollar name law firm in DC - despite the fact that she is a millionaire in her own right thanks to Pigford.

The Left is a well funded machine that uses the mechanisms of government which is even better funded to destroy the right. People like Lois Lerner are protected by our justice system.

In the scrum ace is involved with, there are people - and I think that ace is one of them - who say this isn't a partisan issue, but rather it is an issue of free speech. Because then it is possible to get some Lefties to participate. ace had pro bono counsel from an ACLU type which he might not have if it were couched as a purely partisan battle. So there is some value in that positioning.

However, it is important to remember, the Left is out to get us. All of us. And they don't just disagree, they want to line us up against the wall. And the bad guy here did the Democrat party a solid by providing cover for Bill Clinton's dope smoking. His cause has been championed by Dick Durbin and Joe Biden - people who are still kind of important in the Democrat Party today. Oh, and as a country we kind of thought that Clinton's claimed dope experimentation was problematic, and just 16 years later we did not care at all about electing a guy with a regular marijuana and cocaine habit. At least formerly.

So, yeah, this is some BS that ace has to deal with, but it isn't because he is ace - its because he is one of us.

Thanks for the 1% qualifier. I don't litigate anymore, but during my time in that world I discovered that the bulk of litigators (like myself at the time) are basically just working schlubs.

I don't buy it. The benefits of tort reform is very diffuse, where as the people we're "hurting" are vocal and argue for a living (lawyers).

Not to mention that all we'd hear from the MSM is stories about how the GOP is in bed with businesses that are basically Captain Planet villains and is going to step on the little guys who are going to get screwed over by companies negligence/malfeasance. You want all the GOP presidential candidates to have answer questions from people who were injured about why they're trying to take away the small benefit they got?

140 Just wrapped up one myself, Ace, after 8 hours of mediation.

Funny thing is the plaintiff's counsel learned there what I knew and tried to convince them--their client hides the unfavorable and lies like Barky. That came out, settled cheaply when they all saw the light but they had come to the mediation with grand vi$ion$. Very unhappy campers, the lot of them. Very. I could sense the hate that grew b/t them that day, peaking at the conclusion. Small consolation but nice.
