Good Morning Morons. Today is Tuesday, December 16, 2014. On this day in 1811 a series of earthquakes began near New Madrid, MO (now near Memphis). These were the strongest earthquakes to ever hit the eastern half of the US and among the strongest to ever hit anywhere in the US. Although they were very strong there was little damage because there was very little there at the time to be damaged. This area is still considered to be an active earthquake zone.

The Supreme Court has ruled that a search of your car during an unlawful stop may turn up evidence that may be used in court as evidence. I have never understood why this was ever a question to begin with. When did it become logical to trash evidence because a cop violated the law. I say the perp with the evidence should be arrested as well as the cop charged for his violation.

As I said, this case should have been thrown out as soon as it hit the judge's desk. But I suppose they went shopping for an anti-gun judge who disregarded the shield law passed by congress long ago. The Bushmaster case uses the word entrustment which is directly from the Protection of Legal Commerce Act. That bill does not protect negligent entrustment. Haven't read the thing but they will have to allege that the entrustment was negligent.

So I read the filing. The plaintiffs do not even allege that the "entrustment" was negligent. That seems fatal to the case due to the Federal law protecting those who engage in lawful commerce of firearms.
They spend a lot of time making assertions that may or may not be true. But they seem to be trying to say that the victims were wonderful people, the AR15 is a bad terrible, evil gun so please award us a lot of money. The attorneys seem to be pretty successful slip and fall types. I don't doubt in front of a jury of liberal Connecticutians that this could win. But I think that the Defendants probably have decent legal power of their own ( note that Remington is a defendant) . A little research shows that the "fruit of the poisoned tree" ruling did not come along until 1920 and at that time it only applied to federal cases. Although some States adopted it for State law it was not required by federal ruling until 1961. And yes, it is a pure invention of the courts.
In the 80's the courts applied other limitations: Limitations on the exclusionary rule have included the following: Evidence unlawfully obtained from the defendant by a private person is admissible. The exclusionary rule is designed to protect privacy rights, with the Fourth Amendment applying specifically to government officials. Evidence can only be suppressed if the illegal search violated the person's own (the person making the court motion) constitutional rights. The exclusionary rule does not apply to privacy rights of a third party. However, there is a narrow exception to this standing requirement, the jus tertii standing exception. The defendant cannot take advantage of the situation (police breaching rules) to turn the case to his advantage, in face of other evidence against himself. This falls under the exigent circumstances exception. The Silver Platter doctrine which was ruled unconstitutional in the case of Elkins v. United States in 1960. State officials that obtained evidence illegally were allowed to turn over evidence to federal officials, and have that evidence be admitted into trial. Nix v. Williams held that if the evidence obtained in the unlawful search would almost definitely have been found eventually even without said search (inevitable discovery), the evidence may be brought forth in court. If police officers acting in good faith (bona fides) rely upon a defective search warrant, then the evidence acquired may still be used under the good-faith exception. @sven the Bushmaster that was used was bone stock. Like I said, they filled the thing full of dubious assertions that may or may not be true but are intended to make the reader think the AR15 is the worst thing in the world, ever. They reference military versions that are full auto. Even though this one wasn't. It says that higher muzzle velocities means more lethality (remember I said the assertions were dubious), and so pointing out that the AR15 can be made to have these super high muzzle velocities means that selling one means you could make a super lethal weapon (the implication, not explicitly stated.)
As to the courts eliminating the 2d, well, as much as I am in the Let it Burn camp, the court rulings on the 2d are an area that demonstrate that liberty must not inexorably be lost. Do an internet search for "Google Chrome underlines words". There are some malware programs installed, probably when she initially downloaded Google Chrome. It happened when she allowed different processes during the installation. One of the techie helper websites will tell you some key program names to look for. You'll then need to go into the program manager and uninstall the offending programs. It happened to me recently when I had to reboot my system and reloaded Chrome. Some really nasty stuff in those programs. I got rid of about half a dozen programs and it brought my system back to speedy performance. @sven rumor mills are full of all sorts of info that is also dubious. She was shot in the head four times with a Savage MkII. Doesn't mean that she did or did not buy the Bushmaster for him, but he obviously had access to that rifle without her control, but Savage is not on the defendants list, mainly, I guess, because the attorneys don't represent her estate. The Savage in .22 was bolt action and deadly enough, but that would cut against the argument that the AR15 is uniquely bad. Here is a problem. We are skeptical of the police. I have been in court and watched cops lie and they don't get sanctioned for it. If they lie over stupid little traffic stops I don't doubt they would lie over bigger things.
If we are skeptical of the cops and then reflexively back them when the victim is black, it wouldn't be unreasonable for people to think that this is racism. I am with Mark Steyn on this. The cops kill too many people (and dogs). They have near complete immunity with what they do. And when they do it to support the State instead of the people it is dangerous. I've got plenty of relatives who are cops, the ones in the City have terrible jobs, everyone they interact with is a junkie, a thief or a violent gang member, just shitty workday after shitty workday, so glad I never wanted to join in on that tradition. The ones who work in small towns seem to enjoy their jobs a lot more, have happier lives. Though even in some of the bucolic NE towns, one or two Section 8 developments can bring all the hassles of the big city.

Another interesting aside about the case filing - they go off on Colt even though it isn't a named defendant. Colt's HQ? Hartford, CT.
This case is going nowhere. It may be in the court for a while (read years) tied up in motions, but, like I said, the defendants likely have good lawyers and no doubt the NRA-ILA would be on board, too, and they ave some pretty high powered talent there, too. First MTD would be based on the Federal law which should - should - be all that is necessary to dismiss with prejudice. I would hope that the MTD also ask for attorney fees, also, since the Federal law specifically enjoins the case from even being filed - and they don't allege any of the exceptions to that, particularly negligence. Further down the line would be a change of venue, to get it out of liberalland into a different venue that would have some of Connecticut's plentiful hunters in the jury pool. The police slang for "fabricating evidence to use against a suspect" is 'framing'. Fabricated evidence is 'planted'. The gun used to justify a shooting when the suspect was unarmed is a 'throwdown'. The slang for "Police accepting bribery to ignore criminal behavior" is 'being on the pad'. Do I need to go on? These events are such common every day events that there is slang for them. Some of them are so common that everyone has heard them and don't even realize they are police slang terms. Sure, in special isolated cases police have gone to jail for fabricating evidence - when their fabrications were so transparent that there was no way to avoid seeing through them; but in the vast majority of cases the fabrications stand up.
