I Bring You News Of A Great Republican Victory! The Senate Democrats Have Agreed To Accept McConnell's Surrender With Out Additional Conditions.

Earlier today it looked like the Senate Democrats weren't going to let McConnell surrender on DHS/amnesty funding without having Boehner co-sign the document. Reid and the Democrats must have realized that that was a bit brazen even for them. So they let McConnell bring up the House bill with the solemn promise that he would strip out the offending amnesty provisions. McConnell promptly said the safe word ("Bourbon") and thanked the Democrats for being most generous masters.

The only votes against proceeding to the bill came from Sens. James Inhofe (R-Okla.) and Jeff Sessions (R-Ala.).

"Democrats will support getting on the House Homeland Security funding bill. In exchange, the leader will provide the only amendment, [it] will be a clean Homeland Security funding substitute," Senate Minority Leader Harry Reid (D-Nev.) said.

Democrats had blocked the DHS bill four times before. With a shutdown of DHS set to begin on Saturday, McConnell on Tuesday agreed to split the funding and immigration fights, as Democrats have long demanded.

Reid said earlier Wednesday that the Senate could take a final vote on the DHS funding bill Thursday.

"We look forward to working with our Republican colleagues in the next 24 hours to get this done. All eyes now shift to the House of Representatives," Reid said.

Democrats had earlier worried that if they let the Republicans "get on the bill" McConnell would double cross them and make them vote on amendments. Silly Democrats, McConnell only lies to and cheats conservatives.

So how is McConnell going to keep his "clean bill" "clean"? He'll "fill the amendment tree". You may remember this tactic from the Harry Reid days. It essentially ensures the Majority Leader blocks anyone he doesn't want to offer an amendment from offering it. This way his amendment, the one stripping the anti-amnesty language out will be the only amendment that will be considered.

Now if you have a memory better than say a fruit-fly you'll recall that McConnell argued that "filling the tree" was a dirty trick that he would do away with if the GOP got control of the Senate. In fact, he gave a big speech about it upon becoming Majority Leader (when Reid let's him play the part), just TWO months ago.

“Second, bills should come to the floor, be thoroughly debated, and include a robust amendment process. In my view, there’s far too much paranoia about the other side around here. Both sides have taken liberties and abused privileges. I’ll admit that. But the answer isn’t to provoke each other even more. The answer is to let folks debate; to let the Senate work its will. And that means bringing bills to the floor. It means having a free and open amendment process. It means legislating.

“The Senior Senator from Illinois likes to say that if you don’t want to fight fires, don’t become a fireman, and that if you don’t like taking tough votes, don’t become a U.S. Senator. He has always been right about that. It’s time to allow Senators on both sides to more fully participate in the legislative process, and that means having a more open amendment process around here. Inevitably, this would involve taking tough votes from time to time. But that’s always been the cost of being a Senator. We’re all grown-ups, we can take it. And the irony is, it would probably make this place a lot less contentious, since it’s one of the best things we can do to let off steam. If somebody isn’t allowed to get a vote on something they believe in, of course they’ll retaliate; but if they got that vote every once in awhile, they wouldn’t feel the need to.

“Voting on amendments is good for the Senate, and it’s good for the country. Our constituents should have greater voice in the process. They should also know where we stand on the issues of the day, regardless of whether the majority party thinks those issues are worth debating or voting on. And if Republicans are fortunate enough to be in the Majority next year, they would.

“A common refrain from Democrats is that Republicans have been too quick to block bills from even coming to the floor. What they fail to mention is that more often than not we’ve done this either because we’d been shut out of the drafting process or there wouldn’t be any amendments. In other words, we already knew the legislation was shaping up to be a purely partisan exercise in which the people we represent wouldn’t have any meaningful input. And why would we want to participate in that? Is it good for our constituents? Does it lead to a better product? Of course not. All it leads to is more acrimony.

So when he goes back on his word to have an open amendment process does he do it to punish the Democrats for 8 years of procedural tyranny? Nope. He protects those guys and punishes conservatives.

Team Mitch was happy to give Democrats votes on climate change amendments during the KeystoneXL debate. They even touted how there had been more amendments voted on during their first week in charge than all of last year.

McConnell doesn't make the Democrats pay any price for going nuclear and packing the courts on simple majority votes. Hell, he even rewarded them by letting them have their show votes. But conservatives who want to fight Obama's amnesty? They get thrown in the wood-chipper. Plus as an extra special prize, he screws over the House GOP in the process.

