Alaska wants to seize a pilot's plane over a 6-pack of beer. The Supreme Court will hear his case

The Supreme Court agreed Monday to review an Alaska bush pilot's claims that state authorities have tried to illegally seize his $95,000 airplane after a passenger brought a six-pack of beer on a flight bound for a dry village.
The pilot, Kenneth Jouppi, sued to block his plane's seizure after he was convicted of an alcohol-related misdemeanor charge. The Alaska Supreme Court ruled in the state's favor that Jouppi's plane was subject to criminal forfeiture laws.

In April 2012, Jouppi was preparing to fly a passenger from Fairbanks to a remote village, Beaver, where alcohol was banned. The passenger had packed beer with other groceries in her luggage. State Police troopers searched Jouppi's plane before it departed and spotted a six-pack of Budweiser in a shopping bag.
Jouppi, his company and the passenger were charged with a misdemeanor offense of knowingly transporting an alcoholic beverage into a dry community. The passenger pleaded guilty. A jury convicted Jouppi and the company after a trial. A judge sentenced him to three days in jail.

His videos show diagnostics, repair, and servicing diagnostics with step-by-step tutorials. He even shows tools to make the jobs easier. Somehow, he manages to upload new videos weekly. He's been at it for over 12 years.

EJ1387 (or simply 1387) is a reference to the EJ25 engine family, particularly in the context of the 2.5L SOHC engines found in many 1990s-2000s Subarus. EJ1387 comes from a casting code on the engine block.

I'm not a fan of subaru. I had a 2010 outback. Thing was a fucking lemon. Plus whenever you start a subaru it sounds like there are marbles in the engine. I have good luck with Toyota so I'm probably not straying again.

30 I got my ratchet fruit press working today. This morning I "fabricated" replacement bolts to hold the basket closed (I hammered on some stiff wire to shape it and I am not happy still) and went to work.
The bad news is that I have to have more than 10 gallons of apple pulp to start with to get it to work right, and since I only had five gallons of pulp, I had to do a second squeezing with my old press. On the positive side, I got two gallons of apple juice in half the time. The bottleneck now is canning or pasteurizing the juice

55 My son has a Subaru Cross Trek. He loves it. He put a rack on top and carries a real tire as a spare (no donut), as well as his camping gear. Very tough rig. Does not have the clearance of a truck, but it holds its own on rough roads.

UT has lots of quaint (to an outsider) rules about liquor sales, and the Indian reservations in UT go way beyond that. PACK A COUPLE OF BOTTLES before visiting Monument Valley!

71 Yes, there are dry villages in AK. Natives don't process alcohol the way white folks do, so they get seriously drunk off very little alcohol, and end up doing horrible things to one another when they get that way. Also, incest is rampant in the villages, particularly the ones that are 100% Native.

So, dry village, means no airplanes in or out with alcohol, and they are inspected prior to flying in.

This dude didn't realize his passengers had put beers in their luggage. Instead of racking the passengers, the State went after the pilot, which is already horseshit, but the pilot has this airplane which is worth $95,000, so guess what they decided to take?

It is way out of line with the normal fine for that sort of thing, which the pilot didn't even do, so it's a test case for the Supremes.

Small airplanes are the life's blood of AK, particularly the villages, none of which you can drive to except in the winter on a snow machine.

72 My very old and faithful Honda finally died in 2021, during the crisis of no cars to sell. Given that I had to have a manual transmission car, the pickings were even slimmer. Put in an order for a Subaru BRZ despite TRex's sales pitch for a WRX, waited 8 months and got it in 2022. Two months before we learned we were leaving CA (yeah!) for the East Coast. I love this car. It is absolutely perfect.

Yeah I lived in one. Didn't take long to figure out the major backers and donors who kept this going were the restaurants in town who were allowed to sell alcohol by the drink. (Dry towns are almost never completely dry)
By stopping the sale of alcohol retail, they forced people into their restaurants to buy it at big markups. Easy money.

No, he kept the plane, but it's been under a legal cloud since then. Taking a pilot's plane takes away his ability to make a living up here. I suspect worse things would have happened had they actually taken the plane.

Very common mod for 25 years has been to put a Subaru engine in a Vanagon. The original VW Waterboxer was a dud, and a Subaru is a good fit. Because it is horizontally opposed, it is relatively low and will fit with the stock engine cover. People have put Jetta and Golf engines in them, but they require custom engine covers and one loses cargo space.

