Andy McCarthy: It's Time To Give Up on the Supreme Court as a Court

Here former federal prosecutor Andy McCarthy argues that we should just admit that the Supreme Court has now become a supra-legislature and treat it as such.

Did you notice that there was not an iota of speculation about how the four Progressive justices would vote?

There was never a shadow of a doubt. In the plethora of opinions generated by these three cases, there is not a single one authored by Ruth Bader Ginsburg, Stephen Breyer, Elena Kagan, or Sonia Sotomayor. There was no need. They are the Left's voting bloc. There was a better chance that the sun would not rise this morning than that any of them would wander off the reservation.

...And it is not so much that they move in lockstep. It is that no one expects them to do anything but move in lockstep - not their fellow justices, not the political branches, and certainly not the commentariat, right or left.

It is simply accepted that these justices are not there to judge. They are there to vote. They get to the desired outcome the same way disparate-impact voodoo always manages to get to discrimination: Start at the end and work backwards. Guiding precedents are for the quaint business of administering justice. In the social justice business, the road never before traveled will do if one less traveled is unavailable. But there's a problem. Once it has become a given that a critical mass of the Supreme Court is no longer expected, much less obliged, to do law, then the Court is no longer a legal institution. It is a political institution.

So forget Constitutional strict constructionalism and all that and simply strive to get conservative electors into our third legislative body to start voting against the progressive bloc.

John Hinderaker of Power Line suggests that if we're now in a post-constitutional era, the conservative justices should start discovering new 'fundamental rights' more to our side's liking:

For example, how about a "fundamental right" not to pay income taxes in a percentage exceeding that which other Americans are charged? Why isn't the progressive income tax a violation of the equal protection clause? That is a much stronger argument than the one the Court has just accepted on gay marriage. Or, how about a theory that the Internal Revenue Service is violating Americans' right of privacy-that same right of privacy that the Court found among the emanations and penumbras of the Constitution's actual provisions-in seeking extensive information about taxpayers' finances?

Or how about a fundamental right to affordable energy-or, rather, to be free of government policies that unreasonably raise the cost of energy? If the Supreme Court discovered such a right, the EPA's anti-coal regulations would be unconstitutional. You could write a decision in support of such a "fundamental right" that would be at least as persuasive as Justice Kennedy's "fortune cookie" travesty. What is more fundamental than heating your home and driving your car? To paraphrase Justice Kennedy, what if a voice cries out in the night, saying, "Honey! Can you turn the heat up?"

If conservatives are willing to abandon the archaic notion that the Supreme Court is a court and not a super-legislature, there is no telling what conservative policies might be advanced.

Post-Obergefell, Dissent Is Now The Highest Form Of Bigotry

I thought about this in the aftermath of the Supreme Court's decision in Obergefell v. Hodges, especially when a friend alerted me that the editors of The Patriot-News of Harrisburg, PA, had declared, within minutes of the announcement of the decision: "As a result of Friday's ruling, PennLive/The Patriot-News will no longer accept, nor will it print, op-Eds and letters to the editor in opposition to same-sex marriage."

In a tweet later in the morning, the paper's Editorial and Opinions Editor John L. Micek (until recently a state capitol reporter-yikes!) explained himself curtly: "This is not hard: We would not print racist, sexist or anti-Semitic letters. To that, we add homophobic ones. Pretty simple."

...This is why it was important for the LGBT movement that same-sex marriage be affirmed by the high court rather than piecemeal in the states: Statutes are contingent and temporary, dependent on shifting allegiances and majorities; the Supreme Court is permanent, accountable to no one. The people and our elected representatives are subjective and unreliable; the Supreme Court is objective and irrefutable.

The Patriot-News isn't censoring bigotry. If it were, it would have been rejecting anti-same-sex marriage letters yesterday as well as today. It is censoring dissent-dissent from the new orthodoxy proclaimed by our secular Magisterium, dissent from the prevailing viewpoint of our oligarchs, dissent from the state. And we are to conform ourselves to this orthodoxy not because it is good, but because the state so ordains it.

The Patriot-News later backed off a bit and said that they will allow letters with wrong-think about gay marriage for a limited amount of time.

The Greek government called for a referendum on July 5th on whether to accept the ECB bailout terms or leave the Euro. But events may be already overtaking their plans.

