Megyn Kelly Destroys Obama on the Sanctuary City Murder

I don't usually say that, but she destroys him. She turns the blue glare of her Aryan fury towards his -- yes, his -- personal decision to keep sanctuary cities going. There's a brief video is about halfway down the page; we really need the full video, but I can't find it on Fox.

Kelly's reportorial catch is that the head of ice -- a Ms. Zaldana -- was asked, just four months ago, if she would like Congressional help in telling citiies that their "detainers" -- an order to keep an individual while ICE comes get them, I guess -- were not voluntary things they could honor or disregard at their whim. This is what that the San Francisco sheriff was talking about when Tapper interviewed him -- claiming a "detainer" is "not a legal order" like a warrant and so can be disregarded at will.

Ms. Zaldana was asked, four months ago, if Congress should make it clear that detainers were not disregardable at will by sanctuary cities.

Her answer was:

"Thank you. Amen. Yes."

But then, the very next day, not twenty four hours later, after obviously being read the riot act by a higher-up (either Jeh Johnson, or Obama himself) she reversed herself completely, and wrote a letter to Congress praying that they not misunderstand her, that she does not want any clarification at all on detainers, that it would upset the delicate balance of the police/illegal ecosystem or whatever.

Thank you. Amen, yes. Crack down on the sanctuary cities is what she said, but the very next day, Friday March 20, a complete reversal after the ACLU, immigrants rights groups and others pressured the White House and presto, the head of ICE makes a shocking about face. This time in writing, though, saying, quote, '[a]ny effort at federal legislation now to mandate state and local law enforcement's compliance with ICE detainers will, in our view, be a highly counterproductive step and lead to more resistance and less cooperation in overall efforts to promote public safety." What happened to thank you, amen yes a day earlier? And now, after clear evidence that it is not interested in a sanctuary city crackdown, this administration tells reporters it can't comment on whether the President backs the sheriff or the policies in this case?

So Obama is directly responsible for this woman's murder.

You know how Obama always claims that if we can save one life by any gun control measure? Well, resolving that detainer orders are not voluntary would save many lives.

And yet he wants more people murdered. Odd!

Kelly then blasted Josh Earnest for refusing to answer a question about it, referring the matter to the Justice Department (which would of course refuse comment), and the media for being "too lazy" to do their jobs:

He allowed this to happen. They -- the administration knew the person he placed in charge of ICE was telling Congress, 'yes, help us, get these cities into compliance' and someone took her behind the wood shed and said you're reversing that explicitly and now they don't want to answer for it because they know the press will be too lazy to hold them to account. It is lawlessness.

Honestly, it was the best six minutes of TV I've seen in a long time.


Rick Perry: Cut Off Federal Dollars (For Policing) to Sanctuary Cities. Rick Perry's on the board.

Now obviously one can say cut off all federal aid and sure, that sounds not so bad too. But this is a pretty good proposal, as there's obviously a direct link between the funds to be withheld and the behavior to be corrected.

"In Texas, we have a long history of welcoming immigrants from all over the world, immigrants who have helped make our economy the strongest in the country. It’s not fair that some people try to jump the immigration line by coming across our border illegally. One of the core responsibilities of the federal government is to secure the border. As the recent tragedy in San Francisco has shown us, it’s important for the federal government and local governments to be able to cooperate to apprehend illegal immigrants with criminal histories. San Francisco--and many other cities in America run by left-wing governments--have become 'sanctuary cities' that choose to openly defy U.S. immigration law and prevent cooperation with federal authorities. Perversely, the federal government subsidizes this behavior by sending Justice Department funds to cities that intentionally harbor illegal immigrants in their jails. This has to end."

"Today, I am proposing to pull funding for the State Criminal Alien Assistance Program--or SCAAP--rom sanctuary cities. States with sanctuary cities will lose a proportionate amount of their SCAAP funding as well. SCAAP funding will also be restricted to jurisdictions that actively participate in immigration law enforcement programs. Cities and counties with sanctuary policies in place will also be prohibited from applying for federal law enforcement or Department of Homeland Security grants. Federal taxpayers shouldn’t be forced to subsidize the irresponsible behavior of these governments. Furthermore, the Justice Department should allow federal immigration officials, either through the executive branch or Congressional action, to have access to prisons and holding facilities in sanctuary cities and counties, so as to verify the immigration status of people in those facilities."

The outrage of "sanctuary cities" is fundamental - they should not/never should have been permitted to exist, for a nano-second - WRT any federal law.

as I understand it, it's basically a memo from one law enforcement agency to another saying, "hey when you're done with this guy, hand him over to us so we can try him in our jurisdiction."

So, for example, someone who gets arrested for DUI in one county and gets booked and has a warrant pop up for an outstanding drug charge from another county -- the arresting county reaches out to the other cops and they say "put a detainer on him, when he's out of your county jail on the DUI charge, we want him for his drug charge" or whatnot.

As in, "don't just cut him loose when you're done with him."

So when someone gets booked and bounces back as a 5 times deported illegal, ICE says to the local LEOs "hey, hold on to that guy for us and let us know when you're done with him, we want to deport him again." and San Fran and others are saying "nah, fuck your detainer, we're just going to cut him loose."

