Or not. Totally predictable. At least they threw out the idiotic raisin law for what its worth.

Even if they had somehow shown a shred of intellectual firepower and thrown out the entire bill, the GOP in congress would save it with an emergency piece of legislation.

People wonder why I say this country cannot be turned around. Its not that there are no good people or potentially great candidates. Its that they're too much in the minority. And that's because a democracy gets the government that reflects its culture and social identity. Until that culture changes, until the virtue of the republic is recovered, things will only head in one inevitable direction.

Only a spectacular act of God or ruin will change this trajectory.

91 Anyone who votes for any GOP candidate, donates money to any GOP PAC or candidate, or volunteers time and effort to any GOP candidate or organization, is a fool and is not remotely conservative.

The GOP is to be judged by its actions - not its fundraising appeals. the GOP does not stand for smaller gov't, reducing the size of gov't, reducing spending, repealing Obamacare, deregulation, strong borders, or any other thing that Conservatives believe in.

Voting for the GOP is voting for the DNC. If you vote GOP, you are a leftist. Period.

Don't tell me how we need to vote GOP to save SCOTUS. SCOTUS a) won't "save us" and b) doesn't vote conservative most of the time anyway, even with alleged conservatives on the Court.

The only way to achieve any conservative result is to destroy the GOP and build it back up again. The GOP will not move right if you vote for it despite its leftist actions. If you believe it will - that you are "doing something" because you vote for a "conservative" candidate in this or that primary - you are an idiot. You are the GOP's wet dream - someone they can keep selling the same bridge to over and over and over again.

All conservatives should refuse to vote GOP until the GOP gets rid of its entire current leadership (including Boehner, McConnel, everyone at National GOP, all "consultants", all aides in the house and senate - everyone remotely connected to the current incarnation of GOP leadership in any way) and starts to take action in furtherance of conservative goals. Otherwise, you are voting for the GOP to pursue the same exact policy as the DNC.

Suckers.

It is complete and utter madness. I will say it again. Our government has not been a legitimate entity for a long time now and this ruling just rubs that fact in our faces. You have no recourse in the law because the law is what they decide it is even if they decide it is something completely opposite the text.

Stupid. Giving up on the GOP is not "giving up" on conservatism. It is fools like you who believe we can "change" the GOP by electing one guy, or even a few guys every cycle - that empower the GOP to continue doing what it has always done.
The only way to get the GOP to change is to force it to change. The only way to force it to change is to take away its votes until it does change. Everyone arguing otherwise is simply supporting the status quo.
Your friend Flynn may be a great guy. He may even stay committed to conservatism once elected (I doubt it - experience tells us that principles only remain in less than 1% of elected "conservative" candidates once they are seated). But he is not going to change a thing. Just like Cruz didn't, or DeMint, or Santorum, or any other conservative that got elected in the last 30+ years changed nothing. Hell, even Reagan did not really change anything in the GOP.

Pretending that we must "hope" for the GOP and that if we fail to support the GOP we are "despairing" or "giving up" or "being childish" is nonsense. The only strategic way to change the GOP is to starve it of our votes. the GOP can then decide to either go full fledged and honest after the left vote, competing with the DNC as to who can be the most leftist - or it can move rightward in an effort to win elections.
Any other plan is silly nonsense. It is pissing in the wind.

278 Words don't have a clear meaning to the court system. They have a political goal and find a way to distort the clear meaning to get there. I often say only a lawyer could say 'shall' means maybe.

"Roberts, Kennedy and the four liberal justices" this is disturbingto many of us because, well, liberal is a political word and the court should be straight up following the letter of the law because Congress is charged with writing the law.

This should have been turned back to Congress to fix it, PERIOD. There seems to be little the Courts don't feel the need to put their stamp on. Over stepping their place in the Constitution with Obama doing the same. One thing in common they are liberal. You can't win when your side has rules and the other doesn't.

============
Which is true.

But: It doesn't change the facts, does it?

Where is the pathway to more freedom, more liberty, more prosperity?

It doesn't lie in voting anymore, does it?

Refusing to vote is not giving up. No more than refusing to send another letter to King George was "giving up."

I keep saying this and saying this: There is only one possible brake on the federal government now. The only one left is the states.