Now the story isn't about Democrats protecting illegal aliens over national security, it's about those crazy TEA party nuts in the House who are taking public safety hostage. Which is exactly what the story would have been had the Democrats kept control of the Senate.

If you donated to, volunteered or voted for a Senate GOP candidate last year, you got sold a bill of goods.

Keep something in mind, we're still less than TWO months into the GOP Senate. Do you think it gets better or worse from here? Yeah.

17 Like I said last year: the GOP stating outright and specifically that they will do anything to stop the government from shutting down means they get nothing done except what Democrats want. All the Dems have to do is move toward a stalemate where things lock up and the GOP will always, every time, totally cave and they telegraphed that completely.

There has never been a weaker, more pathetic batch of tepid wretches that we have now in congress. Absolutely despicable.

Its not like anything they do would save the country and turn everything around, but nobody likes a yellow bellied coward.

33 Oh some good news in a "thank the good Lord it isn't happening to us" way. Josh Hamilton is facing some major disciplinary issue with MLB. Apparently "worse" that PEDs.

I don't wish the man any harm, but I'm pretty thankful this is happening while he's no longer wearing a Ranger's uniform.

Posted by: Lauren at February 25, 2015 05:53 PM (MYCIw)

34 Your last point, Drew. Exactly. The new Congress was sworn in about a month ago. After the GOP had *already* taken most of its near-term leverage out of its hands by passing "cromnibus".

Now, this. It's not over - but the Senate side of the GOP has now, literally, pre-emptively surrendered. On an issue the entire party felt too nervous about to surrender back in December (hence leaving this part of the appropriations out of cromnibus).

Amazing. Even in 2015, amazing. And here we are, a few weeks into the session. On an issue with *one* political side (in the electorate): against, strongly. And on this, the Senate GOP folds without a fight.

For those here who are outraged, and appalled, and properly so, a few words. This amendment thing - THIS is really a new low. Not just because the outrage of the years in which Reid abused the process. But for McConnell to explicitly address this very important topic, a few weeks ago - and now this.

Wow. I know it was a different countryand apparently a different universe, but when I was on the Senate side even Reid's behavior would never have been tolerated (withholding unanimous consent, consistently, can shut the place down, and Reid's abuses would have easily triggered such a "nuclear" response just a few years ago).

But for the NEW maj. leader to use this same abusive tactic? As Drew says, exclusively to protect the Dems. I don't think most people here even realize how bad this is.

Amnesty is a disastrously stupid and unfair, unworkable "policy", being implemented in flagrant disregard of the constitution, shredding the rule of law, and it is (paradoxically, in what has become of America?) widely and firmly opposed by the electorate. And on this deservedly hot-button issue, where the political winds, common sense, law, and constitutional/institutional imperatives are at their back, the Senate GOP doesn't just fold, but does so in a way to shield the Dems from even being forced to take damaging roll call votes?

Loss for words.

68 Let me see if I remember how this unfolded. Anyone correct me if I'm wrong.

Upon electing a majority in the Senate (which we were told was necessary to stop Obama, because just having the House meant nothing apparently), the R's decided to pass the "cromnibus" bill in lame duck dem-controlled Senate in order to fund the government for a year.

BUT, the R's said, we wrote it in such a way that DHS will not be funded long term. No, they told us, when we have a majority, we will use DHS funding as leverage to undo Obamas executive amnesties, which is one of the reasons we were, in fact, elected.

Then after some fake hemming and hawing, the R's come to the realization that shit -- Obama might veto our DHS spending bill that strips out executive amnesty! And we don't have a super majority, so we can't overrule a veto.

Shucks, they said. It sounded so good on paper.

Well, now we have to pass a "clean" DHS funding bill. Sorry, voters, our bad! All that stuff we said when we wanted your money and votes... Yeah... about that... Ooops! We meant it, we just, you know, couldn't do anything about it.

And in 2 years they will be saying, 'Hey guys! You know how you gave us a house and a senate majority? Well, get this, if you give us an R president, THEN we can really get to work ... "

And of course, they will continue to support the D platform and agenda, because they don't have 99 seats in the senate and 435 in the house, and only wingnuts thought that with majorities in both chambers and a president, they'd be able to do anything.

And on and on it goes.

So, everyone who freaked out at me and others for sitting out 2012 and 2014 because "it no longer matters who we vote for" ... Do you see my point, yet?

