Supreme Court Refuses to Allow Trump to Procede with Post Office Scanning of Mail-In Ballots, Claiming (Say It With Me) It's Now Too Late to Implement This Rule and It Would "Cause Chaos"

They did exactly what I said they'd do -- Democrats launched lawsuits to delay things and then the courts slow-played it so they could just say, "Whoops, there wouldn't be enough time to implement these changes now that we've dicked around for weeks and weeks, you lose."

This is intolerable.

The Supreme Court on Monday rejected the Trump administration's emergency bid to enforce new U.S. Postal Service (USPS) restrictions on mail-in ballots ahead of the 2026 midterm elections, leaving a lower court's nationwide block in place.

In a brief order, the court said the government was "unlikely to succeed on the merits" for purposes of obtaining emergency relief and had not shown that the legal and practical considerations warranted a stay.

The rules would require federal ballot mail to be sent in envelopes bearing an election-mail logo, capable of being scanned by high-speed equipment and carrying a barcode unique to each voter.

State and local election officials would also be required to submit envelope designs to the Postal Service for review and upload basic voter information to an online USPS portal.

Under the USPS rule, mailings that failed to comply would not be accepted and would instead be returned to election officials to correct and resubmit.

A federal judge previously blocked the USPS from implementing the rules, including the online portal that could be used to track millions of mail ballots.

Justice Brett Kavanaugh agreed with the Supreme Court's decision but indicated the USPS may ultimately have the authority to impose the requirements.


"In my view, based on the briefing the Court has received at this interim stage, there is at least a fair prospect that the final rule falls within the Postal Service's statutory authority," Kavanaugh wrote.

However, he said attempting to apply the rules during the 2026 elections would be "arbitrary and capricious" under the Administrative Procedure Act because state and local election officials do not have enough time to reasonably implement them.


Justice Samuel Alito dissented from the decision, joined by Justice Clarence Thomas.

Alito argued that some of the plaintiffs lacked legal standing and that the remaining challengers were pursuing what the court has previously called a "Hail Mary pass" that "rarely succeeds."

"The Government has made the showings necessary for a stay, so I respectfully dissent," Alito wrote.

Alito said the USPS has broad authority to regulate the collection, handling, transportation and delivery of mail. He also argued that the government would suffer irreparable harm because any reversal of the lower court's injunction would come too late for the midterms.

New York Attorney General Letitia James, whose office helped lead the legal challenge, celebrated the decision as a victory for voters.

"Today, the Supreme Court protected one of our most fundamental, inalienable rights -- the right to make your voice heard at the ballot box," James said. "This last-minute change could have thrown our elections into chaos, and I am truly relieved the Court granted this reprieve."

56 I think the final USPS rule that was promulgated in August was too aggressive in what it required to have much of a chance to be upheld. I think this rule is playing for 2028 with the much bigger prize of the Presidency.

The final rules require:

1. Federal ballot mail be sent in envelopes with three special features: an election-mail logo, the ability to be scanned using high-speed processing equipment, and a specialized barcode unique to each voter.

2. States must design envelopes that adhere to these requirements and submit the designs to the Postal Service for review.

3. States must upload basic information about the voter to a Postal Service portal.

IIRC, only 12 states of the 50 said they could comply with this in time for November. There are certainly more than 12 red states. So even some red states didn't think it could be done.

This is a play for 2028. If it was truly for 2026, Trump would have announced these final rules much earlier than last month.

One of the secrets (it seems) of elections is that overall trends are unevenly spread across the country.

So, electorate goes from R+2 to D+5? Does that mean every district moves to the left seven points?

Of course not. It's going to be deeply uneven.

Deep blue districts will end up accounting for most of the change because they're the most motivated to vote. Deep red districts will hardly budge at all and may even stay exactly the same. Swing districts may move a few points, but definitely not evenly at 7.

That pattern could get worse with the increasing division between how red states and blue states are running their elections. A million more votes in Los Angeles will definitely win the city's districts...which were already D. But nothing for FL in that.

We're screwed and its not trumps fault - is pretty hard to argue against. Barring divine providence, this isn't a problem that is fixable by routine human politics and it was that way before he got started.

It is only a project of part of a day to redesign a flyer to match postal rules for barcodes like that. I used to show reasonably bright high school guys how to do stuff like that all the time. The delay comes from governments designing the RFQ etc... and then kicking off the print shops.

I love the fact that there seems to be an API for everything.

While cleaning up I came across a big old box of cassette tapes, probably a couple of hundred.

I was thinking I should catalog them but doing so would probably take a couple of weeks of manual entry.

So I was like, there's got to be an API out there with a barcode database for music cassettes and sure enough there is.

Built a python script in about an hour, tested it by manually entering in a couple, it worked flawlessly, dug out a barcode scanner from my, I'm probably going to need this in the future box.

And voila, it works.

The API in question is Discogs API.