The states have to stand up for their citizens.

But: Every state legislator dreams of one day getting called up to the big leagues.

So really, not one fucking thing is going to change until a state legislator(s) starts talking about "no, we will not comply. We will not make the citizens of _____ subject to this tyranny."

We are, ladies and gentlemen, at a crossroads: Either we are subjects or we are citizens.

If the former, do nothing.

If the latter: war.

Don't try to soften the blow, don't delude yourself with thoughts of a process solution, don't think there is anything but the extreme political solution left.

Or be a subject.

But don't try and tell me you haven't made the choice to be a servant, a slave, a subject.

You have. You just want me to agree with you self-betrayal.

It was facially illegal under Irish law for the Robertses to travel to Ireland, and adopt the kids, and take the kids back to the States. So the Robertses paid the birth mothers to travel out of Ireland to a third country, and adopted there, and took the kids back to the States. That moved the transaction from "facially illegal" to "questionably legal".

Fuck. You.

Fuck you up the fucking fuck holes you motherfucking motherfuckers. May you be fucked to hell with a pineapple wrapped in rusty barbed wire, and then fucked back again. God damn you to motherfucking Hell you God damned tyrants.

You do not have the God-damned fucking right to my labor. You have no right to what someone else must produce or provide. That means there is NO MOTHERFUCKING RIGHT TO HEALTH CARE YOU GOD DAMNED IMBICILES.

The Constitution provides no authority for the Federal Government to weigh in on Health Care matters in the first place.

Nevertheless, you, there in your ivory palaces decided that you knew better than God when He made man, and that he'd forgotten that Right To Enslave Others -for that is exactly what a right to someone else's labor is. And you wrote a law - which you never even bothered to read - and passed it to enshrine that "Right."

Then you found out you'd written the law wrong, and it went to the Supreme Court. There, you - for you are all of a unit- a single parasite feeding on the labor of others, banning this and that at your whim, attempting to rewright nature to your benefit - decided that the plain language of the Constitution did not matter, that you knew best, and so you upheld the law anyway.

Then you found out you'd written it wrong another way, and it went back to the Supreme Court. There, once again, you decided plain language did not mean anything. No, we cannot base our compliance on the law upon the actual words of the law. Instead we have to guess at the whims of our Feudal Lords.

Fuck. That.

You undermine the Rule of Law at your own peril. Do you think you won't pay the price for instituting the Rule of Man? Most of Human History is the story of the Rule of Man- and it is a brutal, blood-soaked history as one Man continually attempts to overthrow another Man. And this is not ancient history, but recent. What was the Communist Revolution in Russia if not one Man overthrowing other Men? What was the rise of Naziism except for the attempt of one Man to overthrow other Men?

So fuck you. Fuck you for taking this dream that was America and destroying it. Fuck you for turning the Bright Shining City on a Hill into "just one more nation among nations." Fuck you for returning us to the barbarism of the past, all because of your avarice and desire for more power, more privilege.

You are the one who is rewriting history. Roberts was known to be a Big Precedent kind of guy. People (conservatives) were saying at the time they HOPED that didn't mean he would give in to legislative whims.

Everyone knew this was possible. Even someone like me, who knows jack sh*t about the who and whats of the legal profession.

What is surprising to many however, is how much Roberts is consistently doing the left's bidding. People thought he would at least lean right.

474 "I would say 99.9% of conservatives were wholeheartedly behind Roberts nomination"

I took one look at Roberts and figured him for a readily manipulable corporatist hack, not as a staunch defender of black-letter law and Constitutional principle.

And not just nominating Roberts, but sweeping him directly into the Chief Justice's seat?

This *after* the various debacles of "conservatives" who turned out to be anything but. O'Connor, Kennedy, Souter...

Genuine conservatives pay attention to history, and history counsels care in judicial selection, whereas Dubya couldn't be arsed to pay attention.

Pretty much.

I said it yesterday but, LiB has to include the courts--they are just as much a part of the State as Congress and the bureaucracy.

There is no part of the federal government that is legitimate any more but some still cling to the courts as the neutral referee--they are not.

And we are very much to the point where you cannot call yourself a conservative and an American but still give legitimacy to the courts.

