Here Are Hillary's Lies

Above-the-Fold Update:

Hillary Claims:

1. I didn't want to carry two phones, one for my personal emails and one for my government emails, so like I violated the law and stuff. No big deal. So she's claiming she just didn't want to carry an extra 4 ounce phone which, by the way, would not even be carried by her, if she didn't want to; The Queen has stafflings attending to her constantly. She could have made Marie Harf carry it.

2. She claims that "the vast majority" of her emails went to government employees, so they would have been "immediately" saved on government servers. She does not discuss the emails to people who are not government employees -- such as donors to the Clinton Global Initiative.

She doesn't mention her top aides also being on her private system.

She skips over the part where the law says all emails must be preserved on the government's servers.

3. She says "I chose not to keep personal, private emails." In other words, she already got rid of her "personal" emails.

So if you can prove any email was deleted -- well, I guess she considered that "personal."

4. "I took the unprecedented step of asking that the State Department make all of my work-related emails" available to the public.

Note that the only press at this event was the typical international, UN crowd, who are generally softer and really Hate Republicans. The first question posed to her, from a Turkish reporter, was "if you were a man, would all this fuss being made." (sic)

Andrea Mitchell asks, Can you explain when and how you decided to get rid of "personal" emails, and are you bothered that you take so much money from countries like Saudi Arabia, which treats women like your husband does?

A reporter asks if she deleted any work-related emails, and further asks if she will be willing to prove this by permitting independent experts to examine her servers. She says she didn't delete any work-related emails, and says, without saying it, No, you're not going to see my server.

She keeps making this claim that she gets to decide which emails are private or not. This is not true.

Asked about whether it's appropriate to conduct government business on her own server, and if she cleared this with anyone, and if there is any precedent for this, she ignores the questions completely. Asked about security, she says this system was first used for Bill Clinton's office, and avows that it is secure and that there was never a security breach.

How would they know, asked anyone who has a modicum of intelligence.

She is being asked again why she did not meet the recordkeeping obligations, and who, if anyone, she had cleared this with. Once again she claims that she's allowed to use private email (she's not), and that she emailed people on their government account. She says the latter suffices for recordkeeping law purposes, quoting some language (for the law, I guess) that it doesn't matter what form this recordkeeping takes.

This is all wrong. Once again, if she emails Algeria after Algeria donates $500,000 to her family, and when Algeria has business in front of her State Department, that email is not getting saved by State Department servers, as Algeria, obviously, does not have an email account on State Department servers.

She keeps ignoring this. Also, she's ignoring... almost everything.

2- the domain ALSO didn't exist for very long prior to her becoming SoS.

She set up the server specifically to allow her to send emails "off books." Had she not set up the home server, she wouldn't have had to worry about "carrying 2 phones" because she would only have had one email address in the first place.

So this isn't about making it easier on her- because the existence of the off-books server actually makes things more difficult all around.

It's my understanding that it was NOT allowed for anyone to do that. yes she could put HER personal emails on a personal server but she would have to show everytime that any email was personal didn't involved her jobs at State.

So NO it wasn't ALLOWED for her to have her emails on her personal server.

In fairness, we do this in my office because you can't run the work account through your personal phone. For a variety of reasons, some about security and some stupid.

Depends on what program they use for eDiscovery, but basically yeah, its a hell of a lot of work, it depends if the emails are in inboxes are already archived (and how they are archived), and according to the IRS, govt employees have full discretion on what to keep and what to delete... and even the "kept" emails go on a back up tape in west virginia, where they are not searchable for ediscovery since they're not hooked up to the network.

There are programs that write over deleted data so that its actually gone.

But more likely, she swapped out drives at some point since her SOS stint when all of this came to light. Copy over everything you want to keep, run a magnet over the old drives, call it a day.

Would also explain why she sent PAPER copys to state. There'd be no way of knowing if the emails were moved at any point.

Not only do I have both my personal and work e mail on my phone, but my company has a fairly strict policy about using personal email for work stuff (the reverse is less strict, though. I can use my work email for SOME personal stuff, but the trade off is that the company is required by law to retain EVERY SINGLE EMAIL i get/send for 10 years, as a publicly traded company. Exactly the opposite.

As former US Senator AND First Lady, she would have/should have been MORE aware of the legal requirements here than anyonee else.

IE, was she conducting her public business as US Senator from NY using private email servers as well?

The fact that she has this specific history only undermines her claims more. She set up private email accounts specifically BECAUSE she had plenty of experience with email conversations being made part of the public record, and she wanted to avoid it. No other explanation passes the "smell" test.

The next stage is for the liberals to tell us it is no big deal and doesn't matter. "Sure, she lied. She was just simplifying a complex issue so that ordinary Americans can understand it better." Or some such. With Bill it was "Well, everyone lies about sex, it's no big deal." With Hillary it will just be "This is a small matter and no big deal. Most companies / govt agencies retain emails for 10+ years and don't let employees delete any not because they're super worried about being in compliance with the department of compliance, but because they're super worried about lawsuits.

Sexual harassment between employees, wrongful termination lawsuits, etc. etc. can all get fucked up if the company doesnt have a paper trail of emails to point to. So, it costs them a few extra grand a year to keep the emails (even outside the window of government requirements), but if Sally in HR alleges that Bill in sales was making sexual advances towards her and she asked him to stop 3 years ago via email and the company DELETED that email, Sally might get a fat paycheck from the company for their negligence in retaining records.

So... it's cheaper to keep them all.

The emails and contacts that they use have varying levels of security clearance, plus the military (at least used to) uses only Blackberry phones. So they might have a personal phone (iphone or android) and one or two work phones.

Unlikely. She's a private citizen now, not a diplomat, and she can't claim diplomatic immunity just because she's speaking at the UN. She could still be prosecuted by federal prosecutors for any unlawful acts she may have committed while SOS, assuming the statute of limitations has not run on the crimes.

Obama could pardon her, if he felt like it, but none of the after-the-fact justifications/excuses she offered today would help her avoid liability, if she did in fact commit crimes.

In short, we have a better chance of recoveringher e-mails from other countries than we do from Hillary herself.

494 Here is the good news. She just put herself in a major corner. After State discloses her self-selected emails, we will have a universe of documents that are "work-related," not personal emails. There will be no excuse for the omission of any work-related emails from that universe. But here is the thing: if any recipient comes forward with an email, and that email is related to her work at State and it's not included in the disclosed universe, she is screwed. Now the media isn't going to go out there looking for these emails, but it only takes one, because that one will be the canary in the coal mine that proves she is lying. It only takes one person who is a little pissed off they they weren't given a primo position to anonymously forward such an email to a Breitbart or someone else. So let's see how this plays out. I don't think think we're close to the end here.

Domain was created early Jan 2009.

Server currently in use is Exchange 2010 which was not release by M$ until late fall 2009 (and few smart IT people rolled that out on day one). So in all likelihood something else was running in there for at least 9 months and more likely much longer. And there were numerous security issues on all of them, including ability to hack into them.
