Jonathan Turley Will Represent House of Representatives in Lawsuit Against Obama's Executive Lawbreaking

Zealous advocate.

As many on this blog are aware, I have previously testified, written, and litigated in opposition to the rise of executive power and the countervailing decline in congressional power in our tripartite system. I have also spent years encouraging Congress, under both Democratic and Republican presidents, to more actively defend its authority, including seeking judicial review in separation of powers conflicts. For that reason, it may come as little surprise this morning that I have agreed to represent the United States House of Representatives in its challenge of unilateral, unconstitutional actions taken by the Obama Administration with respect to implementation of the Affordable Care Act (ACA)....


As many on this blog know, I support national health care and voted for President Obama in his first presidential campaign. However, as I have often stressed before Congress, in the Madisonian system it is as important how you do something as what you do. And, the Executive is barred from usurping the Legislative Branch’s Article I powers, no matter how politically attractive or expedient it is to do so. Unilateral, unchecked Executive action is precisely the danger that the Framers sought to avoid in our constitutional system. This case represents a long-overdue effort by Congress to resolve fundamental Separation of Powers issues. In that sense, it has more to do with constitutional law than health care law. Without judicial review of unconstitutional actions by the Executive, the trend toward a dominant presidential model of government will continue in this country in direct conflict with the original design and guarantees of our Constitution. Our constitutional system as a whole (as well as our political system) would benefit greatly by courts reinforcing the lines of separation between the respective branches.

After I testified earlier on this lawsuit, I was asked by some House Members and reporters if I would represent the House and I stated that I could not. That position had nothing to do with the merits of such a lawsuit. At that time, in addition to my other litigation obligations, I had a national security case going to trial and another trial case in Utah. Recently, we prevailed in both of those cases. Subsequently, the House General Counsel’s Office contacted me about potentially representing House. With the two recent successes, I was able to take on the representation.

He just spoke about Obama's long train of abuses recently.

"It's a very sad moment but it's becoming a particularly dangerous moment if the president is going to go forward, particularly after this election to defy the will of Congress yet again. I can understand the frustration, these are two political parties that cannot get along but as you said, we have a Democratic process and a Congress that's coming in with the full voice of the American people behind them, that's what an election is, you may disagree with the outcome, but you have to respect the outcome," Turley continued. "What the President is suggesting is tearing at the very fabric of the constitution. We have a separation of powers that gives us balance and that doesn't protect the branches. It's not there to protect the executive branch or the legislative branch, it's there to protect liberty. It's there to keep any branch from assuming so much control that they become a threat to liberty."


"I always tell my friends on the Democratic side, we will rue the day when we helped create this uber presidency," he said. "What the Democrats are creating is something very very dangerous. They're creating a president who can go at it alone and to go at it alone is something that is a very danger that the framers sought to avoid in our constitution."

That would look and sound like the biggest green light in the history of green lights evah to proceed with impeachment.

Which is something that should've already happened. The Repumpkins need to get out in front of this and using just a few selected phrases consistently, they could. They could, for instance, wonder out loud why the president feels it necessary to shut down the government if he doesn't get his way. They need to be vocal to shift the responsibility away from them and onto TFG where it belongs.

"Who ordered the signs saying that the national monuments were closed? You should ask the President."

This would also require standing up to the presstitutes at all times and questioning their reporting and motives whenever possible. Newt could give seminars...

There are ways to court public opinion. The Repumpkins just have to want to.

(Most presidents fall back on foreign policy to remain relevance when their parties get a drubbing in a midterm. That Obama doesn't shows that he was never interested in foreign policy, the natural sphere of presidential power. Beyond adulation, I don't think there really is anything he is interested in.)

I think the point that he is not a conservative but a very well known and respected Constitutional expert from the left is exactly the point. Its a lot more powerful having a guy from the other side say Obama is going to far than having someone on our side say it.

Turley has already testified to Congress that Obama was going to far. He may be a left but he does seem to have great respect for the Constitution and separation of powers.

89 A lawsuit is a pretty feckless way of going at this, and one I'm not sure the Court would allow. If Congress has issues with the President, and it should, it has constitutional remedies available: power of the purse, power to withhold confirmation (thanks Drew), and power to impeach. All three expose Congress to political risks. You know what, that is exactly how the Constitution was set up, to let the electorate know where the accountability resides. The voters can then decide.

Sounded to me that he was putting forth the "goose and gander" argument that Turley just put forward, again. Yep. Mixed feelings on this. On one hand, he makes a compelling argument and seems to be a true believer in our primary objection to the Obama Admin and the Reids/Pelosis that enabled him. On the other, you really voted for Obama and thought the ACA represented a positive in the health care reform debate? It is not. Frankly, the courts should dismiss it. Congress has real Constitutional tools at its disposal. We should demand they use them and not this worthless approach.

On second thought, maybe just having it Court will limit Obama. As I have been on the side that Obama is just bluffing, this could give Obama a reason not to do anything. He can tell La Raza that he wants to do it, but those dart GOP sued me.

Ultimately, I don't think the Court should be involved, but it could just give Obama the excuse to get out of his bluff - and I still believe it is just a bluff - though as I said a few days ago, I'm less convinced of that than I was a week ago.

Jon also has a track record of going after other government secrets, including environmental damage and worker ailments from Area 51.

He recognizes he has the power to directly confront and obstruct Obama, but, he doesn't want to; he wants to cooperate with Obama while having some judge narrow the terms of their negotiation for him. The courts don't do that, for anybody, and they're not going to start with Congress and the President.
