The registry is a Biden-era artifact that registers training providers (driving schools, training organizations, independent organizations that train their own people, etc.) who self-certify that the requirements are met. The registry is public and searchable, and the largest category (Class B behind-the-wheel instruction) has about 3,800 providers listed. In total, going category-by-category, there are just over 28,000 providers currently listed - but there is overlap across categories. A lot of it. At least 739 organizations are listed a total of nine times, since they offer programs in every category. The real number of unique organizations on the list is much, much smaller than the gross number. This puts that 8,000 figure into perspective. Over the last 18 months, federal DOT has probably purged between a third and half of the list, and the 110 removals in this week's emergency action are just the latest wave. Late last year, FMCSA chief Derek Barrs announced that the agency will be winding down the self-certification model, since it is rife with fraud and general inaccuracies (including dormant and defunct organizations). Dumping a large portion of the registry in 18 months is a strong indicator that the registry doesn't work. Along with the 110 revocations announced, there are more on the horizon. From the DOT press release:In July, FMCSA sent 175 investigators in 40 states to conduct nearly 400 investigations of ELDT [Entry Level Driver Training] providers. The investigations uncovered several serious cases of non-compliance ... These targeted efforts resulted in more than 160 notices of proposed removals from FMCSA's TPR. Drivers certified by these 160+ ELDT providers are linked to 239 commercial motor vehicle-related fatalities."More than 160" out of "nearly 400." For those of you doing the math at home, that's a lot. Assuming it is exactly 160 and 400, that amounts to a staggering 40%, and that appears to be a floor. 40% of investigations turned up enough bad behavior that the DOT is going to pull their certifications - on top of the 110 they already did during this initiative and the ~8,000 that preceded it. While DOT is working on purging bad training organizations through the registry, Homeland Security Investigations is also a part of this new push, and they will be targeting a further 200 driving schools. Assuming they're as successful as DOT, expect another 80 to be shut down as a result. Outside of that, HSI is following up on more than a thousand other organizations: HSI, in coordination with USDOT FMCSA and USDOT OIG, disseminated over 1,000 CDL-related business leads stemming from known or suspect business engaged in unsafe practices on the roadways and transportation-sector exploitationThis appears to the backwards-in-time approach, mapping incidents back to organizations and looking for trends. HSI is is also focusing on the fraud side of things - immigration, documentation, financial, medical, etc. The announcement makes a point to outline state-level response options to FMCSA actions - including withholding funding and the final step of the FMCSA decertifying a state so the state cannot issue new or modify existing CDLs if they don't get their problems under control. Time will tell if the FMCSA actually goes that far, but it is a promising sign that they're at least loudly talking about serious consequences for the states that have let the CDL disaster get to this point. While it is absolutely a good thing that DOT and other organizations are hitting hard on the fraudulent training and certification problem, the scale of the problem exceeds even my cynical expectations. IIRC there are, or were, a lot of loopholes that allowed the CDL and trucking industries to avoid.... legal entanglements. Which is how we got into this mess in the first place.

Eliminating illegal immigration and things like voter ID are overwhelmingly supported by an electorate who doesn’t agree on very much. On judges, there is a constitutional separation of powers to be made perhaps, but states could easily amend state constitutions for removal of such protections of judges in their own states. Federal judges, I would set up a rubber room like NYC used to do for teachers they could not fire. Already chief judges in a district have the power not to assign cases to a district judge (I think one in the Houston area was sexually harassing the staff and caused that to happen). I've long thought CDL schools were yet another money laundering operation.
The number of CDL schools is drastically too high to service the number of potential CDL drivers in the USA. There are at most maybe 3 million total CDL drivers in the country. Of that, only about 2 million are active. There are (or were) somewhere between 16,000 and 31,000 (!) CDL training centers and schools in the USA. Federal judges, I would set up a rubber room like NYC used to do for teachers they could not fire. Already chief judges in a district have the power not to assign cases to a district judge (I think one in the Houston area was sexually harassing the staff and caused that to happen). But others were removed before impeachment due to being incarcerated--they were still paid until impeached but not able to hear cases.

I dunno. Suing the state for the behavior of their licensee might be a bridge too far legally. But knowingly issuing a license to an illegal immigrant might get a few judges attention. If a person is present in violation of federal law, or if as in the case of CDL’s there is a requirement the state has ignored I’m betting there are more than a few lawyers who can make that case.

Posted by: Tom Servo Yes, I agree. But an easier way is to return to the appeals system where every decision by Scotus becomes binding automatically on lower courts. The resistance judges are relying on basically endless rehearing of cases by advocate lawfare groups. And the writ of cert system permits them to get away with a lot. If those were converted into appeals, even without an opinion as in affirmed or overruled, then a lot of the Resistance will collapse. Second, Congress can and should require three judge panels to issue any injunction binding federal or state governments. Perhaps even requiring some of those judges be drawn from outside the district. There is and should be no guarantee about judge shopping to succeed. From what little I've read on X, it seems that we have foreign trucking companies with foreign drivers, who are hired by large companies (e.g. Amazon, US govt) to complete deliveries because they are cheap. He could have chose other cases to do that. But Jackson is a complete mouth breather when it comes to the law. This was an odd spot for Roberts to make a stand. I disagree with the chief often, but he usually has better formed arguments and is more a jurist who sides with precedent. Our local revenue offices (DMV, pay property taxes, other stuff) are very, very good. When I renewed my license last time (10 minutes total) they had a list posted at the windows of things that can be used instead of real ID. Didn't need one, VA ID and DOD ID suffice.