Greece has moved to close its banks and impose capital controls to prevent financial chaos following the breakdown of bailout talks with its international creditors. What It's Like to Be in the Blue Man Group

In the smaller shows there is typically seven full time guys. In the bigger shows, like Vegas, there are upwards of nine guys full time. The reason is because we do so many shows. In New York, the typical Broadway run is eight shows a week, and we will often do much more than that. On a slow week we'll do 12, and on a high week we can do upwards of 20. So we need those extra guys to do those shows. This is also another reason why guys stick around for so long, because there is less of a grind that way. There will be slow weeks and you can take leaves of absence to do other artworks. Its just a much more stable, supportive environment that way. And for a theater gig. it was 12 years with 401K, full benefits for me, my wife, and my kid, a really stable setup.
So immediately after the show, we go and clean up a little bit. And this has been a really important part of the show since the beginning, we go and meet the audience as they're leaving the theater. That's a really special part of the show too, or one that I've always enjoyed because you can shed the character slightly. We always talk about that it's 80 percent  Blue Man and 20 percent just yourself at that point. So if someone comes to you and says, 'That show meant so much to me,' you can very quietly say, 'Thanks a lot.' We're not the hardcore character in that moment even though we're still in make up.

The point of that part is so that the person right next to you can have that connection, but the person across the room still just sees a Blue Man. ...So that's about 15-20 minutes. Then we go downstairs, and as we're getting out of makeup, in this other important Blue Man tradition, we have about a 20 minute conversation with the stage manager of the night and the band. We talk about all these different parts of the show. And this is why, again, that guys can stay in it for so long, because it is always, always, always considered a work in progress. There's always stuff that can be done better. Just because there's a guy who's been doing it for 12 or 15 or 16 years, doesn't give them any kind of 'Get Out of Jail Free' card. We're working on stuff day-to-day just as much as trainees are basically.

Sad News at Casa Maetenloch

On Friday we had to put one of our cats to sleep due at aggressive liver cancer. We had Kitty for 9 years but he was already 5 to 8 years old when we rescued him from living (unhappily) under a neighbor's back porch so he was an old cat. He had a very happy life during that time and even his final hours with us in the garden were as happy as they could be given his condition.

After we had had him for a while Mrs. Maetenloch demanded that he be given a real, official name so I dubbed him Kittybot Cougar Unit12. She was not exactly pleased with this. So he became known as Kitty to friends and family and Cougar to outsiders.

He was a good-natured cat who truly loved to be with us and people in general. He was happiest just being wherever humans were and would follow us from room to room to hang out. In fact many an ONT was created with Kitty sleeping at the base of my desk. From waiting in the bathroom in the morning while we got ready for work to greeting us at door when we got home to sleeping in our bed at night, he was a constant happy presence in our lives for nine years. And now we have a Kitty-sized hole in our lives.

RIP Kitty, a good loving cat.

40 Don't worry, it's all good, but the governor of Puerto Rico just announced they're defaulting on about $72B worth of debt. That should have a nice effect on the municipal bond market (which we're told is rock solid, nothing to worry about....hah). Oh, don't worry, they can't legally default, but they can not pay.

It's a nice time to make that little announcement with the GreeceFire getting started. Maybe no one will notice.

One thing I was sure of was the efforts of the Fed and everyone else to "save" the markets was going to lead to an even bigger crash. I just didn't know when and how long the illusion would last. This may be the start, but I'm not sure. We'll know soon enough.

Last year , their Federal level judge blocked a lawsuit or some such thing to legalize gay marriage. And because they are a territory and not a state, our Federal statutes are not binding on them.

Second, take both the WH and broader cultural reactions to things, incl. the ridiculous Confederate flag hysteria.

This WH, already degraded in so many ways the last few years, has reached a new low. Rainbow fucking lighting? Are you fucking kidding me? Has the WH - ever, under any president - engaged in cheap theatrics with the property itself to spike the ball, much less on an outrageous bit of arrogant judicial tyranny to impose a lawless, unneeded and mostly unwanted bit of social engineering? (leave alone that the president at the time conspicuously opposed this bit of social engineering until quite recently)

And the flag thing? WTF? 177 So, about 2:00 today, I'm over BSing with my IRL neighbor -- who, BTW, seems to regard me in about the same light as I am regarded by the Horde ("Is there an off switch? Or at least a pause button?") -- anyway, I'm standing out in the street interrupting his ability to get anything done, and we hear a brief screech, followed by an impact, a block away to our south.




