UVa Dean Accused of Indifference to Rape in Rolling Stone Hoax Now Suing For $7.5 Million

Associate Dean Nicole Eramo, depicted as callous and indifferent to the made-up non-rape of Jackie, had previously written an open letter to Rolling Stone studded with language that legal analysts called "extra spicey," basically laying out a theory of defamation and provisional damages.

Many speculated that this was a prelude to a lawsuit.

Those speculations were as accurate as they are delicious.

Steven Kruiser there knocks the Washington Post's article reporting the suit for merely saying of the rape hoax that it was "debunked" and had "serious flaws.

But in fairness, the author there, T. Rees Shapiro, was the one who did all the reporting to bring this hoax to light.

Her complaint is here.

Here are a bunch of the words.

To personify the University's alleged institutional indifference to rape, Erdely and Rolling Stone cast Dean Eramo, who met with and counseled Jackie, as the chief villain of the story. Erdely and Rolling Stone claimed -both in the article and in a slew of media appearances and interviews designed to increase publicity for the article -that Dean Eramo intentionally tried to coddle Jackie to persuade her not to report her rape; that she was indifferent to Jackie's allegations; that she discouraged Jackie from sharing her story with others; that she abuse[d] Jackie; that she did nothing in response to Jackie's allegations; that she claimed that UV A withholds rape statistics because nobody wants to send their daughter to the rape school ; that she did not report Jackie's alleged assault to the police; that she brushed off' Jackie; and that she actively sought to suppress Jackie's supposed gang rape.

5 These statements, and the portrayal of Dean Eramo, in A Rape on Campus and in Erdely and Rolling Stone's subsequent public statements, are categorically false. Indeed, publicly available information demonstrates that the highly disparaging claims about Dean Eramo are all untrue.

In fact, upon being told of Jackie's allegations of sexual assault -which differed materially from the description Erdely and Rolling Stone published -Dean Eramo immediately offered to assist Jackie in holding her attackers accountable -by going to the police, by pursuing misconduct proceedings within the University, or by both. Dean Eramo ultimately persuaded Jackie to speak with the police, and she arranged and attended two different meetings between Jackie and officers from the University Police Department and the Charlottesville Police Department.

6 Dean Eramo's efforts did not result in an official complaint or report to police -not because Dean Eramo tried to suppress Jackie's allegations or persuade her to remain silent -but because Jackie adamantly refused to cooperate with law enforcement or name her alleged attackers.

As the Charlottesville Police Department has since confirmed, Jackie insisted both to Dean Eramo and to the police that she did not want her claims investigated, and she refused to provide any specific details that would have allowed them to do so. When police again tried to investigate the supposed sexual assault following the nationwide outcry after the publication of A Rape on Campus, Jackie retained a lawyer and refused to speak with the detectives who were trying to substantiate her claims. As the Washington Postlater noted, contrary to Erdely and Rolling Stone's portrayal of Dean Eramo as incompetent and insensitive, Dean Eramo was actually quite active in seeking an investigation and justice for the allegations Jackie presented.

It shouldn't matter.

1- RS was publishing the piece based on Jackie telling the truth. You can't say "Well, we believed everything except *that!*"

2- Even if you didn't believe that, ethics would dictate that you follow up on it to confirm or deny.

I don't think Rolling Stone has an out, here. They ran a story that (events have proven) they should have known (and likely already suspected) was completely false in all material particulars, and in so doing defamed a university, a national fraternity, and (in particular here) a dean of that university.

If I were their lawyer (IANAL), I'd be advising they settle quickly.

How does that work with insurance? If I publish an article or book that I know has no substantial proof, actually has parties involved that have come out and said what we are going to publish is not true, and we do it anyway, does insurance still cover me?

If RS did that -- and I think it likely -- they can say "yer on yer own, sucka" to Erdely and move on to pastures new.

I think she was actively named. At the very least, she was identified in enough detail that there's not even a plausible "Well we tried to keep her identity secret!"

I think the Frat *is* suing RS. At least they were making noises about it.

As for the accused rapist... he can't because he doesn't exist. The guy people thought (for about 10 minutes) might be the guy... isn't the guy (and enough is different about him and Jackie's description that RS has cover there).

UVa administration shut down the frat based off of this story and the allegations. Not sure they can be held liable for doing what Rolling Stone defamed them by saying they didn't do.

They had no choice but to act immediately upon the allegations. Which is why RS should be sued into oblivion by everyone.
I believe the frat is pursuing a lawsuit. Not sure about the accused.

I'd expect that provision is just there to make sure she participates in their defense, unless she has some serious personal dough at risk.

The money to pay any settlement is going to come from: (a) whatever insurance cover RS has, (2) the liquidation value of RS and Wenner Media and (3) the personal assets, including marital assets, of Erdely (presuming you are right in thinking she wasn't working through an LLC).

I'm no libel expert, but if RS/Wenner were warned in writing and in advance, as the suit says, that they were going to publish falsehoods then I bet that rises some advanced level of recklessness liability.

And Jackie could (credibly) say "hey that bitch just made all that shit up" and no one could prove otherwise.

I get concerns by the men who are being railroaded. That should stop. That is why we have a justice system and we look for evidence before convicting.

But rape, particularly something like date rape, is actually hard to prove sometimes so I find this idea that 'unable to prove' = lies as disturbing as I do the automatic presumption of guilt at an accusation. We should realize that the law is imperfect and sometimes bad people are going to get away with things. Sometimes innocents get railroaded and sometimes the guilty go free. And it sucks.

