Oregon's Fascist Gag Order on Sweet Cakes by Melissa

Amy Otto discusses it at the Federalist.

After bankrupting this business and driving it out of business, the Gay Fascism Movement in Oregon isn't quite done with Sweet Cakes by Melissa yet.

"This case is not about a wedding cake or a marriage," Avakian wrote. "It is about a business's refusal to serve someone because of their sexual orientation. Under Oregon law, that is illegal."

In the ruling, Avakian placed an effective gag order on the Kleins, ordering them to "cease and desist" from speaking publicly about not wanting to bake cakes for same-sex weddings based on their Christian beliefs.

Do you know why Avakian did this?

It's because other victims of the Gay Fascism Movement have gotten some amount of public support -- donations, business -- to help them out in their battle against the Gay Fascism Movement.

So Avakian has decreed: Your First Amendment rights to advertise yourself and play for public sympathy are herewith abolished.

While Sweet Mellissa's was driven out of business, they have started an internet-based bakery.

Look at their homepage -- I assume this homepage is written in such a way as to comply with Avakian's lawlesss order. They have a pair of wedding rings at the top of the page -- but they do not say why they are selling baked goods online, as opposed to the normal method of doing so.

They allude to it here:

We here at Sweet Cakes strongly believe that when a man and woman come together to be joined as one, it is truly one of the most special days of their lives, we feel truely honored when we are chosen to do the cake for your special day.

But they can't quite say it -- not without going to jail or suffering another huge fine.

Avakian doesn't want them talking about that. He doesn't want Christian sympathizers to buy cakes from them, and thereby diminish their state-ordered pain.

He is determined that the state of Oregon shall beggar them and they shall remain beggared -- so they don't get to talk about their principled refusal to bake cakes for gay weddings, nor solicit business on that basis.

This is, obviously, anti-American and vengefully Stalinist.

But this is the New Order, isn't it?

Oh by the way the proprietors of Sweet Cakes "mentally raped" the Gay Fascist couple.

Not true. First, most litigation gets dragged out due to disputes over facts. Here, however, the facts are not disputed - in fact, they are clearly set forth in the state agency's order. So the only dispute is a legal one, and therefore easily amenable to a summary judgment motion. Second, if they sue in federal court under 42 USC 1983 (which permits redress for constitutional violations), and they win, they would be entitled to recover their attorney's fees from Oregon.

I decided to google Oregon Human Rights Laws, Civil Rights, etc. The Federal laws are the only thing that seem to apply to employers, the State laws apply to employees and customers. Apparently the State is within its rights to do all of this, with the only appeal being to the Federal laws, esp. as regards Religious Conscience or Objections. So.... screwed.

It's not just in these kinds of cases. The feds sue google all the time and then gag them so they can't tell anyone that the feds were on a fishing expedition looking through peoples emails.

I'm just talking about the gag order. The State has the right to impose fines for violating State law, and if they do it via an agency decision and not a lawsuit then that's fine too. What I don't get is that, typically, a fine is levied by an impartial Administrative Law Judge, not the head of the agency, who was placed there to enforce the law. Weird stuff all around.

Avakian re-inserted the language all on his own. The part of the Oregon law he used as pretext is totally unconstitutional per Brandenburg v Ohio and Hess v Indiana. The definition of gag order doesn't change based on the entity issuing it. Administrative agencies issue orders all the time. But this would be the first time I've heard of one being issued in connection with a little civil rights claim and issued by an agency head as opposed to an impartial ALJ.

Actually, a lot of his appearances in the show are stock footage-- the shot of him at the helm with the viewscreen ahead? It's one shot, reused a lot of times to standardize the special effects matte used to put things on the screen. In part of that loop he turns back and look toward the Captain's chair, but it's the same footage throughout the series.

One hears anecdotal stuff here in the comments lately, to the effect that "this has gone too far". Meh. Even if true, not material to anything of importance.

It takes actual Americans to keep something as historically odd as America going. Mindset, values, understanding. Not much of that any more. And almost none of it in broad sectors - not just the "left" but, obviously, the bulk of the populace. Otherwise - no Obama, no collapse of constitutional rule on practically all fronts, etc.

If something doesn't concretely, immediately affect someone these days, it doesn't exist. There won't be any camps, or any hot civil war, or any of that stuff people here are always speculating about. But if there were - unless, again, the shooting or detentions were taking place next door, or to softball buddies or business partners - yawn. Anyone with an historically American mindset today is, truly, almost alone in this country.

I must say I have never heard my priests talk like that. They speak out against abortion and for religious freedom and everyone once in a while (not all the time - but often enough) we get "lectures" about avoiding sin.

I'm involved in a lawsuit with WA state DNR. I bought the property in 2008 and was never involved in the lease in 2002 or dock. I've been told that I can't claim the dock as I didn't do it when the suit started, but I wasn't part of the original suit. State law says I can have a dock, but DNR disagrees. And they want me to be liable to remove the dock I don't have that's not on my property. The court will twist itself in knots trying to do what the state wants. Thank you, that was a $20k legal expenses education.

It also wouldn't surprise me that, in this case, it wasn't a setup. It's one thing to do it just to prove a point, it's another to do it for $100K.

What an odd thing to say during a church service. Our ultimate loyalty to to Christ and the kingdom of God, but there is nothing against being a good citizen. In the bible confirms this. I must say I have talked about politics more during Obama's presidency than I have before (without ever telling them who to vote for or who i have voted for), but it's always in context of threats against the rights of Christians here and abroad. We always always pray- as we did yesterday- for the protraction and blessing of our country- and that our leaders would gain wisdom and a desire to serve more than be served.

I agree that charity is necessary, but I think the many parish priests (in my area, at least) have fetishized helping the 'poor' to the exclusion of all other considerations, and largely this is out of reluctance to take stands on issues which may be unpopular.

Sermonizing on helping the poor is a safe thing to do. Nobody will object. So every week becomes homilies about helping the poor.

478 I don't preach all that much on helping the poor unless it's in the context of the Biblical passage-and yes, the prophets talk a lot about the poor and money as does Jesus, but they didn't live in a form of government like ours. Also the talk is related to private charity and against rulers who rob the poor because of their excesses (Obama needs a little visit from a prophet. ;^)).Also, when I do it's about giving donations to the food pantry or contributing donations so that kids can have backpacks for school, etc. It's for specific causes. It's also related to our denominational outreach which has a good record for helping out after humanitarian crisis.

Yesterday sermon was about the Lord's Prayer and since it was Holy Communion it was about the larger meaning of "Give us this day our daily bread' and Jesus himself being the bread of life.

Humans are different from most other mammals in that women don't go into heat. A female in heat pretty much brings every male of its species in the area calling for most mammals.
