Yes, Congress Can Defund Amnesty

A follow up to my post on ways the GOP can fight Obama's amnesty.

Earlier a staffer with the House Appropriations committee said that they couldn't defund amnesty because Customs and Immigration Services isn't funded by the annual appropriations bill.

Sean Davis of the Federalist and former congressional staffer tweeted to me this was wrong. He's now written a post calling BS on the claim that Congress doesn't actually have "the power of the purse" over amnesty.

They’re correct that USCIS spending is funded primarily by fees collected by the agency, and that the spending is mandatory, rather than discretionary. That means that USCIS does not need annual authorizations to use those fees to offset expenses. This is actually written into the 1882 law establishing the fees and the authority of the federal government to spend them:

[Follow link to see excerpt from the law]

The only thing that differentiates mandatory and discretionary spending is how often each must be re-authorized. Every single dollar spent by the federal government must be first appropriated by Congress. Just because some spending is not subject to annual appropriation doesn’t mean it’s not subject to appropriation at all. Congress can’t block Obama’s executive order by shutting down the government, but it most certainly can defund it by law.

So yeah, don't buy the "we can't do anything about it BS".

Sorry for the earlier confusion.

3 Unfortunately it doesn't matter. It's all just words. A law is just a bunch of words. The GOPe can defund every damn thing it wants, but it'll do no good. Obama will just carry on merrily breaking the law and daring the GOP to not send out the paychecks.

40 I'm really confused at this point.

I'm not sure if this is the right hand not paying attention to the left (ISIS crisis vs Amnesty) or if the whole amnesty gig is designed as the final nail in the coffin of the Republic.

Quite obviously, there is no political capital to be gained or lost through amnesty. And I don't get the optics of this move, other than putting the coins in the eyes of the republic.

42 Work on an immigration bill that simply states that naturalization status for exisiting illegals is entirely dependent on the effectiveness of preventing further illegal immigration. He wants a million naturalized? Fine - he has to deport 1 million first, and get illegal immigration below 50,000 per year.

At that point he can't claim there is no plan and he has to act himself. It also ruins any potential defense he might have in court.

Yes, this exactly. The night he was elected I said, "Now I know how the non-Nazi German citizens felt in 1933."

Shortly thereafter I remember seeing a photo of a tombstone photoshopped with "America: July 4, 1776 - November 4, 2008".

The country really did die that night. Every thing since has just been the rotting and festering of the corpse.

This is payback
to the Hispanic groups and media for their unwavering support the past 6
years. They don't particularly like Obama but are using him to get
what they want: a new Hispanic country. Remember that interview by
Jorge Ramos where he unexpectedly started to grill Obama, including
about Fast and Furious? That was a warning shot they they could easily
turn on him and ruin him. "We know who and what you are and what you
are doing. You do as we say or we pull the trigger." Few people really
understand the message that was being sent, although Obama and his
handlers clearly did.

For almost twenty years Congress has lied to the American people,
promising to control the border and stop employment of illegals then acting
like a shell game operator and doing
neither.

Until the border is closed and real roadblocks are put in
place to stop employment of illegal aliens are put in place any attempt to legalize
the illegals here is just government spitting in our face.

Comprehensive immigration reform is just a code word for
legalizing illegals and letting everything else disappear down the road.

Hugh Hewitt, of all people, makes some great points in his column at Townhall. The gist is that Obama is a lawless cheat and everybody knows that. Because of that fact, the illegals will know this is no "solution" to their problem, merely a temporary reprieve, and Congressional Democrats (who might give superficial support in the next few days) are really going to go right away into damage-control mode on these EO's.

Worst of all, from the Democrat perspective, is the future damage GOP Presidents will wreak on favored programs in the Environment, foreign policy, taxes, EEOC, Justice Department overreach, and on and on.

The Whigs ceased to exist as a political force in the US, because they lost the trust of their Base...

The base was saying one thing on Slavery, the leadership was impotent by design.... just like the modern GOPe...

They ceased to exist as a party, in eight years... with 1850's technology.

Just as the Declaration of Independence speaks about the consent of the Governed when speaking about government.... Political Parties MUST listen to their base... or like the Whigs, they will cease to exist.

95 I may have missed it being explained somewhere, but I don't understand how the power of the purse works without the involvement of the President.

I don't see where Congress can rescind funding legally without an act that must be signed or vetoed by the President. If it's vetoed, the veto has to be overridden.

If Congress does only passes partial funding bills, the President and the MSM portray this as shutting down the government. And today and probably into next year, these bills will not reach the President's desk because they will always be one vote short of passing the Senate.

It looks like the MSM gives the President enormous power, because they always can slant this.

Is there really an end run that works. Is rescission without Presidential involvement doable?

The executive can't spend anything unless and until the legislature authorizes it. The executive's veto power acts to strangle his own administration. He can veto a particular authorization to demand an amendment; the legal effect is to deny himself funding. The funding is denied, unless it is approved.

This assumes the legislature will remove the executive if it proceeds to issue promissory notes and drafts without authorization.

This, actually.

It's a lot harder (not impossible, but harder) to paint a shutdown as the result of "Obstructionist Republicans" when the Republicans are busy passing funding bill after funding bill.

Especially when none of those contain language that does anything TFG doesn't want. Here a bill to fund DoD. There a bill to fund State. Over that way a bill to fund... whatever. You don't even need "poison pills" in any of them (at least, not until most of the government is back up and running).

At some point, Democrats are going to realize that the SCOAMT isn't up for reelection in 2 years, but they are. If they're nervous enough in the Senate, we might even get a veto overridden.

