Deep State Mafia Boss Anthony "Little Bones" Fauci Pleads the Fifth

This is what I thought he would do.

But now I wonder if he has any legal right to invoke the Fifth.

He was pardoned for all crimes he committed for a ten (or eleven?) year period, 2014 to 2024. Therefore, speaking about his activities then does not incriminate him as he cannot be prosecuted. He could admit the broke every law in America, but that's not self-incrimination, because he can't be prosecuted for what he says.

He could be prosecuted for crimes since then, but not for crimes between 2014 - 2024.

When a court or Congress wants testimony from someone invoking the Fifth, they will grant immunity for that testimony, meaning it cannot be used in any other body in the future for purposes of punishing the testifier. Then testimony can be compelled, as there is no Fifth Amendment right just to keep a secret because you want to keep it a secret.

But Congress doesn't even have to immunize Fauci -- Biden's Magic Autopen already did.

So he should be compelled to testify, or be held physically in contempt until he agrees to talk. (I see now other people are talking about this.)

But I doubt the GOP has the balls to do this.

On the Pardon: Before the hearing @SenRandPaul
a former senior Justice Department prosecutor told me there are three, viable legal strategies to challenge the preemptive Biden pardon.

But there is no easy path.

One strategy calls for charging Fauci with a crime, with the expectation he would file a motion with the court to dismiss based on the pardon. This could open the door to challenging the sweeping pardon's viability and years of litigation.

Another strategy involves Congress. Because Fauci has theoretically been preemptively pardoned against past and future criminal charges related to his NIH work, it can be argued that Fauci has no plausible claim to the 5th Amendment, the right against self-incrimination.

If Fauci takes the Fifth at Senator Paul's hearing (which he has) the committee could seek to compel Fauci's testimony. A finding of contempt could follow.

Finally, one of Fauci's closest associates has been criminally charged. With pressure and the right incentives he might be flipped and become a cooperating witness.

Dr. David Morens, who was a senior advisor to Fauci at the National Institute of Allergy and Infectious Diseases, was indicted on multiple charges including conspiracy and obstruction, including destruction, alteration or falsification of federal records.

Along with allegations that personal email accounts were used to evade the Freedom of Information Act, this could be a powerful motivator.

From media reports: Dr. David Morens has pleaded not guilty to all five federal criminal counts.

Perhaps surprisingly, both the New York Times and the Washington Post have now published articles on the Fauci diaries. Unsurprisingly, both are complete whitewashes. They sanitize his record and reduce the criticism to the suggestion that he may have been a little too narcissistic.

Neither outlet confronts the diaries' central revelation, which is that Fauci repeatedly said one thing in private and another in public. That applies to the possibility of a laboratory origin, the supposed role of the Wuhan seafood market, the Wuhan lab's extraordinarily dangerous gain-of-function research, the infection fatality rate, dissenting scientists such as Jay Bhattacharya, and much more.

This was their chance to admit that they were wrong to trust Fauci, that he was a charlatan, and that they had failed their readers by acting as establishment propaganda outlets rather than journalists. They could even have blamed Fauci and washed their own hands of the entire scandal.

But they cannot bring themselves to do even that.


Update: Rand Paul thinks that Fauci's destruction of official records is prosecutable. I guess maybe this took place after the period of his super-pardon.

He was pardoned for federal crimes only that existed at the time of the pardon. He can still be prosecuted under state laws. Plus, there are some lingering issues about the validity of his pardon.

The pardon also covers only federal crimes that existed at the time of the pardon. So, if Fauci started answering questions now, possibly that could be perjury or some other process crime that would not be covered by the pardon.

His lawyers almost certainly told him to shut his little drooling mouth.

Potential Fauci Rebuttals
1. The constitutionality of a blanket pardon covering crimes not yet charged has never been ruled on by SCOTUS. Therefore, he could still be charged under the theory that such a pardon is illegitimate.

2. Autopen. It is claimed that Biden didn't have anything to do with the pardon. Therefore, it is not a real pardon and he could still be charged with crimes.

39 A couple of lawyer thoughts;

1) Rand Paul should sue Fauci for defamation. Fauci said the statements that Paul made were "slanderous." A civil case would be outside of the autopen pardon and could force Fauci to tell the truth.

