Federal Judge: Obama Officials Must Stand Before Him Personally To Answer Question of Why They Should Not Be Held in Contempt Over Violation of Amnesty Injunction

If you remember, this judge had asked the Obama Administration if he needed to authorize an earlier injunction, in order to keep the Administration from going forward with their Amnesty plans while he considered the issue.

They said: No judge, you have plenty of time. No need for a temporary injunction.

Then, during this period of the judge considering the case, Obama began issuing green cards to people under his amnesty program.

The judge was justifiably angry. He had been lied to and tricked by the Obama Administration.

And then Obama's gangsters got even more brazen. Once the judge issued his injunction, they decided they'd issue even more green cards.

Now he wants these bastards to stand before him, in person, and explain why they should not be held in contempt.

Hanen called the Obama administration's response to his Feb. 16 injunction "unacceptable" and "unprofessional." He also stated that he is "shocked and surprised at the cavalier attitude the Government has taken" towards it.

At issue is the federal government's failure to clear up why DHS issued 2,000 work permits to illegal aliens even after the injunction was in place. The Justice Department made that announcement in May, but DHS and its sub-agencies have not yet explained why applications for the permits were approved.

Hanen says that the government must answer that question to his satisfaction by the end of the month or else appear in his court on Aug. 19.

"Each individual Defendant must attend and be prepared to show why he or she should not be held in contempt of Court," Hanen ordered.

The list of defendants includes DHS' Johnson as well as the heads of Customs and Border Protection, U.S. Immigration and Customs Enforcement, and U.S. Citizenship and Immigration Services.

"In addition to the individual Defendants, the Government shall bring all relevant witnesses on this topic as the Court will not continue this matter to a later date," Hanen added.

I really do hope he just tosses them in jail.

There are multiple layers of protection to preclude executive officials from having to appear in front of the judiciary and I have no doubt this corrupt administration will use any and all defenses to keep from complying. Plus, if the judge enters a contempt order, the Justice Department would be the ones to enforce it - and do you really think this Justice Department under this President has any interest in administering "justice." Texas state judge might use the troopers but this federal court.


Federal judge would issue a bench warrant to the US Marshals. They have national jurisidiction and would arrest them where ever they are. And yes, the marshals are a division of DOJ, butit's not something DOJ has any say over. The warrant is a judicial order TO the Marshals for arrest of certain individuals. Failure to carry out would be contempt for the Marshals and be grounds for revocation of their authority as law enforcement.

Seriously, we live in Lawless America. The Judge can say whatever he wants, can issue whatever orders he wants. Until I see the heads of DHS and ICE on city gates frog-marched into a Federal penitentiary, I'm not going to believe anything is going to happen.

Meaning DOJ doesn't get to decide which warrants to act on and which warrants to ignore, there's no prosecutorial discretion because they're not being prosecuted, they're being arrested and hauled before the judge. Then the judge goes through the contempt proceedings.

I get your meaning that the DOJ could flat refuse to do their job, but if I'm a cantankerous judge, I'm going to issue a recommendation to the Texas law enforcement acceditation agency (state agency that gives reciprocity of authority to federal law enforcement) that the SPECIFIC agents tasked with the arrest of people on my bench warrant (likely people he knows in his courthouse) have their credentials revoked. In other words, you can be a marshal, but you can't be one in Texas.

Also this: that warrant will go into a national warrant database that will show those people have outstanding warrants where ever they go. If you getpulled over for a broken brake light you'll get a warrant check run on you. If it hits, you get arrested on the spot. It also messes with background searches, security clearances. The point is, it's gonna screw with their lives in a very personal way. Better to just face the damned judge.

The House of Representatives has a jail, too.

If someone refuses to testify before the House when summoned to do so, the House Sergeant at Arms can be commanded to take those individuals into physical custody. I believe that the Sergeant is able to invoke federal marshals in that process.

Of course, with the House being run by a crying orange drunk who placidly sells out his country for a coveted ride on Air Force One, the cells aren't going to be being used for any Lois Lerner types any time soon.