I immediately leaped into action and started sprinting toward the scene like a veritable gazelle.....if such a gazelle were an unathletic overupholstered creaky guy in his fifties that would leave lions thinking, "let's save that one for if I ever break a leg or something."



I got to the scene of the accident and ascertained that nobody was seriously hurt, mostly by running up to the calm conversation they were having and shouting "ANYBODY HURT?!? ANYBODY HURT?!?" at the top of my lungs. I then asked whether they would appreciate the attention of the local constabulary -- who could, at the very least, keep fat weirdos from huffing and puffing up to their conversations and screaming at them. They readily agreed that might be a proper course of action.




So I called the non-emergency line and got someone dispatched to the scene. It's actually a dangerous intersection because the through road isn't supposed to be fast but people drive it that way, and the cross road only has yield signs. I think this is actually the second accident in a week.




While the po-po were advancin' on the hood, yo, I went to get a pushbroom, dustpan, and garbage container -- figuring that the intersection was dangerous enough without the possibility of getting a flat while crossing it. The policeman arrived just as I got everything together and I asked him if he wanted to inspect anything or make measurements before I started. He said, "no, but you don't have to do that." While he was taking statements and making notes, I got everything sweeped and binned.




I then pointed out to one of those involved that they'd compromised the crumple zone on the front driver's side and that they needed to make sure that the repair didn't just reskin over it because then the driver would be unprotected in the event of another front end crash. The policeman later noted that they should have the airbag inspected because it possibly should have deployed.......and may be hanging on a hair-trigger.




So, anyway, that's part of the gripping excitement that is The Life of Cthulhu.

I was tasked to type a PDF of what I wouldn't know how to descrbe, but a complete *script,* of how prosecutors examine police officers in DUI cases. Turns out it's literally as down-pat as Shakespeare. Complete with "now Mr. DA, you say this, and Mr. Officer, you say that..."

I support DUI laws, but it's gone way beyond obvious that it's also a huge moneymaker for the cities, counties, states and Feds. And of course just the tip of the iceberg.

See the ridiculous SF gun law case, recently passed over for consideration by SCOTUS, and see Thomas' comments on this refusal to grant cert. See DC's barely-concealed defiance in actually implementing Heller.

Just one of the situations you rightly cited - but when you consider these and other fairly odd indications that the system is NOT working within Heller/McDonald, as usually happens after big cases, and also that (contra this absurd rabbit-out-of-a-hat marriage decision based on the 14th) the 2A cases are factually clear-cut AND revolve around an express limitation on govt. set forth in the constitution .... well ...

If DUI were about anything reasonable they wouldn't be arresting guys riding lawn mowers. BTW, you know that it's legal in many states for cops to come onto your property while your riding your lawn mower drinking a beer and arrest you, for mowing the lawn on YOUR property with a beer. ... and golf carts and the whole lot. And, frankly, anyone who arrests, tries, or in any way participates in these offenses against normal society is far more of a dangerous criminal than any actual drunk driver.

The UK funded a meticulous study a few years ago which found that the majority of drivers actually became safer when mildly inebriated. They recognized their state, slowed down, maintained wider distances from other vehicles, declined to accelerate through changing lights at intersections, et cet.

This did not comport with what the political class desired as policy, so the study was immediately buried.

The study found there is (as one would naturally expect) a tipping point where further intoxication does begin to impair the safe driving of the majority of drivers. That point is higher than the 0.08 standard which the US and UK now employ.

A retired cop who taught a traffic school class which I attended talked to me off the record about DUI and BAC. He said that there are *so* many drivers out there clocking 0.08 that if it really were reliably correlated with driving danger, there would be mass slaughter on the roads every night.

They aren't after the churches for income tax, it's property taxes that they want to hit them with.

Why? There are a crapton of churches located on very valuable property in liberal shithold cities. Couple that with all the things the church has in it used for its services that can be taxed as "machinery" or furniture, and you get another assload of money.

The Left isn't thinking of the Feds getting the money but their allies in local governments that have a want for that cash.

