Early Morning Thread, 12/21/14 - Delayed Payments edition. [krakatoa]

Dear IRS.

I'm so terribly sorry your budget has tightened up this year. I know how hard it is to make ends meet on only 11.3 billion dollars. I can only say, America feels your pain.

It was so nice of you to promise warn us of the pain your inability to manage spending would do to the rest of us. Happily, you will still be able to give your people the raises they so richly deserve putting in those long hours shredding hard drives doing the people's work.

Imma just go ahead and claim 20 dependents from here on out, and pay up at the end of the year, so you guys don't have to worry your tender little heads about getting me my refund on time, mmkay?

3 Good Morning Morons. Today is Sunday, December 21, 2014, also the Winter Solstice. On this day in 1937 Disney's Snow White, the first feature length color and sound cartoon, premiered. The film industry called it Disney's folly because they claimed it would bankrupt Disney's studio. It almost did. It took three years to make it because he ran out of money and had to seek financing elsewhere. But in the end it was hugely successful and is still selling in the video market today.

4 For once I agree with a union official. The NYPD police union is attacking DeBlasio for his previous comments on Ferguson and Garner, blaming the assassination of the two police officers on him. I say some of that blood on his hand deserves to go to Obama, Sharpton, and the MFM because they were just as bad as DeBlasio. In fact, the lying MFM is the one who falsely waved the "bloody shirt" to begin with and created this whole meme.

5 The Army lieutenant who was sentenced to 20 years in prison for ordering his men to fire on three Afghans who refused to halt approaching their check point was likely justified after all. There is a push on now to let him out. Sorry, it's not going to happen as long as we have an anti-American asshole in office. This was a BS charge, followed by a BS trial, and a political witch hunt. And what's more, it appears that evidence was withheld that would have found him justified at his trial in 2012.

8 As expected, Cuban exiles not happy with Obama's plans to normalize relations with Cuba. And a correction to comments I made yesterday regarding that "normalization". Based on the wording in the Fox article I said that he was violating half a dozen acts of congress prohibiting trade with Cuba. According to radio news I heard yesterday evening he has NOT lifted trade sanctions and can not do that legally. He needs congressional action for that.

There are penalties for underpayment of estimated taxes if you fall outside a couple of safe harbor provisions.

Ideally you don't want to pay much or file for a big refund on April 15.

Yeah,Ii will be hit with a big penalty this year. My calendar file ate itself early this year where I had all my flags for sending in 1040ES. As a result I filed no quarterly payments until late November. I was sitting here and read an article about filing and it triggered my memory.

It actually started with Wilson converting us to socialism and then communism, but we had not gone full bore yet. We were what economists call a "mixed economy", part socialism, part fascism, and part capitalism. Obama is trying to eliminate the capitalism part and have us all fascism/communism.

Teddy mostly stomped on buisness and left the taxes alone. Wilson raised taxes for WWI and wanted to keep them elevated for his social programs but congress said no at the time so the public was protected.
Now congress is just as bad as Obama. FDR ruined the public.

Just spitballin' it here, JJ, but my guess would be that when those three were planting socialistic seeds, news traveled slowly, and -- at least when Teedie and Billy Howie were in office -- the country was generally happy and prosperous.

FDR and Choom Boy had full-blown Depressions, which makes radical solutions a little more palatable to the Great Unwashed. Plus, both were absolutely tops at co-opting the Elites (FDR's welfare programs for "artists" was an example) and of course the Mocha Messiah had his status as an Oppressed Minority Who is Not to be Questioned.

Withholding is deemed to be paid evenly throughout the year, regardless of when the actual cash transactions happen.

51 It's tricky as they say they watch for single people suddenly claiming large numbers of dependents. (although they can't find the illegals when they do this)

If you are self employed/business and your wind up paying tax every year and you make over a certain amount (don't ask me what the number is), then they'll demand you start paying taxes quarterly and failing to do so will levy a fine and get an audit.