There was a piece I had read two weeks or so ago by a financial analyst, this being even *before* Greece defaulted and China blew up, who was noting weird divergences in global markets between asset classes that normally have strong correlations.

This analyst was speculating that one of the big global banking houses had incurred a massive derivatives accident. And that there was an ugly unwinding of a bunch of complicated positions going on, a process that was not entirely under control.

Did he name the President as a party? I didn't see that. More likely he's going after the exact people who issued the action in defiance of the judge's order. Now, if they get on the witness stand and say "the president told me to do it" things get more interesting.

As for enforcing the order, the judge can at a minimum put the marshals in the position of choosing between aiding someone who's defied a valid order (their bosses) or defying a valid order themselves. I'm betting there's a few marshals willing to do their job and not go to jail on behalf of their bosses.

Federal bailiffs are employees of the Marshalls, I don't know that a bailiff has any power outside the courtroom - which is a good reason why these Obama admin folks will NOT show up in the courtroom.


If they don't show up and the Judge finds them in contempt, he can order that they be brought before him or jailed or whatever he wants to do - you and me, they would come get us and jail us. They aren't going to go get any Obama admin official from Washington or even anywhere in Texas.

These big-name government officials can be arrested at their homes, or if at a traffic stop, upon failing the warrant check. It could happen; it may not due to political forces, but the federal judges have power to do this. It's just a question of "will" down the line.

Behold the majesty of the US reduced to a Third World/Second World country, lawless, corrupt, and racist. And don't beclown yourself pretending to believe that Judge Hanen's actions are in fact proof that rule of law still exists. Uh uh.

The Congress, given the power by the constitution to oversee all these matters, has refused to use its power to force (that is spelled "force") the executive to not violate the laws. In this case they have specifically hidden behind the federal court being discussed here as an excuse for inaction.

And one federal judge's adherence to law, common sense, and his responsibilities are a meaningless blip, more a reminder of how lawless things are than a sign that the rule of law still breathes. Sanctuary cities. Massive, ongoing illegal immigration, unchecked, undiscouraged, and as we may have documentation for before too long (central American unaccompanied minors wave), actively *encouraged*. Mass release of dangerous felon illegals into the population. Systematic (illegal) refusal to enforce immigration and related laws at all levels, so many different areas it's hard to catalogue them.

But mentioning the epidemic serious criminality inherent in mass illegal immigration is socially unacceptable. And the GOP in the Beltway is focused on getting a highway bill passed. And the most disastrous outrageous (open-eyed) foreign policy catastrophe in US history is a-birthing as we speak.

Not a serious country. And as ace notes, not America - not in a positive, historically meaningful sense.

291 The problem with a contempt citation is it would probably just be a fine that the taxpayers would end up paying anyway, or more precisely, the absurdity of the federal government (the judge) levying a fine against the federal government (the defendant) which presumably gets deposited in the federal treasury.

If they do not show, I would imagine that Judge Hanan would issue a bench warrant and have federal marshals arrest them. At least that is what I would hope to see.

300 I've heard from a friend who used to work in law enforcement that a contempt-of-court charge against a cabinet secretary is a big deal for another reason.

He said it would also inhibit that department's ability to participate in trials in that court, resulting in a lot of dismissals and default judgements where that department is concerned.

This is why, for example, Eric Holder was forced to go and kiss the ass of that one circuit court judge who threatened him with a contempt charge a couple of years ago. If the DoJ couldn't fully participate in trials in that circuit, that would be problematic.

I don't know all the details of how it works or anything, but that's the basic gist of it. And we're talking about the Southern Texas District Court, here, which is a place that probably processes more lawsuits against DHS than most other districts would. Add in the factor of what they call "judge-shopping" and, well, I would expect law firms based in southern Texas to get a lot of new business.

So, I do expect the officials named in this order to take it seriously. To do otherwise would make it a lot harder for them to do their jobs. Or, perhaps more accurately, it would make it much harder for them to exercise their bureaucratic powers.

The Obama Administration is not just commies, they're Chicago MAFIA commies -- as wicked as Lenin and Al Capone combined. Most folks they just blackmail (hence the neutered GOP). But the ones who can't be suppressed, like Breitbart, they murder.