Or will it take a few more election cycles to really sink in?

76 @61 At least Chamberlain actually believed he was restraining Hitler.
-----------------

Not so much restraining, as stalling for time, according to some reports.

Of course, even that didn't work.

But Britain and France weren't ready at that point (though it's also quite likely that everyone overestimated how ready the Germans were as well). And even in 1939, the French got pissy at the Poles when the alliance with Poland dragged them into war with the Nazis.

82 I'm still not sure people realize how unbelievable this is (the amendment tree thing).

The obvious, sensible course for the next two years was to target and sweat every Senate Dem up in 2016 on a few key issues. Typically this would be on filibusters of motions to proceed to a bill, and on veto over-ride votes. You might only win one or two (I think you would win at least two). But meanwhile you would be painting gigantic targets on the backs of those '16 Dem incumbents, (rightly) motivating your own supporters, yes raising funds, and (if the GOP would f***ing open their mouths in a consistent and intelligent way) making inroads in voters' minds about who stands where. Differentiation.

This is the entire meat of Senate political mechanics.

So if this is the model of this Senate, there is, literally, no point to the Senate or its GOP majority. They won't even do the routine, easy, mechanical stuff to help THEMSELVES while pushing sane policies.

Drew may be overwhelmed or resigned, and thus didn't step on the rhetorical gas. But this amendment tree thing is one of the biggest, most outrageous things in years (which is, obviously and unfortuately, saying a lot).

I'm in Commiefornia, so I have the dubious benefit of vote by mail.

Last time round, I received a mail-in ballot, and looked at how the things work. There's a little sealed fold-over flap that's supposed to conceal the area where you write your name, and address, and sign.

I filled it all out and sealed it all up and then experimented, and found it was trivially easy to look in from the side of the "sealed" section of the ready to mail envelope and read off the name and address. Five seconds, tops.

With a bit of publicly available voter registration info, it would be a piece of cake to identify ballots coming from voters associated with particular political parties, and intercept and destroy those ballots as they moved through the postal system. A system staffed by unionized government workers, of course.

Needless to say, I shitcanned the ballot and went in to vote in person.

193 Boehner used Pelosi's "vote on it to see what's in it" strategy with the Cromnibus, cooked up in a backroom by a handful of leaders less than 48 hours before the vote - breaking an explicit repeated promise to allow days of full debate on any legislation, let alone legislation of such scope.

Now McConnell uses Reid's "fill the tree" strategy.

In both cases, they've used these tactics not to attack or frustrate the Dems, but rather their own base and the rest of the people who don't support the unconstitutional amnesties, DREAMers or otherwise.

Consultant-class members (Krauthammer, Will et al) and aspirant apparatchiks (Gabe et al), can peddle as many excuses as they like, but this majority is living up to everything we crazies warned about all last year.
The countdown to "we've done the best we can, we don't hold the White
House, Unity 2016: The Year We Start Fighting" started last November. This time the GOP didn't even give their shit-shovelers a holiday break.

They're the same party that held the whole government under W for years

laughing at us. They won't change. Hell, why should they?

No. Main reason: The GOPe want amnesty (no matter how they can get it) as much as the dems. It's just that simple. The voices of the American people won't stop them. They are our rulers now.

Next step: Encourage your governors to tell DC to fuck off.

Posted by: Soona at February 25, 2015 06:34 PM (/HX7u)

197 Guy, not exactly sure what you're reporting there, but only a very few bills have statutory limits on debate in the Senate. Most filibusters involve blocking a motion to proceed to a bill by "talking" it - that is, not yielding the floor or allowing a vote.

Budget resolutions, however, have a statutory limit of 60 hours of debate, so cannot be filibustered. Cannot recall other bills so privileged (funny, was just trying to remember this talking with my old Senate colleague).

So I *doubt* there is any filibuster-proof or privileged form of a DHS appropriation that can come to the floor. Just an appropriations bill, like all the rest. Well - could be wrong, but hey this is funny in a dark way - this DHS appropriation might be the first one passed "in regular order" (not in a CR) since 2008. Wow. Just one little obscure geeky index of national degradation (and GOP worthlessness, since this situation could have been ended at any time with a willingness to fight and do something).

I'll give it a shot - but remember, I'm not defending McConnell. Hell - I chafe at the notion of defending Kentuckians. But I'll give it a try - out of a sense of fairness.

