FISA Is A Catastrophic Failure, And Should Be Allowed To Die

Except...our government is fanatical about spying on us, and there is no way that a temporary pause in their ability to spy on Americans will survive. That pause is for purely political reasons, as the House simply doesn't like President Trump's nominee for Director of National Intelligence (DNI). Once that little pissing match is cleared up, they will go back to merrily supporting warrantless searches and surveillance of Americans.

Oh, they have their cute little legal subterfuges that protect them...we Americans are swept up in that surveillance by accident! Really! It's true! Our government claims, without a hint of irony or sarcasm, that when Americans are spied upon without a warrant, it is merely coincident to the surveillance of a foreign national, and they respect our God-given natural rights to safety from government intrusion.

US intelligence community's foreign spying powers expire after lawmakers reject FISA extension

The law enables the US government to surveil non-Americans abroad without first going before a judge to get a warrant.

However, that surveillance often sweeps up communications of American citizens in the process. The controversial spy power was reformed in 2024, but some critics want additional changes.


This shit has been going on forever, and FISA was supposed to be the solution to the myriad domestic spying programs that our Constitution expressly forbids.

Except that after FISA was passed in 1978, spying on Americans seems to have increased! Here is a small sample of the dozens of programs that our government used or uses to spy on us.

FISA is so obviously a rubber stamp for fishing expeditions based on political or personal expediency that it's embarrassing that any legislator defends it. But most of them do, and it's only the dust-up with Bill Pulte as DNI that they even bothered to look up from the trough and actually do something.

Most of the Bill Of Rights address these affronts to our freedom and liberty, yet our government cavalierly disregards those rights, claiming the always convenient, "National Security Imperative," or whatever phrase is in fashion to describe the destruction of our freedoms.

He said that in 1776, and it applies today. Government should serve us, not the other way around. And...government should also fear us as a free people. The Second Amendment of the United States Constitution guarantees that, and today we see shocking examples of countries whose citizens have become subjects exactly because their governments no longer fear them.

This is not a call to arms; this is simply a recognition that we must defend all of our rights, no matter how trivial-seeming or unlikely. Most of us will never be swept up in the surveillance of a foreigner, and most of us will never be surveilled coincident with an investigation. Except...we can never know that with certainty unless we fight back against the rapidly encroaching totalitarianism of our government.

Yes, that sounds melodramatic...just like the wholesale arrest and detention of hundreds of peaceful demonstrators after January 6th, 2021 sounded like a conspiracy-theorist's fever dream.

I think every federal agency/bureau/department has an investigative "authority" to look into their specific areas of purview. This is limited, is not as comprehensive as FIA that permits more expansive, and intrusive investigations into public life.

56 Under the Katz v US in 1967, you are entitled to a reasonable expectation of privacy. That was actually an advance over the older trespass theory in Olmstead (first wiretapping case) where physical invasion of property was involved.

In Katz, the government bugged a phone booth where Katz the bookie placed his bets, dealt with customers, etc. and they would turn on the mikes in the phone booth whenever he was in there and turn off when he left.

Search was thrown out because Katz had a reasonable expectation of privacy in the phone booth. Later, in the 1978 Smith v. Maryland case, you had phone records of who you called and how long you talked to them no longer needing a warrant under the third party doctrine.

I'm not convinced those are always wrong or include something destructive. I think it's more a matter of degrees. I can jealously guard something against theft, corruption or destruction, which I would regard to be entirely appropriate in a number of situations - like your kids' innocence or your wife's fidelity. I think one can be envious without a necessarily secondary evil motive, such as I could be envious of someone's killer vacation or new sportscar but be happy for them in their achievement. So I'm not convinced those are automatically "bad" things but rather depend on the context.

Add in FISA with its ridiculous hops rule and degrees of separation and suddenly it means Big Brother and those who hold its leash being able to Stasi with methods they could only dream of.

The law has not caught up with technology in all kinds of ways. This of course is a glaring example but even things as seemingly trivial as the requirement to have your registration and proof of insurance on you. Cops have all that shit at their fingertips on their in-car computer. They know you if you do or don't have insurance before they even pull you over, and they know who the car is registered to by the license tag or the VIN. The only reasons for these requirements to remain as they are, with a few outliers, is simply a matter of revenue generation.

FISA itself though was a legislative cover for spying on communications and actions which as they cross borders, there is NO expectation of privacy (same as physically crossing the border or customs). That is old settled law, where FISA makes it worse is the collection of data up to three hops and not requiring a warrant to unmask domestic counterparts of intercepts between other domestic comms using the three hop rule. That is what was abused in the Trump cases.

I think a revamp might be requiring liability insurance for individual cops be required and the removal of qualified immunity from all government officials except life or death immediate situations.

And individual cops that insurance agencies refuse to cover means unemployment. The public should not have to pay for the misdeeds of criminals in uniforms, they should have the pay themselves with their jobs and money. Qualified immunity too was stretched far beyond street law enforcement to bureaucrats denying rights to students for example.

Rehnquist court created the doctrine and Scotus needs to severely prune it back to its original intent-- a split second mistake involving life and death for cops (like shooting a creep with a fake gun).

In UK and elsewhere, there is no exclusionary rule but rather that the cops involved in illegal searches can be sued individually and even criminally charged for trespass.

About the only way you can ensure that the device is not listening reporting is to put it in total isolation--aka Faraday cage with no network access allowed ever. Feds have the tech to turn mikes on and off even when you think they are 'disabled' remotely. I think a more recent search indicated all Fakebook users are within 3.5 degrees of separation now. And that is where FISA needs to be cut back. Originally in 1978, it was designed to catch spy rings where you had one outside liaison to the KGB or whatever but that liaison then ran the internal spy ring composed of native sources. That's what that massive NSA server farm in New Mexico or wherever it was is for, and that's that the "AI" data centers will continue to do. The ironic thing is that the person that tries to preserve privacy by actions (which you can to some degree) suddenly becomes an anomaly in the data where the agency suddenly concentrates its attention on the outlier to determine why.

I saw a story the other day here in Florida. A guy was arrested for something like trying to lure a minor to kidnap or abuse… no eyewitnesses but simply AI said the guy on the video (from the store) is that guy. They arrest him… he was never within 2 hours of that location. He successfully sued the police department. I’m glad he did… to me that is one scary story

You'll see more of it. Another guy was identified by AI states away for committing armed robbery except AI recognition was wrong. Another massive lawsuit. And by removing more and more people from teh chain of collection and instead relegating it to algorithms that no one really understands, you will get more and more slop of computers talking to other computers and making 2+2=5 calculations.

The very computer systems as they try to concentrate more and more information so that the higher ups can try to rule society in the end are going to crash and fall, hopefully only affecting us regular folks in a minor way.