574 The most striking thing in Roberts' affirmation is that he sites the intent of the legislature.

The legislature didn't draft the law and few, if any of them, read the law. So it is impossible to know what the intent of the legislature was.

They relied on consultants, like Gruber to draft the law and we know what his intent was. It was to punish the state who didn't set up exchanges.

So Roberts is full of shit.

Surprisingly.

608 Roberts has been clear in previous opinions that he isn't going to use the Court to save the people from their electoral choices.

If people want the ACA repealed they are going to have to elect a president and a Congress who will, rather than relying on the Court to do their work for them.

Conservatives can bitch and moan, or they can organize and vote next year.

Frankly, this ruling denies Hillary the optics of "Defending Your Health Care" (tm) had subsidies gone down and various "solutions" been subsequently argued about in Congress for the next 18 months.

It's a horrible decision for a slew of reasons, but one of those reasons is NOT that it huts Republicans running next year, because it doesn't. It enhances their case and simplifies their ability to clearly oppose ACA without the distractions having to "solve" the lack of subsidies problem would present.

Obama and his ilk won for a reason.

Same sex marriage is being accepted for a reason.

Our economy is in the shitter for a reason.

There aren't two parties (if there every were two) for a reason.

The media can lie and obfuscate for a reason.

Etc.

The reason is that the majority in the country believes those actions or situations are okay.

We're on the minority side and probably will be from now until the cumulative effects of these uninformed and ill conceived ideas overwhelm the country. And perhaps beyond that point.

I keep running the Texas secession scenario through my head and keep coming up with...

*thousands of leftists are trucked in to ally with the Mexicans, all of whom are whipped into riot status all across the state.

If Texas manages to contain that...

*The President announces that all federally held land in Texas is now free to claim and settle by Mexicans. That's only 1.8% of the state but the border is allowed to completely disintegrate as the flood really begins.

If THAT fails...then the foreign military measures, also up through Mexico and from the Gulf.

673 We must deviate from the usual rules of statutory construction when interpreting the 22nd Amendment. While Section 1 states that "[n]o person shall be elected to the office of the President more than twice," the ratifying States left the term "twice" undefined. We find that as used in the Amendment, the States intended the term to mean "ten times."

Even without the Court's finding of the State's intent, the current President would not be ineligible. The 22nd Amendment clearly states that no person "shall be elected" more than ten times. Because the President continued in office as a result of a general acclamation and not as the product of an election, the 22nd Amendment does not control.

Meh, big law doesn't exactly work that way. They let their conflicts departments figure out if different matters cause conflicts. In some instances if the client provides lucrative work, an attorney take the client and go to another firm.

675 Jesus H. Christ, people, get a grip.

Yes, we must still vote Republican, for the sake of the occasional decent court appointment. The next Clarence Thomas will not be appointed by President Shrillary McCankles. Every great once in a while, Republicans appoint a good one. Democrats never, ever do. If we had 9 hard-left justices on SCOTUS we wouldn't be having this sob-fest, we'd already be in the camps.

And yes, we must still support candidates like Flynn. That is how we change what the GOP is: One congressperson, one governor, one dog catcher at a time. Primary the RINOs and replace them with conservatives. Yes, this will take time and effort. And money. Anyone who flounces in with "I will not vote, I will not contribute" -- fuck off.

No, we won't succeed with violent revolution. We can't bring on "the burning times" by applying for welfare.

We need to purge the RINOs from the GOP, electorally. Yeah, it will be hard. Stop your pissing and whining. You're demoralizing your compatriots.

676 I'm not a legal scholar. I don't even play one on TV. But I see a lot of anger at the GOP over this, and I consider that to be a separate issue. At issue here is a principle that the words written of a law are all the SCOTUS can and should rule on. It is not their place to deign intent. If the congress intended something to be in the law, it should have been written into the law.

That the GOP would have quickly changed the part of the law that needed changing is a political issue, and all the scorn heaped on the GOP would be deserved, at that time.

This ruling is absurd. The original ACA ruling was absurd.
We aren't governed by principles which limit.... anything... anymore.
We are ruled by men with power.

