Current Conservative Presidential Darling Pretty Indifferent On Same Sex Marriage Ruling

Marco Rubio....pro-intervention and nation building, pro-amnesty, but indifferent to SSM ruling.

“While I disagree with this decision, we live in a republic and must abide by the law. As we look ahead, it must be a priority of the next president to nominate judges and justices committed to applying the Constitution as written and originally understood…

“I firmly believe the question of same sex marriage is a question of the definition of an institution, not the dignity of a human being. Every American has the right to pursue happiness as they see fit. Not every American has to agree on every issue, but all of us do have to share our country. A large number of Americans will continue to believe in traditional marriage, and a large number of Americans will be pleased with the Court’s decision today. In the years ahead, it is my hope that each side will respect the dignity of the other.”

Allah took exception to my characterization of Rubio as "indifferent" but had the decision gone the other way, what would he have said differently? "While I'm thankful for today's ruling and understand the passions on both sides, we live in a republic....blah....blah...respect the decision....blah...blah...respect each other...blah....blah...conservative judges."

Why so tepid Marco? Oh, right....donors.

Oh and while we do live in a republic (theoretically) it's important who and how laws are made. If judges do it, it's not a republic. Marco should probably think on that for a bit.

This is your guy GOP? Swell.

Ted Cruz has a fundraising idea, I mean, a response....let Congress vote on keeping Supreme Court judges every 8 years. Odds of passing that amendment to the Constitution? Yeah.

Anyone selling a "solution" to this that requires an amendment is simply blowing smoke up your ass.

So what is the solution? I have some ideas and will have a post on Monday about it.

In the meantime the short answer is....stop protecting people from the big government they support. Too many people who have spent years and decades advocating for bigger and bigger government have to be made to enjoy it as much as we have been.

For me it starts with the Catholic Church. They and any other church that discriminates against gay couples will find up being sued and forced to perform ceremonies or will lose their tax status.

My reaction: Oh well.

US bishops have spent decades advocating liberal big government programs (ObamaCare, as long as they are exempted and amnesty spring to mind) all while enjoying an exemption from its effects or sharing in the burden of the costs via their tax exemption.

Well they are going to get a taste of what they've been building and they aren't going to like it one bit.

While I will lament to loss of an important American value, it won't be the first progressives have killed. But I will laugh as they and others like them are shocked that the government they are so happy to sic on others turns on them.

I keep being told there isn't a critical mass of people who support big government. Fair enough. So now it's time to create one. No more exemptions and safe harbors from which people safely sell me and my values down the rive to protect theirs.

Big government is the best salesman for small government. It's time we let it loose on it's supporters.

Added: In the interest of interfaith comity I should note I'm looking forward to synagogues and mosques being taxed as well.

90-95% of your congregants vote for Democrats? Well, then I'm sure you'll be happy to be subject to even more of what they impose on the rest of us.

Obama does not have that authority and neither does congress. Tax exempt status for churches began before there was a USA.

About the only meaningful tax they are exempt from is local property tax and the federal government has no control over that at all. If a church has "earned income" they already pay taxes on that.

At the very minimum, states will use the precedents of this week to start rolling back property tax exemptions. And that's as long as the Feds don't step in and do it for them.

Our shitty little town here has high property taxes and the very reason is that tax exempt status. Every city block downtown has a church on it taking up half the block. So all the people who are not tax exempt have to make up for it.

Just to remind ourselves that The Church is not the building but rather the body of believers. I'm even willing to do it in the Spring and Fall when the weather is as nice as it gets here.

But will most of the churches go meek and fold, or will it be Onward Christian Soldiers? I'm guessing enough will fold that most of the rest of the large denominations will see resistance is useless and give in.

Rest assured, an effort will be underway shortly to defile every sanctuary in the US. Lists will be made and dates reserved. Your own church will not be immune. He is dangerously close to being acceptable to conservatives, but doesn't seem to be their first choice. He *is* the first choice of a lot of the business as usual Republicans.

I don't think Walker is the answer. I read an article yesterday (might have been at National Journal) that reviewed his fairly coy behavior over the past couple of years on SSM. I think Walker is a lot like Mitch "Truce" Daniels.

Only the legislative branch can create law. There is absolutely nothing in the US Constitution that gives the Supreme Court the authority to create law, and in fact there is nothing that gives them the right of judicial review either in that they are the final deciders of what is and what is not constitutional. The Marshall Court gave SCOTUS that extra-constitutional power in the Marbury ruling. If we accept that we are a constitutional republic then technically the SSM ruling is not a law; the only way it can technically be a law is if the Constitution is regarded as being null and void, which in the opinion of most on this blog is probably true as there are no real separation of powers anymore since the legislative branch has effectively been neutered by the courts and executive during the Bush/Obama administration.There's a big difference between Obama and his bureaucrats creating law (which they have no power or authority to do) or expanding upon laws already passed (again, no authority) or refusing to obey and enforce laws (for the last time, no authority) than legitimate laws such as Obamacare being unpopular. Legalizing SSM across the country by judicial fiat is not legitimate nor is redefining basic English to keep certain aspects and definitions of Obamacare in place.