Yep. People know that the chances of anyone getting into an accident is very, very low - even if they're drunk as hell. But they take one or two accidents and blow them out of proportion, making people think that if you get in a car drunk, in any way, you're almost guaranteed to get into a fatal accident. And that's just obvious bullshit. But they need to make it sound so immediate and grave so that they can arrest everyone drinking within earshot of any "motorized vehicle" (to a scooter) and can put up un-Constitutional random roadblocks to search all of us ...

I'm weird, I've never been a pet person. Probably because of my OCD, which of course leads to my severe distaste at even the thought of having to clean up a litter box or other varieties of dander. (I often joke to my family, I'll get a pet as soon as they invent one that doesn't poop.)

The older I get though, I can definitely understand why people love their pets, especially big shaggy friendly dogs. ;-)

Now, a legitimate complaint is the doubling of fines in "construction zones", then putting vacant work sites up and down the freeway to git you for that.

I have a cat story I've maybe told here before, but I think it's worth sharing again.

We came home from a trip, neighbor was taking care of our 20 yo cat. Wife goes in first and says "Sally is dead"!

I find the cat under the coffee table, cold and not breathing. Go out back and dig a hole to bury her. As I pick her up and get to the back door I hear a gasp.

We decide is the death gasp, air expelling from a dead body. I place her in the grave. When she is laid on the cold ground her legs start to move!

Bring her back in and pet her, she seems to respond, now I can see her breathing.

After a bit I realize it's time to let her go and stop petting her. She died a few minutes later.

It was amazing, my touch brought her back from near death, she was waiting for us. And once I let her go she passed. It was very weird.

275 Absolutely agree that DUI laws are abused, but in my senior year of high school, I lost two friends to a couple of drag racing drunk drivers.

They literally peeled Regina off the steering wheel. She was 16.

Chris died when they took her off of life support after several years in a coma. She was 15 t the time of the "accident"

Diane got away with a crushed pelvis, 12 broken ribs, broken left shoulder, elbow and wrist, a broken jaw and crushed left orbital socket. Also 15.

I have no doubt that the drag racing is ultimately what did the damage ( 110 on impact) but the drinking impaired their judgement. They had been pulled over earlier that night, and since they said they were going right home, the cops let them go with a warning.

Getting your license taken away won't stop a drunk from driving. Probably 5-10% of the people on the road have no license or are driving on a suspended license, and they don't care.

Several years ago, a woman was drunk as shit and killed a highway worker on her way home. During the lead up to her trial, she was not allowed to use alcohol or drugs and would be given breathalyzer tests, she failed them and was put into jail until her trial. She is found guilty and sentenced, she gets paroled. Several months later a motorist calls the police about someone weaving all over the road. Cops stop the car, and it is her, drunk as shit. Now she may be going back to the slammer, but who knows with the court system.

Guy I worked with 20 years ago decided not to pay a speeding ticket. Months later, his license was suspended. One morning on his way home from work, he decided to stop and get a biscuit at Hardees, his car smoked so bad that you could see it coming for miles. A cop was behind him at Hardee's and decided to pull him over to tell him to get it fixed. Cop finds out that his license is suspended, he gets 30 days in jail.

BTW, if he had been pulled over 2 weeks earlier, he would have gotten a warning, but a car dealer's son had been killed by a drunk driving on a suspended license 10 days earlier, so the local cops were cracking down big time.

The initial ticket the vet got cost like $125 face value, but after all the extra fees and such were added the ticket price jumped to near $400. Now I know everyone here has $400 cash lying around for such an event, but rest assured much of the rest of the country don't. They buy everything on time, and their check is gone as soon as they get it.

So in a month, you don't have the near $400 to pay when due, so then they tack on ANOTHER $375 to that ticket.

aaaand that's when the trouble started...

Yeah, that sounds like a fair and just system to me. But hey what do I know.

PERFECT! How did I not think of that??

They're about 5 weeks old, that should be just right. They're on our back deck, and are at that optimum cute kitty age where they run all about and are learning to pounce and are in fact climbing the stucco walls of our house..

Then there are the teeny wee dumplings on the front porch, just three weeks and so precious and sweet that you all but die of adorableness when you look at them.

And fat! Is that normal? I am not feeding them at all, they are still nursing.

Have you tried sand or dirt? My best years of my childhood was having my own sandbox and digging cat scat out of it over and over again, so I know kitties love sand.