Not always true. BJ Clinton ruined several women's lives with his sexual predation--using money, influence, state troopers, and finally Carville, etc to facilitate his actions. His victims had to prove their innocence first before being allowed to mention his guilt. To conflate that with "unwanted kissing" or "date rape" to me, is not right.

The School District CLAIMED publicly that the guy had no contact with kids; but in reality, every single parent had been told for YEARS to specifically tell their kids to go get reassured by this one specific guy if they needed help at night.

Lawsuits? You haven't seen lawsuits yet until this case gets into high gear. This is Silicon Valley -- many of the parents are rich, educated, and/or are lawyers themselves.

Absolutely. For choice there should be one adult of each sex (yeah, I went there - there are only two - so suck it, SJWs) on call at night, and BOTH respond to any problems.
I'd actually worry about any guy who would be willing to take that job as constituted. Any normal guy would consider the risks wildly unacceptable; no upside, and a boatload of potential downside. Also IIRC, the story that Jackie told Renda and the various survivors groups was different yet again from the stories she told Ryan et al and Erdley.

I don't know, but the media loves to conflate those terms depending on the circumstances.

They use them as synonyms enough that when a guy grabs a girls ass and it fits the narrative, the media says "sexual assault" and people assume they mean rape.

She specifically referenced the story ( with pseudonym for #jackie) and by this false story attempted to promote a campus rape crisis narrative, to change policy that would hurt people and encourage title ix actions against colleges (which, when there are fines or payouts or expensive programs, divert endowments,tuition,and tax dollars away from other students, and educational purposes).

Also, people within the activist groups where her story was circulating, were actively speculating about young men responsible for Jackie's terrible abuse. She was avoiding a false police report, but she was not blameless of harm before RS got in the picture.

I'd turn it around: would they want to date UVa gals? They might want to think about that. First, any subsequent allegation will be taken as vindication for Jackie's crap, and second, I could easily imagine an undercover (?) SJW trying to achieve precisely such validation.

The sheer size and brutality of the story she concocted leaves little room for much sympathy, IMO. This was not a girl crying to her friends about how a boy she liked had sex with her and then wouldn't call her back, and isn't he awful? And don't you want to comfort me now? And won't you take me out on a rebound date, Ryan? That kind of stupid over-emotional crap is what I'd expect out of a spoiled college girl who wanted a boy to like her. It's not right, but at least it wouldn't actually hurt anyone (except maybe Ryan, who dodged one hell of a bullet by knowing not to stick his dick in Jackie's crazy).


But no. This girl was willing to concoct a brutal gang rape so mind-boggling on all levels that, within 24 hours of hitting the mainstream press, it was well on the way to being debunked. She was more than happy to invent truly twisted, depraved acts that she claimed had been visited upon her (hours of rape on broken glass?), and then was ready and willing to smear her "friends" after the fact when she didn't get the result she wanted. This is fabulism taken to extremes. The only way it could have been WORSE would have been had she accused an actual human being rather than a made-up catfishing persona. The fact that she didn't? That she was willing to maintain a farce for as long as she did, was willing to manufacture a bloody, brutal rape, and then NOT go to police about it? That tells me that she KNEW how wrong what she was doing was, and she did it anyway. She had enough consciousness of guilt to know that filing a false police report about such a ludicrous, easily disproven rape would land her in trouble, so she didn't do it. She just let the story fester as she basked in the glow of victimhood she'd created for herself.


She is deserving of only scanty sympathy, and that's only if she has a legitimate, diagnosable mental disorder. Otherwise she's nothing but a g-ddamn liar, and a hysterical one at that.

But that's kind of important, imo. I guess for me, that would have been the line that moved it from crazy crazy nonsense an 18/19 year old did to get attention to actual malice.

She's a liar. Yes. She's crazy. Yes. What she did wasn't right. Absolutely I agree with that.

I just don't think her intentions were to hurt specific people and she definitely resisted any attempt to get her to slander a specific person or file a false report that could get someone sent to jail. So she at least had a moral line that she drew for her crazy self. It is not the one I would draw or you would draw, obviously.

So she is not in the same category for me as the mattress girl, or the duke rape stripper lady. I believe Rollins Stone and UVA are more culpable and caused the majority of damages. I'm not sure what the proper punishment for Jackie actually would be as she didn't file a false report and she didn't name a specific person.

Proper punishment for Jackie is what she's getting: mockery and derision. Eventually she might grow up, pen a column or memoir about her experience, and reflect back on what a foolish, ridiculous thing she did, and what profound consequences it had on the national "conversation" on "rape culture." At that point I'll be happy to call her a changed woman.

He's also suing the president of Columbia U. and the professor who approved the Mattress Project for art class.

I'm not sure why he isn't suing the mattress girl too, unless there's some reason he can't sue her in federal court (which is where his lawsuit is). Granted, she personally probably doesn't have a lot of assets, but she is more at fault than anyone he is suing.

Try to get the facts straight. It was Richard Bradley, followed by Robbie Soave, who first questioned the provenance of the RS story, and they took a lot of flak for it at the start. WaPo and Shapiro did jump in then, to their credit, but there was not a peep from them until well after Bradley first raised doubts, even though they were the only national media with full time "boots on the ground" in Central Virginia.

Of course it's speculation, but in your heart, do you really think WaPo would have debunked that story on their own, if it wasn't already falling apart?
