ATF Moves To Ban AR-15 Ammo

Believe it or not, this is only one of three jaw-dropping and lawless moves by the Obama Administration this week. Oh, we'll get to the others in a bit.

While the media dry-humping itself over Walker gotchas and inane llama and dress color stories, the ATF is doing this:

As NRA has been reporting since the night the news broke, the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) is moving to infringe upon the rights of law-abiding gun owners with a drastic reinterpretation of a nearly 30-year-old law regulating so-called “armor piercing” ammunition. So draconian is BATFE’s new “Framework” that it would prohibit the manufacturing, importation, and sale of M855 ball ammunition, one of the most popular cartridges for the most popular rifle in America, the AR-15. Not coincidentally, the AR-15 is among the firearms the Obama Administration has unsuccessfully sought to outlaw. If they can’t ban the pie, so the thinking apparently goes, they might at least get the apples.

They are honest-to-God moving to eliminate all AR-15 ammunition from the market. This was always a fringe lefty pipe-dream of the "just tax ammo at $15 per round" variety, but now it's a reality. Call your Congressman, for real this time.

Okay, fair. Should have been more clear. *The Administration* is moving to eliminate AR15 ammo. ATF from the non-lead side, followed by what is probably an inevitable EPA lead-ban to follow.

15 While this needs to be stopped its also important to note that green tip is onlya portion of the ar15 ammo. It's the steel core that they are going after. There will still be other types of ammo available for the ar15.

Ban lead rounds from the EPA side of the house, and the market goes to copper/tungsten.

31 I've said it before...the GOP presidential candidate needs to use this kinda thing to advocate for a new law. All federal regulations and policies are frozen in place, and any change must be approved by congress and the president like any other law/bill. Have an annual regulations bill to slow this crap down, and give people better odds fighting it in court. Might make an exception that no vote needed for removal or lessening of regulation, and only needed for addition, creation or increase.

I was pondering this earlier today and here's the problem, other than that whole delegation thingy. *stompys all of the Administrative Procedure Act*

The US system of checks and balances requires that each branch respect the authority of the other. It is not designed and cannot handle easily when one branch runs riot. In this case, it's the Executive more or less acting as if Congress has been disbanded. No, I'm not overstating that. The Executive is acting with full unitary authority. The Court system is not designed to move with alacrity on anything at all. Congress has ceded so much authority since, to pick a date at random, 1946, that it cannot now move rapidly to counteract the Executive's actions.

Thus, when you have an Executive branch who has decided that it will burn all restraint on authority to the ground, then the checks and balances buckle. That's not even taking into account that Congress has stated that it will not exercise the full panoply of responses to such actions.

Now, add in that Congress contains within it those who are not only unwilling to stop the Executive but who are whole heartedly in support of the Executive's actions and we are facing an all out, full blown Constitutional crisis.

The center will not hold.

The EPA was told by the SCROTUS that they cannot ban lead bullets. So I am guessing (judging by the fact they actually mentioned it in their M855 ban proposal) that the BATFE will say that lead bullets have no 'sporting purpose' because it harms the environment.

That 'sporting purpose' flies in the face of the 2nd. It needs to be repealed, along with NFA '34, GCA '68, and GCA '93.

I haven't read it yet so I can't really comment on the specifics of the work. The basic analytic framework he uses is sound and, again, we're discussing another matter where those who were warning about the logical conclusions of the APA way back when were absolutely correct. He is completely right that this is a reversion to the mean of an Emperor.

Here's the thing. Congress could eliminate ALL regulatory authority tomorrow. All of it. Every last little single tiny bit of it. The various regulatory agencies are extra Constitutional (I would argue non-Constitutional) after all. Those agencies exist by Congressional sufferance only. Congress made them. Congress can eliminate them.

Good luck getting any traction for that idea.

There are some practical steps that can be taken by Congress short of that, such as passing legislation eliminating judicial deference to agency decisions. But that won't happen either.

By the by, I cannot tell you how delighted I am at the notion of being a Gojira.

Executive Orders are only meant in the day to day functioning of the Executive Branch. Problem is, the entire bureaucracy - every friggin' agency and department - is under the control of the Executive Branch.

So Federal regulations carry the force of law even if no one in Congress wrote it or passed it, and no voter ever voted for it.

Funny thing is that I'm pretty sure that anything that's done by these agencies can be done by our legislature via a committee. We don't really need these unelected officialsatall, and any perceivedneedhas been created by the agencies themselves.

What I said was he can only issue orders that are supported by the authority given him under Article II and only those LISTED authorities. Not only is there an authority listed that allows him to ban bullets, but there is an amendment that specifically prohibits that.

Okay. INCREDIBLY quick and dirty primer on admin law and, yes, this is leaving out all kinds of bits and bobs but whatever.

My shrieking about the Delegation Doctrine, which is more properly considered the Non-Delegation Doctrine is that Congress cannot merely shove legislative authority off on some unelected officials. I know, I know, don't hurt yourself laughing at that.

But that's why the Administrative Procedure Act is so important. Back in 1946, Congress decided that Governmentin' Is Hard and more or less passed a law that said it could too shove legislative authority off on unelected officials so long as those actions stayed within the lines of the APA.

Needless to say, there is more than a bit of hither and yon as to the bounds of regulatory authority and staying within the lines.

But that also means that, no, the President cannot merely issue any old EO that he wants. In theory, if the various and sundry requirements of the APA are not met, then the agency's action is improper. The big ones for our purposes are publication of proposed rules and limits on rulemaking authority.

There has been a tiny bit of pushback on agency overreach by SCOTUS recently, see re: Sackett and the beatdown of the EPA, but not remotely enough.

Congress can pass laws restricting what agencies can do. Courts can stop acting as if any agency action is due full deference and, more importantly, stop treating advisory letters from an agency as fully implemented rules.

The DOD buys it because of NATO standardization. Look at other better options. Hornady TAP, Speer Gold Dot or Fusion, Mk 318 (or its civilian cousin the Federal Trophy Bonded Bear Claw), or my fave, the 77 grain match loads and the 70 grain Barnes TSX copper solid.

Diversify calibers, and remember, train on the bad guys' stuff. Resupply is the enemy dead if necessary. No point in surrendering or being taken alive. What difference between ISIS chopping your head off on camera or the Feds locking you up forever?

The ban applies to the M855 because of the steel penetrator in it. Note that M193 won't be banned and is actually better then M855 at close range (inside of 200 yards or so).

The problem is logistical. Banning M855 decreases supply, hence increases costs. Since M855 is the NATO standard it is produced in many countries and military production overruns feed into the civilian supply.

So they are not banning 5.56 nor are they banning particularly good 5.56, but they are reducing the total supply which will increase cost. And the market won't act to counteract that fully, because M855 supply leverages off of government production/contracts.

Also, my understanding of the "armor piercing bullet ban" is that it only banned handgun rounds with a complete steel (or other designated material) core, and it does not apply to M855 since M855 has only a pasrtial steel core. Hence the administration is once again making up law as it goes along.

As I indicated in my last post, M193 is actually better at ranges you are likely to use your AR. For longer range use you are better off with heavy 75 gr or 77 gr match bullets used in rounds like Mk 262.

The M855 ban is nevertheless a very bad thing for the economic reasons I posted above.

Both tumble and fragment, but M193 is more consistent and more lethal, as well as cheaper. And it penetrates steel plate better too, at close ranges, owing to the velocity. And it has a slightly flatter trajectory over the first few hundred yards.

M855's advantages only show up at longer distances, where Mk 262 is a better choice.

That said the ban on M855 is disgusting. It is flat out wrong, and will drive up prices long term by reducing supply.
