No Biggie, But the Obama Administration Lied to a Federal Judge and May Now Be Sanctioned

Lot of that going round.

I've never seen a useful explanation of the chain of events here, so I'm going to guess: I think the judge wanted to know from the Obama Administration if any action on the illegal executive orders was going to be taken, short term, before the judge even had a chance to consider the issue.

I believe Judge Hanen wanted to know this because he wanted to know if he had to order a temporary restraining order against Obama, blocking him from taking action before the merits of the case could be heard. (In such cases, an emergency hearing is had and a mini-presentation of the case is held, so that the judge can decide if the case seems likely to win on the merits.)

I believe the Obama Administration told the judge: Nah bro, there's no need for an emergency restraining order, we're not going to do anything on immigration for a while. So Chillax, Bro! You have all the time in the world to consider this case at leisure!

But then Obama actually issued work documents to 108,000+ illegal immigrants even while Hanen was hearing the case.

Thus, Obama issued documents to 108,000 illegals before Hanen had the chance to estop them. They told Hanen to not worry about issuing an emergency injunction before a decision on the case, and then, during that period where Hanen thought no action was being taken, they rushed out documents to 108,000 illegals.

And then they didn't tell Hanen about that until three weeks later.

And also: Obama is now claiming those 108,000 illegals are already "grandfathered" in and the judge cannot take the documents away, even though those documents were issued in defiance of his (ultimate) order.

Hanen is pissed, and he says he feels like "a fool" for having taken the lying Obama at his word.

A federal judge sharply scolded a Justice Department attorney at a hearing on President Obama's immigration executive actions, suggesting that the administration misled him on a key part of the program -- and that he fell for it, "like an idiot."

The testy court hearing was held Thursday in Texas by U.S. District Judge Andrew Hanen. The judge suggested he could order sanctions against the administration if he finds they indeed misrepresented the facts.

At issue is whether the DOJ misled the judge into believing that a plank of the Obama program -- giving deportation reprieves to thousands of young illegal immigrants brought to the U.S. as children -- would not go forward before he made a ruling on a request to halt it. In fact, federal officials had given more than 108,000 people three-year reprieves before that date and granted them work permits under the program.

Hanen chided Justice Department attorney Kathleen Hartnett for telling him at a January hearing before the injunction was issued that nothing would be happening with regard to one key part of Obama's actions, an expansion of the 2012 Deferred Action for Childhood Arrivals program, known as DACA, until Feb. 18.

"Like an idiot I believed that," Hanen said.

And I'm sure you'll be shocked to hear this, but the Department of Justice is protecting Hillary from having to reveal her allegedly "private" emails.

The Justice Department is defending former Secretary of State Hillary Clinton from a motion to subpoena her private emails under the Freedom of Information Act (FOIA).

"Such action is unnecessary and inappropriate under FOIA," DOJ officials wrote in a legal briefing filed Thursday. Officials were responding to a case launched by Larry Klayman, the founder of the conservative watchdog group Freedom Watch.

The Justice Department describes Klayman’s call for a subpoena as "speculation" in its brief.

"Plaintiff provides no basis, beyond sheer speculation, to believe that former Secretary Clinton withheld any work-related emails from those provided to the Department of State," the agency says.

Riiiight.

But in the meantime, Trey Gowdy has sent a letter to Hillary asking her to turn over her Mystery Servers to a neutral third-party in order to ascertain if official documents have been deleted.

Republican Rep. Trey Gowdy, the chairman of the House Select Committee on Benghazi, has sent a letter to former Secretary of State Hillary Clinton's attorney requesting that she turn over her private email server to the State Department's Inspector General or to another neutral third party.

"The Committee must have objective assurances it, and by extension the House of Representatives as a whole, has received all relevant information requested and necessary for a thorough investigation into what happened before, during and after the attacks in Benghazi, Libya," he wrote in the letter. "More broadly, the equities in these emails extend beyond this Committee. The House of Representatives and the American people are entitled to a complete accounting of the Secretary's official record during her time as Secretary of State."

The letter asks her to respond by April 4.

"Should Secretary Clinton continue to maintain that the server and its contents are hers alone, I will inform the Speaker of the House of Representatives so that he can use the full powers of the House to take the necessary steps to protect the best interests of the American people," he added.

33 The real crime is making the Federal Judge look foolish, but it's easily understandable. The Federal Bureaucracy is so huge that no one department can know what all the other departments are doing at any one moment. So it's easy to see that one department could easily be rounding up the usual suspects and shipping them off to happy happy fun camp while another department is telling the judge that no such thing is happening even as subversive elements are capturing video as the usual suspects are lining up for the buses to take them to Happy Camp.

So no crime was committed here. It was all accidental, coincidental, and the fault of a rogue department that didn't get their email that day.

The Beltway GOP are terrified of taking on Historic First directly, but there's no reason why underlings should not be being hung out to dry.

Very interesting things can happen when low level people end up in front of the hot lights and under oath. Especially when they start to realize they might be thought of by their bosses as disposable patsies.

Most in the "let it burn" camp fundamentally misjudge the situation - no amount of "math" is going for force kineticdramatic change or awakening. The forces of irresponsibility have only begun to tap their options for distortion, theft, and can-kicking.

But an outright collapse in rule of law at a serious level might - slight chance, but might - suffice to shock at least those jealous of their own power prerogatives into action. A full disembowelmnet of rule of law is closest to fruition in immigration. All that's really missing is some good executive-on-judiciary action, and some defiant states leading to a serious national conflict with DC.

