Bowe Bergdahl, For Whom Obama "Traded" Five Terrorists, To Be Charged With Desertion

Thank you for "trading" terrorists to get this fine American boy back, Mr. President.

I put "trading" in quotes because Obama just wants excuses to release terrorists -- the "trade" here is a pretext to do what he already wished to do.

Sgt. Bowe Bergdahl, who was held captive by the Taliban for five years after leaving his remote post in Afghanistan, has been charged with desertion and misbehavior before the enemy, according to a source familiar with the case.

My Favorite Move... of the leftwing press is its constant use of the Passive Voice to get across its own beliefs and desires without admitting whose beliefs and desires these are.

For example, two weeks ago I saw the headline: Tom Cotton Finds Himself on Defensive After Iran Letter. Finds himself on defensive from whom? well, from the Press, naturally, but they don't want to admit they themselves are driving this story and therefore the subject of this story, so they write the headline to obscure just who it is that Cotton finds himself on the defensive against.

They do this with "Raises Questions" all the time, too. Scott Walker Campaign Raises Questions About Transparency is a made-up headline along these lines.

Anyway, the NYT wants you to know that a vague mass of people, who they will not name, does not have much "appetite" for seeing Bergdahl serve time in jail.

Obama and Democrats largely got a pass on national security in the 2012 election because Bin Ladin was killed.

The average American though is starting to get nervous again, and for good reason. National Security is why the Republicans dominated the Executive Branch throughout the Cold War. They didn't trust Democrats on National Security.

I'm not sure if this one thing by itself really hurt Dems, but I do think this and many other actions by the Obama administration have given back any foreign policy/defense cred they seized following the Bush presidency.

This is definitely a weak spot for Dems - it may not trump other spots that they may have an advantage over the GOP - but I think on these issues the voters trust the GOP more (or if there was ever a gap between the GOP and the Dems with the Dems ahead - it has been narrowed).

A Dishonorable Discharge has a lot of federal restictions placed on you once you are out which many don't know. Such as, "you are not allowed legally permitted to own firearms." Alot of guys usually file a DD 293 to get their discharge "upgraded."

Pretty much so. Congress' power to declare war is a plenary power, meaning they have all of the power regarding that subject. Congress can declare as much war as they want from the full and formal to much more limited hostilities - limited as to geographic area, which forces are to be used, which forces are to be attacked, and so forth.

The first foreign war the US was in after the revolution was the Undeclared Naval War with France and the SCOTUS had to deal with a claim about an American merchant ship that had been recaptured by an American privateer. The court held that it wasn't a full declaration of a "perfect war" - like WWI or WWII; but since nations can wage limited wars that power to declare a limited war belongs to Congress and thus the letter of marque issued was good despite no formal declaration.

Perhaps I am mis-interpreting you, but i'm not sure I agree fully with your statement. They have power to declare war - that is it (they then have power of purse). But they do not have power to limit which forces may be used - not to my understanding of the Constitution anyway. Congress can declare war against France but only using the Navy. I think the President would fully be within his right to say - you declared war against France and I am going to only use the Army.

I think in the US political parties tend to be a pendelum that swings back and forth.

I certainly don't believe the GOP is going to dominate the future, my point is I get tired of the "the Left owns the future" meme spread by the MSM, Democrats, and our own side.

If you looked logically at Democrats' position right now, it's awful, and the GOP is probably at a near all time high for elected office holders.

If it's as you say, then why hasn't there a formal declaration of war since WWII? As I've understood it, and from the little bit of information I've been exposed to, a declaration of war initiates a whole different national/industrial reaction than limited armed conflicts, "police actions" if you will. A declaration of war usually means the disruption of everyday life as we know it in order to supply and support the actions of war.

As I've understood it, and from the little bit of information I've been exposed to, a declaration of war initiates a whole different national/industrial reaction than limited armed conflicts, "police actions" if you will. A declaration of war usually means the disruption of everyday life as we know it in order to supply and support the actions of war.

It is political cowardice for sure. And I would prefer we just say what things are. But I don't think it changes anything from a constitutional perspective of whether Congress has actually declared war or not.

Yes, but some of that is political - both branches have to deal with political realities. The Dems hated the Iraq war, but they never fought to defund it. We are arguing hypotheticals here. My point was that Congress cannot tell the President how to conduct a war - or military engagement. Congress can use what oversight powers it has to guide the president and they can make it a political issue. But they lack the inherent Constitutional authority to limit the President in ways you suggested.

That is my belief anyway.

This debacle in the media is the made up controversy of why did you trade 5 top terrorists to get our man back.

The real controversy should be, exactly why did Obama want these 5 specific terrorists released. Bergdahl was nothing except an opportunity to get these guys released. Obama even tried to make Bergdahl more important to the U.S. by holding a parade and the like.

This is all an obvious attempt to hide the real reason for wanting these 5 released - and that is what the media should be trying to figure out.

Was there some backroom deal that got us something for their release and Bergdahl was just a convenient face for that? It would be my guess. I can't possibly believe that Obama is really pro-terrorist and just wanted them released for free.

Because a Declaration of War means that you intend to disregard the Customary Relations Between Nations. You can systematically steal their stuff and imprison their citizens for instatnce. These are normally frowned on.

ISIS and other non state actors are more in the line of pirates. You not only *can* do just about anything to them that you want but are in many ways *obligated* to capture and/or kill them.

Truth to tell I can't think of a Western Country that has executed a soldier for desertion since the end of WW II. That's not to say that they didn't execute plenty of soldiers for desertion during WWI and WW II. It's just that they stopped doing that along about 1945. Private Eddie Slovik was the last US soldier executed for desertion.
