Amen! I've seen the SNL Hillary skit posted in several conservative sites, but they also absolutely skewered Ben Carson during the Weekend Update section. Not just one joke, but 4 or 5, with the last one being the "comedian" saying something like, "This just in, Ben Carson's presidential run is over. (Recall the Patty Hearst situation, where the nature of her involvement in SLA crimes was a major issue.) Re the "outside the US" aspect, consider the precedent the drone strikes set: suppose Rush Limbaugh crosses into Mexico. OK for Obama to smoke him with a drone? He signs the order, and classifies him as a terrorist. (I'm choosing a silly and extreme example to make a point.) Besides, the Constitution does not limit American citizens rights vis a vis the US government to their being inside the US. So in principle Obama could smoke Rush Limbaugh inside the US, which legally (I believe) would be no different than doing so overseas. So much as I applaud these particular a-holes getting smoked, I do not support use of drones on American citizens, regardless of where they are. This is the ONE case where the criminal justice model SHOULD be applied, not for foreign terrorists on foreign soil, where the drumhead court martial and execution are to be lauded. I disagree. The moment you have temporally divorced the act of punishment (the drone strike) from the damaging act (joining AQ), it becomes a law enforcement question. If you're in arms against the country, outside the country and the reach of normal law enforcement, you're a proper target of intel and military activities, period. The "innocent bystanders" thing seems like a red-herring to me. *IF* the other considerations are all checked off (that is: due process has been followed), then I have no problem with a drone strike taking out a US Citizen terrorist in a foreign country. In that case, I see "innocent bystanders" the same as I do in the case of a raid-type arrest: everyone near the subject is in danger, just because of the situation. We don't have to like it, and we shouldn't celebrate it (well- unless the "innocent bystanders" were all members of AQ in good standing), but neither should we let it stop us. There is a "white paper" the DOJ released justifying the use of drones. The reasoning is thus;
1. The authority given the commander in chief permits him to target Al Qaeda. 2. he was Al Qaeda 3. He posed an imminent threat to the United states, which has the right of self defense. They have a very broad view of imminent, however there is proof of this guys involvement in everything from 911 to Ft Hood to the underwear bomber 4. Because of the lack of cooperation of the Yemeni government there was no lessor step that could be taken So the argument seems to be his membership in al Qaeda plus being an imminent threat trumps his citizenship That is the governments argument. You can pull that apart but please let's stick with the facts as they are. He was traveling with al Qaeda. He was Al Qaeda. His son was not the target and had the appearance of a grown man. He knew he was a target. Jay in criminal trials there are findings of fact. Sometimes the sides even agree when the facts are uncontroverted. When the sides agree to a fact, it is taken as true. Both Hassan and the underwear bomber admitted being in personal contact with this guy and inspired by him. His involvement in thoses cases has been adjudicated. And it's as close as we would ever have got because he would never leave the protection of Yemen.
Since you want to live in the land of hypotheticals, let's try this one out. Let's do what you want. He stays in Yemen. He stays on line. He directs more attacks within the U.S. We, by your reasoning, can't touch him We can't try him in absentia. Unconstitutional. We can't drone him. I guess we could open another front and go to war with Yemen to get him.