Well, so in the case of the guy in San Fran -- he was picked up on a drug warrant from a decade ago. ICE said "hold him, he's a multiple felon who we've deported multiple times. Let us know when we can come pick him up."

Then the decade old drug warrant got dismissed, and the judge just let the guy go. They never contacted ICE.

The charge he was in front of the judge for got dismissed, so local LEOs had no reason to hold him.

Actually, defending against invasion is one of the very few responsibilities that the federal is tasked by the Constitution, with tons of extra powers in order to effectively carry that out. That is one of the most basic responsibilities of the federal government and the States most assuredly cannot decide not to comply in this.

I think he's arguing the actual specifics of does the federal government have the ability to FORCE a city to house someone and tell them when the person is available to be picked up. It would force the city to use resources and put them under constraints.

A strict reading of the constitution would say... maybe? I don't know.

It's a really "in the weeds" argument if I'm reading his argument correctly.

And I don't know the answer.

But we don't live in a world where anyone reads the constitution strictly, so I kind of have less patience for this line of reasoning then I used to. Because when "shall not infringe" and "interstate commerce" don't mean what they say, and "abortion" is a constitutional right to "privacy" found in the penumbras and emanations of the constitution... well, c'mon.

I'd say its less ignoring federal law and more they do not have to enforce it. The state only has to enforce the law of that state. Just as the state of NY does not have to enforce the laws of NJ - the state of NY does not have to enforce the laws of the federal government.

Re CO - the state got rid of some of its weed laws. The federal laws still exist. But the federal government is not showing much enforcement of those laws at least in CO. But that is a good example.

That's almost it. Both WA and CO got a memo of understanding or some such that the DOJ would not pursue action in or against WA or CO for violating existing federal law. This was one of the first things, in conjunction with suing AZ over SB 1070 (immigration enforcement) that began the slow slide of respect for law in this country.

It became clear then that we were becoming a nation of, not laws, but men.
Executive Amnesty is just another nail in the coffin.

Well, they essentially did nullify a federal law.

The FDA classifies marijuana as a schedule I drug -- no medical use, highly abuseable. Congress has made all schedule I drugs illegal in the US.

CO decided to ignore federal law and allow citizens and stores in their jurisdiction to flaunt federal law in regards to marijuana.

That sounds like nullification to me.

Well, in a situation like this, the question is can they COERCE the state (city) to house a prisoner and "hold them" on a federal warrant then notify the feds they have them then wait for the feds to show up.

I mean, clearly its a very routine thing for one jurisdiction to hold someone until another jurisdiction comes to pick them up. But can the feds FORCE a city to do so? As in, if the city refuses to, can they... arrest the jailers who released them? Fine the city? Shut off federal funding?

Let me turn this. What if there was a federal law limiting open carry which is legal in Texas. Texas picks someone up on an unrelated charge. ATF says to hold the person until they get there. Texas processes him and lets him go because the Gov has basically said we are not going to hold any suspect for ATF if we have no other reason to hold him.

I'd have no problem with that.

And for your example (and the guy in San Fran) it's not like the local LEOs are dismissing the warrant. They're just ignoring it.

DUI breathalyzers are also a joke, scientifically. They use an artificial "average" baseline for the amount of alcohol we have naturally in our systems. Of course, everyone is different.

For weed? They have saliva tests that are fairly accurate and inexpensive.

But uh... why not just arrest someone if they're driving recklessly and ... don't arrest them if they're not?

People have been getting high and driving for decades. Cops arrest people for DUI for drugs every day, whether its marijuana, opiates, prescription drugs, OTC drugs, whatever. Basically, the officer thinks you're impaired, you fail the field sobriety test, and he charges you with DUI.

I don't know why this is suddenly becoming a thing.

DUI is kind of... outside the realm of normal law. It's traffic court. Except its a felony.

And they convict people every day of exactly the scenario you describe, and unless you're a Kennedy who can claim to be sleep drinking and driving, you're not getting off.

Also why they have dash cam video recordings of the stop.

Immigrants may not talk to police if "they think you're also going to be enforcing the immigration laws." In 2008, Clinton voted against an amendment to yank some federal funds from sanctuary cities. California Democratic Sens. Dianne Feinstein and Barbara Boxer voted likewise -- but it didn't stop them from criticizing San Francisco for releasing a repeat offender.

"The 2008 budget amendment was a choice between sending a political message or funding California law enforcement, and I chose to fund the police," Feinstein explained in an email. "I continue to believe we can deport criminals who are undocumented and still support law enforcement."

Perhaps Feinstein and Clinton are living back in 1985, when Feinstein was mayor and signed San Francisco's sanctuary city law.

344 I like Perry. He's a proven success at governance, and a conservative Republican. We have some very successful governors and former governors running this year, and a business executive who NEVER declared bankruptcy.

For those who discount experience, we have some dynamic young candidates with fresh approaches.

And we have Bozo the Clown and his sideshow, just in from the hair stylist with a new blow-dry look and a $10,000 suit. And the rubes line up with the money to see him like he was The Dog-faced Boy.

345 Perry's idea is a good one but it's a crime to spend money for unauthorized purposes. You can't take money for sidewalks and curbs and spend it on sewers and you can't take money to pay for detaining and returning criminal aliens and spend it on gay pride parades. Prosecute them.