I agree. Last time the shutdown occurred right before the Obamacare rollout. The public hadn't seen all the destructive elements of Obamacare and did not support what they perceived as a Republican led fight.

Now the public has seen Obamacare and they hate it. More everyday. And they do not support this type of executive action.

If it is handled properly, a shutdown could be blamed on Obama this time. Particularly with a united Congress.

No it can't, because the Liberal Democrat Union Member Media will not go along with it.

When Reagan vetoed the budget, (because the Democrats put up insane levels of spending) The media blamed the President.

When Clinton vetoed the budget (because it didn't have enough spending to suit him) The media blamed the "Republican Congress."

The media is the fly in our ointment. It is the Gordian knot tying most of our problems together. It is the institution that we ought to be working to destroy because if we don't, it's constant leftward push will eventually destroy us.

So when the GOP takes the White House next, they'll just do the same thing, right? Enact public policy and rescind Acts of Congress by just ordering non-enforcement.

No prosecution of Obamacare mandate absconders...taxpayers who refuse to pay capital gains or more than 15%...Polluters...

Posted by: Radeaminit at November 20, 2014 01:38 PM (Xv7f/)

175 The GOP's own immediate political calculations are more important than defending the very document that gives them power.

What gives them the right? They swear an oath, the GOP has a DUTY:

I do solemnly swear that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter: So help me God.

178 "There will not be a "defunding" bill for Amnesty. You can't "defund" a non action."

He's reportedly also promising to issue work permits they can carry to third parties, which is a positive action requiring funding, and incidentally demolishes his theory of "discretionary prosecution".

Senator Ted Cruz went to the Senate floor today to quote Cicero against Obama's illegal amnesty.

180 I'm baffled still by how the Senate passes a bill. Does it require 51 (or more) votes to pass or does it require 60 (or more) to pass.

I thought 51 was enough, and if it also passed in the house then it goes to the President for veto (what else).

If that's the case, why did Keystone fail with59 votes to pass? What is this "key procedural threshold" that held it up? Will the next Senate with59 republicans be able to get past that and get these bills onto the President's desk?

Question for the legal types.

Let's say I'm an illegal Hungarian alien who is not covered by Obamanesty.

ICE tries to deport me.

Can I defend on the basis of selective enforcement and national origin discrimination?

191 "Rush is dumbstruck and frustrated today...like Levin was last night... This is a seminal moment for our country... we're watching a contrived and purposely agitating ( see community organizer ) Constitutional crisis."

That's why the Congress will scramble to end the crisis by giving retroactive authorization.

And that's why Obama does it.

Posted by: Radeaminit at November 20, 2014 01:38 PM (Xv7f/)

It's charming that you think they'll be able to take it next. We might excel in future mid-terms due to the fact that the left can't really be bothered with those, but the general? With possibly 10 million new tax paying voters (because it *will* happen that way) paying back the favor the JEF just did for them?

Posted by: tdpwells at November 20, 2014 02:17 PM (5ZFPz)

195 Sure they can defund it in the House, see the bill get tabled in the Senate, and nothing happens. I don't have any confidence that they will do anything in January, but wait and see maybe?

My best guess, for what its worth (which ain't much) is that they will do a lot of delaying actions, avoid controversy, and be fairly quiet until 2016 (like the Democrats largely did from 2006-200.

196 Money is fungible. The bureaucrats just shift things around and adjust the color of money. To really hit where it hurts - cut SES positions and limit the number allowed within 100 miles of DC. Don't just cut travel budgets, limit the annual total per individual in SES positions.

Oh Noes!!11!! How will the gov't recruit the "best and the brightest"? Well, the current crop isn't doing so hot, maybe we should let the "adequate and the competent" have a shot.

Posted by: supergirl at November 20, 2014 02:54 PM (bNnI1)

197 What a lot of people fail to realize is that most of the Democrat leaders don't really care if they lose elections. Whether they win or lose, their agenda keeps marching on.

If we win in 2016 it still won't matter. Winning then, btw, is an open question. If we have a bunch of new socialist voters, it may not matter if HRC is a lousy candidate. They'll vote for Socialism, because it is what they believe.

In any case, unless Americans find some way to get the Socialist lifetime appointees, their army of dug-in bureaucrats and the RINOS themselves out and stop the shredding of the torn and tattered Constitution, this whole lousy program will just keep marching merrily along.

I have, as I said before, pretty much given up hope. People bellow and bloviate, make threats and bluster, and nothing gets done. I don't believe anymore that anything will be done before it is far too late. It may be far too late already.

I used to want to live forever. Now all I want to do is take care of my responsibilities until they don't matter anymore. Living and vainly hoping that things will be better is heartbreaking. I hate myself for clinging to shreds of hope because it hurts too much to watch everything we had piddled away by our "leaders".

America is ending because a vile ideology has taken hold in all the halls of power, and no one will act to stop it.

200 the republicans won't do anything about it. the republican party is weak, weak, weak, and between boehner and mcconnell i don't which one is the bigger wimp. neither one of them has any idea what they are dealing with, and niether one of them knows what to do, at least that is what they are feigning. you all know that the republican party has many that support amnesty. for these jerks, the more immigrants the better! they want cheap labor, and they don't really care about the culture, traditions, and history of this nation. as long as they can make a buck, great! they also like obamacare. after all, they won't have to be stuck with it like the rest of us. they will NOT do A N Y T H I N G, and we all knew they wouldn't stand up to obama even as we held our noses as voted for them. we knew that they were progressive-light. as george carlin once noted, "this is the best we can do, folks." these republican leaders are our best and brightest? teh. the republican party is no longer a viable political party at this point, and furthermore, this is no longer a representative republic.
