Charlottesville PD: After Months of Investigating the Baroque Gangrape Alleged by "Jackie," There Is, Get This, No Evidence That Such A Thing Happened

Though they are politically correct enough to say that the complete absence of evidence that anything happened at all doesn't mean that something didn't happen.

"We have no basis to conclude that anything happened at that fraternity house," Chief Timothy Longo of the Charlottesville police told reporters.

He said that the student, identified in the article as Jackie, refused to give a statement or answer questions when she met with police in December, two weeks after the article was published.

Two weeks after the article was published, it had only barely been challenged.

Yet she wouldn't talk to police about it.

Plainly sounds like a woman who was Serious You Guys assaulted.


Longo said that police found no evidence that a party took place at the fraternity, Phi Kappa Psi, on the night of the alleged gang rape in September 2012, as described in the article.

The chief stressed that the conclusion did not mean that "something terrible didn't happen to Jackie," only that police could not corroborate it. He characterized the investigation as suspended, not closed.

How ridiculous. In order to appease a noisy and influential political lobby, we're all required to pretend along with Jackie.

On the plus side, police have been able to identify that totally-hot upperclassman who was totally into Jackie.

In fairness, that's not necessarily PC speak; he's merely speaking within the facts he knows right now. He does not know definitively that no rape occurred, but he DOES know definitively that there is at present no evidence for such.



We teach scientists to talk that way ("X is consistent with Y," rather than "X proves Y," because there may be another explanation for the data that we haven't yet thought of), so that they'll think that way.

Someone correct me if I'm wrong: didn't she try to recant the story before Rolling Stone published it?

Because that's actually fairly important to me. One, it shows she knew she was lying- that, indeed, nothing "horrible" had happened to her. But, two, it also shows that Rolling Stone knew (or should have known) that the article was based on a lie.

Which is actually the bigger deal, here. A college student lying about it to shore up her "victim" cred is one thing. A national magazine smearing an entire college campus and everyone who has ever been at a given Frat is something else entirely.

The plain language in the constitution says that when you are accused of a crime you have the right to face your accuser in court.

Yes, and no. The problem with "Jackie," as I see it, is that from what evidence there actually is it certainly looks like she fabricated the whole thing in order to try and get a boy. And then when that didn't work out she apparently parlayed her sob story into status with the campus "anti-rape activist" community. Now, while none of that may be illegal it speaks to something seriously defective in our culture where a young woman (a) apparently has no fear of making up a horrendous accusation for a dumb purpose, and (b) is then treated as some kind of elevated person because of her made up victim status. This is all kinds of screwed up and needs to be seriously addressed and corrected in our culture.

The state is not your accuser. The state is acting as an agent for the person or persons who make the allegation. How to fix?

We don't make robbery victims go to civil court to recover stolen items, do we? Restitution is part of the criminal punishment.

Is it adequate to leave "theft of reputation" a civil matter? Is there a level of offense to reputation which should rise to the level of a criminal offense in its own right?

393 Right now, sexual assault accusations are treated differently than physical assault accusations. In most jurisdictions, sexual assault accusers are given much greater degrees of privacy and anonymity. I think that is wrong. I think it should be treated like any other violent crime.

Already many victims refuse to participate. One of the women attacked by the vermin who later attacked and killed two coeds at UVa refused.

399 CD I am very familiar with the facts of both these cases. Both refused to go to the police. Both stated publically in several different types of campus forums, that they had been raped. While Rolling Stone did not provide Jackies name, every one on campus knew about her. She has spoken out publically at some "take back the night" campus events. She was hardly anonymous. In fact her status as victim required she be out, and known. And she was on UVA

As a former prosecutor I think the problem is in letting campus kangaroo courts anywhere near serious offenses like rape. They have no business handling these cases extra judicially. A serious offense like rape belongs in the hands of the local police department. Who would have required an interview with Jackie. Which would have subjected her to criminal liability

The police only need the report of a crime to investigate if a crime occurred.

A girl claiming she was raped should be enough warrant for the police to investigate if it actually happened. What else would they do?

Alternative reality Policeman: "Miss, if you're not going to accuse a specific person as your rapist, we're not investigating. You didn't get a good look at him and are too traumatized to remember? Too bad."