1. Bevins wins. McConnell gone.

Problem being - Bevins was caught in lies as basic as claiming he was an MIT grad when he was not. The cat really, really was shown to be shady. I was disappointed - because I hoped McConnell would get bounced out on his ass as well. I can't blame voters from recoiling from a candidate shown to be not only a liar, but a bad one.

2. Grimes wins. Doesn't matter because Rs still have the majority McConnell gone.

True - but hindsight is a hell of a thing. At the time, the "We Can Retake the Senate" thing was pretty strong. And remember, It Doesn't Matter Let it Burn folks like me and others weren't taken quite as seriously as we are now ... at least among the DayWalkers that I tend to post with. Plus - the Dem was shown to be pretty anti-coal, including taped comments from her staff saying stuff like - I kid you not - "After the election, they're fucked" regarding the coal industry.

Remember folks - since November - we've went from "These Third Party People are just not serious" to "You've got to be shitting me, why are we still backing these losers".

House has acted, now Senate has a different bill, so conferencing needed, or House takes up/defeats Senate version, then back to conferencing. Or - House ADOPTS Senate version. If THAT doesn't trigger at least an open rebellion in the House caucus, then ....

A small hope. But I'll take it.

After the uprising of the 17th of June
The Secretary of the Writers' Union
Had leaflets distributed in the Stalinallee
Stating that the people
Had forfeited the confidence of the government
And could win it back only
By redoubled efforts. Would it not be easier
In that case for the government
To dissolve the people
And elect another?

Laurie ... I get it. I really do. You and I have no quarrel over this. I wish the bastard had lost too.

All I'm trying to say - poorly apparently - is that I work with more than a few Conservative Kentuckians (yes, they exist) who absolutely HATED Mitch - but backed off of Bevins once he was proven a liar, and then held their nose and voted McConnell in the hopes of a Republican Senate. And that view was loudly encouraged on this board at the time, by all the "sensible folks".

I can't disparage those folks for voting McConnel when not given a alternative. And I can't blame them for not getting to Let It Burn as fast as me. Hell - I've taken shit here for some of my literal Let It Burn outlooks.

240 Wolf, a conference report is not privileged and is subject to a filibuster, I believe. So there's no magic in a conference process, as far as needing only 51 votes to pass. Motion to proceed can still be blocked via objection and filibuster.

In any case, this no-amendment approach by McConnell is simply astonishing in its brazenness - unless there's an angle or consideration I'm missing.

If eighty cents or above for every dollar donated goes to its stated causes, is considered a good PAC.)

254 Amnesty would have happened anyway. Its ridiculous to pretend otherwise. And maybe now we can stop making this silly issue a litmus test. The small, loud minority that cares about this will have to get in touch with reality and adjust accordingly.

256 ""It's almost as if Bevin was a spoiler ... "

It's an unavoidable problem with dissident candidacies, third party or primary alike. Almost all viable candidates and/or their potential donors are scared off by the "you'll never do business in this state/party/country" threats that the uniparty representatives can enforce. Even if your guy wins (like Brat), you're a black sheep forevermore with the establishment and its cronies. If he loses, you have nothing to show for it. And supporting a party that's explicitly against handing out goodies doesn't exactly bring the donors a' runnin, either.

Thus we get a lot of situations where you either run an unvetted dented can or no one.

I'm for starting a third party with very limited ambitions, picking our spots and only running in the bare handful of races where a decent candidate can be fielded. Be satisfied with one House seat to start and work up nationally, do what can be done mainly on local and state levels first.

262 Gee, Begonia, it's probably a good thing that no one you know that didn't go to college couldn't find a good paying trade in say, construction. Because of the huge influx of illegals into the country, the Carpenters union stopped offering their apprenticeship program because nobody would hire them. The jobs had all been filled by illegals willing to work for less and be paid under the table. Or that DBA who had to train his Indian *dot, not feather* replacement who would work for less and then overstayed his visa. Did you know that Parkland Memorial Hospital in Dallas, over sixty percent of live births there are to illegal immigrant women, and none of them have health insurance. You know who picks up the bill? And who picks up the bill for educating all those dreamers when mom and dad are working for cash and not paying any taxes? I believe I read that illegals cost the city of LA sixty billion a year in services. Yeah, amnesty is such a great thing. Victor David Hansen wrote a three part essay on how illegal immigration has radically changed the central valley in CA. Maybe you should look into that.