The Rule of Law has officially ended. King v Burwell has now made that certain for future rulings. ("Words no longer have meaning" -Scalia. "We must look to the over all intent" -Roberts. The intent was to strong arm the States and the "stupid American voters" -paraphrasing Gruber

Legislators at various levels introduce measure after measure to infringe on Free Speech (such as climate change/same sex marriage). They are supported by the mob to shame people into silent compliance. Other issues come into play with their success.

695 Not that it still wouldn't have won, but I'm sure they're still hanging the illegal adoption of Roberts' Irish kids over his head.

696 DynamiteDan, I have no doubt that ObamaCare will fail.

But I can't quite picture a scenario where it's replaced with the free market. Hell, we haven't had a free market in medicine for...what, 50 or 60 years?

Once insuring everyone, regardless of pre-existing condition, inevitably bends the cost curve up (which it must, of course -- imagine what your car insurance would cost if the insurance company wasn't allowed to ask you how many tickets or accidents you've had), and once they get rid of all grandfathered "transitional" plans and force them into ACA-compliant plans (which they're scheduled to do in 2016, but they'll delay it a year, after the elections), the shit will hit the fan and the whole thing will collapse.

But then what? They will have driven the cost of medical care even higher than it is now; they will have driven independent GPs out of practice and into retirement, so supply will be diminished. At that point, I'd guess we'll all gladly embrace single-payer.

Which was the plan all along.

697 "Roberts has been clear in previous opinions that he isn't going to use
the Court to save the people from their electoral choices."

Apparently he did with this ruling

He allowed an executive branch regulation defy a clearly written law. His whole reasoning this time is that the healthcare system will be so screwed up without the illegal executive regulation that the intent must have been different.

698 Iwish I could say I saw it coming, but hope springs eternal. . . . until today.
Stop listening to anything they say, because it's all lies, lies, and now, officially, from the Supreme Court, a ruling that declares that wordsmean anything you want. Given their love of stare decisis, that means it's over for the USA from now on, as they can rewrite "intent" of any law that comes before them.
Welcome to the new nation, and its name is1984.

700 Takeaways:

Another nail in the coffin of the "Supreme Court appointees matter so TeamGOP" argument.

Article V Supporters: SCOTUS and all lower judges need to be term-limited and forever barred from acting as mediators, arbitrators, lobbyists or otherwise having even the appearance of impropriety/bias/conflicting interests after they've served as a judge. Judge needs to be a career capper or a career track in and of itself - no switching hats to get the private gravy which prospects might further enhance your existing political or other biases. Accountability must be introduced into the judicial decision-making process, with parties having standing to bring suit or otherwise to scrutinize the judge's potential conflicts of interest, their contacts and communications during the decision making process, and to enforce discipline - by a jury, not a peer/Congressional vote - on judges who cross the line of impropriety in that process (Judge Walker's refusal to recuse himself in the CA Prop 8 case comes to mind).

An independent judiciary is an unaccountable judiciary, and with the rabid politicization and overreach into areas 19th century judges feared to tread, the risk/reward ratio of judicial accountability has shifted since John Adams advocated for our present lifetime appointed Star Chamber system. If they won't self-police, we need to police them.

The guys already kowtow to "public opinion" (as expressed by the media and their 20+% prog base, not the actual public), so all "independence" is doing is letting them grease the slippery slopes for the progs without accountability.

701 For any political office, the amount of power, the scope of that power, the length of your term, and your accountability to the electorate and to oversight all have to be balanced.

For SCOTUS and lower judges alike, this is the present "balance" : lifetime tenure, no electoral accountability and almost no oversight, and the ability to essentially write legislation from the bench and make orders which will almost certainly be implemented by executive authority.

This needs to change. In the first 100+ years, judges voluntarily limited their activities, mitigating these concerns. Not so much in the era of "active, progressive, take-charge" government.

703 "We need to purge the RINOs from the GOP, electorally."

That will take longer, with less results, than a third party. Our future conservative and libertarian leaders will either be corrupted and co-opted in the GOP or our resources will be spent for false-flag candidates (see Paul Ryan, Ayotte, etc...).

Better a third party to gauge our real strength in numbers or lack thereof, with better message integrity, discipline and branding, wielding power as a pivot point like minor parties do in parliamentary systems.