I have a cat story I've maybe told here before, but I think it's worth sharing again.

We came home from a trip, neighbor was taking care of our 20 yo cat. Wife goes in first and says "Sally is dead"!

I find the cat under the coffee table, cold and not breathing. Go out back and dig a hole to bury her. As I pick her up and get to the back door I hear a gasp.

We decide is the death gasp, air expelling from a dead body. I place her in the grave. When she is laid on the cold ground her legs start to move!

Bring her back in and pet her, she seems to respond, now I can see her breathing.

After a bit I realize it's time to let her go and stop petting her. She died a few minutes later.

It was amazing, my touch brought her back from near death, she was waiting for us. And once I let her go she passed. It was very weird.

I have attended two human deaths -- my grandfather and the fiancee's mother -- where medicine was not enough to keep someone alive.....but they lived until their loved ones were near.




And, not able to move a muscle and in terrible straits, their loved ones held their hand and said out loud, something like "I'd keep you with me forever, but not at this cost." Moments later, they were gone. These were in ICUs, but there were nurses nearby. There was no medical explanation as to why they lived so long; there was no medical explanation as to when they passed. The two situations were 3000 miles apart, and I was the only person at both.

Now now, driving is a privilege and there are base expenses for having a car, and having cash or credit to cover a fine is one of them. In an era of potential $100 fill-ups, having access to a potential fine is prudent. Don't/can't do that? Then live on the edge or get a bus pass.

And the guy in question skipped a court date, let the fines go to collections and so on. Again, not paying what the government wants from you rarely ends well.

328 My brother once got a ticket for speeding. i can't recall exactly what the acts were but IIRC what happened was he passed a rookie cop who pulled out, pulled him over and said he could just "tell" that my brother was speeding and was giving him a ticket for 5 miles over the posted. My brother, ever the calm one, argued and got hotter and hotter, (the rookie cop admitted he did not even have a radar gun). Finally my brother signed the ticket, te cop steped behind my brother's car and my brother pulled out into traffic, pulling out and buckling his seatbelt as he went. Yep, the cop jumped in his car and pulled him over for driving on a public road without his seatbelt fastened. My brother refused to pay that one and I believe actually avoided the warrent until it expired.

Clay litter is not harmful to baby kittahs but if you want to litter train them, I would start with a container that is short enough for them to get into (a regular litter pan is like Mt. Everest when your legs are only four or five inches long)

I had a similar experience w/ my maternal Grandmother. She had a stroke, I was there maybe three days later.

She didn't react to anything but when I held her hand and told her I had on my hand the ring she gave me on my HS graduation she reacted.

It's tough losing these people, but it's just because they were so fantastic in contributing towards your life.

Savings or barter.... I will also pass on a tip from when I was uninsured. Treat medical care like any other purchase and compare prices by calling at least three doctors that can provide the service you need (when you can as this obviously won't work in an emergency). Most doctors will offer a discount for same day cash payment for services of between a third and half off of their normal prices. In an emergency, get the hospital care you need and then call the billing office afterward to see if they can offer you the same discount they would give an insurance company and to make arrangements to pay the bill in small monthly increments.

Took nearly an hour for the hospital to figure out what they would bill me. I asked for their lowest insurance rate. I asked the very nice woman struggling - and a bit embarrassed to be doing so - with this problem- "can you think of any other transaction you are ever part of where nobody knows the price? A plumber doing a repair call? Fixing a dented fender? A hair styling?" She actually got it - she said no, and that's bizarre.

So even back when I could (fairly easily) afford decent PPO "insurance" (haven't been able to since January 2014, by coincidence I guess), I have wondered how much "insurance" there was in the cost. I figure the actuarial cost + 3% profit (typical in the industry) for me was probably less than half of what I paid back then. The opposite, which we've been living and has now been made much worse, will have a similar impact in the other direction. My mother recently dislocated and broke her arm. The insurance plan she was forced on basically told her the nearest doctor she could see that they'd help pay for was in something like 70 or so miles away in another county.

Thankfully she can pay out of pocket, though the unplanned expenses won't have repercussions.

I was in a similar situation with a follow-up to an emergency room visit.

Obamacare = paying out of pocket for real medical attention.