121 Thank you for ONT Mr. TRex. As a two time Subaru owner I heartily approve. Our current 2012 Outback replaced a 2007 Forester which was murdered (wrecked) by our then 17 year-old. Single car accident. Carelessness. No one hurt thank God!

No real complaints other than as I mentioned recently - if you have to replace a tire you have to replace all four unless they're fairly new.. I don't know why. It's in the manual. Has something to do with the symmetrical All Wheel Drive.

The 2012 has a timing belt which cost $2500 to replace as 'routine' maintenance at 105k miles. I'm told later models have a chain which doesn't have to be replaced. The headlights are also difficult to replace, especially the driver side. I've given up trying to do it myself since Pep Boys will do it for $50 or so.

The Outback is nicely appointed and gets amazing gas mileage for a car it's size - almost 30 mpg at 70 mph.

We're considering replacing the 2012 with either a new Outback or a Lexus. I'm leaning toward the Subaru as it runs on regular. Lexus wants Premium.

The real problem is that the pilot had no idea the passengers had the beer on them, and he never did fly any of it to the village, so why they went after him is because his plane is worth so much money, and they would get that benefit. It far outstrips the price of the fine. Ridiculous.

That was a big failure before 2010. They came up with a new gasket, and that's pretty much disappeared as a problem. My forester had the gasket replaced($2200) at 41k, but it has run great since. It laughs at snow, until it gets higher than the bottom of the grill. I've cruised around Jeeps, 4W trucks and even quattros on snowy uphills. It now uses a quart of oil every 4k, but I change it around 3500, so no big deal. 236,000 mi.

169 Oh man, I fell down the rabbit hole on that "Dry Village" law up in Alaska. First off, Beaver is a town of 17 to 101 population depending upon the time of year and what's in season. They voted to make it dry because of all the locals getting hammered and shooting each other, or other types of violent crime.

There are 32 Fully Dry towns in Alaska. There are another 28 that are dry in the sense that they don't sell alcohol. The State law requires you know which towns fall into which category, and the asset seizure is written right into the State law (not just the municipality). There are no mulligans on the law. "I didn't know" is not a valid defense. Many believe that Alaska is so strict on the asset seizure because they use some of the confiscations for their various government employees once acquired and don't auction all of them off.

I'm not sure how the pilot gets snagged for the passenger's indiscretions on this one, especially since the confiscation occurred before leaving Fairbanks.

Well, so is the alcohol-fueled violence in the villages, so they decided they would rather have the law on their side.

It is hard to overestimate the horrible damage alcohol does in these villages. Between the lack of real jobs, the sheer laziness due to welfare checks, the lack of education (even though we put schools in every damned one of those villages), and the incest, I find it remarkable that anyone survives living there, but they choose to do so anyway.

I don't have issues with villages deciding to be dry, or the law enforcement of same, but this case is over the top, blaming the wrong guy, and taking much more than is warranted.

205 I had a Subaru, a GL Wagon. In general, I found it to be a very good vehicle. It had a simple 4 wheel drive that did very well in Minnesota winters.

There was one problem, every time I had it serviced, there was a very expensive surprise, a part that cost way more than it should have. One in particular, a chunk of ice was kicked up by a car in front of me and hit a head light. The glass on the front was broken. The head light still worked, the reflector behind it was intact. The bracket that held the headlight to the car was undamaged. When I tried to replace the glass at the front of the headlight, I discovered the glass, the reflector, the bracket, even the light bulb were all sold as one part and it cost me 210 dollars, in 1989, to repair that headlight.

There were several other expensive surprises over the ten years I owned that car and now, I have a list of car companies which I will NEVER EVER do business with, Subaru is at the top of that list, Chevrolet is right underneath it.

Dad, reportedly a sometimes excessive drinker, did a lot of travel around the state. On family vacations, I saw that he always had his own little traveling tavern kit, a nice leather case with bottles, jiggers, martini mixing equipment, et al.

I'm sure he would have been horrified at the next generation's traveling kit, with pipes, papers, lighters, film canisters for the smoke. Not the same at all, no sir.

State laws prohibiting liquor by-the-drink were gradually ignored by clubs who got around the BYOB rules. Those laws were changed after an aggressive state atty general started cracking down on enforcement. Since then, you can not only buy cold beer over 3.2, but buy it in grocery stores, along with wine and liquor! IIRC, there were still some dry counties for a while. With, of course, liquor stores and bars all along the county lines.

Those were days.

