@gunpolicy
"Although the district court’s injunction applies only to plaintiffs and certain other specified persons, the Department has determined to exercise its enforcement discretion to create greater uniformity, consistent with the Attorney General’s statement today. Consequently, effective October 9, 2026, ATF will no longer require individuals to seek ATF approval under the NFA before making or transferring short-barreled rifles, short-barreled shotguns, silencers, and “any other weapon” as defined in 26 U.S.C. § 5845(e). ATF will also no longer require such items to be registered in the National Firearms Registration and Transfer Record. These policies apply uniformly to anyone otherwise subject to these requirements, not just to the plaintiffs in the litigation."

On a related gun note, United States v. Miller ( 1939 ) was adjudicated incorrectly by the Justices' own logic. The defendant was not able to defend, and the court decided that sawed-off shotguns had no military use, which of course they do and did back then; if you are in cramped fighting conditions like house-to-house and room-to-room fighting, they are quite applicable.

38 Ok, from the horse's mouth, ATF site:

"Under ATF’s guidance, ATF will not enforce the requirements for individuals to apply and receive ATF approval before making or transferring short-barreled rifles, short-barreled shotguns, suppressors (silencers), and certain other concealable firearms known in the law as “any other weapons.” ATF also will not enforce the NFA’s registration, tax-stamp or related requirements for those covered items. The $200 tax remains in place for machine guns and destructive devices. The NFA requirements apply in full to those weapons.

The guidance does not supersede state and local laws that restrict NFA firearms. Because many state laws require individuals to register NFA firearms, ATF will continue to process NFA applications that are submitted. The guidance also does not affect the Gun Control Act’s requirement to obtain ATF approval before transporting short-barreled rifles and short-barreled shotguns in interstate commerce. Individuals may obtain that approval by filing a Form 20, whether or not the item is registered under the NFA."

70 There are no rules about responding to your own comment. In literature, it's called building a narrative. Even when building a beautiful edifice, you're going to spill some mortar. Michelangelo left a big pile of marble chips and shards, when sculpting some of the finest creations in human history. Don Garlits left rubber on the dragway.

107 On a related gun note, United States v. Miller ( 1939 ) was adjudicated incorrectly by the Justices' own logic. The defendant was not able to defend, and the court decided that sawed-off shotguns had no military use, which of course they do and did back then;

They knew what they wanted to do and they did it. The decision said that it "was not in judicial notice" that short barreled shotguns had military use. Which was true since the defense did not show up and presented no evidence at all. They choose intellectual dishonesty.
