Tyler Robinson's Defense Team: Yes, Our Client Shot and Killed Charlie Kirk, But "The Shooter Hit the Intended Target," So No One Else Was In Danger and So the Death Penalty Should Be Off the Table

To get the death penalty, there must be an enhancement to "mere" murder. I would think that premeditated murder is enhancement enough, but in Utah, mistakenly regarded as a red state, you need to murder someone in a bad way.

Those "bad ways" of committing murder include putting additional people in danger or killing someone for a political motive.

Robinson's team concedes that he murdered Charlie Kirk -- I mean, he admitted it eleven times in texts and verbal admission to his parents.

But they say his shot was well-aimed and did not put anyone else in danger, so he should not be executed for his murder.


NBC "News:"

Lawyers for the man charged with killing conservative activist Charlie Kirk say he shouldn't be eligible for the death penalty because the shooter "hit the intended target" during the assassination last year at a Utah event attended by thousands of people.

Defendant Tyler Robinson's attorneys say prosecutors have not proven that others who attended Kirk's event at Utah Valley University on Sept. 10 were endangered by the shooting -- a potentially aggravating factor under state law that would make it a capital crime.

Utah law states that if a defendant "knowingly created a great risk of death to another individual" other than the victim who was killed, it can be used as an aggravating factor. But Robinson's defense team notes that the state needs to show there was a "high probability" that Robinson put the thousands of people gathered at the Turning Point USA rally where Kirk was speaking at risk for death, and not just a "possibility" of that happening.

"The state has failed to show that the actual conduct created a 'high probability' that someone other than Mr. Kirk would be killed and, thus, this theory fails as a matter of law," according to their briefing. "Where no other person was injured in a manner creating a great risk of death, and no other shots were fired, the allegation of ... (an) aggravator cannot be sustained."

Defense attorneys contend there was no one else in the "line of fire" when the fatal shot was fired. Furthermore, "the firing of a single shot at an intended victim that hit only the intended victim" is not an aggravating factor "merely because other people were in the vicinity."...

"The bullet that struck and killed Mr. Kirk was not fired in an enclosed bedroom or space but rather, an open-air arena with what the state's witnesses termed, 'a clear line of sight.' There were no threats to others in the course of conduct. There was no one 'directly' next to Mr. Kirk when he was shot, and there was no one under the tent on the side that Mr. Kirk was struck or behind him in the breezeway. Multiple shots were not fired. There were no ricocheting bullets."

They also claim there is no evidence that Robinson murdered Charlie Kirk for political reasons... despite Robinson marking his bullets with slogans indicating this was a Trans Vengeance Execution.

Now, it may occur to you that this is rather bad news for the world's stupidest narcissist Candace Owens.

But if you believe that, then you have kept admirably clean of information about Candace Owens.

This retard says the defense's admission that Robinson murdered her "best friend" Charlie Kirk hardly puts a scratch in her Grand Theory That Erika Kirk, French Intelligence, Egyptian Planes, Mormon Bee-People and of course The Jews Killed Charlie Kirk.

Candace is having her latest blowup because the defense's new 41-page filing in the Tyler Robinson case uses exactly none of the wild claims she's spent the last 11 months pushing. Rather than make the case that Robinson is not guilty, the filing focuses almost exclusively on trying to spare him from the death penalty.

-The filing spends only one page contesting the actual murder evidence, by arguing that Lance Twiggs's testimony was improper hearsay. ALL the rest of the filing concerns aggravating factors or secondary charges.

-The filing admits that Charlie was killed by a rifle shot from the Losee Center -- it explicitly describes the person captured on camera on the Losee rooftop as "the shooter." There is absolutely no effort to talk about exploding microphones, either directly or indirectly by contesting the idea Charlie was killed by a rifle round.

-The filing never argues that Robinson was not at UVU -- in fact, on page 22, it says "the evidence shows Mr. Robinson walking up and down stairs at UVU" and calls it a "reasonable inference" that his impaired gait was caused by a "fully-assembled rifle."

-The filing admits that Robinson was texting with Lance Twiggs, telling him "Im gonna turn myself in willingly." When Lance asks if there's any way he avoid prison, he replies "I highly doubt it."

Professional lawyers, unlike dishonest podcasters, have ethical obligations that bar them from saying things they know are untrue. So, unsurprisingly, their defense bears absolutely no resemblance to the one Candace has spent months shilling to her audience.

It...kind of makes sense, I guess. There's a reason we have things like manslaughter, second degree murder, 1st degree, etc. Spraying bullets into a crowd, or using a large explosive device, to kill one specific person, even if you only hit the intended target, is worse than killing them when they're alone and no one else is at risk.

