Sefton: sefton at cutjibnewsletter.com | BADASS: State Department Refusing to Answer Perfectly-Fair Questions About How It Handled FOIA Requests Concerning Hillary's secret, hidden Email AccountsBecause when people FOIA'd to get information about Hillary, the State Department never disclosed the existence of these accounts, even when specifically asked about the mere addresses of any private accounts Hillary might use for official correspondence. In other words: They just lied. And now they won't answer questions about their previoujs lying. As The Daily Caller, The New York Times and others noted on Tuesday, Clinton’s use of a personal email account --— HDR22@clintonemail.com -- thwarted the FOIA request process.Because you can't FOIA that which the government will not admit even exists. Since 2009, federal regulations have required agencies to preserve emails generated on outside systems. By failing to make those documents available to the Department, Clinton avoided having her emails made subject to numerous FOIA requests. TheDC wanted to know how the State Department handled those FOIA requests once they were submitted by media outlets and special interest groups. Did the FOIA office search State Department email systems for Clinton’s records and then, because she had not made them available to the agency, determine that no records existed? Or did the FOIA office contact Clinton or her aides only to be told that no such records existed? Figuring that out would shed light on who was responsible for the agency being in violation of federal regulations. It would also help determine whether Clinton went out of her way to avoid transparency, an allegation which was bolstered by Wednesday's revelation that the former first lady operated a private email server out of her Chappaqua, N.Y. home. TheDC asked the State Department these specific questions and others. The agency answered some questions, but ignored the ones pertaining to the FOIA handling process.I can't quote this all because I have to give the Daily Caller the benefit of its reportage. But you should read the article. I am leaving several delicious things out of the excerpt, including... Oh just read it. It'll take you three seconds. Comments(Jump to bottom of comments)1

This seems pretty clear:
All agency-administered email accounts are likely to contain Federal records. This includes email accounts with multiple users (such as public correspondence email addresses) or email accounts for an individual on multiple systems (such as classified and unclassified email accounts). In addition, agency officials may create Federal records if they conduct agency business on their personal email accounts. Email sent on personal email accounts pertaining to agency business and meeting the definition of Federal records must be filed in an agency recordkeeping system. http://1.usa.gov/1GoGVOK Posted by: MTF, Bring On the Art. 5 Convention! at March 05, 2015 06:10 PM (FCsIb) Posted by: OregonMuse at March 05, 2015 06:11 PM (MBVn2) 74
