Free Speech Is Binary: We Either Have It Or We Don't [CBD]

This is not complicated. The legal limits on speech are obvious, narrow and understandable, and don't include upsetting homicidal maniacs.

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

But....our betters seem to think differently. Here is a Fox News pundit with an inside-the-beltway take.

Greta Van Susteren, staunch defender of free speech, speaking of Pamela Geller's event:

"Everyone knew this event would unglue some who might become violent and the police had no choice but to do their jobs and be there to protect against violence."

"Was it fair to the police, to knowingly put them at risk by this unnecessary provocation?" Van Susteren asked. "I say no."

So...exercise of our God-given rights that are codified in our country's most important legal and social document is an unnecessary provocation.

Let's follow this surgically-enhanced, Scientology-spouting talking head's logic to its clear and unmistakable conclusion.

The six police officers charged in the death of Freddy Gray should be convicted and imprisoned without trial, because it is abundantly clear that were they to be found not-guilty, Everyone knows "this event would unglue some who might become violent and the police" would have "no choice but to do their jobs and be there to protect against violence."

Pamela Geller deserves our cheers and our gratitude, not self-serving, craven criticism.

As I commented last night on the ONT, the Russian reporter who contributed a brief report about the WWII flyover in DC as part of a world round-up of Victory Day events for Russian state TV added a nice slap at President Bumbles, noting that the president did not participate in any ceremonies, as he was visiting a sporting goods factory (sic) out of town (Nike in Oregon).

Funny highlight of the parade - Azeri military contingent in funky camo with even funkier cyclist-type wrap-around shades leading the international section of the procession - don't they have ceremonial dress down in Baku? Also funny that the Armenian contingent, dressed more appropriately, followed right behind (thinking the whole time - "heh, we kick your cheese ass any time you mess with us, remember?").

And the Russkis haven't quite gotten the memo on "moments of silence". Putin kicked one off at the end of his remarks, and instead of silence, some sort of tolling tone over the PA system ticked off the seconds. Very annoying, completely destroyed the power of silence at such an event.

The Russian TV replay of the original June 1945 parade film, with informative notes, was actually very interesting too. Troops with working dogs, M38 carbines slung over their backs - never knew the Soviets had dogs in the fight. And the graphic in the corner showed a stripper clip of 7.62X54R .... reminding me I need to re-shellac two of my Mosin Nagants, wrap the barrel to stabilize the handguard on one, and check/fix the clip feeding on all of them.

Russian TV approvingly (of course) quoted a statement by Berlusconi saying the "boycott" of the 70th anniversary parade did not represent isolation of Russia, but the decline of the west. Agreed. As Putin himself noted, this holiday is the biggest common one shared by all the former constituents of the USSR. Showing respect - even cleverly finding a way to highlight the massive US support as an ally - at this event would have been the far smarter and classier move. It's not Putin's day, and is not seen that way by Russians (or Kazakhs, or Azeris, or others).

Oh - and they now even have their version of Rolling Thunder - mass biker rallies to commemorate military holidays. Couldn't catch the details, minus the US flags flying from the rear of the bikes, looked the same.

I don't. Just thinking back to when I was a kid. My high school had two arch rivals; both schools colors were purple and gold. The night before a football game against one of these schools had its share of mayhem - most harmless, some not. Anyway, the cops would patrol the town pick up any kid wearing purple and gold. The reasoning was that was a danger of violence at the hands of the purple-and-gold wearing kids or against them. On the one hand, these kis had their rights, but on the other, there was a clear, present danger that bad stuff was about.

I'm generally aware of what the Constitution says. Case law is different; there's so much of it.

And Rochus Misch was just a flunky, about as low on the totem pole as one could be in that particular little crowd. As low as one could be without being an outright servant, like a cook or chambermaid, I guess. I don't see him as being especially evil; just an ordinary guy that got caught up in an evil enterprise. 198 The first amendment is one of the most misunderstood of the ten amendments in the bill of rights, except maybe the second amnedment which even though it is written plainly the liberals don't like it and the courts until recently backed them up.


The problem with the first amendment regarding speech is that it was originally intended to apply only to the federal government and it was originally only intended for political speech.


Then the courts got involved. I think the first was the first one of the bill of rights that was "incorporated" to apply to the States as well as the federal. This was done out of another one of those bad cases that ultimately made bad law. IIRC it arose out of a case of "seditious libel" about a local politician. I won't spend the time to look it up but that is what I remember. And subsequent rulings have been all over the board trying to iron out the problems with new rulings after the first awful one.


Be that it may, it is settled law now and now the only one of the BOR not incorporated is the one that calls for the use of a Grand Jury in felony cases.


The second has now been incorporated but the Supremes put "conditions" on it that are not in the wording and the cities like Chicago and Washington have thumbed their nose at the rulings.

True story. I used to live in the Back Bay section of Boston. There is a nice park separating the lanes of Commonwealth Ave where people go for walks, bike ride, etc. I used to take my dog for a walk there.

Over the years people have donated trees and benches often in the name of someone else. Barney Frank's family planted a tree for him as a graduation present (I think) and there is a little sign mounted in the grass in front of the tree stating it.

My dog decided to take a nice big steamer right on the sign. I cleaned up most of it but left a little turd as my free speech response to Barney.

You might make a subtle argument that the City of Garland could have refused to provide security, but (a) it clearly did provide security, and it worked spectacularly, and (b) if it had not, there would have been lots of Texans willing to do so. So problem solved. She held the event, got righteous PR for the cause, and the world is down two terrorists today. Win, win, win.