With regard to the House and Senate, I don't think this is true at all.

They have substantial power. They've just been cringingly cowed by fear of being called racist into a refusal to use that power.

Eric Holder should have been impeached, for example, after refusing subpoenas. And if he refused to appear, the House Sergeant at Arms should have been dispatched with a squad of U.S. Marshals to bring him in by force.

If nothing else, the ensuing drama would have made clear to the general public that something had gone very very wrong with the normal course of operations of the federal machinery.

I don't give a hoot how it looks on the evening news dragging illegal aliens across the border. Pack the whole family off together if they want to stay as a family unit. I should care, it's a valid concern. The opposition would run wild with it.

They need to end this birthright citizenship loophole. Taht would stop a lot of this nonsense.

We have citizens who can't get jobs and we have lawbreakers competing for what little jobs there are. Put that on the evening news. I believe the balck community is starting to wake up to this because they have been the hardest hit.

This HB-1 visa crap has to stop also. Put a realistic salary requirement and that will stop all that.

Look, I'm not against immigrants. My wife and daughter are immigrants but we did it the right way.

This whole mess is a slap in the face to anyone who followed the law to immigrate. Maybe we need to get some of them on the news.

Had a situation where I got a parking ticket in Va Beach VA. for 2 motorcycles parked in the same space...

Walked up as the meter maid was writing the ticket... and you could see that my Bike was in the center of the spot... someone else I did not know had parked beside it...

Tried to explain... but she didn't care...

Next DAY, I was on a 6 month US Navy Deployment... did the paperwork and the Navy was supposed to go get me a continuance so I could fight the ticket.... they didn't.

Pulled back into Norfolk, and was taken off the ship in cuffs for 'Failure to Appear'....

Spent my first night back stateside after 6 months... in Jail... for a parking ticket...

Next morning... explained all this to a Judge... ended with "just glad I didn't run a Red Light... or it would probably be a death sentence case by now...'

Judge Laughed, made me pay the original fine... and let me go....

You truly misunderstand how shit gets done in Washington, and any Member of Congress' state and district offices. You also misunderstand what it takes to get a member (trust me, they're all really "members") to listen to you.

Take this from a guy who used to answer constituent mail sent over to DoD from the Hill.

I especially enjoyed the thrice annual proposals from various prisons around the country written by inmates who proposed the creation of a "Dirty Dozen" style brigade in the Army where prisoners could have their sentences commuted.

Yes. Those were always the best.

I think I most enjoyed the illiteracy. But I have to admit the the illegibility was always a hit too. Or....or maybe I really just loved them for the spiral bound notebook paper upon which they were written...complete with frayed edges.

Forgive me, I am in a long-term rage state brought on by the likes of out current bunch of traitorous politicians and was perhaps a bit sarcastic.

In reality, I think this is an excellent idea, but I don't have any practical suggestions as to how to get it into a functional process. I think jwest #97 is a start, and Allen's response could be the basis of something really good. Y-not and WeirdDave are also running a fantastic thought provoking "seminar/bloginar" here as well. And I agree, a conservative position honed by Horde constructive criticism should be one that could be presented effectively to a much larger office, if you could find a spokesperson or candidate with the balls to present it.

A key problem IMHO is that you need an administrator/adjudicator and some non-trivial collaborative tools to do something like this as well as a lot of time to get in a presentable state, particularly the interpretive dance part.

On twitter itself, the most recent tweet is at the top. Twitchy, I believe, reorders them to read from top down....i.e., the order in which they were typed, so the oldest tweet is first or the original tweet if you will, followed by replies to the original tweet.

@ precedes someones twitter handle, i.e., @AceofSpadesHQ. If you wanted to send a tweet to ace, you would have to type that first, followed by your msg.
# is what's called a 'Hashtag'. People use it to get something 'trending' or group tweets about a particular subject. If you click on the hashtag you will go to a page that contains all the tweets where people included that hashtag as part of their tweet.

I don't doubt your sincerity at all. In fact, I'm totally with you.

I'm just saying that the VAST majority of members view us as rubes and proles. They believe that they're in Congress because they're smarter than the average bear and the very fact that we're NOT there serves as proof of our low-class status.

I've even seen - up close and personal - "Horde approved" members treating their own constituents like shit. They really DO think they're special.

So, when you get in a member's face as you described, they just smile, and go home and laugh about that guy who thinks his opinion means anything.

You get a members attention by forming a group, raising money, writing op-eds against him, and talking to anyone who will listen. It's a pitifully slow process....but once you reach critical mass, it's the only thing that gets their attention.

My view is tempered by the reality that they're unlikely to listen for quite some time and time is really what we're running out of.

These are worth bookmarking, because he approaches the subject in a methodical manner. He points out that most people who consider themselves "preppers" are thinking in terms of SHTF or TEOTWAWKI type scenarios, which are low probability.

His series starts out with more common calamities like house fires or your car breaking down miles from nowhere, and scale up from there. Definitely worth a read.

You would be surprised by how lead is still out there other in bullet form. It is easily recastable into the caliber bullet you wish. The formula for gunpowder is pretty simple. A little experimentation and you will have a acceptable substitute for what you buy in your local shop for reloading. Electricity is not needed to machine new casings from Brass stock. Casting brass stock is also relatively easy.

The shop to produce all this is easily hidden by woods or underground.

Research is the key.