So what Marco Rubio is saying is not that he is "law abiding" but rather that he believes the Supreme Court can create and change (not just strike down) laws despite the absence of any Constitutional authority to do so.

Some of us know it can be fast and how fragile the bubble is, but none of us really know for sure. All I know is I feel like we're on the cusp.

I hope I'm wrong. Given the consequences to the poor, young, elderly, and sick, I'd rather the left be correct and have their utopia, I'd rather be completely mistaken in my politics and economics than see what is coming happen. I've been wrong before. But I just cannot see how in this case.

All their expenses would be business related. Most of their 'income' would be in the form of gifts under $10,000 per donor per year. It seems to me the government wouldn't be going after the churches so much, but the taxpayers who donate to them large dollars for the write offs, just trying to cut off funding that way.

That's not going to do anything other than break up some bigger churches that already are licking the Govts. jockstraps, and give a bigger reason to get smaller 'cells' of churches.

It would be a huge backfire for the government to do that.

Agreeing with someone's teaching or not doesn't mean they should necessarily be taxed. Tax exemption is because the organization is viewed by government to be a net benefit to society which reduces the government's load in terms of law enforcement and costs to provide services. Thus, they are given a tax break.

You might not like why churches do what they do or how they teach but churches have counseling services, support hosts of charities, have food banks, etc, etc. Almost all adoption agencies for example are religious in origin and run by churches.

Disagreeing with someone doesn't mean they should be penalized by the government. Churches are actually saving you money in taxes.

You may laugh, but I have a half a dozen of these, each with holster, two mags and that weird Polish cleaning rod, all cleaned, over oiled, and racked in the safe. I only use one for carry purposes, and it's the most beat up of the bunch, a '68 with the failed plum bluing. I honestly don't think I could lose money on them if I were inclined to sell.

Absolutely. I was impressed by Rubio when he first came on the scene five years ago, but he has proven to be the willow in the wind type that is trying to not offend anyone in his quest for higher office.

Which makes him incredibly unattractive.

One of the reasons I believe Obama still has a decent popularity rating is not because of what he does, but because he does what he says he is going to do. He gets things done. Even if it isn't what people want, there is a natural attractiveness to a human of someone who is sure and determined and carries through.

Which is why virtually none of the Republican candidates are attractive in a leadership sort of way. They all seem so weak and that naturally is repulsive to most humans. I think that is programmed in as a survival mechanism in us, and centuries of "enlightened thought" doesn't eliminate it.

Except that it didn't uphold law, it struck down the law and overturned constitutions in 13 different states. What the SC did was decree that the state constitutional amendments, duly voted on by state's citizens in various states such as Michigan, are null and void.

The second Obama vetos the bill the 2016 election is a single issue election, reigning in a lawless court. Hold the focus there, don't let the media wing of the Prog Party distract with details of Ocare or teh gheys.

And if the so called 'conservative' Republicans can't even
muster a bare majority then that too would make useful fodder for the
coming election cycle.

Last I heard Sen. Rubio is a sitting U.S. Senator and can introduce legislation, can he not? There is no spending or taxing in that one paragraph so there is no need to begin in the House. The Legislative Branch should now, faithfully and immediately, exercise its mandate to supervise and superintend the Judiciary. They should:

Impeach Justices Kennedy, Breyer, Ginsburg, Kagan, and Sotomayor. Heck. Chief Justice Roberts, too. And they should impeach every federal judge who oversteps the limits of the Constitution. Every one. Every time. Good faith and mistaken judgement notwithstanding, neither incompetence nor malice can stand when our Liberty stands tied to a pole surrounded by flaming kindling.

And then, at a minimum, the Republican Senate should refuse to confirm any Supreme Court Justices while the current administration lasts. And it seems not to much to ask, when they do confirm anyone, to demand faithful adherence to the Constitution. Call it a litmus test if you will.

As necessary--damn Saul D. Alinsky!--rinse and repeat.

I went to a local community event last night that included a small rodeo. I was struck by the thoughtful prayer that invoked Jesus Christ given by the cowboy announcer prior to the start and then was almost in tears over the cowgirl loping her horse around the arena carrying the flag while all sang the Star Spangled Banner. Tears for what our country has become under the boot of a minority but also appreciation for the many fellow Americans who still believe in this country's founding.

Maybe. The GOP in Congress may not be able to stop this but they can make the case that the Feds are acting in an inappropriate manner when it comes to the States. The Dems aren't in power through most of the country and this sort of an action could be shown to be how unsuited they are to governing.

