Sefton: sefton at cutjibnewsletter.com | Federal Judge in Florida Overrules DC Judge, Orders the DHS to Turn Back on SAVE's Verification System for Determining Aliens' Eligibility for Benefits -- and VotingRemember foreign judge "Sparkle" Sooknanan? She claimed that it was unconstitution for Trump to check voter names against social security numbers to determine if they were eligible to vote. She herself is a foreign citizen -- she has dual citizenship, and never renounced her foreign one, despite suggesting that she would if approved to be a judge -- so she's very invested in the idea that foreigners should rule United States citizens.Libs of TikTokBut not a Florida federal judge says "turn the machines back on." He himself was the judge in a case where states sued the DHS to secure the elections, and the consent decree reached by the DHS and the states was that these safeguards were to be implemented. So "Sparkle's" ruling contradicts a judge-approved settlement between the states and the federal government. For that reason, he's "overruling" her. Federal judge hands Trump big win, directs DHS to restore voter verification features of SAVE system The SAVE system was enhanced under the Trump administration to better support state election integrity efforts, including maintenance of state voter rolls.I'm not sure how a Florida district judge can "overrule" a DC district judge, since both are equals. Appeals courts overrule district judges below them. But this judge, overseeing the DHS/state settlement, might have some special authority to protect the settlement. So is it over? NOPE! Judge "Sparkle" says she doesn't care what another judge with direct responsibility to oversee this settlement says, she says she's a Cultural Enricher here to set us all straight! Kyle Becker

I don't think this is an attempt at an overruling.
I think this is just conflicting rulings in different districts. The conflict will necessitate resolution at higher levels faster. I wouldn't expect it to go all the way to SCOTUS. Sorry I'm late. According to Brave AI, Graham Platner is still on for November:
>>> No, suspending a campaign does not count as withdrawing under Maine law. To be replaced on the general election ballot, a candidate must take the specific legal step of formal withdrawal, which is distinct from merely suspending campaign operations. Key Distinctions: * Formal Requirement: A candidate must submit a signed, written notice of withdrawal to the Secretary of State’s Elections Division. A public announcement, press release, or social media post stating that a campaign is "suspended" is legally insufficient. * Precedent: In April 2026, Governor Janet Mills suspended her U.S. Senate campaign but explicitly stated she was not withdrawing. Because she did not file the formal paperwork, her name remained on the primary ballot, and votes cast for her were counted. * Current Status: As of July 9, 2026, Deputy Secretary of State Jana Spaulding confirmed that a "public declaration is not an official withdrawal." Until the signed letter is received by the 5 p.m. deadline on July 13, the candidate remains the official nominee, and the party cannot initiate the replacement process. The opposite rulings by 2 District Court judges will probably lead to expedited appellate court rulings. That's about all the split means. The opposite rulings still apply in the 2 Districts. If Trump thinks he can win at SCOTUS, he could move for an expedited SCOTUS hearing. Naturalized citizens are legally permitted to serve as U.S. Senators, Representatives, and Federal Judges. Unlike the presidency—which explicitly requires a candidate to be a "natural-born citizen"—members of Congress and federal judges only need to meet distinct citizenship duration and age mandates.
The specific constitutional requirements are: U.S. House of Representatives: At least 25 years old and a U.S. citizen for at least 7 years. U.S. Senate: At least 30 years old and a U.S. citizen for at least 9 years. Federal Judges: The U.S. Constitution sets no specific age, citizenship, or educational requirements for federal judges, though they are appointed by the president and must be confirmed by the Senate. The United States fully allows dual or multiple citizenship. Under current U.S. State Department rules, American citizens are not required to choose between U.S. nationality and another citizenship.
I wonder how many times a constitutional amendment has been sought. More than theatrical. But this is interesting: According to the Constitution of India, India strictly prohibits dual nationality. If a citizen of India voluntarily acquires U.S. citizenship, they automatically lose their Indian citizenship. The "Sort Of" Solution (OCI): To help immigrants who had to give up their passports, India later created the Overseas Citizenship of India (OCI) card. It is often called a "pseudo-dual citizenship" because it grants lifelong travel, residency, and business rights in India, but does not allow the cardholder to vote or hold public office there. Why issue a strictly controlled license or permit like a CDL if you can't verify that the person who is issued it is the same person that either earned the certification, or exists at all? There's actually very little chance that Sparkle's ruling gets upheld on appeal. The idea that the government can't access it's own data was already adjucated earlier this term. In a split 2-to-1 decision (American Federation of Teachers et al. v. Scott Bessent et al), the U.S. Court of Appeals for the Fourth Circuit upheld the government's authority to share sensitive records across departments, for instance. To be fair, I can understand people wanting Waters out of there as much as possible.

I'm sorry that you haven't been paying attention to the overall court situation.
There's actually very little chance that Sparkle's ruling gets upheld on appeal. The idea that the government can't access it's own data was already adjucated earlier this term. SCOTUS will definitely side with the administration if there's a split at the appeal level between the DC circuit and the 11th. So, yes, it may get overturned in a year or two by the Supremes... but then I never thought the Supremes would use Brit Law on the Eve of the 250th Anniversary of our Declaration of Independence, to over ride the clear intent of the author of the Birthright citizenship question... and ignore the laws that the people who ratified it passed AFTER the fact. Investigators say a Fort Wayne man cut off his penis, lit it on fire and then used it to set his mom's garage on fire.
Christopher Peden is charged with one count of Arson. Peden was arrested last week and his bond was set at $10,000. He has since posted that bond. --------------- Well, it sounds like it was finally good for something. Gives a whole meaning to "Talking Heads" and Burning Down The House." /I denounce myself ... We are in unchartered waters. Posted by: US Navy Sailor Nope, it conflicts with a SETTLEMENT decree made in Florida prior to the decision. Her decision is going to get stayed and then be discarded sometime later by the appellate court. By waving her ass around the second time denying the Florida district court judge's administration of settlement litigation and failing to stay her order, it is likely that the appellate courts will do it for her. And btw, a similar situation arose in the 7th Circuit where Florida sued the American Society of Pediatricians or some such over tranny conversions and taht Society, hqed in Chicago promptly got an order from a local district judge quashing the lawsuit. 7th Circuit also in Chicago bitchslapped the local district court and the lawsuit will proceed in Florida federal district court.
Appellate courts tend not to be amused when district judges create more emergency work for them by ignoring clearly established guidelines of jurisdiction and staying in their local lane. Posted by: whig at July 09, 2026 03:48 PM (E4rtv) Processing 0.04, elapsed 0.038 seconds. |
