Unshocking: Biden Prosecutor Jack Smith Mishandled Classified Information While Prosecuting Trump for Mishandling Classified Information

BREAKING: Just-declassified messages reveal an assistant to Special Counsel Jack Smith violated SCIF security procedures and others on his team mishandled classified material WHILE prosecuting President Trump for allegedly mishandling classified info in 2023-2024.
"This is yet another example of law enforcement's double standards in the previous administration," said Senate Judiciary Chair Grassley, who uncovered the new records.

The NY Post:

Prosecutors under former special counsel Jack Smith apparently disclosed classified material after bringing charges against President Trump over identical violations, according to internal government records released Wednesday.
Messages between members of the special counsel's office from July 2023 show that investigators seemed to provide "access to classified materials" without confirming those who reviewed the information did so on a "need to know" basis.
Other communications from Oct. 15 and 16 of that same year revealed that "a classified letter" was left out, while on April 19, 2024, a Sensitive Compartmented Information Facility (SCIF) was left open because "no one closed it the day before."
"That's a violation and an incident so I need to know the details," said Carli Rodriguez-Feo, a Department of Justice veteran who has worked in its Litigation Security Group.
An assistant to Smith, Stephanie Van Buskirk, appears to have been responsible for the security lapse.
It's unclear whether the special counsel's office members involved in the exchanges were working on Smith's case against Trump involving the alleged retention of classified documents at the 45th president's Mar-a-Lago estate or his alleged attempts to overturn the 2020 election results.

Sen. Chuck Grassley (R-Iowa) released the communications in a letter to Acting Attorney General Todd Blanche, claiming they suggested a "double standard" by the Biden administration.
"Talk about the pot calling the kettle black," Grassley said in a statement. "According to these messages, Biden DOJ personnel may have committed the very offense for which Jack Smith was prosecuting President Trump."
The Iowa Republican's letter cited former Secretary of State Hillary Clinton's mishandling of classified material -- and the DOJ's decision under former President Barack Obama not to prosecute her for it.

He also noted the DOJ's non-prosecution of Biden, who was clearly guilty, but presented as a "well-meaning elderly man with a poor memory," which -- and I wasn't aware of this -- turns out to be a perfect defense against an Espionage charge.

Yep. Never formally appointed as special counsel under the required law and he was a former fed prosecutor working at the Intl Criminal Court in Euroland when brought back by Garland to head the charade. So IIRC, Smith, as he did not have a federal office at the time as a duly appointed and confirmed major officer of the US, could not have done what he did--lead a prosecution.

Garland and the DoJ contended at the time that Smith was a minor officer of the US under the supervision of Garland and did not need Senate confirmation but that is contradictory to the special counsel statute.

Often the usual practice of DoJ ,since the independent prosecutor appointed by a judicial panel is defunct legally, is to take an existing prosecutor appointed and confirmed from another jurisdiction and use them as a special prosecutor.

Smith was a former fedgov prosecutor but not a current one when brought back from Euroland. So could not be a major officer under the US Constitution without senate confirmation.

Dunno if it's still the case, but you had to have a Secret clearance for my MOS, because of the COMSEC equipment in the Abrams, as well as in other track vehicles.

It was reiterated, often, the punishment if you were lax in your duties regarding COMSEC equipment, especially in a combat zone.

Don't be ridiculous. In fact, it is pretty well settled that tit for tat is about the only way to resolve problems. Otherwise one side will always defect from any agreement to screw you. As have the Dems repeatedly.

The reason that the independent counsel office disappeared is that Democrats instead of the GOP started getting gored by it. It was fine for Democrats during the Reagan years to use that as a bludgeon but suddenly when Clinton got in with all sorts of ethical and legal shortcuts, the Dems suddenly wanted the independent counsel statute gone.

Wishful thinking has no place in politics nor law.

179 The real answer though is rather obvious. There is way too much money and power to be gotten by winning political office. If you want people more interested in the general good and less interested in money and power you need to reduce the power of government.

The American model has broken down because even diluted between different offices there is too much power and because the permanent bureaucracy and 1.5 of our political parties are one interest group it isn't all that diluted...

Even when the stakes are picayune, you have people taking advantage of their power to get money, sex, or other things they want. Your local government is likely just as rife with corruption, cronyism, favoritism, and hanky panky as it is in Washington. The scale might be different in the degree of theft (although not in urban/surburban areas), but the self dealing, pay for play, honest graft, punishing enemies and rewarding friends, and people using power to get sex and money goes on.

The fault is in humans, not government per se. And part of that is the very people that want office are the ones that you should never put in. And a percentage of those will go bad.

I saw Eden recently and it was ok - the plot is a group of Germans in the 1920s trying to settle on the Galapagos islands and yes one think I imagine is you didn't want to be anywhere downwind from them...

First 2 seasons are outstanding. And if they would have ended it with the finding the irradiated Earth episode instead of continuing for another 10 episodes in the last season, would have made for the ultimate nilistic show. Oh well. Blood and Chrone movie was pretty good.
