The court found Obama's order to go "beyond prosecutorial discretion" and therefore beyond the permissible extent of executive action. He thus discarded consideration of the action in handling the case before him.Comments(Jump to bottom of comments)1

Here's hoping that happens over and over. Of course, if the Republicans really cared about it, there are myriad ways they could fight the Executive Amnesty. Things like impeaching Cabinet officials. Let's presume that court decisions such as this one bubble upwards into and through the federal appellate courts.
Eventually, the SCOTUS grant cert. The case is heard. There's a 5-4 decision overturning Obama's executive order. Obama contemptuously ignores the court. Then what? Because that's the most likely of outcomes. Based upon historical precedent. Also among the most likely of outcomes: that "Agent Orange" Boehner and "Guild Navigator" McConnell shrug in pretended resignation, and meekly acquiesce to Obama's latest outrage. Based upon historical precedent. Posted by: torquewrench at December 16, 2014 02:13 PM (noWW6) 38

Sure he does. But do ICE and DHS personnel? Obama will only be in office another couple of years- they have their whole careers to consider. If enough of these cases say "Nope, he doesn't have that authority," then the agencies will follow what the courts say- because failing to do so could prove bad when the next President caves to political pressure and starts looking for bodies to throw to the wolves. The idea is that it's more valuable for the Dems long-term if they can keep using the issue to bash Repubs as the party of white racist who hate Noble People of Color. Yeah. Illegal hispanics. Among the legal community (especially the actual immigrants, as opposed to those 3rd & 4th generation Americans who just happen to claim still to be Mexican), amnesty doesn't sell well. THEY had to go through the full process, why should these other schmoes get a free ride? On the other hand, if this doesn't get stopped some way... well, then we have the makings of instant legalization (I can give the rough outline again, but I already have several times). And then the Democrats really *will* completely own the hispanic vote, because so many *will* really owe their citizenship directly to Democrats. I'll take this as good news. Eventually I see the same result in the Supreme Court, and it wouldn't surprise me if a few liberal justices joined the majority.
Is it difficult to force the Executive Branch to enforce laws it doesn't want to? Of course, but if the Court finds this action illegal, the people that actually do the day to day work of enforcing our border with deportations, etc are going to probably not going to risk breaking the law because of Obama's speech/temper tantrum after the midterm elections. It also slams the brakes on work permits, government benefits, etc for these illegals. If government departments start issuing these sorts of things on their own accord, they will be looking at real legal problems. Our separation of powers is messy, but it is worth something to have the legislative branch shut Obama down, both legally and politically. Posted by: McAdams at December 16, 2014 02:37 PM (s3C2u) 154

"The
center here, benignly named the South Texas Family Residential Center, is to house women with their children while their deportation cases move through the courts. Scrambling to respond to the surge of families across the Rio Grande this summer, Homeland Security officials opened a temporary center for 700 migrants on a law enforcement campus in Artesia, a remote town in southeast New Mexico. The last migrants in Artesia will be transferred out this week and the center closed, officials said.Dilley will begin receiving migrants in coming days. Officials refurbished barracks that had been a camp for workers in this oil and gas boomtown. About 480 women and children will be housed here while a much larger, permanent facility is built next door, officials said." So, yeah, big new processing center. And last I read the "migrants" were being scheduled for hearings 4-5 years out, so I don't buy that this is a place for them to stay while waiting. The ruling does nothing substantive in the short run, BUT - - it is a legal ruling from a judge. I'm sure the regime will go to a leftist judge to overrule it but it's still a ruling that now goes through the courts, and perhaps followed on by many more rulings. Posted by: J.J. 12 The court found Obama's order to go "beyond prosecutorial discretion" and therefore beyond the permissible extent of executive action. He thus discarded consideration of the action in handling the case before him.
