Clinton and Obama Judges Combine to Overrule the Military's Judgment about Good Military Order, Insist That No One Can Reject Transgenders In the Military for Any Proper Logical Reasons

It can only be arbitrary and "based upon animus." There are no conceivable reasons why people with a history of mental illness and a dependency on constant medical interventions and mind-affecting artificial hormones would not make for good recruits.

Divided appeals court rules Trump administration's ban on transgender military service is unconstitutional

Washington -- A divided federal appeals court ruled Monday that the Trump administration's policy banning transgender individuals from serving in the military is likely unconstitutional.
A panel of three judges on the U.S. Court of Appeals for the D.C. Circuit split 2-1 in finding that the ban rolled out by Secretary of Defense Pete Hegseth last year was driven by animus toward transgender people.
Judges Judith Rogers and Robert Wilkins agreed that the Trump administration's policy targeting transgender service members likely violated the Constitution's guarantee of equal protection.
The two judges agreed to leave in place a preliminary injunction that prevented the Defense Department from removing transgender troops who are in the military. That order is narrow and only covers the active-duty plaintiffs in the case.
"The government's stated reason for issuing the Hegseth Policy as based solely upon gender dysphoria was pretextual, and that instead, the Hegseth Policy was premised, at least in part, on a non-legitimate state interest to harm the politically unpopular group of transgender persons," Wilkins wrote in an opinion, adding that President Trump "declared transgender people as categorically unfit for military service explicitly because of their gender identity."

In other words, we don't have to examine the reasons offered for the policy, because we know they're lies, and once you exclude the reasons offered -- which we know are lies -- there are no reasons left, and hence it's "arbitrary." Oh, and the lies are motivated by "animus."

Therefore, we pencilnecked DEI hires are in charge of the armed forces now. Ooooh-rah, bitches!

Wilkins and Judge Justin Walker, meanwhile, allowed the administration to enforce restrictions on transgender plaintiffs who sought to join the military but were prevented under the new policy from doing so.
Walker, who authored a dissenting opinion, was nominated to the federal bench by Mr. Trump in 2020. Wilkins was appointed to the D.C. Circuit by President Barack Obama, and Rogers was tapped for the appeals court by President Bill Clinton.
Mr. Trump signed an executive order in the opening days of his second term that targeted active-duty and prospective service members with gender dysphoria. The president's directive said that the military's "high standards for troop readiness, lethality, cohesion, honesty, humility, uniformity and integrity" are inconsistent with the "medical, surgical and mental health constraints on individuals with gender dysphoria."

"This is not a case where we are left to speculate why the government drafted such broad, undifferentiated classifications," Wilkins said. "Unless we are going to fall for the old Groucho Marx line -- 'who are you going to believe, me or your lying eyes?' -- we have direct evidence in this case that animus motivated the classifications in the Hegseth Policy."

The Obama and Clinton judges just pretend that being on a lifelong diet of hormones and surgeries won't disrupt readiness or result in so-called "military personnel" calling out sick for duty.

Note, however, that the policy isn't completely undone. Both the Clinton and Obama judge agree that the military may refuse to recruit transgenders going forward.

The Clinton judge would only permit the transgenders who sued to remain in the military. I assume that this is the actual holding, because it's what both the Clinton and Obama judges agree on. (The Obama judge would extend this to all transgenders currently serving.)

Sooner or later, SCOTUS is going to have to rule that the Administrative Procedures Act is not a catch-all for getting around the relevant statutes, jurisdiction requirements and rules to manufacture a federal case before a friendly judge.

The concurrence of Thomas last week shows he, at least, is getting real tired of the lower courts just making shit up.

What would be hilarious is, when they over-rule this, to remand it to the DC circuit, with an order that the circuit enter an opinion consistent with their ruling and that it be specifically signed by all judges of the circuit.
Any who refuse will be placed on admin leave.

Good news and bad news. The good: After almost six months, I finally received that pension payout from the 1970s-80s job, and a few days earlier than I expected. And there was more money to it, as well.

Bad: They thought somehow it was a direct payment to me, and took out state and Fed taxes!!! This despite my telling them in writing it was to be a direct rollover. They swear on the phone they have the election form, but not the page indicating the recipient, my IRA. So the incompetents cut me a check despite my rollover choice -- and without calling or informing me they had a conflict.

They can be sanctioned for that particular vice but even judges get annoyed when all the court cases start backing up on their docket. And that annoys the clerks too. So make them choke on it in some cases, where it is clearly froot loops decision, summary reversal where the plaintiff loses but there is no crevice allowed by the lower court to repeat the whole charade using new reasoning.

Don't have to go that far. Simply whether or not they are deployable in the field suffices. Troops have long been separated from the military due to an inability to be deployed for wartime. Fat, diabetic, etc. So anyone taking hormones, etc. are likely not deployable under medical standards as well as physical.

Nope. You are confusing due process with equal protection. Due process is an individual right, Equal Protection is a group aka collective right to be treated the same as others in the same group. Where it gets confusing, due to Scotus bumfuckery, is that they created a fundamental freedoms application of due process to the equal protection clause which is how they came up with substantive due process used in Roe. So the idea is that troons as a class are denied protection that other non-troons get to do. And that denial is because they have a fundamental freedom protected by the due process clause to be a troon and thus join the military.

That is the garbage result of Lawrence v. Texas being overruled when Scotus said sodomy was a fundamental freedom. That led to Windsor destroying DOMA, and then Obergefell, gay marriage.

Well, the military acts like they don't like fatties, and were that a recognized demographic--unlike people who just feel they should have different junk--it cold be construed as "animus" toward fatties.

It's easy to illustrate the non-uniform expansion of this principle so that "groups" recognized by the court get protected in ways that "groups" the court is unconcerned about do not.

Blind people don't have the same access to driver's licenses (as i said 1000 times in the SSM debate).

But, here's the kicker, they just don't care. They aren't animated about those arguably equal "exclusions". They just don't care whether principles can be mathematically applied, but they'll pretend they're mathematic applications all the same, thank you.

George Washington did just that when the Senate misbehaved with him on a treaty approval. So he set the precedent that presidents cannot be subpoened to appear before Congress, they can do so willingly but not be compelled by Courts or Congress. That action also set up the doctrine of executive privilege.

Never meant to be mathematical. Equal protection clause starts with a reasonable premise--people are and should be equal under the law. But it became a way to import privilege on the basis of skin, sex, etc. as it is used today. Legislation has to be done primarily dealing with classes--taxpayers, non taxpayers for example. It is not treating non tax payers unfairly if they cannot get a tax refund where they paid nothing in for example. But, if I treat them differently using irrational criteria--only redheads pay taxes, all others do not, then one could argue based on nonsensical actions that the government is acting irrationally.

Or in the Louisiana case involving coffins, Lousiana banned anyone other than morticians licensed by the state from selling coffins. Monks sued the state of Louisiana and won because the rationale by the state was that it was to prevent groundwater infiltration-which is reasonable. But Louisiana required water proof vaults for all coffins anyway which meant that the coffin regulation became rent seeking rather than a rational reason.