2) No reason for the Administration not to pursue a pardon is no good/pardon is good strategy contemporaneously. If the pardon is good, then it is contempt of Congress to invoke the Fifth at a hearing. If it is not, well that really makes things interesting!

3) Fauci needs to be billed for his US Marshall bodyguards and drivers that were given to him after he resigned.

4) I really wish someone would ask him that line from that "Let's Make A Dope Deal" Cheech and Chong bit "Okay, Bob, what is your name, Bob?"

55 Yeah, it's theater, but as a lowly post-doc here in Louisiana, it royally pisses me off that the guy here who oversaw the NIH (which pays my salary) is going to skate on this. Nearly anybody else in his position would be frying, but he's going to get a pass here because of his position and connections.

So much for the "openness" and "integrity" our academic scientific society prides itself on. I also doubt I'm going to see any condemnations of Fauci from the two scientific organizations that I'm a member of (to defray publishing costs), if anything, quite the opposite.

Though I agree that the likelihood of any real consequences are virtually zero, I take a tiny comfort that the process is the punishment. His six lawyers aren't cheap. His megalomanic behavior, which was assumed before, has been proven with the publication of his diary entries which he had tried to delete.

Sure, there will be masked idiots lighting candles with his face on them for years to come. But his legendary status is being tarnished, if only a bit, and that, given his ego, must be almost unbearable.

Because he has a pardon Fauci can't plead the Fifth so he has to testify truthfully. Paul could set him up with a perjury trap. Or Fauci would need to sing like a canary.

But hold on -- Fauci might argue that Joe's pardon is only for federal crimes so he still has exposure on past crimes and needs the Fifth. This gets into the weeds, and I'm not a criminal lawyer.

Paul's next move is to hold Fauci in criminal contempt and jail him until he testifies. This happens to journalists who are protecting their sources.

I'll take the bet that no judge will interfere in this.

Going to jail is for contempt may be Fauci's only move.

I think the president should have to pardon for specific offenses for two reasons. The public preception and pressure is a check on the power of the pardon. Nope. Only federal crimes. Civil lawsuits are still on the table. State AGs have civil statues as well they could use. Almost all states have some version of Section 5 of the FTC Act that gives AGs very broad authority to investigate and bring civil lawsuits. It's not a criminal statute, so no chance of prison, but the monetary penalties can be stiff.

The pardon power dates back to the era of the British monarch over the colonies. Since the king was the titular head of teh courts, and literally had personal immunity (sovereignty)--he could extend forgiveness for any and all crimes. This was frequently done after rebellions where multiple violations of the king's law happened but in the interest of quelling societal unrest, the king pardoned all.

An early test of the American pardon was G. Washington pardoning participants in the Whisky Rebellion. Later you had the blanket pardons of the Southern rebels which led to Carter's blanket pardon of Vietnam draft evaders.

Good luck with that. NIH employees in a discretionary role have a pretty solid qualified immunity from civil suits. (Westfall Act).

Not sure of the process to pull qualified immunity is Fauci's former position. I think they'd have to show a Constitutional violation, and even then I think Congress has to pull it.

My wife passed away in August of last year. Cause of death was Thrombotic Thrombocytopenic Purpura (TTP). She had taken the J&J vaccine when it became available, which was mid-2002.

Initial onset of symptoms began in May of last year. After a multitude of tests, her specialists could not determine the cause of her symptoms. She was hospitalized in August, placed in ICU and passed away 5 days later.

NIH insists that there is presently no known link between TTP and the J&J vaccine. I call bullshit.

TTP is caused by a deficiency in a certain blood enzyme which causes the platelets in the blood to cluster (clot) and disperse throughout the body causing significant damage to internal organs if not diagnosed early and treated. If you'll recall, the J&J vaccine was pulled due to reported medical cases of significant clotting.

Early on, certain medical experts who opposed the rush to vaccination stated that they expected reports of vaccine injury/death to peak in the 3-5 year period following vaccination. My wife took the vaccine in 2022 and died in 2025.

EcoHealth Alliance distributed federal funds to 'other regional partners' to assist with localized biology & logistics: Wuhan University School of Public Health received over $200,000 & $50,000+ was budgeted to East China Normal University to assist in geographic data modeling & ecological analysis of viral hotspots.

In the end, EcoHealth got most.

Strict federal procurement and clearance rules are governed by the Federal Acquisition Regulation (FAR), the Procurement Integrity Act, and specific agency clearance threshold.
