So glad we gave up five important Al Qaeda terrorists to get Baby Bowe back.

The television network, citing senior defense officials, said the charges could come within a week.

8 We sorta went over the possible charges in RD's thread this morning. If they were to throw the book at him, he could be executed. But we all know that ain't happening, not with this clown car of an administration.

I still think he'll wind up a leftard hero with a dumptruck full of money soon.

It is not AWOL when in the Face of the Enemy....

I understand that Obama is doing everything in his power to destroy our military... by destroying its institutions, traditions, and its honor...

This will tell us how far the PC Military will bow to him....

This case right here, will show us whose side the military will be on...

The Army says there is no truth to media reports claiming a decision has been made to charge Sgt. Bowe Bergdahl with desertion.

The Army continues to review the case against Bergdahl, said Paul Boyce, a spokesman for Forces Command, on Tuesday morning.

1- The current report from NBC is incorrect, and the Army has not reached a decision at all.
2- The army is dissembling, and leaked this as a trial balloon so that they can increase or even decrease the charges based on public perception.

He has a third of a million in back pay in the balance, and a lifetime disability rating for future pay and bennies...

I'd say they'll rate him ~30% on a headshed VA claim for "pow status"...

the MOST they'll do is wristslap away MAYBE ~25,000 or so BUT my spidey sense tells me he'll be dinged a month's pay "for going AWOL"....

they HAVE to do something or they are derelict in the good of the corps BUT Ogabe doesn't want them to do anything....

what I assure you is they will not do the just thing.....

so yes Bowe Bergdahl will legally be held to have deserted less than a kid who hates military life and runs from boot camp.....

I'll bet hobo bucks on it.

If I remember... Capts Mast could only deal with minor charges... those with a Maximum Penalty of 30 deals in the brig...

AWOL was done at Capts Mast... but the one time a guy did desert, and missed ships movement trying to get out of Desert Storm...

Once the charge was Missing Ships Movement, and Desertion.... the CO had to remand him to a Court Martial.

Another reason he won't be tried for desertion.

Its one thing to have released the 5 terrorists and then to "find out" ("I'm shocked to find there's gambling going on in this establishment!") that the reason he was "captured" was he had gone AWOL.

That one is bad enough, but the American public (even if it were widely known) would think "meh. He's still One Of Ours."

OTOH, if the story is, "Obama unilaterally and illegally released 5 terrorists to secure the return of a deserter/traitor," that one is a whole lot harder to spin.

Based on service length and known pay rates, Bergdahl's back pay and hostile fire pay would be about $150,000. If he is designated as a Captive or Prisoner of War, Bergdahl could also receive special compensation that would total about $148,000. The $148,000 would include Basic Allowance for Housing (BAH), Basic Allowance for Subsistence (BAS), and station per diem over the past five years. This figure does not include interest these payments would have earned over the past five years.

1- The current report from NBC is incorrect, and the Army has not reached a decision at all.

3- The army is dissembling for some other reason (to keep the WH out of the loop, possibly).

Last time Obama gave a speech on a base to the enlisted, I was struck by a wire service photo, which showed that the front four rows of the audience had been absolutely packed solid with black service members (who were loudly ecstatic to see him and fell all over one another for handshakes, hugs and selfies). Far out of proportion to the actual number of black service members.

Meanwhile, the back rows, devoid of blacks, were notably more reserved in their welcome. But of course also less noticeable to Obama.

The media loves disaster stories. It really isn't all that surprising when they overhype them and particularly when they happen where a large percentage of people live including themselves.

305 Are we sure? I mean it is NBC here, if they are reporting it, they could be wrong.

Actually charging him with desertion? Are they sure it is not something else, like AWOL or missing movement?

As I read down the article, it says this:

According to the network, charges against Bergdahl will not say that he left the base with the intent to never return.

So, hard to believe, but NBC doesn't know what the hell it is talking about.

Well, if that is the case, then he is not being charged with desertion. Intent never to return is a necessary element of the offense.

So that means they will charge him with AWOL, most likely.

Which is what I predicted. He will get an AWOL and probably an Article 15 (non-judicial punishment) that busts his rank and 30 days in jail. That would mean that the Army can keep his back pay.