Wife drives a 24 Forrester. I've had several over the years but that was late 90's back when they were $500 cars and all you really needed to do to make them new again was replace the CV axles in the front. I got really good at those over the years. Best one I ever had was an 83 Wagon. Best car in the snow I had ever owned.

248 The county I live in used to be “moist”: wine and beer but no hard liquor. Favorite liquor store was called the County Line, and was just past the county line. Now the law has changed, and it seems like there is a liquor store on every other corner in town.

It ain't stuck.
That's a Loyale, or GL1800 wagon.
Came with a 1.8i litre opposed four putting out a whopping 85 hp from the factory. After it was introduced and sold like crazy in the mountain west it became apparent that the little engine couldn't at high altitudes and they gave it a turbo. The boost provided was just enough to make the engine viable above the tree line.

My FIL had one and took it out west for a multiweek driving vacation. Got caught in a rare rain event and loaded up the undercarriage and wheelwells with so much clay he had to take it to a town to be pressure washed off. Never missed a beat, even fighting clay to turn the wheels. Impressive for what it was. Loved the 2 stick setup. But extra slow. 2nd slowest car I've had.

UT has lots of quaint (to an outsider) rules about liquor sales, and the Indian reservations in UT go way beyond that. PACK A COUPLE OF BOTTLES before visiting Monument Valley!

The problem with "dry villages" and "dry reserves" is that those villages and reserves simply export their problem drinkers to the nearest "wet" community. So the Indians come from the reserve in to the Big Smoke, with the expressed intention of getting rip-roaring drunk, thereby cementing the "drunken Indian" stereotype into the minds of the locals who have to deal with them. And there is no incentive for the Indians to learn to drink socially in moderation. It's institutionalized fail.

256 The town in jersey where I grew up was weird with the dry town thing. We had liquor stores, but there was no place to sit and have a drink, other than 2 places. One of them was grandfathered because Washington probably drank there it was so old, and that place had a house rule of you had to be 27 years old to enter. The second one was so close to a bordering town it got zoned as the other town. Other than that there were no places to drink. It really didn't matter because all the bordering towns were 2 miles or less away, and the main drag split 2 different towns. The north side was one town, the south side was my town. The north side had bars, which we literally could walk to. Still, it was strange. A little trivia, if you ever saw the movie, that movie was literally written by a chick that lived across the street from me, and the bar in that movie was inspired by the bar we could walk to on the north side of the road which was the other town.

The Women's Christian Temperance Union, which, believe it or not, is still around, was the driving force behind Prohibition, and conducted rear guard activities after its repeal. "If we can't stop you from drinking, we can make it as uncomfortable as possible" accounts for many stupid drinking laws. For instance, it was illegal (in 1973) to stand while drinking in WA state. I don't know if that is still law.

261 That was a big failure before 2010. They came up with a new gasket, and that's pretty much disappeared as a problem. My forester had the gasket replaced($2200) at 41k, but it has run great since. It laughs at snow, until it gets higher than the bottom of the grill. I've cruised around Jeeps, 4W trucks and even quattros on snowy uphills. It now uses a quart of oil every 4k, but I change it around 3500, so no big deal. 236,000 mi.

265 I thought the AMC Eagle was the official car of the US Ski team, at least in the early 80's? It was sort of fun to have a station wagon, complete with fake-wood paneling on the side, with 11" of ground clearance, a full 4wd drivetrain, automatic transmission, plowing through the snow while you feel like you're sitting on grandma's couch. My parents had an '80 wagon, and I had an '83 SX/4. Amazing what those cars could do. The Subaru Outback I drive now is much more technologically advanced, but I'd wager the Eagle would beat it off-road.

266 In TX, it’s still local option. The county I live in was a dry county until recently. By recent I mean at some point this century they ditched being a dry county. At the county line you can see where a liquor store once stood that would sell alcohol to county residents.

Indeed, Lubbock County was a dry county until 2009 or so. I forget the exact year. But for the longest time you did not go to Tech for the party scene.

Seriously. I found myself in KS late one Sunday night and tried to buy a beer and found out I could not buy a beer in KS past 2000 (or 8pm) on Sunday nights. WTF?

Or: In TX, no hard liquor sales except in liquor stores, but go to NM and you can buy hard liquor in Walmart.

Back in 2021 IIRC the law changed in TX so that you can buy alcohol starting at 1000 on Sundays rather than 1200. Not at liquor stores which are all closed, however.
