Politically Corrupt, Devoutly Anti-American Supreme Court Reaches Randomly Into Its Grab-Bag of "What's Hot" and "What's Not" Rulings, Puts Texas Abortion Restrictions on Hold
Update: "Gay Reparations?"

This isn't a full ruling on the merits, but rather a restraining order to keep the situation in place while the Supreme Court has a nine-man political debate about it and Elects a New Law.

The part of the Texas law being estopped is always the one I thought was most problematic and likely to result in court action -- the one that basically shutters abortion clinics, I think the ones where they have no doctor on staff with privileges at a nearby hospital.

Although sold as a "health" measure, I think it's pretty obviously put in there to keep the number of abortion clinics low, which may be a problem.

But the Supreme Court is basically spinning the Wheel of Made-Up Law lately, randomly guessing the consonants and letters that will spell out its opinions, so who knows.

And yes, Obama solicitor general David Verelli has already admitted that tax exemptions for religious institutions opposed to gay marriage are officially under jeopardy under the Supreme Court's latest lawmaking without the consent of the governed, so you have that to look forward to.

BTW, a guy I trust says that he was speaking to an informed source on the Gay Marriage side of things, and he says that "gay reparations" are going to be a live issue in 2016, and something that all candidates will have to take a position on.

Well, yes, but then again: no.

The law pretty specifically raises the health standards of abortion clinics to that of any ambulatory surgery center. Those would be centers that do things like removing your tonsils and other minor procedures.

Yes, the law was written knowing that most abortion clinics don't hold themselves to that standard. Yes, the law was written knowing that many/most abortion clinics would not be able to afford the change.

No, it was not actually specifically *to* shutter abortion clinics. That was just a really nice bonus.

I prefer by county because that is the best organized sub-state division of political power. By municipality isn't - and for large cities, they should nearly always be a county themselves.

I can't make up my mind on this myself. I was thinking about selling some off when they were up (as they were down last I checked) but I don't know that that's happening anytime soon.

There are nail salons that are regulated more heavily for health codes than abortion clinics. I wish that was hyperbole, believe me I wish that was. Gosnell might have been an outlier but I bet there is at least one clinic in every state that is a fright health wise.

The first girl killed or maimed because she went to an unsafe abortion clinic in TX, better be splashed on the front pages. It's what the left would do. Personalize the victims, like the left tried to do with the fake rape cases. Make people know their faces.

86 I haven't seen the exact text of the TX regulations, and I don't trust the WaPo to tell the truth about anything. However, it is not uncommon to require physicians who perform certain types of office surgery to either have privileges at a nearby hospital for the same procedure, or to have a transfer agreement in place with a nearby hospital so they can get a patient there promptly if things go south.

No, it is indeed a health measure. I've had a D&C before for a missed miscarriage. It was performed at an ambulatory surgical clinic by my OBGYN who had admitting privileges at the hospital across the street. I was put under by a board certified anesthesiologist, was under the care of a nursing staff and my doctor, and was watched in recovery for an hour by an RN.

Contrast with the same procedure at Abortions R Us where a doctor, with no OBGYN training at all, can do the procedure in a converted store front with halls too narrow for a gurney and with a "team" of "medical professionals" without so much as an LVN. Said doctor has no admitting privileges, and if the patient has a complication, has no recourse but to call 911 and hope for the best.

Anyway, assuming licensing and all they'll likely be able to admitting privileges somewhere honestly. (Now there is a side issue that is entirely unrelated to this where hospitals are dumping admitting privileges for anyone who isn't their employee, but that's not incredibly wide spread yet.)

Every other doctor performing every other type of surgery (including, as I mentioned the *exact same surgery*) is required to have admitting privileges. There is absolutely no reason that abortionists should be exempt from this requirement.

1. So? The intent doesn't matter. The regulation is a reasonable one and I bet dollars to donuts it's one that is applied to other invasive medical procedures with a high risk of hemorrhaging.

2. Aren't these sorts of regulations handled locally for all other things? Why does the Fed Govt need to get involved?

I am really baffled that anyone who is conservative doesn't get ticked off when the Feds want to poke their nose into local regulations on something like this.

For one thing, a handful of abortion clinics already met the increased health standards. Okay, it's like 7 in the whole state, but still- that does prove that "Hospitals won't give an abortionist admitting privileges" doesn't apply.

For another, if you're at an ambulatory surgery center, they're usually near the hospital already- sometimes literally across the street or adjacent, sometimes even in the same facility, just a different wing. Abortion providers, however, have to call 9/11 if something is wrong. When seconds count, the ambulance is only minutes away.

Finally, though related to the second point, a lot of abortion clinics are not big enough - their doors and halls are not wide enough for gurneys and so forth, so when there is a problem, they're reduced to man-portable boards. And that's once the ambulance does arrive.

So, yes, such health requirements will shutter abortion clinics. Considering the fact you're going in for major surgery with chance of life-threatening complications, I'm prepared to be okay with that.

The reporter actually asked them if they were happy to be getting the benefits offered with marriage now. One just quietly said, Uh huh.

So two men, in their fifties at least, are getting married . Why? So one can claim the other's SS benefits when he dies and his pension if he has one.

I would have loved for the reporter to have asked them how their lives will be different in two days now that they have a piece of paper and some judge or unitarian minister blesses their "union".

If SS wasn't insolvent before , imagine the hole it's going into now.

Not a lawyer here, but this doesn't fix the property tax issue. Most of the property tax exemptions at the state and municipal level seem to rest of the 501c3 status granted by the Feds.

Yes, you have to be licensed in the state you are practicing in. Some doctors hold license in mulitple states, but it's not typical because of the expense of continuing education requirements, relicensing etc.

Typical abortion clinics hire the bottom of the barrel medical school graduates who have not been invited into a practice or residents who are moonlighting to make some money.

I've been to enough black churches to know that if they have to fall in line, most of them will fall in line. The ones that don't will be utterly ignored by the MSM and won't be harassed by the IRS in any way, in any case, just like the mosques that won't perform abominations.

510 I know one thing for sure. The largest welfare zones in any major
city, where the majority of residents who aren't receiving some form
of govt handout are either criminals or on probation aren't exactly
hotbeds of conservatism. No need to go sifting through govt. data and
election results. Just go hang around any neighborhood or apartment
complex and do the research first hand. Report back what you find, if
you live to tell about it.

519 The Supreme Court is a political body that acts as a de facto legislature...an unelected Super Parliament. As such, its members should stand for elections. If the essence of tyranny is rule without the consent of the governed, the court seems to fit the bill. Yes, the Justices are appointed and confirmed by elected officials, but they serve for life and there are no effective checks and balances to the Court. The idea of an impartial court that would rule on the constitutionality of legislation is good on paper, but in practice that is not how things are working out. Let's drop the pretense and elect these holier than thou dictators. The only thing worse than an Imperial Executive is an Imperial Court, cloaked in a fake mantle of impartiality.
