Background Check Should Not Have Permitted Dylann Roof to Buy Gun at All; Mistake Was Due to Lack of Timely Records-Gathering by FBI and Police

So obviously what we need is more laws on citizens, to make up for a massively incompetent government.

The NYTimes, of course, brands the FBI's and police's errors a "loophole" that must be fixed.


The man accused of killing nine people in a historically black church in South Carolina last month should not have been able to buy the gun he used in the attack, the F.B.I. said Friday, in what was the latest acknowledgment of flaws in the national background check system.

A loophole in the system and an error by the F.B.I. allowed the man, Dylann Roof, to buy the .45-caliber handgun despite having previously admitted to drug possession, officials said.

Mr. Roof first tried to buy the gun on April 11, from a dealer in South Carolina. The F.B.I., which conducts background checks for gun sales, did not give the dealer approval to proceed with the purchase because the bureau needed to do more investigating about Mr. Roof’s s criminal history.

Under federal law, the F.B.I. has three days to determine whether there is sufficient evidence to deny the purchase. If the bureau cannot come up with an answer, the purchaser can return to the dealer and buy the gun.

So the police did not give the FBI the record in time, or the FBI did not request it in a timely way, and did not have, in any event, the report after three days, so Roof bought the gun.

The NYTimes is branding this a "loophole" for strategic leftist political agitation purposes -- if the government doesn't have its shit together, it's a "loophole" that can only be cured by a blanket restriction.

A writer at Reason attacks the NYT, and the FBI, for claiming its own incompetence is a "loophole" in the law.

Yes, FBI: In a way, it is a "loophole" in the law that criminals get away with crimes when law enforcement officials make deadly errors.

This "loophole" has existed since the first night's guardsmen in the Middle Ages.

Are you just becoming aware that if you sleep on the job, criminals will ply their trade without detection?

BTW, there's a "loophole" in the international system that allows ISIS to butcher Christians and Iran to build nuclear bombs, with which to nuke Tel Aviv.

That "loophole" is called Barack Hussein Obama.

He also doesn't like doing his job. He likes golf and Interesting Italians and having his picture taken with celebrities.

The sad part is that many states do not forward their criminal and mental health records to the FBI NICS system. The poor overworked court clerks just don't give a shit. There are "only" about 90,000 denials a year. Most of those are bogus, due to bad records, wrong guy, etc. There are about 1,000-2,000 legitimate denials (Felon, Mentally Ill, etc). And the government actually prosecutes about 2 dozen cases per year.

I have an unusual name, the first background check took about a week in the late 1990's. Since the FFL was a friend's friend, we waited it out. (Also if I failed, my site access at work could be jepoardized by the failure) Last one in 2013 took about 60 seconds.

And the mighty wise and omnipotent judges don't care. This is not the first Back Ground Check Fuck-up. This will not be the last either.

Here in WA they had some recent stories about cops not actually submitting rape kits that were collected to the lab. We're not talking backwater towns of 10K people, we're talking Seattle PD.

A rape kit, from what I understand, is something that takes hours to correctly collect. It has to be done by a person with special training. It's invasive and humiliating to the woman who has already been violated in a very personal way. Can you imagine going through that and finding out the Seattle PD couldn't be bothered to pass the kit along to the Crime Lab?

254 Fox News is saying the FBI's lack of response "prevented" the gun dealer from not selling the gun to Roof. That is precisely incorrect.

I just purchased a gun from a newly opened local dealer - I was curious and he wasn't busy, so he explained how the Brady Bill works.

The FBI has 3 days to respond to the dealer's background inquiry; their possible answers are approved, denied, and delayed. Approved and denied are self-explanatory; delayed gives the gun dealer discretion after the 3 day period to sell or refuse to sell based on his/her judgement. In Roof's case this is what happened. You can't really blame the dealer, but neither can you claim he/she was forced to sell the gun.

In the case of a delay, such as Roof had, the FBI still has 30 days from the initial background request to approve or deny the purchase. If it's eventually denied and the dealer has already legally sold the gun, then he can call the customer and request it be returned; if the buyer refuses to return, the FBI will pay him/her a visit and seize the gun. Likewise, if the gun dealer is uncomfortable with contacting the customer, he/she can request the FBI to handle confiscating the gun and returning it to the dealer. (there's a code associated with a "deny" that identifies the reason, such as 'Applicant is a verified commenter @ AoSHQ)

Btw, if you're one of those people who is constantly facing a 3 day delay for firearms purchases, it's probably because you've had a driver's license in multiple states. For a fee, you can have all of your former residence states' background info transferred into the database of the state you live in now and you will be approved (or denied!) in seconds, as long as your current state has a fully computerized background check system. Check with your gun dealer to get the website address - it's all handled online.

This is one of the reasons the back-ground check law was written this way- to prevent the Federal Government from foot-dragging its way to a full on prevention of gun purchases.