They were sure that I had paid in full while I was there. Someone at corporate had "assumed" ... I had them annotate my account ... Anthem is no longer my insurer (and hasn't been since November 2013). I think we're square.

Why did Anthem still have my name and account?

That hasn't worked out so well -- people's reaction is to opt out and negotiate cash. I'm so pissed at anyone involved with Obamacare [AARP, various insurance] that I'll actually boycott their asses. Check the cost curves for medical areas with little to no insurance (elective cosmetic surgery and dermatology, etc.). Flat. Hmmm. Darndest thing.

Recall, ten thousand years ago (2008/9?), when some major corporations did what they could to reduce the needless financial waste (Von's/Safeway? One CEO did a WSJ op-ed on it). Reimbursement for costs for most minor things, employees encouraged to price shop. Rational, minimal self-insurance (company working with insurance company) for the larger stuff. I believe this company (ies) had experienced an abrupt end to rising medical costs, commencing immediately. And that was working *within* the artificially mangled medical finance system, overall.

Really gotta go, but I can never view the country the same way again. The economic illiteracy and lack of common sense that makes this O-care catastrophe - almost the exact opposite of everything that needed to be done - possible. And USMC, I think you're wrong - in the sense that "collapse" will not guarantee improvement.

Learning curve is flat.

Weird is that I'm finding that as I slouch towards decrepitude, the most sleep-inducing time of day is about a half hour before I have to get up. Sometimes I make a cup of coffee around 4:30AM and within a half hour, I can barely keep my eyes open. Best, if not shortest sleep ever!

I hate my job. I dread going to work. Except I like the actual work I do. I just hate my job.

And, I don't know that finding a new job would help. I am introverted, and I really just don't like being around people. And, I am not a fan of the structure of work hours.

I am a good worker, don't get me wrong. If someone said, "Here is your project. You have 40 hours this week, any 40 hours you choose, to get it done." I would be good as gold. But, to work within the confines of a 8-5 workday, around people....it just drives me batty.

Yeah sometimes it is the same with me, I will drink coffee and then get tired. and I looked it up, and there is actually a point where you can drink too much caffeine, and if that happens, you get sleepy.
But this time it was because I had tons of cr*p that I have to do today, plus, smoke alarm beeped saying battery was low, so that woke me up

Good Morning Morons. Today is Monday, June 29, 2015. On this day in 1956 the Federal Aid Highway Act of 1956 was signed, officially creating the United States Interstate Highway System. Eisenhower thought this law was probably unconstitutional but he had pressed for it. This was one major boondoggle from the government that I didn't think was unconstitutional because the Constitution provides for "post roads" which this could easily be said fell under that article.

But as one news story I linked to a while back said, Boeing had enough promised graft already to go decades. But that raises another question, do they still get their "promised" graft if there is no longer a bank there to give it?

She had one of her top canines stuck through her upper lip, and looked dead. I saw her move a little and stopped for her, postponing whatever I had planned that day. That's a reasonable response. Personally, I hope churches also begin counseling their members to forgo secular marriage altogether. Obtaining a marriage license could become a simple matter of expediency akin to how you arrange your 401K. Get a license if it puts money in your pocket, but that's the only consideration.

Their unfunded liabilities are astronomical, as well as some other States and cities. However, those are not even being considered now. The problem PR has, and CA originally had was they could not pay the debt or interest on their debt. They had a bunch of bonds coming due and could not pay them off.

These types of debts are much worse that the "unfunded liabilities". These are liabilities due now or default. Default has another name too, its called bankruptcy.


They had tried to float another series of bonds to pay the old ones but had no takers. So guess what, Democrat Congress passed a bill to buy their shitty bonds at that time. I think it was somewhere around $50B. Since they lost the House that has not been possible again.

Yep, based on what we heard Sunday, they are not going to perform state marriages. At least that is what is going to be proposed at the synodical convention. I figure it will pass.

On the other hand, they see this as only delaying the inevitable. The gov't is on the path of forcing churches to perform homosexual "marriages" and those that don't are going to face the consequences.

The fact that the synod president posted the quote from the Lutheran in Germany from 1932 about illegitimate ruling authorities tells me they don't like where this is heading. The LCMS is very follow the law whenever possible and talking about the gov't being a superior power but not ruling authority speaks volumes to their thinking.