If you're salaried, just figure out how many dependents would null our any with holding. if it's over 7-10 or so I'd be careful and I'd look for some other way to zero my liability. (like quit your job and go on the black economy)

If you're moving somewhere else, consider just stop filing at your new job/location. Sometimes accounts fall through the cracks. Especially if you don't have a lot of other liabilities or any 1099's that can be used to triangulate what you're doing.

They rely heavily on voluntary compliance. They do have programs in place to correlate w-2's with w-4's, 1099's and your employers filings.

But they can only do so much.

Failure to file is usually not enforced until/unless you've made a very large amount and not paid any taxes on it and done so more than once. And it makes it easier if you're a celebrity. People who get charged usually have some other charge along with that.

Also a primary way that the IRS finds out about something you're doing that's questionable is from your ex or soon to be ex, you're account who's also a chiseler and he throws you to them to cut his sentence. They also have a rat line for anyone to tell them about someone else not paying. Sometimes the rats get a percentage of any recovery.

Remember what Ol Ben said: "3 can keep a secret if 2 of them are dead".

The only income I have had since I retired that was subject to withholding was my retirement. But when I started getting SS a couple of years ago my income from retirement went down by the same amount I was getting from SS.

That reduced it below the threshold for withholding. I have been filing quarterly payments also since I retired because most of my income is not from interest and dividends from investments I made over my career. Since the retirement no longer had withholding and there is none for SS, and interest/dividends all of my tax payments are from the quarterly send in.

But still the problem wasn't the withholding amount. The problem is w/o those flags on my calendar I completely overlooked it and sent nothing in after the 1st qtr.

The change to direct election of Senators has, despite what Vic thinks, a certain logic to it. In fact, I prefer it to allowing the corruptocrats in legislatures to pick another crony to "represent" me.

(Yeah, I know the current crop of Senators are uniformly pathetic, but the public carries the can for that, not the basic process.)

And the income tax after WWI is, in a sense, somewhat equivalent to the "Patriot Act" after 9/11. People will suck it up and endure erosion of rights/financial hardship when it is sold to them as necessary to recover from a catastrophe.

I was 18 working construction as a "self employed contractor". I had no clue. Ended up owing about 2k after the year and those guys were like the Mob. Seriously threatened almost daily with garnishment or jail. Ended up getting a high rate loan just to pay them off.

If you move around a lot, you can stay off their radar. Stay in one spot doing the same thing for years and yeah, they'll eventually zero in.

He was also not paying ANY taxes. If you are salaried and the amount taken out is about what you would pay, you can keep from filing for quite a while. (that may have changed as the computers get better) They've tightened up on 1099's from businesses so self employed are easier to track now.

And I'd bet that he had an accountant or partner or boss who realized what he was doing and ratted him out to save themselves some money and maybe get a finder's fee.

If you're completely in the black economy (totally off the books with everyone. Like the illegls do) you can avoid them for quite a while.

And unless you've got large amounts that you paid no taxes on for years, the recovery for failing to file is to send in the forms with late payments and the late penalties. They usually won't bother trying to put you in jail. (unless you ignore them AND stay in the same place where they can find you.)

I think a majority of the current Senators would have still found their way in if they had to suck up to legislators to get their gigs. And perhaps a few who were even more reprehensible and corrupt, especially from states like MA, CA and NV.

Term limits? Absolutely. I'd go farther than that, but will not advocate what I want to see, which is a system that involves dungeons or, perhaps, walls, blindfolds and rifles on a regular basis for any elected officials who violate the law in any way during their terms.

Not talking about term limits for mayor of NYC. There were several States that had enacted term limits for their congress critters. I don't remember all the details, but as soon as the States started passing term limits court actions began. Initially the court refused the cases on standing. Rudy crossed the aisle in a deal with the Democrats to rig a scheme where they could get standing. That is when SCOTUS shot term limits down.