Charlie, as I recall, had people all around him, though, and the bullet was a powerful rifle cartridge that could reasonably be expected to pass through the target, with a changed trajectory, and ricochet off the ground. Is that enough threat to innocent bystanders to meet the threshold? It's a good legal question.

It is all fun and games until the libel and slander lawsuits roll in and this case is pretty much going to make it an open and shut case for Candace to be held liable by Charlie's widow. Then I think the floodgates are going to open and she flees the country to avoid paying judgment. No one wanted to sue a nasty pig wallowing in the mud because a) the pig likes it, and b) there is a real threat that Ovens will cause one or more of her demented flying monkeys to cause harm and harassment to the person suing her.

Like Alex Jones, it is all fun and games until the jury verdict rolls in and the judge enforces the inevitable judgment.

The second one the prosecutors have is something about endangering kids or making them watch it or something. Lots of kids in the audience watched Charlie die. The defense argues that "Well, it was a college campus! How could Robinson know kids might be there?"

The third one is the political/trans angle: Robinson killed Kirk because of his political views. Defense argues that there is not enough evidence of that one so Robinson shouldn't be put to death for that.

All of these are weak defense theories, but they have to argue something I guess. But no, the prosecution has more than one arrow in their quivers here.

Don't blame Utah for this, it was a Scotus ruling that restored the Death Penalty, Gregg v. Georgia, where they only allowed death penalty statutes on the basis that the penalty had to be imposed only if specific aggravating circumstances showing the murder was somehow worse than regular murders including murder for money, murder for politics, for sexual depravity, drug dealing, etc. etc. around the murder occurred.

The jury (some states used judges before Ring v. Arizona required only a jury to impose a death sentence) was to take into account ALL aggravating facts and mitigating facts (which are not to be limited by statute) into account before imposing the sentence.

The mass of evidence precludes trying the old SODDI or TODDI defense--some other dude did it or the other dude did it. I suspect that we are going to see, if Furry asshole is called as a prosecution witness, that the defense will make it like Tyler was besotted and manipulated into killing-so the motive was love, not political hatred.

The Brits struggle to do a Midwestern American accent. It's very difficult because it's so unique and a fusion of disparate elements with the Irish "R" but lots of Germanisms worked in. Much of what we think is "American" is German, and when the German language was forcibly suppressed in 1917, I think a lot of speakers bent American English into something of a pretzel.

I used to buy the argument that the death penalty gave the state too much power, but I now feel that a quick death is better than locking someone in a dungeon for life. For one thing, prisons are expensive, and we're basically forced to feed scumbags who in every previous civilization would have been executed.

Hugh Laurie was asked if doing an American show in America with Americans helped him with House's accent and he said no. He always had to work hard to make sure he got it right because American English is very inconsistent.

Southern accents, on the other hand, are very easy for the English to do, and that's what they often resort to if asked to play an American.

Yeah, Prussia and Hannover were owned by major powers and thus somewhat insulated from the kind of stresses that spark emigration. There were revolts and civil wars in 1848 that sparked an urgent need to leave the scene for many, who then came to the US and fought in the ACW. A German District in Cincy was called 'Over the Rhine' because it was across a canal and had lots of Germans.

Foreknowledge isn't the same as predestination. Foreknowledge is knowing something will occur. Predestination is making something occur.

The classic formulation:
God knows all things perfectly.
God knows X will happen.
Therefore X will happen. (necessity of the consequence)
It does not follow that you could not have done otherwise. (necessity of the consequent)

God's knowledge tracks what free agents will freely do. It doesn't force the choice.

Shoot a 30-06 in a Garand weighing ten pounds with range ammo--150 gr at 2700 is not horrible in part because the gas operation lessens the recoil impulse. Fire it in a six pound bolt action 18-20 inch barrel rifle and using 160's or 170's bullets, it can be unpleasant.

The fit of a rifle and how much you work out makes a difference too. Heavy muscles in the shoulder can help shield and cushion the recoil impact and the rifle butt of the stock means x amount of energy is applied over x amount of surface area contacting the shoulder. Fatter stock, greater dispersion of force on the shoulder, thin and small stock butt, much more unpleasant.

Then we have rifle butt pads--none or steel, you best have a firm hold on the rifle cause woo boy it can pound. Put a thick recoil pad or a shooters jacket. Much less.

I find 30-06 in a decently weighted rifle more pleasant in recoil than firing 12 gauge slugs from a shotgun, ceteris paribus.

A while back a friend of mine brought his Dirty Harry Model 29 and compared it to my Taurus Tracker. We used the same ammo in both.

We all figured the 29 would have less felt recoil due to its massive size. We were wrong. The Taurus was much nicer due to the rubber grips and the ported barrel. Still a handful, but not as bad as that Smith.
