Never formally appointed as special counsel under the required law and he was a former fed prosecutor working at the Intl Criminal Court in Euroland when brought back by Garland to head the charade. So IIRC, Smith, as he did not have a federal office at the time as a duly appointed and confirmed major officer of the US, could not have done what he did--lead a prosecution. Garland and the DoJ contended at the time that Smith was a minor officer of the US under the supervision of Garland and did not need Senate confirmation but that is contradictory to the special counsel statute. Often the usual practice of DoJ ,since the independent prosecutor appointed by a judicial panel is defunct legally, is to take an existing prosecutor appointed and confirmed from another jurisdiction and use them as a special prosecutor. Smith was a former fedgov prosecutor but not a current one when brought back from Euroland. So could not be a major officer under the US Constitution without senate confirmation. The real answer though is rather obvious. There is way too much money and power to be gotten by winning political office. If you want people more interested in the general good and less interested in money and power you need to reduce the power of government.
The American model has broken down because even diluted between different offices there is too much power and because the permanent bureaucracy and 1.5 of our political parties are one interest group it isn't all that diluted... Your local government is likely just as rife with corruption, cronyism, favoritism, and hanky panky as it is in Washington. The scale might be different in the degree of theft (although not in urban/surburban areas), but the self dealing, pay for play, honest graft, punishing enemies and rewarding friends, and people using power to get sex and money goes on. The fault is in humans, not government per se. And part of that is the very people that want office are the ones that you should never put in. And a percentage of those will go bad.
