Rogue Prosecutor John Chisholm, Union-Connected Partisan Behind Wisconsin's Evil "John Doe" Intimidations, Now Suggests That Walker Should Be Prosecutable as a Criminal For Criticizing The John Doe Investigations

If Scott Walker is any kind of a man and a real contender, he will move heaven and earth to cast this vicious partisan out of office.

This is what Walker said, correctly:

“They were looking for just about anything. As I pointed out at the time, it was largely a political witch hunt.”

John Chisholm was informed of the remark, and now threatens to prosecute the Governor for criticizing him:

"As to defamatory remarks, I strongly suspect the Iowa criminal code, like Wisconsin’s, has provisions for intentionally making false statements intended to harm the reputation of others,” Chisholm said in a statement Saturday responding to Walker's comments.

Note Chisholm states -- not by accident -- that Wisconsin has such a provision. He is therefore threatening to a new prosecution of the governor for criticizing his lawless witch-hunts.

This is an outrage. Enough.

Step One: Pass a law permitting a jury to strip a prosecutor of civil immunity if he is found to have acted with malice in pursuing an alleged political crime.

Step two: Pass another law permitting a prosecutor to be prosecuted and jailed for ten years for acting with malice in pursuing an alleged political crime.

We'll fix your wagons, buddy.

30 I've said repeatedly here and elsewhere that one judicial reform that needs to be passed is one where Prosecutors do not have the power they currently have.

They are basically unsupervised. They can bring the power of the state against anyone they choose and they have the entire police forces of the state and all it's departments at their beck and call.

They're only supervision is thru the rulings of judges and remotely possible impeachment.

The judges are part of the problem. A inimical prosecutor can make a judges life as much a hell as a judge can make a defense attorney's or defendants life hell.

Prosecutors are in the aggregate responsible for the over charging of defendants thus making it more likely that an innocent person (of the base charge) will take a plea due to jury's being so easily swayed and the prosecutors being in position to manipulate or out right falsify the evidence.

They are effectively immune to prosecution for any misdeeds and they will protect the police who will in turn protect them.

They have turned our justice system into a Criminal Enterprise with them at the top.

(not all of course but the degree gets worse every year.)

Part of the problem is that too many are elected and the other problem is that too many are political or have political aspirations. This makes them dangerous and attracts the unsavory to do their bidding.

Time for Prosecutorial Oversight along with Tort Reform to regain a justice system which people can respect.

I disagree. A problem we have is believing that political positions should be neutral. They cannot be. They will not be.

The only problem with passing a law now is that you wouldn't be able to get Chisholm on it if he brought his case before passage of the law. Ex post facto...you cannot make illegal what someone has already done if it was legal at the time they did it. If you pass the law first and then he is such a fool as to keep going, then you have him. And, of course, the main thing would be that it sets precedent to real in unlawful behavior.
The only thing I would say is that relying on a jury in a purple state to remove a blue prosecutor's immunity could at times be like pissing up a rope. Knowing how jury selection works, it could end up being a coin toss. Which is no big deal really.

GJ's assess a bundle of facts and issue a bill or no bill based on those facts. GJ's don't issue gag orders and the person in question is quite able to spout off in the court of public opinion all they want.

To be counter to your assessment of GJ's, they have the power to delve where ever they wish. The courts try to down play that fact but SCOTUS has ruled several times that a GJ can bring a bill to other parties other than just the one the prosecutor wants.

There are both Federal and state actions pending at the moment. In something that would be ironic if it didn't make me want to punch a manatee, the state Supreme Court arguments were held last week but the hearings were kept secret to preclude the names of those being targeted from being leaked.

The Federal action is very interesting because it gets into a problem with the Anti-Injunction Act (very short and dirty version: a Federal court won't issue an injunction in a state matter since the state courts should be the ones doing that). What do you do when what you are enjoining is an overreach by the state court system itself?

Here's something else this case and many others are pointing out. Judges are rubber stamping warrants. Mind you, that's been a problem for decades and decades. But it's worse now. The prosecutor found a judge to blow through issuing all of the warrants in one day. This points out the ridiculousness of what are to be safe guards in the statutes.

Oh this can't happen unless a judge signs off! People hear that and think there's some kind of hearing, not someone emailing pdfs to a judge with "Okay just sign at the bottom".

The solution? Strip immunity. That will help a great deal.