The court - one guy, actually, plus the 4 statist stooge/freaks whose names people are probably starting to forget, such idiotic apparatchiks for state power they have become - literally and clearly usurped the treaty power, rewrote a key provision of a treaty, and then used that to hamstring the govt. in time of war.

Acceding to that idiocy only weakens and endangers the system - in fact, irony of ironies, Roberts himself wrote in dissent to that decision that the court's "bait and switch" bad-faith ballet with Congress threatened the very constitutional system. Which is the point.

When the SCOTUS is both wildly exceeding its authority (cramming every issue it pleases into a "civil rights" framework) and then using that authority arbitrarily and absurdly (marriage redefinition), no, the bland mewlings of compliance with the court are not a useful response. The system IS broken. The crisis is in not fixing it, NOT in acknowledging it's broken.

Congress' authority to define jurisdiction and reach of the courts lies there, almost never used in history. As some above note, USE it - or try to, and again, for the billionth time, USE that split as a differentiating factor to give voters and society some choice, some idea that there IS a choice. Basic politics 101, for a party/group actually interested in winning, and for a purpose.

Measure. Photograph. Document. And turn it all over to your local bureaucracy for code enforcement.

But most importantly follow up on that bureaucracy and ensure that they are taking action! When they fail to do so inundate your local council or commission meetings with complaints -- why are we paying for these bureaucrats if they will not enforce the laws on the books? Inundate them with your complaints, phone calls and messages of failure, incompetence and lack of enforcement. And if they refuse to comply we must file lawsuits to force them to comply -- either the regulations and codes are enforceable against everyone equally or they are not.

We must be like a swarm of locusts descending on a fertile field and leave NOTHING but a dry, barren waste behind. But this.... this is the price to pay for living under the heavy weight of Big Government -- and it can't be too bad since we are told it is so good.

We must use every obscure law, regulation, act, edict or code against the left. We must force them to use their meager resources to comply with what they have told us is so good for us. Lawfare is a legitimate tactic of the left and they have spent decades condoning such actions -- we will simply apply their own rules and tactics against them.

The end result will either be a diminished size of the State or outright rebellion -- either way it will kick start change.

360 Although of COURSE the efforts to eliminate dissenting churches will start with the Catholics (and, of course, the Mormons), it will totally avoid Black churches and Islamic mosques. Not because they don't condemn this ruling even more strongly, but because the administration is chicken$hit.

361 I don't comment on this site, I'm actually more of a lurker, but I can't really help myself anymore. I must comment.

A lot of the posts made on this blog resonate with me, especially lately. I'm Conservative on a lot of issues, except when it comes to SSM. I don't have a problem with same sex couples getting married. I'm more of a spiritual person than I am a religious person. As long as people don't bother me or others with getting what they want by way of force, I really don't care what they do. However, it has been well shown that Christian businesses that do not provide services for a gay couple's wedding, due to it being against their religious beliefs, can get a mob sent after them to put them out of business or face paying a ridiculous lawsuit. To me, that is forceful. I don't approve of harassment to punish others for not having the same view as another group of people. It's just not right. But we seem to be stuck with politicians that only care about themselves and preach hate, harassment, lawlessness, and more, to the people of this country. Our society has become filled with monsters, that believe their way is the only way people can live by. Freedom be damned.

After The Supreme Court decided it can make law, I set out to look for any of our founding documents that state they are allowed to do so. I knew it was something they could not do, but I had to double check, because my mind was blown. Surprise, that's not their job! Yet, people are thrilled about it and are willing to ignore the abuse of power, because special groups got their way. They don't stop and think that letting such abuse of power slip by, could lead to a future of a right or freedom they enjoy, being taken away by that same abuse of power. When I try to explain this to anyone, even those with Conservative leanings, I am treated like a crazy person with a fondness for conspiracies. It makes rather sick.

While society has caused me anger over their willful ignorance, I find myself being pissed off that no one is taking a proper stand and that these people aren't getting a taste of their own medicine fast enough. I'm also upset that their ignorance will cause me to suffer with them.

363 In the meantime the short answer is....stop protecting people from the big government they support. Too many people who have spent years and decades advocating for bigger and bigger government have to be made to enjoy it as much as we have been.

More winning through losing? That worked out great in 2006 and 2008. I can hardly wait.

364 If we think the notion of 3/5 of the state legislatures agreeing to be bound by a paragraph is ridiculous and impossible, then it's over.

I mean NOTHING you do in national politics is as simple as enacting a Constitutional amendment. It took six months to give the vote to 18 year olds.

I'm not saying you have to agree with every paragraph proposed, but if you can't accept that a paragraph will meet with the active support of a majority of the American people, then what are we? What are you playing at when you endorse any person for any office?