From what I've seen of some GOPers like Flynn, Amash, Gomert and a few others, I'd welcome them. I'm taking an "if we build it they will come" approach to existing pols, but I think we'll find our best leaders in building the party, ground up.

704 The court ruled today that a law is nothing more than a set of goals and aspirations. The text and intent quite literally do not matter. They did nothing short of endorse rule by fiat.

708 KING ARTHUR:
Each evening, from December to December,
Before you fall asleep upon your cot,
Think back on all the tales that you remember
Of Camelot.

Ask every person if he's heard the story,
And tell it strong and clear if he has not:
That once there was a fleeting wisp of glory
Called Camelot.

CHORUS:
Camelot! Camelot!
I know it gives a person pause,
But in Camelot, Camelot,
Those were the legal laws.

KING ARTHUR:
Where once it never rained til after sundown,
By eight a.m. the morning fog had flown . . .
Don't let it be forgot
That once there was a spot
For one brief, shining moment . . .
That was known as Camelot!

712 I still love -- and mourn -- AMERICA.

But what we have now? This ain't America any more, my friends: it's an alien viral entity that has bored into America's nucleus and injected its own foul DNA.

So what do we do? We Christians have a model on how to live and die under an Emperor Nero. I hope our non-Christian friends can find a way to hold fast.

From circa three thousand years ago: "De Profundis."

"Out of the depths have I cried unto thee, O Lord,
Lord, hear my voice; let thine ears be attentive to the voice of my supplications.
If thou, Lord, should mark iniquities, O Lord, who shall stand?
But there is forgiveness with thee, that thou may be feared.

I wait for the Lord, my soul does wait, and in his word do I hope.
My soul waits for the Lord more than they that watch for the morning: I say, more than they that watch for the morning.

Let Israel hope for the Lord, for with the Lord there is mercy, and with him is plenteous redemption.
And he shall redeem Israel from all his iniquities."

We've been here before, and we'll be here again, until his coming again in glory to judge both the quick and the dead. What we need is a new Great Awakening.

713 I understand the ruling; but I still have confusion on this topic.

Yes, that part can't stand as the "Affordable Care Act" was designed to provide affordable care, and couldn't with that provision.

My question. Why bother writing 800+ page laws?
SCOTUS has ruled it is the Judiciary's job to figure out how to make a law actually work; and to change it as needed.

The legislature should simply write 3-4 sentences outlining the goals; and have the Judiciary make the actual specific details and change those as needed.

That's what the SCOTUS just ruled is the proper method; why is the Legislature still trying to write 800+ page laws?

Paragraphs written on a cocktail napkin; that's all the legislature should be doing. Everything else is the province of the Judiciary. Right?

What are they good for?

Absolutely nothin'!

717 Chief Justice Roberts is a despicable human being. He is a piece of fecal matter. Decades from now as people discuss the collapse of the once great United States, his name will feature prominently in the tragic tale.

How this man sleeps at night is a complete mystery to me. Roberts, perhaps more than anyone else, was the one man that had the power to keep us from going utterly over the cliff. Instead, he has enthusiastically embraced Obama's agenda. The democrats must have some serious dirt on Roberts - that or he really is just evil to the core.

Every time I see a pic of his smiling face I think of a boot stomping on a human face forever and cringe. He's smiling because he is one of those wearing the boot.

718 In a two-party system, the only thing a third-party gets you is one-party rule. The only way forward is to remake the Republican Party. Running some Kamikaze third party will simply split the moderate to right-wing vote and assure electoral victory for Democrats in perpetuity. Honestly, it's not rocket surgery.

719 On a side note, Scalia has one helluva zinger in his dissent when he said, "We should start calling this law SCOTUScare."

Posted by: Lamont Cranston at June 26, 2015 02:19 AM (Rtyzj)

720 I read both the majority decision and the dissent. Scalia has not only prevailed over Roberts and the majority, he has deeply embarrassed them. He has shown them to be utter cravens who have sacrificed their impartiality and their honor to provide an unlawful outcome.

I hold Scalia in great honor. He is a national treasure, as are Alito and Thomas. The majority, however, are faithless curs who deserve the rough edge of every honest man's tongue and the back of every decent man's hand.
May God damn those who voted for this decision to endless torment in Hell.
