Pennsylvania District Court Finds Obama's Executive Action on Immigration to be Unconstitutional

If I understand this right, Obama's executive order became an issue because party in a deportation action sought to claim protections under Obama's lawless order.

The court found Obama's order to go "beyond prosecutorial discretion" and therefore beyond the permissible extent of executive action. He thus discarded consideration of the action in handling the case before him.

The easiest way would have been to say "you don't get to spend money on this" but John Boehner seems to have torpedoed that particular option, at least for the moment.

Among the legal community (especially the actual immigrants, as opposed to those 3rd & 4th generation Americans who just happen to claim still to be Mexican), amnesty doesn't sell well. THEY had to go through the full process, why should these other schmoes get a free ride?

On the other hand, if this doesn't get stopped some way... well, then we have the makings of instant legalization (I can give the rough outline again, but I already have several times). And then the Democrats really *will* completely own the hispanic vote, because so many *will* really owe their citizenship directly to Democrats.

The Russian economy depends very strongly on the price of oil. With oil plummeting recently, along with the sanctions and a few other (otherwise very minor) missteps from Putin, it all added together to do this.

153 I'll take this as good news. Eventually I see the same result in the Supreme Court, and it wouldn't surprise me if a few liberal justices joined the majority.

Is it difficult to force the Executive Branch to enforce laws it doesn't want to? Of course, but if the Court finds this action illegal, the people that actually do the day to day work of enforcing our border with deportations, etc are going to probably not going to risk breaking the law because of Obama's speech/temper tantrum after the midterm elections.

It also slams the brakes on work permits, government benefits, etc for these illegals. If government departments start issuing these sorts of things on their own accord, they will be looking at real legal problems.

Our separation of powers is messy, but it is worth something to have the legislative branch shut Obama down, both legally and politically.