As a small business you can expense a lot of things to keep your net income down. Take advantage of that. If you know however that you will show a big profit in a particular year then making quarterly payments is probably a good idea. Sometimes it depends on cash flow.

I have been looking for the specific case and the details. Originally the anti-term limit crowd could not get standing because the courts said that they had not been "injured". Rudy made a deal with the Democrats that he would provide a case that would get standing. And it did, and standing got shot down.

The case that they shot them down with was finally U.S. Term limits v Thornton coming out of AR. I can't find the initial details but if my memory is correct Rudy was up to his elbows in this case.

The fair tax unfairly penalizes retired people and the developer of that PPOS openly admits that. It also keeps the progressive tax, and it also carries with it a lot of the same unfair bull shit that the current system has. It would be a massive tax increase for me.
A flat tax with no exceptions and no deductions is the best way to go. and a flat rate of 8% would be enough.

I am a flat tax fan myself, but have reservations about 'no exemptions'. Consider my grandmother. She lives on about $28,000/year now, and pays 0 tax. She isn't exactly living the high life, in fact, she's having to spend down her savings.

At 8% she would have to pay $2,240 in tax. That would be a hell of a burden for her. Thus, I have reservations about the 'no exemptions'. Eliminating other Fed taxes would *not* offset the $2.240.

As I understand it, the EZ Pass is a kind of RFID device. Essentially the only information it returns is a serial number. The computers back at the shop match up the serial number to your account and deduct the toll money from your account. Since the location of all the sensors is known, they can easily calculate the time at which your EZ Pass was read at each sensor and if it shows up at Sensor B in less time than it would take to get from Sensor A at the legal speed limit, they can automatically generate a speeding ticket for you.


That capability has always been there. The reason most states have not done that is because it discourages people from getting EX Pass cards and the EZ Pass devices make processing of payments for toll roads much cheaper than any alternatives. If people start prying the EZ Pass devices off their windshields, they either stay off the toll roads, resulting in congestion on the alternate routes and underused toll roads which have trouble paying the bonds which financed construction of those roads.

All in all, it is a short sighted greedy policy that is likely to backfire on the people doing it.

If the prosecutor's office had simply been allowed to winnow out these obviously bullshit "eyewitnesses", the case against Wilson would have appeared much more flimsy from the start, and it would have been much more difficult for Sharpton, Parks and Crump, and the like to whip up total hysteria. (Hysteria that has now resulted in the deaths of two cops.)

Other technologies (laser, radar, MK 1 eyeball) are being used to detect speeding IN the toll plaza area. Which can be hazardous to staff, and to other drivers, depending on the toll plaza configuration. Some toll plazas essentially automated old designs, where toll collectors have to walk from a building on one side across many lanes. Not too unsafe if every car has to stop to pay the toll. If some lanes are entirely automated, there are people who will try to drive through at 70 mph.

Which in GHWB's phrase, wouldn't be prudent.

194 Last year I had some IRS "difficulties", mainly brought upon myself. I kinda fucked up some tax calculations and ended up sending in too little.

A few months after the fact I get a letter from the IRS explaining that I owe several thousand dollars in penalties and interest along with the extra tax I owed.

I wrote back a letter detailing that I made a mistake, why I made the mistake, and asked for a forgiveness of the fines/interest.

A month later got a letter back saying OK, just pay the additional tax within 30 days and we'll waive the fines/interest.

This year I called the IRS as well with a question. After an hour on hold - literally an hour - I had a very helpful and knowledgeable person to talk to.

I'd still love nothing more than to eliminate income tax, but as far as the IRS goes, they're not all monsters there either.

204 You can claim any amount of deductions you want on your W-4, as long as you can keep your owed amount under $1k when you file. It's only when you owe more than $1k that you are supposed to pay a penalty for deliberately underpaying. In fact, tweaking your W-4 so you pay the minimum deduction amount required to stay out of refund territory is a recommendation I see a lot, when it comes to money management.