Yeah I hear you but from where I Stand, the over whelming % of those in the Military- and in my case read that as Navy/Marines are still "white" and many of the "Blacks" are from Africa who are coming here to make a better life for themselves and their families and don't assume they are all liberal assholes. They are not. And as I said the the Military I know is still much whiter than the general public. And those American "Blacks" are much better educated than the general population and they are mostly doing it on their own and while many Enlisted are still more liberal than the overwhelming Conservative Officer Corps, they are not crazy liberal.

OBAMA GETTING SUED BY OHIO OVER EXCESSIVE OBAMACARE TAXATION

In a news release, Warren County Commissioners said they opted to make the initial payment of $94,710 on Jan. 15 because the ACA's penalty for non-compliance is $100 per day, per covered life -- or just over $180,000 per day

I doubt that. If fines were true, every state would be subject to them. And it doesn't change the fact that he's expanding a program which is already losing money. Any short term papering over with federal cash will be of no consequence in the long term. If one state were assessed, but not another, then he'd have standing in court.

So here's another politician thinking of nothing but the short term, te election cycle and the MFM.

490 During the Iraq War, there were numerous cases of left-wing activists intentionally arranging to have themselves "kidnapped" by jihadists for the very purpose of then getting exchanged for terrorists held by the coalition forces.

It was seen as a way of putting your body on the line to help fight against capitalism.

Many of these fake kidnapping/exchanges worked exactly as planned.

But in some instances, the jihadists did not play according to agreed-upon playbook, and ended up mistreating/raping/torturing their idiotic kidnap volunteers anyway, as if they really were enemy infidels that had been captured.

And frankly, I had no sympathy for them if that happened. You make a deal with the devil, you deserve to get burned.

I don't think the Holy Father is stupid by any means. I just don't think he thinks that deeply about the political and economic subjects he comments upon. I do think he thinks deeply about faith, and that's evident in his daily homilies and the Angelus, etc. But from his comments I think he is very much out of his depth on the political. He does one of two things: 1. parrots the popular leftist talking points, or 2. Does the wishy washy thing that self-proclaimed moderates do to try and make ex selves look neutral, where you condemn both sides without taking a stand for anything.

And I agree, coming across the southern US border is not brave by any stretch of the imagination. It's a political stunt aimed at the first world. You're right, it would be a brave stand for something worthwhile if he did the same thing but moved it to the southern border of Mexico. It would be brave if he stopped pointing the finger at those trying to preserve Catholicism and instead maybe took the German bishops to the woodshed for trying to sell our faith out in exchange for a bigger share of tax dollars. This crap at our border is BS.

This is intended to shame people in the US into willy-nilly accepting any and everyone that sticks a toe across our borders as a full- on citizen that we are then 100% responsible for their well- being.

If you sit there passively and wait for it, yeah, it won't come up.

The way to yoke a Pope is to ask the Vicar of Christ leading questions about morality. Reagan got it. W got it. Pinkos get it.

508 Ma and Pa Taliban will not be happy.

I still chuckle over Ralph Peters' nicknames for his parents.

509 What wasn't reported is that the unit in question is a Taliban unit.

510 If it hasn't been noted, I'll add that I've seen several leftist articles and tweets that have referenced the right and their accusations against Bergdahl. They used this as an example of the right being extremist or anti-troop. I should have book marked them as this story obviously proves the right right.

511 Bergdahl is NOT a deserter!!!

A deserter merely leaves his post, and the military, with no intention of returning.

Bergdahl intentionally handed himself over to the enemy, which was helpful to them.

Giving aid and comfort to the enemy is what the Constitution calls "treason", if I'm not mistaken.

Similarly, Major Hassan was not a terrorist. He didn't commit some random act of violence to make people afraid. He CHANGED SIDES within our borders. He, too, is more accurately labelled as a traitor.

Why are those two men still breathing?

512 #511 Why are those two men still breathing?
Because the Commander in Chief is playing for the other team too!

513 So glad we gave up five important Al Qaeda terrorists to get Baby Bowe back.

In this instance, Obama followed the Republican playbook for negotiating: Give up something of even more value than that which is being pursued.
